In this introduction to the issue on New Trends in Latin American Constitutionalism, Santiago Legarre offers his remarks at the opening of the conference on New Trends in Latin American Constitutionalism held at Notre Dame Law School in 2013. After briefly recounting the origins of the conference, Legarre summarizes some of the key modern challenges in Latin America and the role of constitutionalism in addressing these challenges. Legarre pays particular attention to the rapid growth of income inequality in the region. He ultimately concludes that some of the major challenges to the region are rooted in a lack of consensus …

Jailhouse snitch testimony is inherently unreliable. Snitches have powerful incentives to invent incriminating lies about other inmates in often well-founded hopes that such testimony will provide them with material benefits, including in many cases substantial reduction of criminal charges against them or of the time they are required to serve. At the same time, false snitch testimony is difficult, if not altogether impossible, for criminal defendants to impeach. Because such testimony usually pits the word of two individuals against one another, both of whose credibility is suspect, jurors have little ability to accurately or effectively assess or weigh the evidence. …

Strangers come into a child's room in the middle of the night, drag her kicking and screaming into a van, apply handcuffs, and drive her to a behavior modification facility at a distant location. What sounds like a clear-cut case of kidnapping is complicated by the fact that the child's parents not only authorized this intervention, but also paid for it. This scarcely publicized practice-known as the youth-transportation industry-operates on the fringes of existing law. Florida is one of 12 states that have a no-fault law. The first party benefit coverage is known as personal injury protection (PIP). Every policy sold in the state must include at least $10,000 in personal injury protection. This law went into effect in 1971 and is now being challenged. Changes in consumer, lawyer, and doctor behavior as well as changes in the legal and economic environment have diminished the positive impact of the no-fault law. This thesis will focus on the diminished effectiveness of the no-fault law in Florida. It will be based on research from primary sources. Other …

The following document is a capstone thesis project focusing on the unique experiences of graduate forensic coaches through lens of liminality, a performance theory used to describe a sense of being between social identities when going through a rite of passage. The author contends that this liminal experience has unique characteristics which are important to consider in the context of identity and forensic culture. In order to gather data, the author utilized qualitative, semi-structured interviews with current graduate forensic coaches. The resulting interviews were interpreted using a process of open coding to determine key themes of the experience. The author …

This study explores the associations between the independent variables of organizational motivations and culture with the dependent variable of organizational commitment to local jail reentry partnerships. A cross-sectional, mixed methods design was used based primarily on a quantitative survey mailed to organizational informants involved in jail reentry activities within three central Florida counties. Qualitative data was also collected by observing conveniently sampled reentry meetings and analyzing the content of social artifacts, such as meeting handouts, minutes, e-mails, and other related documents. More recently, there has been an additional spotlight on issues that are exacerbated when prisons are over capacity, such as prison rape and the use of restrictive housing (housing inmates in isolated conditions). In the case of prison rape, federal standards have been placed on institutions through the passage of the Prison Rape Elimination Act (PREA). General consensus among corrections professionals is that a lack of internal action diminished their voice during the creation of the PREA standards. This research explores whether commercially sexually exploited children (CSEC) abuse drugs or face greater histories of abuse than their delinquent peers. This research will evaluate whether girls who are CSEC victims experience more abuse of drugs or experience more physical, emotional, or sexual abuse. The study also explores whether CSEC victims witnessed more abuse than non-CSEC victims. A survey of needs and issues facing delinquent girls was given to 130 girls between the ages of 13 to 18. Questions asked about their drug use, abuse history, and whether they witnessed abuse. This research found that many girls who are CSEC …

Since September 11, the United States has waged two very open wars in Afghanistan and Iraq. These two wars have killed nearly 7,000 U.S. military personnel and left some 50,000 American troops wounded; they have also left an unknown number of Iraqi and Afghan soldiers and civilians dead or wounded. But alongside these two costly and visible wars, the United States has also been waging what amounts to a third war.

Digital evidence plays a crucial role in child pornography investigations. However, in the following case study, the authors argue that the behavioral analysis or “profiling” of digital evidence can also play a vital role in child pornography investigations. Industrial control system communication networks are vulnerable to reconnaissance, response injection, command injection, and denial of service attacks. Such attacks can lead to an inability to monitor and control industrial control systems and can ultimately lead to system failure. Idiographic digital profiling (IDP) is the application of behavioral analysis to the field of digital forensics. Previous work in this field takes a nomothetic approach to behavioral analysis by attempting to understand the aggregate behaviors of cybercriminals. This work is the first to take an idiographic approach by examining a particular subject's digital footprints for immediate use in an ongoing investigation. IDP provides a framework for investigators to analyze digital behavioral evidence for the purposes of case planning, subject identification, lead generation, obtaining and executing warrants, and prosecuting offenders.

Communicating parties inside computer networks use different kind of identifiers. Some of these identifiers are stable, e.g., logins used to access a specific service, some are only temporary, e.g., dynamically assigned IP addresses. This paper tackles several challenges of lawful interception that emerged in modern networks. The main contribution is the graph model that links identities learnt from various sources distributed in a network. The inferred identities result into an interception of more detailed data in conformance with the issued court order. This paper explores the forensic implications of Apple’s Fusion Drive. The Fusion Drive is an example of auto-tiered storage. It uses a combination of a flash drive and a magnetic drive. Data is moved between the drives automatically to maximize system performance. This is different from traditional caches because data is moved and not simply copied. The research included understanding the drive structure, populating the drive, and then accessing data in a controlled setting to observe data migration strategies. This work examines the problem of case prioritization in digital investigations for better utilization of limited criminal investigation resources. Current methods of case prioritization, as well as observed prioritization methods used in digital forensic investigation laboratories are examined. After, a multi-stakeholder approach to case prioritization is given that may help reduce reputational risk to digital forensic laboratories while improving resource allocation. Investigating seized devices within digital forensics represents a challenging task due to the increasing amount of data. Common procedures utilize automated file identification, which reduces the amount of data an investigator has to examine manually. In the past years the research field of approximate matching arises to detect similar data. However, if n denotes the number of similarity digests in a database, then the lookup for a single similarity digest is of complexity of O(n). In 2014 there was a unanimous decision that requires a warrant for all cell phone searches. This has some strong implications on the forensic analysis of mobile phones, and to that end, this article discusses and summarizes this legal precedent with its practical implications.

Brett Shavers is a former law enforcement officer, a digital forensics examiner, an adjunct instructor, and a frequent speaker at many conferences. After writing his first book, titled Placing the Suspect Behind the Keyboard: Using Digital Forensics and Investigative Techniques to Identify Cybercrime Suspects, he co-wrote his 2nd book with Eric Zimmerman and Jimmy Weg, who is a knowledgeable technical editor. Both Brett and Eric are experts in cyber forensics, with many years of law enforcement experience at both the state and federal levels.

The Cost Of Privacy: Riley V. California’S Impact On Cell Phone Searches, Jennifer L. Moore, Jonathan Langton, Joseph Pochron

Riley v. California is the United States Supreme Court’s first attempt to regulate the searches of cell phones by law enforcement. The 2014 unanimous decision requires a warrant for all cell phone searches incident to arrest absent an emergency. This work summarizes the legal precedent and analyzes the limitations and practical implications of the ruling. General guidelines for members of the criminal justice system at all levels consistent with the Supreme Court’s decision are provided.

In this work, a survey was conducted to help quantify the relevance of nineteen types of evidence (such as SMS) to seven types of digital investigations associated with mobile devices (MD) (such as child pornography). 97 % of the respondents agreed that every type of digital evidence has a different level of relevance to further or solve a particular investigation. From 55 serious participants, a dataset of 5,772 responses regarding the relevance of nineteen types of digital evidence for all the seven types of digital investigations was obtained. In the 1970s, the US Congress meticulously considered the possibility of creating a federal law of torts. The federal effort began almost a decade after many state supreme courts had expanded manufacturer liability for defective products. The state-level expansion caused a reaction among state and federal legislatures. The initial federal presence took the form of investigatory efforts, but those were soon followed by legislative proposals. The federal legislative proposals occurred simultaneously with some states' efforts to enact their own products liability laws.
