วัตถุประสงค์หลักของบทความวิจัยมุ่งอภิปรายการใช้ภาพเล่าเรื่องเพื่อเป็นเสียงสะท้อนผ่านการสื่อสารที่สามารถมองเห็นในชุมชนท้องถิ่นโดยคนในชุมชนเป็นผู้เล่าและสะท้อนเสียงส่วนลึกที่สุดในการแก้ไขปัญหาที่ดินในอุทยานแห่งชาติทับลาน อนึ่ง ผู้เข้าร่วมในการศึกษามีจำนวน 6  คน จาก18 คนในงานวิจัยเพื่อร่วมในการวิจัยภาพถ่ายเล่าเรื่อง ได้แก่ ชาวบ้าน เอ็นจีโอ และพระนักพัฒนาในตำบลไทยสามัคคี ซึ่งประโยชน์จากการใช้ภาพถ่ายเล่าเรื่องจะช่วยบันทึกเรื่องราว สะท้อนแง่มุม และแลกเปลี่ยนเรียนรู้ ถือเป็นประจักษ์พยานในการศึกษาปัญหาที่ดิน อีกทั้งช่วยพัฒนาความสามารถของพลเมืองในการถกแถลงสาธารณะโดยใช้ภาพถ่าย ดังนั้นการศึกษานี้นำมาสู่การจุดประกายให้เห็นถึงบทบาทของการใช้ภาพเล่าเรื่องว่าเป็นวิธีการในการเข้าถึงแก่นแท้ในความรู้สึกเชิงศีลธรรมของประชาธิปไตยแบบปรึกษาหารือผ่านมุมมองของประชาชนในการพัฒนาชุมชนร่วมกันและเข้าถึงผู้กำหนดนโยบาย ทั้งนี้การนำผลงานวิจัยไปใช้เน้นเพื่อการพัฒนานโยบายสาธารณะและการเติมเต็มการศึกษาประชาธิปไตยแบบปรึกษาหารือในการจัดการปัญหาความขัดแย้งเรื่องที่ดิน

บทความเรื่องนี้ศึกษาปัญหาอาชญากรรมลูกผสมที่เป็นปัญหาสำคัญในสังคมไทย โดยวิเคราะห์ปัญหาจากการสังเคราะห์เอกสาร พบว่าปัญหาอาชญากรรมในสังคมไทยในศตวรรษที่ 21 ถูกปรับเปลี่ยนจากการเป็นรูปแบบเดี่ยวมาเป็น “อาชญากรรมลูกผสม” ซึ่งเป็นการผสมผสานกันระหว่างอาชญากรรมรูปแบบต่าง ๆ ทั้งอาชญากรรมรูปแบบเดิม อาชญากรรมรูปแบบใหม่ อาชญากรรมรูปแบบอื่น ๆ และที่อาจจะเกิดขึ้นในอนาคต ทำให้เป็นอาชญากรรมแบบเบ็ดเสร็จ มีความซับซ้อน เชื่อมโยงสาเหตุจากปัจจัยการเปลี่ยนแปลงสังคมโดยเทคโนโลยี ปัจจัยด้านสภาพแวดล้อมทางสังคมในระดับมหภาค ปัจจัยด้านสภาพแวดล้อมทางสังคมในระดับจุลภาค ปัจจัยด้านกายภาพ/ชีวภาพ และปัจจัยด้านจิตวิทยา ที่ประสานสอดคล้องกับวิธีการก่ออาชญากรรม ทำให้ไม่สามารถเข้าใจรูปแบบที่แท้จริงของอาชญากรรมที่เกิดขึ้นได้โดยง่าย นอกจากนี้แล้วอาชญากรรมลูกผสมจะแตกต่างกันขึ้นอยู่กับอาชญากรผู้วางแผนเพื่อให้บรรลุเป้าหมายของการก่ออาชญากรรมนั้น โดยมีลักษณะสำคัญ ได้แก่ ผู้กระทำผิดหรืออาชญากรมีการรวมตัวกันเป็นเครือข่าย/องค์กรมากขึ้น กระทำการข้ามรัฐ/ไร้พรมแดน พึ่งพาเทคโนโลยี และใช้วิธีการที่หลากหลายซึ่งส่งผลกระทบในวงกว้าง ไม่จำกัดช่วงเวลาและสถานที่ สร้างการเลียนแบบ เข้าถึงเป้าหมายได้ง่าย ไม่จำเป็นต้องเผชิญหน้ากับเป้าหมาย คุ้มค่ามากที่สุดในการก่อเหตุต่อครั้ง เกี่ยวข้องกับการใช้ชีวิตประจำวัน ติดตามตัวผู้กระทำผิดมาลงโทษได้ยาก ทำให้ต้องใช้บุคลากรและงบประมาณจำนวนมากในการปราบปราม ป้องกันและแก้ไข

ความก้าวหน้าของเทคโนโลยีดิจิทัลได้ส่งผลกระทบอย่างรวดเร็วและรุนแรงต่อระบบเศรษฐกิจและสังคมในปัจจุบัน ภาครัฐจึงจำเป็นต้องปรับตัวเพื่อให้มั่นใจว่าการเปลี่ยนผ่านในทางเศรษฐกิจและสังคม และการจัดสรรผลประโยชน์จากเทคโนโลยีได้รับการจัดการอย่างมีประสิทธิภาพ ที่ผ่านมา แม้ประเทศไทยจะมีการกำหนดยุทธศาสตร์การพัฒนาเทคโนโลยีดิจิทัล แต่การเปลี่ยนผ่านสู่สังคมดิจิทัลที่เท่าเทียมกันยังคงเป็นความท้าทาย งานวิจัยนี้ใช้แนวทางเชิงคุณภาพ ศึกษาการดำเนินงานด้านเทคโนโลยีดิจิทัลของภาครัฐในปัจจุบัน ผ่านระบบการให้บริการในรูปแบบอิเล็กทรอนิกส์ ประกอบด้วยระบบการออกใบกำกับภาษีอิเล็กทรอนิกส์และระบบให้บริการรับคำร้องขอหนังสือเอกสารอิเล็กทรอนิกส์ของกรมสรรพากร ระบบการจดทะเบียนนิติบุคคลทางอิเล็กทรอนิกส์ กรมพัฒนาธุรกิจการค้า ระบบพิธีการศุลกากรอิเล็กทรอนิกส์ กรมศุลกากร และระบบการชำระค่าธรรมเนียมทางอิเล็กทรอนิกส์ สำนักงานประกันสังคม รวมทั้งศึกษาองค์ประกอบความสำเร็จการใช้งานระบบดังกล่าว ผลการศึกษาพบว่าองค์ประกอบความสำเร็จของการปรับใช้ภาครัฐดิจิทัลอยู่ที่การลดความเหลื่อมล้ำด้านดิจิทัล การส่งเสริมทักษะด้านดิจิทัล และการออกแบบสถาปัตยกรรมของภาครัฐเพื่อให้ตอบสนองความต้องการและความคาดหวังของประชาชนได้ดียิ่งขึ้น

การวิจัยครั้งนี้มุ่งศึกษาการพัฒนาระบบนิเวศที่เอื้อต่อการส่งเสริมความเป็นผู้ประกอบการสังคมในมหาวิทยาลัย ใช้รูปแบบของการวิจัยเชิงคุณภาพ ได้แก่ การสัมภาษณ์เชิงลึกกับผู้มีส่วนได้ส่วนเสียในระบบนิเวศผู้ประกอบการสังคมทั้งในเชิงนโยบายและในเชิงปฏิบัติ และปัจจัยแวดล้อมเกื้อหนุน ผลการวิจัยพบว่าระบบนิเวศที่เอื้อต่อการส่งเสริมความเป็นผู้ประกอบการสังคมในมหาวิทยาลัยไทย คือการเชื่อมโยงกันของห่วงโซ่ทางคุณค่าที่มีความสลับซับซ้อนเช่นเดียวกันกับระบบนิเวศทางธรรมชาติ เชื่อมโยงความสัมพันธ์ระหว่างปัจจัยต่าง ๆ ที่มีหน้าที่แตกต่างกันแต่มีการพึ่งพาอาศัยกันเป็นเรื่องสำคัญ โดยองค์ประกอบและปัจจัยเกื้อหนุนต่าง ๆ จำเป็นจะต้องมีควบคู่กันไปอย่างสมดุล ได้แก่ การบูรณาการประเด็นการประกอบการทางสังคมเข้าสู่การเรียนการสอนในมหาวิทยาลัย การสร้างงานวิจัยเพื่อส่งเสริมความเป็นผู้ประกอบการสังคม การสร้างเครือข่ายวิจัยเป็นกลไกเชื่อมต่อการสร้างผลกระทบทางสังคมผ่านกลุ่มผู้ประกอบการสังคม การให้คำปรึกษาและระบบพี่เลี้ยง การเชื่อมต่อความช่วยเหลือจากภาครัฐและภาคเอกชน การเข้าถึงแหล่งเงินทุนสนับสนุน และการสร้างพื้นที่การทำงานร่วมกันสำหรับส่งเสริมความเป็นผู้ประกอบการสังคม และองค์ประกอบหลักที่เป็นหัวใจของระบบนิเวศที่เอื้อต่อการส่งเสริมความเป็นผู้ประกอบการสังคมในมหาวิทยาลัยไทย คือทรัพยากรบุคคลในฐานะผู้ขับเคลื่อน ผู้ให้กำเนิด และผลักดันส่งเสริมความเป็นผู้ประกอบการสังคมในมหาวิทยาลัยให้ประสบความสำเร็จ

บทความเรื่องนี้ได้นำเสนอความเข้าใจเกี่ยวกับความคิดทางการเมืองของ John Stuart Mill ว่าด้วยแนวทางการป้องกันทรราชของเสียงข้างมาก โดยใช้วิธีการศึกษาแบบปรัชญาการเมือง ผ่านการวิเคราะห์ตีความตัวบทอย่างละเอียด ผลการศึกษาพบว่าทรราชของเสียงข้างมาก ในทัศนะของ Mill คือ สภาวะที่คนฝ่ายเสียงข้างมากในสังคมกดขี่หรือละเมิดเสรีภาพของคนฝ่ายเสียงข้างน้อยในสังคม ซึ่งมีอยู่ด้วยกัน 2 ประเภท คือ (1) ทรราชของเสียงข้างมากโดยกฎหมาย (2) ทรราชของเสียงข้างมากโดยสังคม หรือทรราชของเสียงข้างมากโดยมติความคิดเห็นและอารมณ์ความรู้สึกที่แพร่หลายของคนส่วนใหญ่ในสังคม Mill หวาดกลัวทรราชของเสียงข้างมาก และถือว่ามันเป็นความชั่วร้ายประการหนึ่งในสังคมประชาธิปไตย ดังนั้นเพื่อป้องกันทรราชของเสียงข้างมาก Mill จึงเสนอว่าปัจเจกบุคคล สังคม และรัฐ ต้องมีหลักการสำคัญอันเป็นแนวคิดและแนวปฏิบัติร่วมกัน ซึ่งได้แก่ (1) หลักแห่งอรรถประโยชน์ (2) หลักแห่งเสรีภาพของปัจเจกบุคคล (3) หลักแห่งขันติธรรม (4) หลักแห่งความเป็นภัยอันตรายแก่ผู้อื่น (5) หลักแห่งการมีส่วนร่วม (6) หลักแห่งการปกครองแบบมีตัวแทน และ (7) หลักแห่งการกระจายอำนาจและการปกครองท้องถิ่น

การวิเคราะห์เชิงสถาบันของระบบเตือนภัยล่วงหน้าสำหรับอุทกภัยในประเทศไทย : กรณีศึกษา อุทกภัยจากอิทธิพลพายุโซนร้อนปาบึก พ.ศ. 2562 ในจังหวัดนครศรีธรรมราช, ธวัฒชัย ปาละคะมาน

การวิจัยในครั้งนี้มีวัตถุประสงค์เพื่อ 1) ทบทวนบริบทและแนวคิดระบบเตือนภัยล่วงหน้าสำหรับอุทกภัยที่มีในประเทศไทยและต่างประเทศ 2) ศึกษาการบริหารจัดการของระบบเตือนภัยล่วงหน้าสำหรับอุทกภัยของประเทศไทยในเหตุการณ์อุทกภัยจากอิทธิพลพายุโซนร้อนปาบึกในพื้นที่จังหวัดนครศรีธรรมราช  3) ข้อเสนอแนะเชิงนโยบายต่อการเสริมสมรรถนะกลไกเชิงสถาบันของระบบเตือนภัยล่วงหน้าสำหรับอุทกภัยของประเทศไทยในพื้นที่จังหวัดนครศรีธรรมราช โดยใช้วิธีการวิจัยแบบผสมผสาน ซึ่งมีการใช้เครื่องมือการวิเคราะห์เครือข่ายทางสังคมและการสัมภาษณ์เชิงลึก วิธีเชิงปริมาณโดยใช้แบบสอบถาม ผลจากการวิเคราะห์ข้อมูล พบว่า 1) ประเทศไทยมีหน่วยงานที่มีอำนาจหน้าที่ตามกฎหมายเพื่อดำเนินการด้านการเตือนภัยจำนวนมาก แต่มีการดำเนินการเตือนภัยที่สอดคล้องกับมาตรฐานสากลโดยเฉพาะในหน่วยงานระดับส่วนกลาง 2) ภาพรวมของเครือข่ายการเตือนภัยล่วงหน้าอยู่ในลักษณะการผสมผสานระหว่างเครือข่ายตารางแบบบางส่วนกับเครือข่ายที่เข้าถึงได้หลายช่องทางที่ไม่สมบูรณ์ บ่งชี้ว่า 2.1) เครือข่ายขาดการกำหนดบทบาทหน้าที่และทิศทางอย่างเป็นทางการจึงทำให้สมาชิกในเครือข่ายมีปฏิสัมพันธ์กันในระดับต่ำ 2.2) สมาชิกในเครือข่ายไม่มีการดำเนินกิจกรรมด้านการเตือนภัยล่วงหน้าเป็นการเฉพาะพอที่จะก่อให้เกิดการปฏิสัมพันธ์ระหว่างกัน ส่งผลให้เครือข่ายขาดความเหนียวแน่น และ 2.3) เครือข่ายในระดับท้องถิ่นขาดการเชื่อมโยงกับกลไกการเตือนภัยล่วงหน้าอย่างเป็นระบบ 3) เสนอให้มีการกำหนดให้มียุทธศาสตร์การเตือนภัยล่วงหน้าเป็นการเฉพาะที่กำหนดความสัมพันธ์เชิงอำนาจอย่างเป็นทางการของหน่วยงานต่าง ๆ ให้สอดคล้องกัน ตลอดจนกำหนดกลไกการติดตาม การประเมินผล และการพิจารณางบประมาณด้านการเตือนภัยที่มีเอกภาพทั้งประเทศ ตลอดจนกำหนดกลไกและการเตรียมพร้อมด้านการเตือนภัยในระดับพื้นที่อย่างเป็นรูปธรรมในแผนการจัดการภัยพิบัติท้องถิ่น และจัดให้มือคู่มือมาตรฐานปฏิบัติการด้านการเตือนภัย

การมีส่วนร่วมในกระบวนการที่ไม่มีส่วนร่วม? : มุมมองต่อการจัดการน้ำหลังเหตุการณ์น้ำท่วมใหญ่ พ.ศ. 2554, เผ่าไทย สินอำพล

การปฏิรูปโครงสร้างการอภิบาลน้ำของไทยเกิดขึ้นหลังจากเหตุการณ์น้ำท่วมใหญ่ พ.ศ. 2554 เพื่อลดความเสี่ยงอุทกภัยและสร้างความมั่นคงในภาคการผลิต มีผลต่อสมดุลอำนาจทั้งในการกำหนดนโยบายและการปฏิบัติตั้งแต่ในระดับชาติจนถึงท้องถิ่น บทความปริทัศน์ชิ้นนี้สะท้อนความก้าวหน้าและความท้าทายในการจัดการน้ำของประเทศไทยภายใต้กรอบแนวคิดการอภิบาลน้ำแบบมีส่วนร่วม ผลการศึกษาพบว่าการจัดการน้ำในปัจจุบันเริ่มให้ความสำคัญต่อวิถีชีวิตผ่านการใช้พื้นที่รับน้ำนองและโครงการจัดการน้ำชุมชนด้วยข้อมูลสารสนเทศ แต่มิได้ทำให้เกิด “จุดเปลี่ยนแห่งความร่วมมือ” อย่างแท้จริง เนื่องจากการเปลี่ยนศูนย์อำนาจการจัดการน้ำไปสู่ระบอบรัฐราชการอย่างเข้มข้น ทำให้ชาวชนบทที่รองรับน้ำท่วมให้ภาครัฐมีวิถีชีวิตอยู่บนความไม่แน่นอน และยังเปิดโอกาสให้ภาคการเมือง ภาคประชาสังคม ชุมชนท้องถิ่น และภาคส่วนอื่น ๆ ในการมีส่วนร่วมกำหนดนโยบายน้อยเกินไป จึงขาดการบูรณาการความรู้ที่หลากหลาย และการกำหนดสิทธิในการจัดการน้ำร่วมกันอย่างเสรี การต่อรองระบอบอภิบาลน้ำควรต้องดำเนินต่อไปให้สอดคล้องกับความต้องการที่แท้จริงของสังคม

การบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) : กรณีศึกษาโรคติดเชื้อไวรัสโคโรนา 2019 (Covid-19) ในเขตอำเภอเมือง จังหวัดนครราชสีมา, วรัชยา เชื้อจันทึก

บทความวิจัยนี้มีวัตถุประสงค์ 1) เพื่อศึกษาระดับการบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) และ 2) เพื่อเสนอแนวทางการพัฒนาการบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) ใช้การวิจัยเชิงปริมาณ โดยใช้แบบสอบถาม (questionnaire) กับ 1) บุคลากรขององค์กรปกครองส่วนท้องถิ่น ประกอบด้วย นายกองค์กรปกครองส่วนท้องถิ่นหรือตัวแทน ปลัดองค์กรปกครองส่วนท้องถิ่น เจ้าพนักงานป้องกันและบรรเทาสาธารณภัย นักสาธารณสุขและสิ่งแวดล้อม จำนวน 104 คน 2) บุคลากรโรงพยาบาลส่งเสริมสุขภาพตำบล ประกอบด้วยผู้อำนวยการโรงพยาบาลส่งเสริมสุขภาพตำบล พยาบาลวิชาชีพชำนาญการ เจ้าพนักงานสาธารณสุขชำนาญงาน จำนวน 60 คน 3) ตัวแทนชุมชน จำนวน 140 คน รวมทั้งสิ้น 304 คน วิเคราะห์ข้อมูลด้วยสถิติเชิงพรรณนา ผลการวิจัยพบว่าระดับการบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) ในภาพรวมอยู่ในระดับมาก (  = 4.06, S.D. = 0.52) เมื่อพิจารณาเป็นรายด้าน พบว่าด้านที่มีค่าเฉลี่ยสูงที่สุด คือ การพัฒนาศักยภาพระบบการเตรียมพร้อม (  = 4.15, S.D. = 0.54) รองลงมาคือ การเสริมสร้างความร่วมมือการเตรียมพร้อมรับมือ ( = 4.06, S.D. = 0.60) การบริหารจัดการแผนแบบบูรณาการ ( = 4.02, S.D. = 0.66) และการเสริมสร้างศักยภาพของทุกภาคส่วน ( = 3.89, S.D. = 0.43) ตามลำดับ 2) แนวทางการพัฒนาการบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) ได้แก่ การเสริมสร้างศักยภาพของทุกภาคส่วน ประกอบด้วยการเสริมสร้างศักยภาพขององค์กรปกครองส่วนท้องถิ่น การเสริมสร้างศักยภาพของโรงพยาบาลส่งเสริมสุขภาพตำบล การเสริมสร้างศักยภาพของชุมชน การเสริมสร้างศักยภาพของอาสาสมัครสาธารณสุขประจำหมู่บ้าน (อสม.) และการเสริมสร้างศักยภาพของประชาชน

อินเดียกับการจัดการจลาจลในกรณีแคชเมียร์, สุรัตน์ โหราชัยกุล, สิริกร ธารีรัตนาวิบูลย์

นับตั้งแต่ได้รับเอกราชในปี ค.ศ. 1947 อินเดียก็เผชิญความท้าทายด้านความมั่นคงมาโดยตลอด ในบรรดาความท้าทายเหล่านั้น การก่อจลาจลในรูปแบบต่าง ๆ ที่เกี่ยวกับแคชเมียร์หรือในแคชเมียร์ ปัญจาบ ภูมิภาคตะวันออกเฉียงเหนือ และนักซาไลต์ เป็นภัยคุกคามที่บั่นทอนความมั่นคงแห่งชาติของอินเดียมากที่สุด บทความนี้มีวัตถุประสงค์เพียงข้อเดียวคือ เพื่อตอบคำถามวิจัยว่าอินเดียมีวิธีจัดการกับปัญหาจลาจลในแคชเมียร์อย่างไร ในขณะเดียวกันก็มีข้อโต้แย้งสำคัญสองประการ คือ (1) การก่อจลาจลในแคชเมียร์มีปัจจัยภายนอกมาเกี่ยวข้องอย่างสำคัญยิ่ง ทำให้รัฐบาลอินเดียแก้ปัญหาได้ยากลำบาก และ (2) การแก้ปัญหาแคชเมียร์ของอินเดียมีหลักคิดและวิธีตรงกับกรอบความมั่นคงแบบดั้งเดิมและกรอบความมั่นคงของมนุษย์ผสมผสานกัน ต่างจากโลกวิชาการที่มักจะมองกรอบทั้งสองแยกจากกันสิ้นเชิง บทความแบ่งออกเป็น 3 ส่วน ส่วนแรกบรรยายพัฒนาการประเด็นปัญหาการจลาจลในแคชเมียร์ ส่วนที่สองอธิบายการจัดการจลาจลแคชเมียร์ของอินเดีย และส่วนสุดท้ายสรุปเนื้อหาใจความของบทความพร้อมทิ้งท้ายด้วยข้อคิดบางประการ

วัฒนธรรมสร้างสรรค์ขององค์การสมองซีกขวาซึ่งเป็นองค์การที่มีศักยภาพในการทำหน้าที่ของสมองซีกขวาในการผลิตจินตนาการนั้น เป็นหัวใจสำคัญในการสร้างนวัตกรรมองค์การระดับโลก อาทิ มหาวิหาร ซากราดา ฟามิเลีย บทความนี้มีวัตถุประสงค์เพื่อศึกษาลักษณะการบริหารวัฒนธรรมองค์การ ของวัดร่องขุ่น จังหวัดเชียงราย ว่าได้อาศัยวัฒนธรรมสร้างสรรค์ขององค์การสมองซีกขวาหรือไม่ อย่างไร ในการสร้างนวัตกรรมองค์การ และศึกษามาตรการเพื่อส่งเสริมและประยุกต์ใช้กับองค์การภาครัฐ โดยอาศัยการบูรณาการข้ามศาสตร์ ด้วยวิธีวิจัยแบบผสม ทั้งเชิงปริมาณและคุณภาพ เครื่องมือในการวิจัย ได้แก่ แบบสอบถาม แบบสัมภาษณ์กึ่งโครงสร้าง และแบบสัมภาษณ์เชิงลึก กลุ่มตัวอย่าง ได้แก่ กลุ่มผู้ที่ปฎิบัติงานในวัดร่องขุ่น กลุ่มผู้เชี่ยวชาญสาขาต่าง ๆ และกลุ่มสาธารณชน ข้อค้นพบคือ (1) การบริหารวัฒนธรรมองค์การของวัดร่องขุ่น ได้อาศัยวัฒนธรรมสร้างสรรค์ขององค์การสมองซีกขวาทุกมิติ ข้อมูลจากแบบสอบถามแสดงว่ากลุ่มตัวอย่างมีการรับรู้วัฒนธรรมสร้างสรรค์ ลักษณะองค์การสมองซีกขวา และการสร้างนวัตกรรมของวัดร่องขุ่น อยู่ในระดับสูงที่สุด สอดคล้องกับผลการสัมภาษณ์และข้อเสนอทางทฤษฎี (2) มาตรการส่งเสริมและประยุกต์ใช้การบริหารด้วยแนวทางวัฒนธรรมสร้างสรรรค์ขององค์การสมองซีกขวา เพื่อสร้างนวัตกรรมขององค์การภาครัฐ ได้แก่ การส่งเสริมวัฒนธรรมเชิงรุกและวัฒนธรรมมืออาชีพ การขจัดวัฒนธรรมความกลัวและวัฒนธรรมการลอกเลียนแบบ

งานวิจัยเรื่อง “แนวทางการเพิ่มประสิทธิภาพของการบังคับใช้พระราชบัญญัติป้องกันและปราบปรามการมีส่วนร่วมในองค์กรอาชญากรรมข้ามชาติ พ.ศ. 2556” มีวัตถุประสงค์เพื่อศึกษาแนวทางการบังคับใช้กฎหมายของต่างประเทศในการป้องกันปราบปรามองค์กรอาชญากรรมข้ามชาติ ประเมินผลการดำเนินงานและผลกระทบของการบังคับใช้ รวมทั้งปัญหาอุปสรรคของหน่วยงานในกระบวนการยุติธรรมและหน่วยงานที่เกี่ยวข้องต่อการบังคับใช้พระราชบัญญัติป้องกันและปราบปรามการมีส่วนร่วมในองค์กรอาชญากรรมข้ามชาติ พ.ศ. 2556  อันนำมาสู่การเสนอแนะแนวทางการเพิ่มประสิทธิภาพของการบังคับใช้พระราชบัญญัติฉบับนี้ โดยเป็นการวิจัยเชิงผสมผสานระหว่างการวิจัยเชิงปริมาณและการวิจัยเชิงคุณภาพ ผลการศึกษาพบว่าการบังคับใช้พระราชบัญญัติฉบับนี้มีประสิทธิภาพในด้านคุณภาพของการนำมาใช้ โดยสามารถเป็นเครื่องมือในการป้องกันและปราบปรามการกระทำผิดขององค์กรอาชญากรรมข้ามชาติขนาดใหญ่ที่ส่งผลกระทบมูลค่ามหาศาล บรรลุเจตนารมณ์ของกฎหมายในการลงโทษองค์กรอาชญากรรมข้ามชาติ ข้อเสนอแนะที่สำคัญ ได้แก่ การกำหนดนโยบายในการนำพระราชบัญญัติฉบับนี้มาใช้อย่างจริงจัง การจัดทำคู่มือการปฏิบัติงานควบคู่กับการสร้างความรู้ความเข้าใจแก่เจ้าหน้าที่ผู้เกี่ยวข้อง และการจัดตั้งหน่วยงานกลางทำหน้าที่ใน  การตรวจสอบคดีที่เกี่ยวข้องกับองค์กรอาชญากรรมข้ามชาติ เป็นต้น

Using hermeneutical methodology, this paper examines some of the legal fictions that form the foundation of Federal Indian Law. The text of the U.S. Supreme Court’s 1823 Johnson v. M’Intosh opinion is evaluated through the lens of the Convention on the Prevention and Punishment of the Crime of Genocide to determine the extent to which the Supreme Court incorporated genocidal principles into United States common law. The genealogy of M’Intosh is examined to identify influences that are not fully apparent on the face of the case. Mixed human deoxyribonucleic acid (DNA) samples present one of the most challenging pieces of evidence that a forensic analyst can encounter. When multiple contributors, stochastic amplification, and allele drop-out further complicate the mixture profile, interpretation by hand becomes unreliable and statistical analysis problematic. Probabilistic genotyping software has provided a tool to address complex mixture interpretation and provide likelihood ratios for defined sets of propositions. When it comes to the Supreme Court’s criminal jurisprudence and its relationship to racial (in)equity, progressive scholars often focus on the tartness of the lemons. I leverage key informant interviews, participant observations, and event ethnographies to form a four-year institutional ethnography of the implementation of produce prescriptions within West Virginia alongside a legal-policy archaeology methodology to understand how produce prescriptions have been institutionalized and funded within the US Farm Bill.
