This content analysis paper investigates the portrayal of the legal profession onstage within legal dramas first performed in the twenty-first century. There has been no previous research that has focused on a comprehensive analysis of the specific content of legal dramas, so this study is exploratory in nature. This study emphasizes the importance of learning about the content characteristics of legal plays and legal characters. This content analysis seeks to answer two research questions. Solitary confinement is widespread and recognized as harmful in society. However, it is not as researched as other controversial issues, including immigration, gun control, abortion, etc. Due to this, it is hard to gauge how supportive the public is or isn't of related practices. In a general sense, public support has been established by legislators crafting policy, and by extension United States Supreme Court decision making. This is particularly crucial in discussions on interpretations of the 8th Amendment/ cruel and unusual punishment. Existing case law, such as Peoples V. It’S Time For A Change: A Proposal To Abolish Solitary Confinement From Canadian Prisons, Amy Rico

Despite Canada’s reputation for being a leader in human rights, its treatment of prisoners requires a closer examination. In particular, prisoner and human rights advocates have widely criticized the use of solitary confinement in Canadian federal and provincial prisons as a form of torture. Solitary confinement imposes excruciating and demeaning conditions on prisoners, jeopardizing their mental and physical welfare. Following court decisions deeming solitary confinement unconstitutional, the federal government replaced the formal use of solitary confinement with structured intervention units. However, these units continue to be a reformulated version of the original practice, sustaining the torturous conditions subjected to inmates. …

Since the financial crisis of 2008, left-leaning legal thought has experienced a renaissance within the American academy. From law and political economy to critical race theory to feminist legal studies to Marxist legal theory, new perspectives have flourished, and marginalized traditions have been revived and revised. These new perspectives and revisionist projects all share an intellectual debt to the critical legal studies (“CLS”) movement of the late 1970s and 1980s. A robust and extensive body of empirical research, and a rich historical record, documents a recurring and pervasive influence of race in the application of California’s death penalty. This article reviews the legal and social science research to document multiple paths through which institutions and processes produce these racial disparities over many decisions in many cases across four decades. The article reviews relevant literature by decision, institution, or actor and presents key findings. This thesis examines the treatment of jury duty and voting in the United States through the philosophical framework of John Stuart Mill and Alexis de Tocqueville. While jury duty is legally mandated, voting remains optional, despite both civic responsibilities being foundational to democratic participation. This research explores the historical, theoretical, and practical implications of voting becoming compulsory in the United States, as it is in other democratic nations. สถานการณ์ความขัดแย้งในพื้นที่จังหวัดชายแดนภาคใต้ของประเทศไทย เดิมถูกจัดเป็นการขัดกันทางอาวุธที่ไม่มีลักษณะระหว่างประเทศภายใต้กฎหมายมนุษยธรรมระหว่างประเทศ บทความนี้มีจุดประสงค์เพื่อเปิดโอกาสให้มีการประเมินการจำแนกประเภทการขัดกันทางอาวุธดังกล่าวใหม่ โดยพิจารณาจากพัฒนาการของสถานการณ์ความรุนแรง ประกอบกับองค์ประกอบของการขัดกันทางอาวุธที่ไม่มีลักษณะระหว่างประเทศ กล่าวคือ เกณฑ์ความรุนแรงและเกณฑ์การจัดตั้งของกลุ่มติดอาวุธ นอกจากนี้ บทความนี้จะวิเคราะห์ถึงผลกระทบจากการปรับใช้กฎหมายมนุษยธรรมระหว่างประเทศและกฎหมายสิทธิมนุษยชนระหว่างประเทศ ต่อสถานการณ์ความขัดแย้งในพื้นที่จังหวัดชายแดนภาคใต้ โดยนำเสนอว่าการบังคับใช้กฎหมายระหว่างประเทศดังกล่าว ก่อให้เกิดข้อท้าทายทางกฎหมายในการให้ความคุ้มครองสิทธิของผู้ที่ได้รับผลกระทบ กล่าวคือ สิทธิในชีวิต, สิทธิในเสรีภาพและสิทธิที่จะได้รับการเยียวยา ซึ่งข้อท้าทายเหล่านี้ส่งผลเป็นการลดทอนความคุ้มครองแก่บุคคลดังกล่าวภายใต้กฎหมายสิทธิมนุษยชนระหว่างประเทศ รวมทั้งมีผลกระทบในเชิงลบต่อสถานการณ์ความขัดแย้ง

คณะกรรมการกำกับกิจการพลังงาน (กกพ.) มีข้อจำกัดในการกำกับดูแลการประกอบกิจการไฟฟ้าเพื่อรองรับและส่งเสริมการเปลี่ยนผ่านด้านพลังงานสู่สังคมคาร์บอนต่ำตามพระราชบัญญัติการประกอบกิจการพลังงาน พ.ศ. 2550 (“พ.ร.บ. การประกอบกิจการพลังงานฯ”) ฉบับปัจจุบัน เนื่องจากยังไม่อาจออกใบอนุญาตประกอบกิจการไฟฟ้าสำหรับกิจการที่เกิดขึ้นใหม่ เช่น การประกอบกิจการนำเข้าและการส่งออกไฟฟ้า การรวบรวมโหลดไฟฟ้า การจัดการระบบจัดเก็บไฟฟ้า การประกอบกิจการโรงไฟฟ้าเสมือน และการประกอบกิจการไฟฟ้าและการให้บริการไฟฟ้าโดยผ่านระบบเทคโนโลยีสารสนเทศ ดังนั้น จึงควรมีการแก้ไขนิยามของกิจการไฟฟ้าตามกฎหมายให้ครอบคลุมการประกอบกิจการเหล่านี้ พ.ร.บ. การประกอบกิจการพลังงานฯ ควรถูกแก้ไขเพื่อรองรับสถานะของผู้ใช้ไฟฟ้าที่ผลิตไฟฟ้าได้เองให้ชัดเจน และมีบทบัญญัติที่รองรับสิทธิของบุคคลเหล่านี้ในการผลิต ใช้ และขายไฟฟ้าส่วนให้ผู้ใช้ไฟฟ้ารายอื่นได้ นอกจากนี้ เพื่อให้กฎหมายมีศักยภาพในการรับรองและคุ้มครองสิทธิในการเชื่อมต่อและใช้ระบบโครงข่ายไฟฟ้าเพื่อการส่งผ่านไฟฟ้าที่ผลิตจากพลังงานหมุนเวียนเพื่อรองรับการซื้อขายไฟฟ้าระหว่างเอกชนซึ่งมิได้เป็นเจ้าของโครงข่ายไฟฟ้าเอง กฎหมายจึงควรเพิ่มบทบัญญัติกำหนดหน้าที่ของผู้ประกอบกิจการไฟฟ้าที่มีระบบโครงข่ายให้คำนึงถึงการใช้ระบบโครงข่ายของผู้ผลิตไฟฟ้าจากทรัพยากรพลังงานหมุนเวียนอีกด้วย โดยยังคงรักษาความเชื่อถือได้ของระบบโครงข่ายไฟฟ้าเอาไว้ เมื่อการเปลี่ยนผ่านด้านพลังงานอาศัยการมีปฏิสัมพันธ์และการทำธุรกรรมแบบกระจายศูนย์ซึ่งผู้ผลิตและผู้ใช้ไฟฟ้าซื้อขายและส่งมอบไฟฟ้ากันโดยแบบที่มีการแข่งขันกัน กกพ. จึงควรมีอำนาจเพิ่มเติมในการเสนอให้คณะกรรมการนโยบายพลังงานแห่งชาติให้ความเห็นชอบการตั้งตลาดพลังงาน และเพื่อส่งเสริมตลาดไฟฟ้าในประเทศไทย พ.ร.บ. การประกอบกิจการพลังงานฯ และควรเพิ่มบัญญัติซึ่งกำหนดห้ามมิให้ผู้รับใบอนุญาตประกอบกิจการระบบโครงข่ายไฟฟ้ามีพฤติกรรมหรือการประกอบการอันมีลักษณะเป็นอุปสรรคต่อการจัดตั้งและพัฒนาของตลาดไฟฟ้า เพื่อให้การกำกับดูแลการประกอบกิจการไฟฟ้าสามารถก้าวตามพลวัตการเปลี่ยนผ่านด้านพลังงานในระดับสากล กกพ. จึงควรมีอำนาจกำกับกิจการพลังงานให้เป็นไปตามมาตรฐานตามกรอบความร่วมมือระหว่างประเทศด้านพลังงานและสิ่งแวดล้อมที่มีผลผูกพันประเทศไทย ในมิติของอัตราค่าบริการ พ.ร.บ. การประกอบกิจการพลังงานฯ ควรถูกแก้ไขให้เป็นฐานทางกฎหมายให้ กกพ. สามารถกำกับดูแลอัตราค่าบริการให้เหมาะสมกับกิจการไฟฟ้าแต่ละประเภท นอกจากนี้ กฎหมายควรกำหนดให้สัญญาเพื่อจัดหาไฟฟ้าโดยเฉพาะอย่างยิ่งที่รัฐรับซื้อไฟฟ้าจากเอกชนข้อสัญญาที่ทำให้เกิดความยืดหยุ่นในการคิดอัตราค่าไฟฟ้าซึ่งอาจลดต่ำลงจากการเปลี่ยนแปลงสภาพเศรษฐกิจ สังคม การลงทุน หรือเทคโนโลยีในมาตรฐานของสัญญาเกี่ยวกับการให้บริการพลังงาน

การท่องเที่ยวแห่งประเทศไทย (ททท.) เป็นหน่วยงานรัฐวิสาหกิจซึ่งมีหน้าที่ในการประชาสัมพันธ์และส่งเสริมการท่องเที่ยวไทย ททท. มีสำนักงานสาขาที่ตั้งอยู่ในเขตสหภาพยุโรป รวมทั้งมีสำนักงานใหญ่และสำนักงานภูมิภาคหลายสำนักงานที่ตั้งอยู่ในประเทศไทยและมีการเก็บรวบรวมข้อมูลส่วนบุคคลในเขตของสหภาพยุโรปและในประเทศไทย ดังนั้น ททท. จึงอยู่ภายใต้บังคับที่จะต้องปฏิบัติตามกฎหมายคุ้มครองข้อมูลส่วนบุคคลของสหภาพยุโรปและของไทย แต่อย่างไรก็ตาม ททท. มีการดำเนินกิจกรรมที่มีความหลากหลายที่เกี่ยวข้องกับการประมวลผลข้อมูลส่วนบุคคล จึงก่อให้เกิดปัญหาในการปฏิบัติตามภาระหน้าที่ตามกฎหมาย ยกตัวอย่างเช่น การบ่งชี้ว่า ททท. มีสถานะเป็นผู้ควบคุมข้อมูลหรือผู้ประมวลผลข้อมูล การบ่งชี้ฐานทางกฎหมายสำหรับการประมวลผลข้อมูลในแต่ละกิจกรรม งานวิจัยนี้จึงมุ่งศึกษาประเด็นปัญหาและอุปสรรคของ ททท. ในการปฏิบัติตามข้อบังคับทั่วไปเกี่ยวกับการคุ้มครองข้อมูล หรือที่เรียกกันว่า General Data Protection Regulation (GDPR) และพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 รวมทั้งมุ่งเสนอแนะวิธีการที่เหมาะสมในการบริหารจัดการปัญหาและอุปสรรคดังกล่าว เช่น การจัดทำคู่มือกำหนดแนวปฏิบัติขององค์กรในการปฏิบัติตามกฎหมาย ทั้งนี้ เพื่อเป็นการลดความเสี่ยงที่ ททท. จะมีความรับผิดที่เกิดขึ้นจากการไม่ปฏิบัติตามกฎหมาย อันจะส่งผลเสียต่อชื่อเสียงของ ททท. และประเทศไทยต่อไป
กระบวนการคัดกรองผู้ลี้ภัยของประเทศไทย: การริเริ่มให้ความคุ้มครองแก่ประชากรพลัดถิ่นในรัฐที่มิได้เป็นภาคีต่ออนุสัญญาผู้ลี้ภัย (Thailand’S National Screening Mechanism: Initiating ‘Asylum’ Procedures In A Non-Signatory To The 1951 Refugee Convention), Prima Sukmanop

ประเทศไทยมิได้มีกฎหมายภายในประเทศที่รับรองคุ้มครองสิทธิในการแสวงหาที่ลี้ภัยจากการประหัตประหาร (Right to Seek Asylum from Persecution) ของผู้พลัดถิ่น (Forcibly Displaced Persons) ซึ่งรวมถึงผู้ลี้ภัย (Refugees) เป็นการเฉพาะ ทั้งนี้ เมื่อเดือนกันยายน พ.ศ. 2566 สำนักงานตรวจคนเข้าเมืองได้เริ่มคัดกรอง “ผู้ได้รับการคุ้มครอง” ตามระเบียบสำนักนายกรัฐมนตรีว่าด้วยการคัดกรองคนต่างด้าวที่เข้ามาในราชอาณาจักรและไม่สามารถเดินทางกลับประเทศอันเป็นภูมิลำเนาได้ พ.ศ. 2562 หรือที่รู้จักกันในนาม National Screening Mechanism (NSM) โดยคนต่างด้าวที่ผ่านการคัดกรองจะได้รับการคุ้มครองจากการถูกบังคับส่งกลับไปยังประเทศต้นทางที่อาจมีภยันตราย (Protection Against Refoulement) แม้ประเทศไทยจะมิได้เป็นภาคีต่ออนุสัญญาว่าด้วยสถานภาพผู้ลี้ภัย ค.ศ. 1951 และพิธีสารที่เกี่ยวข้องก็ตาม แต่กระบวนการคัดกรอง NSM ปรากฏลักษณะสำคัญที่คล้ายคลึงกับกระบวนการพิจารณาสถานภาพผู้ลี้ภัย (Refugee Status Determination: RSD) ซึ่งสำนักงานข้าหลวงใหญ่ผู้ลี้ภัยแห่งสหประชาชาติ (UNHCR) ได้ดำเนินการในประเทศไทยมาหลายทศวรรษ อย่างไรก็ดี เมื่อกระบวนการคัดกรอง NSM ถูกดำเนินงานโดยหน่วยงานภาครัฐ อีกทั้งเป็นกระบวนการภายใต้กฎหมายว่าด้วยคนเข้าเมืองซึ่งยึดโยงกับความมั่นคงของชาติและผลประโยชน์ทางการเมืองในระดับภูมิภาค จึงอาจมีข้อพิจารณาอื่นนอกเหนือไปจากความเสี่ยงต่อการประหัตประหาร แตกต่างไปจากบริบทความคุ้มครองระหว่างประเทศ อันเป็นเจตนารมณ์ของกระบวนการคัดกรองผู้ลี้ภัยโดยทั่วไป ดังนั้น จึงเกิดข้อถกเถียงว่ากระบวนการคัดกรอง NSM อาจมิใช่กระบวนการพิจารณาสถานภาพผู้ลี้ภัยในระดับชาติตามความคาดหวังของประชาคมโลก แต่เป็นเพียงข้อโต้แย้งภายใต้กระบวนการตรวจคนเข้าเมืองที่ยังคงปรากฏข้อจำกัดแก่การเข้าถึงสิทธิขั้นพื้นฐาน และอาจยังมิใช่วิธีการแก้ไขปัญหาผู้ลี้ภัยอย่างยั่งยืน

แม้สิทธิชุมชนจะเป็นสิทธิระดับรัฐธรรมนูญมากว่าสองทศวรรษก็ตาม แต่การขาดความชัดเจนในรายละเอียดของสิทธิ นับเป็นอุปสรรคสำคัญต่อการที่ศาลปกครองจะวินิจฉัยรับรองสิทธิชุมชนให้เกิดผลในทางปฏิบัติ จากปัญหาดังกล่าวจึงเป็นที่มาของงานวิจัยฉบับนี้ที่มุ่งศึกษาแนวคิดและทฤษฎีเกี่ยวกับสิทธิชุมชน และคำวินิจฉัยคดีปกครองเกี่ยวกับสิทธิชุมชนของต่างประเทศ เพื่อนำมากำหนดเป็นแนวทางทางกฎหมายในการวินิจฉัยคดีพิพาทเกี่ยวกับสิทธิชุมชนในศาลปกครองของไทย ผลการศึกษาพบว่า “สิทธิชุมชน” เป็น “สิทธิเชิงกลุ่ม” ซึ่งมีพัฒนาการมาจากกฎหมายสิทธิมนุษยชนและกฎหมายสิ่งแวดล้อมระหว่างประเทศ โดย “ชุมชน” สามารถใช้สิทธิทางศาลได้โดยการมอบหมายให้ปัจเจกบุคล และ/หรือ นิติบุคคล ที่เป็นตัวแทนหรือผู้แทนของชุมชนนำคดีไปฟ้องต่อศาลในนามของชุมชน และในกรณีที่ศาลปกครองพิจารณาแล้วเห็นว่า ผู้ฟ้องคดีเป็นผู้ทรงสิทธิชุมชนตามรัฐธรรมนูญและมีสิทธิในการเข้าถึงและใช้ประโยชน์จากทรัพยากรธรรมชาติและสิ่งแวดล้อม เช่น มีสิทธิในการดำรงวิถีชีวิตในพื้นที่ป่า เป็นต้น แม้ว่าจะมีข้อจำกัดที่ทำให้ศาลไม่สามารถออกคำบังคับให้ผู้ฟ้องคดีเข้าไปดำรงวิถีชีวิตอยู่ในพื้นที่ป่าได้ก็ตาม หากแต่ผู้ฟ้องคดีฟ้องขอค่าสินไหมทดแทนจากการที่ต้องสูญเสียสิทธิในการกำหนดเจตจำนงของตนเอง และ/หรือ สิทธิในการเข้าถึงและใช้ประโยชน์จากทรัพยากรธรรมชาติและสิ่งแวดล้อมมาด้วย ศาลปกครองย่อมสามารถกำหนดให้ฝ่ายปกครองชดใช้ค่าสินไหมทดแทนให้แก่ผู้ฟ้องคดีจากการที่ต้องสูญเสียสิทธิดังกล่าวในการดำรงวิถีชีวิตตามจารีตประเพณี ตามบรรทัดฐานคำวินิจฉัยของศาลต่างประเทศได้

ในปี พ.ศ. 2541 (ค.ศ. 1998) องค์กรอุทธรณ์ขององค์การการค้าโลก (the World Trade Organization) ได้ให้ความสำคัญของค่านิยมเรื่อง “การอนุรักษ์สัตว์ป่าที่ใกล้สูญพันธุ์” ได้แก่ เต่าทะเล ว่ามีความสำคัญเทียบเท่ากับค่านิยมเรื่อง “ประสิทธิภาพทางเศรษฐกิจ” ตามทฤษฎีทางเศรษฐศาสตร์เรื่องความได้เปรียบโดยเปรียบเทียบ (Comparative Advantage) โดยตัดสินคดีข้อพิพาทระหว่างประเทศสหรัฐอเมริกากับประเทศอินเดีย ปากีสถาน มาเลเซีย และไทย ว่ามาตรการของประเทศสหรัฐอเมริกาที่ห้ามนำเข้ากุ้งจากประเทศอินเดีย ปากีสถาน มาเลเซีย และไทยนั้น แม้จะเป็นมาตรการที่ไม่สอดคล้องกับข้อ 11 ของความตกลงทั่วไปว่าด้วยภาษีศุลกากรและการค้า (General Agreement on Tariffs and Trade หรือ GATT) ก็ตาม แต่ก็ได้รับการนิรโทษตามข้อ 20 (จี) ของความตกลงฉบับดังกล่าวเนื่องจากเต่าทะเลเป็นทรัพยากรธรรมชาติที่ใช้แล้วสูญสิ้นหมดไป เมื่อวิเคราะห์เปรียบเทียบระหว่างคำตัดสินในข้อพิพาทดังกล่าวกับมาตรการเก็บคาร์บอนข้ามพรมแดนของสหภาพยุโรป (European Carbon Border Adjustment Mechanism หรือ EU-CBAM) แล้ว อาจชี้ให้เห็นได้ว่าในอนาคต หากมีข้อพิพาทที่เกี่ยวข้องกับมาตรการดังกล่าวเข้าสู่กลไกระงับข้อพิพาทขององค์การการค้าโลกแล้ว คณะพิจารณาข้อพิพาทและองค์กรอุทธรณ์ขององค์การการค้าโลกซึ่งตระหนักดีถึงปัญหา “วิกฤตโลกร้อน” ที่เกิดขึ้นในปัจจุบัน ก็มีแนวโน้มสูงที่จะให้ความสำคัญกับค่านิยมสากลเรื่อง “การอนุรักษ์ชั้นบรรยากาศโลก” อันได้แก่ การลดปริมาณการปล่อยก๊าซเรือนกระจกเข้าสู่ชั้นบรรยากาศของโลกเพื่อไม่ให้อุณหภูมิของโลกสูงขึ้นเกินกว่า 2 องศาเซลเซียส ภายใน พ.ศ. 2593 (ค.ศ. 2050) ไม่น้อยไปกว่าค่านิยมเรื่อง “ประสิทธิภาพทางเศรษฐกิจ” และคงจะตัดสินให้มาตรการ EU-CBAM ได้รับการนิรโทษตามข้อ 20 (จี) ของความตกลงทั่วไปว่าด้วยภาษีศุลกากรและการค้าเช่นเดียวกัน

Keith Allen Harward served 33 years in prison in Virginia for a rape and murder (The Innocence Project, 2025). The main evidence for his conviction was bite marks found on the rape victim’s legs. Someone broke into a house and murdered a man and raped the man’s wife. The rape victim described the man who had assaulted her, saying he was wearing a sailor’s outfit. A shipyard security guard nearby reported a man in a blood-spattered E-3 sailor’s uniform. The purpose of this study is to gain a deeper understanding of how criminal prosecutors and defense attorneys describe the negotiation process of plea-bargains, and the roles and discretion they exercise during it. Additionally, plea-bargaining is not well understood by many members of the public, so this research allows the public to gain insight and knowledge into the process. This study consisted of in-depth, qualitative interviews with both prosecutors and defense attorneys. The results of the study were analyzed through a content analysis. "The current study adds to the literature on prison foodways and media studies by exploring the role of prison food on the show Orange is the New Black (OITNB). Specifically, this project aimed to better understand the nature of televised incarceration experiences through the way in which incarcerated characters interacted with food in the scenes. "For previously incarcerated persons, affordable and safe housing options are scarce. Barriers to securing housing include federal mandates (i.e., eligibility requirements) as well as local rules and regulations (i.e., zoning and ordinances). When housing is available, disclosing criminal history on applications impacts individuals’ chances to rent (Philips & Spencer, 2013). A lack of a consistent rental history, no personal and/or employment references, and securing capital to cover security deposits are added challenges. "This study proposes to investigate how public views on the wrongful conviction issue are connected with the perceived need for criminal justice reform and whether the professional experience in law enforcement influences these perceptions. This study employs a qualitative research design, deriving its conclusions from the comparative analysis of the survey responses concerning the issue of wrongful convictions and the criminal justice system collected from 45 law enforcement professionals and 35 individuals without such experience. "General strain theory posits that individuals commit crimes when they experience negative emotions following various sources of strain. One such source of strain is poverty. In this study, researchers use focus group data and apply a general strain framework to analyze criminal offending during the Missouri Community Action Network's Poverty Simulation© (2022) at a regional comprehensive university in the Southeast region of the United States. A total of 99 undergraduate and graduate students participated in the focus groups at the end of the simulation. Colonial mural art in the Yucatán Peninsula represents a cultural intersection where Christian iconography and Maya artistic traditions converged in a complex visual dialogue. Maya Christian Murals of Early Modern Yucatán (Texas University Press, 2024) offers a detailed analysis of these pictorial expressions, exploring how Indigenous artists reinterpreted colonial impositions by preserving ancestral techniques, materials, and symbolism.
