ประเทศไทยมิได้มีกฎหมายภายในประเทศที่รับรองคุ้มครองสิทธิในการแสวงหาที่ลี้ภัยจากการประหัตประหาร (Right to Seek Asylum from Persecution) ของผู้พลัดถิ่น (Forcibly Displaced Persons) ซึ่งรวมถึงผู้ลี้ภัย (Refugees) เป็นการเฉพาะ ทั้งนี้ เมื่อเดือนกันยายน พ.ศ. 2566 สำนักงานตรวจคนเข้าเมืองได้เริ่มคัดกรอง “ผู้ได้รับการคุ้มครอง” ตามระเบียบสำนักนายกรัฐมนตรีว่าด้วยการคัดกรองคนต่างด้าวที่เข้ามาในราชอาณาจักรและไม่สามารถเดินทางกลับประเทศอันเป็นภูมิลำเนาได้ พ.ศ. 2562 หรือที่รู้จักกันในนาม National Screening Mechanism (NSM) โดยคนต่างด้าวที่ผ่านการคัดกรองจะได้รับการคุ้มครองจากการถูกบังคับส่งกลับไปยังประเทศต้นทางที่อาจมีภยันตราย (Protection Against Refoulement) แม้ประเทศไทยจะมิได้เป็นภาคีต่ออนุสัญญาว่าด้วยสถานภาพผู้ลี้ภัย ค.ศ. 1951 และพิธีสารที่เกี่ยวข้องก็ตาม แต่กระบวนการคัดกรอง NSM ปรากฏลักษณะสำคัญที่คล้ายคลึงกับกระบวนการพิจารณาสถานภาพผู้ลี้ภัย (Refugee Status Determination: RSD) ซึ่งสำนักงานข้าหลวงใหญ่ผู้ลี้ภัยแห่งสหประชาชาติ (UNHCR) ได้ดำเนินการในประเทศไทยมาหลายทศวรรษ อย่างไรก็ดี เมื่อกระบวนการคัดกรอง NSM ถูกดำเนินงานโดยหน่วยงานภาครัฐ อีกทั้งเป็นกระบวนการภายใต้กฎหมายว่าด้วยคนเข้าเมืองซึ่งยึดโยงกับความมั่นคงของชาติและผลประโยชน์ทางการเมืองในระดับภูมิภาค จึงอาจมีข้อพิจารณาอื่นนอกเหนือไปจากความเสี่ยงต่อการประหัตประหาร แตกต่างไปจากบริบทความคุ้มครองระหว่างประเทศ อันเป็นเจตนารมณ์ของกระบวนการคัดกรองผู้ลี้ภัยโดยทั่วไป ดังนั้น จึงเกิดข้อถกเถียงว่ากระบวนการคัดกรอง NSM อาจมิใช่กระบวนการพิจารณาสถานภาพผู้ลี้ภัยในระดับชาติตามความคาดหวังของประชาคมโลก แต่เป็นเพียงข้อโต้แย้งภายใต้กระบวนการตรวจคนเข้าเมืองที่ยังคงปรากฏข้อจำกัดแก่การเข้าถึงสิทธิขั้นพื้นฐาน และอาจยังมิใช่วิธีการแก้ไขปัญหาผู้ลี้ภัยอย่างยั่งยืน

ปัญหาการวินิจฉัยคดีพิพาทเกี่ยวกับสิทธิชุมชนตามรัฐธรรมนูญของศาลปกครอง (Judgment Issues Of The Administrative Court In Community Rights Cases Under The Constitution Of The Kingdom Of Thailand), Adisorn Kongphunpin

แม้สิทธิชุมชนจะเป็นสิทธิระดับรัฐธรรมนูญมากว่าสองทศวรรษก็ตาม แต่การขาดความชัดเจนในรายละเอียดของสิทธิ นับเป็นอุปสรรคสำคัญต่อการที่ศาลปกครองจะวินิจฉัยรับรองสิทธิชุมชนให้เกิดผลในทางปฏิบัติ จากปัญหาดังกล่าวจึงเป็นที่มาของงานวิจัยฉบับนี้ที่มุ่งศึกษาแนวคิดและทฤษฎีเกี่ยวกับสิทธิชุมชน และคำวินิจฉัยคดีปกครองเกี่ยวกับสิทธิชุมชนของต่างประเทศ เพื่อนำมากำหนดเป็นแนวทางทางกฎหมายในการวินิจฉัยคดีพิพาทเกี่ยวกับสิทธิชุมชนในศาลปกครองของไทย ผลการศึกษาพบว่า “สิทธิชุมชน” เป็น “สิทธิเชิงกลุ่ม” ซึ่งมีพัฒนาการมาจากกฎหมายสิทธิมนุษยชนและกฎหมายสิ่งแวดล้อมระหว่างประเทศ โดย “ชุมชน” สามารถใช้สิทธิทางศาลได้โดยการมอบหมายให้ปัจเจกบุคล และ/หรือ นิติบุคคล ที่เป็นตัวแทนหรือผู้แทนของชุมชนนำคดีไปฟ้องต่อศาลในนามของชุมชน และในกรณีที่ศาลปกครองพิจารณาแล้วเห็นว่า ผู้ฟ้องคดีเป็นผู้ทรงสิทธิชุมชนตามรัฐธรรมนูญและมีสิทธิในการเข้าถึงและใช้ประโยชน์จากทรัพยากรธรรมชาติและสิ่งแวดล้อม เช่น มีสิทธิในการดำรงวิถีชีวิตในพื้นที่ป่า เป็นต้น แม้ว่าจะมีข้อจำกัดที่ทำให้ศาลไม่สามารถออกคำบังคับให้ผู้ฟ้องคดีเข้าไปดำรงวิถีชีวิตอยู่ในพื้นที่ป่าได้ก็ตาม หากแต่ผู้ฟ้องคดีฟ้องขอค่าสินไหมทดแทนจากการที่ต้องสูญเสียสิทธิในการกำหนดเจตจำนงของตนเอง และ/หรือ สิทธิในการเข้าถึงและใช้ประโยชน์จากทรัพยากรธรรมชาติและสิ่งแวดล้อมมาด้วย ศาลปกครองย่อมสามารถกำหนดให้ฝ่ายปกครองชดใช้ค่าสินไหมทดแทนให้แก่ผู้ฟ้องคดีจากการที่ต้องสูญเสียสิทธิดังกล่าวในการดำรงวิถีชีวิตตามจารีตประเพณี ตามบรรทัดฐานคำวินิจฉัยของศาลต่างประเทศได้

ในปี พ.ศ. 2541 (ค.ศ. 1998) องค์กรอุทธรณ์ขององค์การการค้าโลก (the World Trade Organization) ได้ให้ความสำคัญของค่านิยมเรื่อง “การอนุรักษ์สัตว์ป่าที่ใกล้สูญพันธุ์” ได้แก่ เต่าทะเล ว่ามีความสำคัญเทียบเท่ากับค่านิยมเรื่อง “ประสิทธิภาพทางเศรษฐกิจ” ตามทฤษฎีทางเศรษฐศาสตร์เรื่องความได้เปรียบโดยเปรียบเทียบ (Comparative Advantage) โดยตัดสินคดีข้อพิพาทระหว่างประเทศสหรัฐอเมริกากับประเทศอินเดีย ปากีสถาน มาเลเซีย และไทย ว่ามาตรการของประเทศสหรัฐอเมริกาที่ห้ามนำเข้ากุ้งจากประเทศอินเดีย ปากีสถาน มาเลเซีย และไทยนั้น แม้จะเป็นมาตรการที่ไม่สอดคล้องกับข้อ 11 ของความตกลงทั่วไปว่าด้วยภาษีศุลกากรและการค้า (General Agreement on Tariffs and Trade หรือ GATT) ก็ตาม แต่ก็ได้รับการนิรโทษตามข้อ 20 (จี) ของความตกลงฉบับดังกล่าวเนื่องจากเต่าทะเลเป็นทรัพยากรธรรมชาติที่ใช้แล้วสูญสิ้นหมดไป เมื่อวิเคราะห์เปรียบเทียบระหว่างคำตัดสินในข้อพิพาทดังกล่าวกับมาตรการเก็บคาร์บอนข้ามพรมแดนของสหภาพยุโรป (European Carbon Border Adjustment Mechanism หรือ EU-CBAM) แล้ว อาจชี้ให้เห็นได้ว่าในอนาคต หากมีข้อพิพาทที่เกี่ยวข้องกับมาตรการดังกล่าวเข้าสู่กลไกระงับข้อพิพาทขององค์การการค้าโลกแล้ว คณะพิจารณาข้อพิพาทและองค์กรอุทธรณ์ขององค์การการค้าโลกซึ่งตระหนักดีถึงปัญหา “วิกฤตโลกร้อน” ที่เกิดขึ้นในปัจจุบัน ก็มีแนวโน้มสูงที่จะให้ความสำคัญกับค่านิยมสากลเรื่อง “การอนุรักษ์ชั้นบรรยากาศโลก” อันได้แก่ การลดปริมาณการปล่อยก๊าซเรือนกระจกเข้าสู่ชั้นบรรยากาศของโลกเพื่อไม่ให้อุณหภูมิของโลกสูงขึ้นเกินกว่า 2 องศาเซลเซียส ภายใน พ.ศ. 2593 (ค.ศ. 2050) ไม่น้อยไปกว่าค่านิยมเรื่อง “ประสิทธิภาพทางเศรษฐกิจ” และคงจะตัดสินให้มาตรการ EU-CBAM ได้รับการนิรโทษตามข้อ 20 (จี) ของความตกลงทั่วไปว่าด้วยภาษีศุลกากรและการค้าเช่นเดียวกัน

El presente artículo analiza las dinámicas de sostenibilidad ambiental en comunidades mayas del estado de Yucatán, México, enfocándose en los riesgos ambientales y las respuestas adaptativas desarrolladas frente al cambio climático. El trabajo se desarrolló en tres comunidades: Yaxunah, caracterizada por la producción artesanal y la sobreexplotación del árbol de Chaká (Bursera simaruba); Ixil, que enfrenta disputas territoriales e inundaciones recurrentes; y Sotuta, afectada por la contaminación acuífera derivada de una granja porcina en zonas aledañas. "The current study adds to the literature on prison foodways and media studies by exploring the role of prison food on the show Orange is the New Black (OITNB). Specifically, this project aimed to better understand the nature of televised incarceration experiences through the way in which incarcerated characters interacted with food in the scenes. Through an analysis of 601 food-related scenes in OITNB, findings suggest: 1) food is a vehicle for additional layers of institutional control of captive bodies, 2) food plays myriad non-food roles such as medicine, a transactional medium, a vehicle for contraband, and even sexual pleasure, …

"For previously incarcerated persons, affordable and safe housing options are scarce. Barriers to securing housing include federal mandates (i.e., eligibility requirements) as well as local rules and regulations (i.e., zoning and ordinances). When housing is available, disclosing criminal history on applications impacts individuals’ chances to rent (Philips & Spencer, 2013). A lack of a consistent rental history, no personal and/or employment references, and securing capital to cover security deposits are added challenges. "This study proposes to investigate how public views on the wrongful conviction issue are connected with the perceived need for criminal justice reform and whether the professional experience in law enforcement influences these perceptions. This study employs a qualitative research design, deriving its conclusions from the comparative analysis of the survey responses concerning the issue of wrongful convictions and the criminal justice system collected from 45 law enforcement professionals and 35 individuals without such experience. "General strain theory posits that individuals commit crimes when they experience negative emotions following various sources of strain. One such source of strain is poverty. In this study, researchers use focus group data and apply a general strain framework to analyze criminal offending during the Missouri Community Action Network's Poverty Simulation© (2022) at a regional comprehensive university in the Southeast region of the United States. A total of 99 undergraduate and graduate students participated in the focus groups at the end of the simulation. Colonial mural art in the Yucatán Peninsula represents a cultural intersection where Christian iconography and Maya artistic traditions converged in a complex visual dialogue. Maya Christian Murals of Early Modern Yucatán (Texas University Press, 2024) offers a detailed analysis of these pictorial expressions, exploring how Indigenous artists reinterpreted colonial impositions by preserving ancestral techniques, materials, and symbolism. Black Americans have long faced discriminatory treatment while shopping in retail establishments, including, most notably, being subjected to increased surveillance, inconsistent pricing, and inferior customer service. There is widespread consensus amongst scholars that sanctions—the deliberate withdrawal of customary trade and financial relations—do not work. Despite this perception, states are deploying sanctions at an increasing rate. This Article explains this paradox by arguing the predominant notion of sanctions’ utility employed by scholars is unduly constrained, narrowly focusing on the ability of such measures to modify the behavior of sanctioned parties while disregarding the alternative benefits this instrument can deliver. Problem: The shift from a focus on rehabilitation to the more punitive, “tough on crime” approach to illegal behavior in the U.S. has been enacted in no small way by policies connected to the use and abuse of drugs. The disparities between crack and powder cocaine—two chemically similar substances—have headlined this shift (Vagins and McCurdy 2006). However, research is scarce on laypeople’s approval of deterrence approaches for drug offenses, including as a function of types (e.g., powder vs. cocaine possession). This required the Smithsonian Museum to repatriate any human remains or funerary objects associated with Native American Ancestry back to their tribes. The predominance of international criminal law as a frontline response to atrocity crimes prioritizes the countering of impunity as an overarching goal. A corresponding “anti-impunity norm” identifies the legal punishment of individual perpetrators as a core requirement in legal responses to atrocities. This anti-impunity norm – the requirement to prosecute and punish – is also a legal obligation for state parties to the International Criminal Court. But the anti-impunity norm equates impunity’s opposite – accountability – with the imposition of legal punishment. There are certain rights that are explicitly enumerated in the Constitution, e.g., right to bear arms, right to free speech, right to a speedy and public trial. There are also rights that aren’t specifically written out but are nevertheless enjoyed by people nationwide. Mediante una metodología cualitativa, que incluye observación libre, conversaciones grupales y pruebas fonológicas, se investigan las características lingüísticas de los hablantes saharauis, cuya lengua materna es el hassanía. “Sovereignty,” Arendt says, “is contradictory to” the human condition. It is not, in any event, the kind of thing that can be shared across generations. Subsequent generations lack sovereignty to the precise degree that they are bound by the decisions of their predecessors. It is no answer to say that contemporary citizens participate in the sovereignty of a whole, transgenerational people. "Correctional staff behavior can impact inmates’ perceptions of procedural justice and facilitate incidents of prison misconduct and violence. This analysis showed findings gathered from 136 female inmates incarcerated in a state correctional system. This exploratory analysis examined inmates’ self-reported responses about direct experiences, perceptions, and interactions with correctional officers. Findings from 19 Likert-scale items highlighted inmates’ encounters with correctional officers, however, results shown here focused on findings uncovered from a content analysis performed on inmates’ written comments to an open-ended item. The emerging themes portrayed correctional officers as disrespectful, indifferent, misusing authority, and dehumanizing."

"Internships play a crucial role in the educational and professional training of students. This article presents a qualitative evaluation of the benefits and challenges of an undergraduate internship through an examination of self-reflective journals completed by 20 seniors majoring in criminal justice. Findings were organized into five major themes: knowledge acquisition, professional development, personal development, affective development, and awareness of the realities of the criminal justice system. The most frequently cited benefits included increased learning, the ability to apply coursework to the internship experience, and improved career readiness. Prior research has examined the quality and effectiveness of Institutional Review Boards (IRB). However, research on the experiences of criminology and criminal justice researchers when interfacing with their IRBs is scant. This study seeks to fill this gap through the exploration of experiences criminology and criminal justice researchers have had with IRBs. "This research explores disinformation delivered during the 2019 Canadian Federal election. This study explores the methods and techniques used by the perpetrators of disinformation campaigns in the context of Canadian elections. This research also examines whether the disinformation discovered during the election falls within criminal foreign interference. Critical discourse analysis is used to qualitatively analyze 26 articles published by a Northeastern U.S. based independent news website within the ten months leading up to the election.
