Managing Crowdfunding Risks In Terrorism Financing: A Mediated Analysis Of Government Intervention And Donation Intentions, Fithriadi Muslim, Eva Achjani Zulfa, Muhamad Syauqillah
Indonesia Law Review
Crowdfunding has emerged as a popular platform for collective funding of social, charitable, and commercial projects. However, its increasing use has raised concerns over potential misuse, including as a source of terrorism financing. This study investigates the relationship between donation intentions using crowdfunding and the risk of crowdfunding being used as a source of terrorism financing. Furthermore, it explores the mediating role of government intervention in this relationship. Using a Structural Equation Modeling-Partial Least Squares (SEM-PLS) second-order approach, the research evaluates the interaction between donor intentions, crowdfunding risks, and government regulations. A majority of Indians do not have effective access to legal services, despite the constitutional promise of access to justice. There are two intertwined reasons for this: the unavailability of a sufficient number of good quality lawyers, and the high costs of accessing legal services. The Indian legal profession is highly unequal, with ‘prestige’ being the currency of upward professional mobility. The professional regulator, the Bar Council of India, simply lacks the capacity to regulate quality. Inaction As Nonformal Reaction: Rethinking Crime Perception In The Era Of Data Breaches, Irnasya Shafira Hadi

This study analyses the Indonesian public’s response to government data breaches and advocates for an expanded defintion of nonformal reactions to crime in the digital context. It argues that existing criminological frameworks, particularly Mustofa’s (2021) model—which views nonformal reactions as active and confrontational behaviours such as demonstrations or vigilantism—should also acknowledge inaction, apathy, and emotional disengagement as valid public reactions. This paper employs a conceptual-qualitative approach, combining an interdisciplinary literature review, interpretive policy analysis of the Personal Data Protection Law, and triangulation with digital behaviour data to develop its analysis. ABSTRACT: This article examines the structural constraints of the United Nations Security Council, with a focus on the veto power of its permanent members and its implications for intervention and peacekeeping. Through a realist lens and grounded in structural analysis, it contends that the recurrent paralysis of the Council in the face of mass atrocities stems from entrenched power asymmetries. The paper advances a bifold proposal: the adoption of the French-Mexican initiative to suspend veto use in cases of mass atrocities, and the entrenchment of the Council’s authority to authorize the use of force under defined conditions. This paper examines the impact on the South Korean Cultural Entertainment Indus- try(CEI) of China’s “Korea Limitation Order”. In November 2016, Beijing restricted South Korean artists from holding concerts and the broadcast of South Korean TV dramas and banned cooperation between the two countries in the entertainment in- dustries. This paper focuses on the effect this had on exports of cultural products and relating industries from Korea, and how Korea was able to adjust to this geopolitical shock. Does Bilingualism On Resumes Affect Callback Rates?, Autumn Halfpenny
Dartmouth Undergraduate Journal of Politics, Economics and World Affairs
I study the influence of bilingualism in Spanish on the likelihood of receiving a callback for female customer service positions in the Chicago area. Data are collected from sixteen unique resumes submitted to 131 different job postings in an audit study, with applicants differing in bilingual ability. Bilingualism in Spanish significantly in- creases the likelihood of a callback by 17.86%-25.4%, implying bilingualism is valued in customer service roles. This suggests that bilingualism in Spanish may increase job prospects. While previous research studies this using observational and survey data, I use an audit study design with resumes to obtain causal results. …

The Effects Of Pandemic School Closures On Standardized Testing Outcomes: Evidence From Connecticut, Michael Manieri

During the Covid-19 pandemic, schools around the nation closed to prevent the virus’s spread. Following these closures, students’ performance on standardized exams worsened. Using a two-way fixed effect model with district and year fixed effects, I examine if the use of non-traditional schooling modes (i.e. hybrid and virtual) during the pandemic is associated with lower ELA and Math proficiency rates in Connecticut public schools. I find that Connecticut public school districts’ Math and ELA pass rates on the annual Smarter Balanced exam significantly decreased as they used higher levels of virtual and hybrid education. The following qualitative study examines a new increase of technological surveillance used on immigrants by San Diego’s local law enforcement. Drawing from in-depth interviews of the San Diego Privacy Advisory Board and Trust SD, insights of technological related violations are sanctioned by the San Diego Police Department. This is done through ambiguous language regarding “criminal investigations” and lack of definitive use policy, despite several memorandums and recommendations by the SD Privacy Advisory Board. Present findings reveal a duality of immigrant surveillance instigating hyper-visible tracking and broadcasting an image of their criminality. This research project examines how grassroots social organizations contribute to the advancement of immigrant legal protections and shape immigration policy, with a particular focus on formerly incarcerated migrants in California. I focus on case studies and the personal experiences of organizers from Homies Unidos, Border Angels, and other organizations that operate near the San Diego–Tijuana border region. The study illustrates how these groups provide essential services, mental health support, and community-based initiatives for vulnerable and formerly incarcerated immigrants. By conducting oral histories and ethnography as methods for preserving emotional labor and shared memory, this research challenges prevailing narratives that criminalize …

Juvenile delinquency tends to be higher in single-parent households (Kroese et al., 2021). Research investigating this phenomenon has found conflicting results on whether a juvenile has lower rates of delinquency with a custodial father (paternal hypothesis), custodial mother (maternal hypothesis), or whether gender is secondary to other factors. Similarly, some studies found that the interaction of the juvenile living with a same-gendered parent was associated with lower levels of delinquency. Further complications include how parental variables, such as behavioral control and support levels, may interact with the juvenile and custodial parent gender (Hoeve et al., 2009). In Haris Ibrahim [2023] 2 MLJ 296, the Federal Court of Malaysia discussed the legal limits to executive authorities’ powers to investigate judges on suspicion of crime. The case is a rare contribution to the jurisprudence on judges’ criminal liability at common law, as well as a case study in the challenges of reconciling judicial independence with other principles of the constitutional framework and other actors’ roles therein. The Court held that the implied constitutional principle of judicial independence requires that executive authorities follow a “set of protocols” (which the Court formulated) when investigating sitting judges. Decision makers attempting to classify a binary state of the world may commit two types of errors. Even when the two alternative states have equal prior probabilities and when the two types of errors are equally costly, a classification criterion may be chosen which leads to one type of error being committed more frequently than the other, because of asymmetries in the data that informs their decisions. We formalize this possibility through a categorization of data-generating processes (DGPs), which may be ‘oriented’ towards evidence favoring one of the two alternatives, or which may be ‘unoriented’. The constitutional reform of September 30, 2024 to article 2 marks a substantive change in the recognition of indigenous peoples as subjects of public law, with their own patrimony, valid normative systems and express right to conserve, protect and develop their cultural, material and immaterial heritage. Extractivism And Water Crisis In The Moroccan Draa Oasis: Global South Reflections On Responsibility And Resistance, Ahmed El Khatabi

Abstract. The Draa Oasis in southeastern Morocco is experiencing severe water scarcity, driven by climate change and intensified by the expansion of watermelon agribusiness and desert tourism. This article explores how external investors, empowered by national agricultural policies, have disrupted traditional water governance systems rooted in collective management. Through ethnographic fieldwork involving interviews, focus groups, and spatial mapping, the study examines the socio-environmental consequences of groundwater depletion and land commodification. It argues that investors fail to assume ethical accountability for the ecological degradation they cause, despite being aware of the oasis’s fragile ecosystem. บทความนี้มีวัตถุประสงค์เพื่อศึกษาประสบการณ์ของระบบกฎหมายฝรั่งเศสในการจัดกลุ่มกฎหมายที่มีคุณค่าในระดับรัฐธรรมนูญ โดยอาศัยคณะตุลาการรัฐธรรมนูญเป็นองคาพยพในการจัดกลุ่มและพัฒนาหลักการทางรัฐธรรมนูญที่มีความเป็นพลวัตให้เกิดความชัดเจนภายใต้ทฤษฎีการจัดลำดับศักดิ์ของกฎหมาย โดยผลการศึกษาพบว่า คณะตุลาการรัฐธรรมนูญได้อาศัยบทบัญญัติของรัฐธรรมนูญแห่งสาธารณรัฐฝรั่งเศส ค.ศ. 1958 ที่กำหนดให้คำวินิจฉัยของคณะตุลาการรัฐธรรมนูญมีผลผูกพันทุกองค์กรมาใช้ในการพัฒนากลุ่มกฎหมายที่มีคุณค่าในระดับรัฐธรรมนูญ โดยการวินิจฉัยให้เอกสารทางกฎหมายอื่น ๆ ถือเป็นส่วนหนึ่งของกลุ่มกฎหมายที่มีคุณค่าในระดับรัฐธรรมนูญ ซึ่งประสบการณ์ดังกล่าวสามารถนำมาปรับใช้กับระบบกฎหมายไทยได้ในกรณีที่ต้องมีการตีความเอกสารทางกฎหมายที่มีมาก่อนการประกาศใช้รัฐธรรมนูญให้มีสถานะดังเช่นรัฐธรรมนูญ รวมถึงการตีความหลักการทางกฎหมายที่เคยปรากฏในรัฐธรรมนูญฉบับก่อนแต่ไม่ปรากฏในรัฐธรรมนูญฉบับปัจจุบัน

ความตกลงที่ครอบคลุมและก้าวหน้าสำหรับหุ้นส่วนทางเศรษฐกิจภาคพื้นแปซิฟิก (Comprehensive and Progressive Agreement for Trans-Pacific Partnership: CPTPP) กำหนดนิยามของสินค้าใช้แล้วที่ผ่านกระบวนการผลิตซ้ำ ว่าเป็นสินค้าที่มีส่วนประกอบของวัสดุเดิมที่มีการนำมาปรับแก้บางส่วนหรือทั้งหมด ทั้งมีอายุการใช้งานเท่าสินค้าใหม่และสามารถใช้งานได้เหมือนกับหรือใกล้เคียงกับสินค้าใหม่ และมีการรับประกันจากโรงงานเช่นเดียวกับสินค้าใหม่ อย่างไรก็ดี CPTPP ได้กำหนดห้ามมิให้ประเทศสมาชิกเลือกปฏิบัติต่อสินค้าดังกล่าว ซึ่งกฎหมายเกี่ยวกับเครื่องมือแพทย์มิได้กำหนดหลักเกณฑ์เกี่ยวกับเครื่องมือแพทย์ลักษณะดังกล่าวไว้ ดังนั้น หากประเทศไทยเข้าร่วมเป็นสมาชิกเป็นข้อผูกพันจะต้องยอมรับเครื่องมือแพทย์ใช้แล้วที่ผ่านกระบวนการผลิตซ้ำ ก็จำเป็นต้องพิจารณาตัวอย่างการกำกับดูแลเครื่องมือแพทย์ของต่างประเทศประกอบกับการบริหารจัดการความเสี่ยง ไม่ว่าจะเป็นความเสี่ยงต่อผู้รับบริการสาธารณสุข บุคลากรด้านสาธารณสุข ผู้ใช้แรงงานในอุตสาหกรรมการผลิตเครื่องมือแพทย์ ตลอดจนความเสี่ยงด้านสิ่งแวดล้อม ทั้งนี้ เพื่อจัดทำมาตรการทางกฎหมายในการกำกับดูแลเครื่องมือแพทย์ใช้แล้วที่ผ่านกระบวนการผลิตในประเทศไทยตั้งแต่ขั้นตอนการผลิตก่อนออกสู่ตลาด ระบบเฝ้าระวังและการติดตามตรวจสอบ รวมทั้งการจัดการขยะเครื่องมือแพทย์ที่เหมาะสม

หลักหน่วยทางเศรษฐกิจเดียวกัน ซึ่งได้รับการพัฒนาขึ้นโดยศาลสหภาพยุโรป เป็นหลักที่เอื้ออำนวยให้ผู้ใช้กฎหมายแข่งขันทางการค้าสามารถพิจารณาความเป็นผู้ประกอบธุรกิจและวินิจฉัยคดีที่เกี่ยวข้องกับกฎหมายแข่งขันทางการค้าได้อย่างสอดคล้องกับความเป็นจริงทางเศรษฐกิจ อย่างไรก็ดี วิจัยฉบับนี้พบว่า พระราชบัญญัติการแข่งขันทางการค้า พ.ศ. 2560 มิได้ให้การยอมรับหลักหน่วยทางเศรษฐกิจเดียวกันในฐานะหลักในการพิจารณาความเป็นผู้ประกอบธุรกิจ ด้วยเหตุนี้เอง จึงมีความจำเป็นที่จะต้องแก้ไขนิยามของผู้ประกอบธุรกิจตามพระราชบัญญัติฉบับดังกล่าว เพื่อให้เกิดการยอมรับหลักหน่วยทางเศรษฐกิจเดียวกันอย่างถูกต้องและเหมาะสม

หลักเกณฑ์ในการพิจารณาความรับผิดทางอาญาของผู้กระทำความผิดที่มีสภาวะจิตผิดปกตินับเป็นปัญหาสำหรับศาลและนักกฎหมายมาช้านานในอดีต เนื่องจากผู้กระทำความผิดบางรายอาจกระทำความผิดไปโดยไม่รู้สึกตัว เพราะมีสาเหตุมาจากความบกพร่องทางประสาท สมอง จิตใจ อารมณ์และความเครียด ซึ่งความผิดปกติทางจิตขนาดใดจึงจะนำมาพิจารณาว่าผู้นั้นไม่มีความผิด หรือมีความผิดแต่ควรยกเว้นโทษหรือลดโทษนี้ ศาลของประเทศอังกฤษได้วางหลักสำคัญไว้ในการพิจารณาคดี McNaghten’s (1843) ว่าต้องสันนิษฐานไว้ก่อนว่ามนุษย์ทุกคนมีจิตปกติ เว้นแต่จะมีข้อสันนิษฐานซึ่งสามารถพิสูจน์ได้ว่าขณะกระทำความผิดจำเลยได้รับความเจ็บปวดจากโรคทางจิตจนไม่ทราบเนื้อหาและสาระสำคัญของการกระทำ กล่าวคือไม่สามารถรู้ได้ว่าสิ่งนั้นถูกหรือผิด หลักเกณฑ์ดังกล่าวนี้ได้ถูกนำไปใช้อย่างแพร่หลายทั้งในสหรัฐอเมริกาและประเทศในภูมิภาคยุโรป ซึ่งนำไปสู่การตัดสินว่าจำเลยไม่มีความผิดโดยศาลจะมีคำสั่งให้ควบคุมตัวจำเลยไปรับการบำบัดรักษาที่สถานพยาบาล สำหรับการพิจารณาถึงความรับผิดของผู้ที่มีจิตบกพร่อง โรคจิต หรือจิตฟั่นเฟือน ตามแนวทางในการพิจารณาคดีของศาลนั้นหากผู้กระทำไม่รู้สำนึกของการกระทำย่อมไม่มีความผิดตามประมวลกฎหมายอาญา มาตรา 59 ถ้าหากผู้กระทำรู้สำนึกแต่ไม่สามารถรู้ผิดชอบ หรือไม่สามารถบังคับตนเองได้ถือเป็นเหตุยกเว้นโทษ และถ้าผู้กระทำความผิดยังสามารถรู้ผิดชอบอยู่บ้าง หรือยังสามารถบังคับตนเองได้บ้าง ผู้นั้นต้องรับโทษสำหรับความผิดนั้น โดยศาลจะลงโทษน้อยกว่าที่กฎหมายกำหนดไว้สำหรับความผิดนั้นเพียงใดก็ได้ตามมาตรา 65 ซึ่งจะเห็นได้ว่าในกรณีที่ศาลตัดสินว่าจำเลยไม่มีความผิดนี้อาศัยความตามมาตรา 59 ถือว่าผู้กระทำความผิดไม่รู้สำนึกซึ่งใช้หลักเกณฑ์เดียวกับบุคคลทั่วไปซึ่งหากไม่รู้สำนึกในการกระทำก็ย่อมไม่มีความผิด ดังปรากฏตามคำพิพากษาฎีกาที่ 8743/2544 คำพิพากษาฎีกาที่ 2590/2562 แต่สำหรับผู้กระทำความผิดที่มีจิตบกพร่อง โรคจิต หรือจิตฟั่นเฟือนนั้นได้กระทำความผิดไปโดยไม่รู้ถึง “สภาพ” และ “สาระสำคัญ” ของการกระทำจึงควรบัญญัติแยกไว้เป็นอีกมาตราหนึ่งให้ผู้นั้นไม่มีความผิดและหากผลของการกระทำความผิดมีความร้ายแรงต่อชีวิต ร่างกายหรือทรัพย์สินของผู้อื่นก็ควรให้เป็นดุลพินิจของศาลในการมีคำสั่งให้ส่งตัวผู้นั้นเข้ารับการบำบัดรักษาในสถานพยาบาลได้เช่นเดียวกับที่บัญญัติความไว้ใน มาตรา 48 นอกจากนี้ หากผู้กระทำความผิดยังสามารถรู้ผิดชอบหรือยังสามารถบังคับตนเองได้บ้างก็ควรมีเกณฑ์ลดโทษตามความร้ายแรงของการกระทำความผิดดังเช่นหลักเกณฑ์ตามประมวลกฎหมายอาญาของสาธารณรัฐฝรั่งเศสเพื่อให้เกิดความเป็นธรรมต่อผู้เสียหาย ทั้งยังควรนำวิธีการคุมประพฤติมาใช้บังคับหลังจากที่จำเลยพ้นโทษในกรณีที่ผู้นั้นได้กระทำความผิดร้ายแรงดังเช่น สาธารณรัฐฝรั่งเศสและประเทศอังกฤษ เพื่อป้องกันมิให้ผู้นั้นกลับมากระทำความผิดซ้ำขึ้นอีก

บทความวิชาการนี้มุ่งเน้นศึกษาบทบาทของศาลกฎหมายทะเลระหว่างประเทศในการให้ความเห็นแนะนำเกี่ยวกับการเปลี่ยนแปลงสภาพภูมิอากาศ โดยเป็นการวิเคราะห์สาระสำคัญของความเห็นแนะนำ Request for an Advisory Opinion submitted by the Commission of Small Island States on Climate Change and International Law (Request for Advisory Opinion submitted to the Tribunal) Case No.31 และวิเคราะห์และสังเคราะห์ผลประโยชน์ที่ประเทศไทยในฐานะรัฐภาคีของอนุสัญญาสหประชาชาติว่าด้วยกฎหมายทะเล ค.ศ. 1982 จะได้รับจากความเห็นของศาล โดยผลการศึกษาพบว่าประเทศไทยจะได้รับผลประโยชน์ทั้ง 2 ด้าน คือ 1. ผลประโยชน์ในแง่กระบวนการพิจารณาของศาล และ 2. ผลประโยชน์เกี่ยวกับการออกนโยบายและมาตรการเกี่ยวกับการป้องกัน ลด และควบคุมภาวะมลพิษของสิ่งแวดล้อมทางทะเลและการปกป้องและรักษาสิ่งแวดล้อมทางทะเลจากการเปลี่ยนแปลงสภาพภูมิอากาศ

อำนาจของผู้จัดการมรดกตามกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายเป็นเรื่องที่มีความสำคัญ โดยเฉพาะอย่างยิ่งในสภาพการณ์ปัจจุบันที่โลกได้ก้าวเข้าสู่ยุคแห่งความไร้พรมแดนจึงอาจทำให้ทรัพย์สินของเจ้ามรดกกระจัดกระจายอยู่ได้ในหลายประเทศ การที่จะพิจารณาว่ากฎหมายของประเทศใดเป็นกฎหมายที่ใช้บังคับกับนิติสัมพันธ์ในเรื่องอำนาจของผู้จัดการมรดกนั้นย่อมเป็นหน้าที่ของกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมาย สำหรับระบบกฎหมายขัดกันว่าด้วยอำนาจของผู้จัดการมรดกนั้นอาจแบ่งได้เป็น 2 ระบบ กล่าวคือ ระบบที่แยกเรื่องผู้จัดการมรดกออกจากเรื่องทรัพย์มรดก และระบบที่ไม่แยกเรื่องผู้จัดการมรดกออกจากเรื่องทรัพย์มรดก ในขณะที่เมื่อพิจารณาถึงกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายนั้น กฎหมายขัดกันของแต่ละประเทศได้ให้การยอมรับจุดเกาะเกี่ยวในการค้นหากฎหมายที่ใช้บังคับกับเรื่องอำนาจของผู้จัดการมรดกไว้แตกต่างกัน โดยกฎหมายขัดกันของอังกฤษได้อาศัยกฎหมายภายในกำหนดถึงอำนาจของผู้จัดการมรดก ในขณะที่กฎหมายขัดกันของประเทศจีนได้อาศัยกฎหมายแห่งถิ่นที่ทรัพย์นั้นตั้งอยู่เป็นจุดเกาะเกี่ยวส่วนภายใต้ระบบกฎหมายขัดกันของไทยนั้นไม่ได้มีการกำหนดกฎเกณฑ์ในการเลือกกฎหมายเพื่อใช้บังคับกับเรื่องอำนาจของผู้จัดการมรดกไว้เป็นการเฉพาะ จึงต้องใช้กลไกการอุดช่องว่างของกฎหมายตามมาตรา 3 พระราชบัญญัติว่าด้วยการขัดกันแห่งกฎหมาย พุทธศักราช 2481 ซึ่งกำหนดให้ใช้กฎเกณฑ์ทั่วไปแห่งกฎหมายระหว่างประเทศแผนกคดีบุคคลบังคับ

Abstract
This study encompasses the following urban wetlands: "La Kisst," situated in the city center, and "María Eugenia," located in the southern part of the city of San Cristóbal de las Casas. There are four wetlands within the municipality, all of which have been protected as natural areas by a Ramsar decree since 2008. The research aims to assess the socio-environmental vulnerability of the two wetlands using indicators in the environmental, social, and legal dimensions, thereby establishing the degree of vulnerability of the urban population exposed to flooding. The goal of International Humanitarian Law (IHL) is purported to be the humanization of wars. Nonetheless, the atrocities committed in wars and the war criminals’ impunity suggest the failure of IHL. Notwithstanding, some voices call for reforming and developing IHL. In contrast, this thesis argues that IHL should be rejected entirely since the distinction between privileged and unprivileged combatants indicates that IHL is biased against anti-colonizers. It is biased in three senses. Firstly, IHL, particularly the distinction between privileged and unprivileged combatants, is dominated by Western rationality, which can be noticed in the domination of the civilization concept with its …
