The differences in treatment between Black and white Americans in the past fifty years has been a topic of thought in the minds of political and sociological scholars since the inception of the War on Drugs in 1971. These differences in treatment may lead to discrimination legally, resulting in longer prison sentences and a higher proportion of Black Americans in prison. This study analyzes the results of the War on Drugs that led to disproportionate imprisonment of Black Americans, including mandatory sentencing laws, drug classifications, and discrimination within law enforcement and the legal system. It is well-documented that leaders' conceptual complexity can affect their decision-making, but what about its broader effects on political violence? While Hermann & Sakiev (2011) and Conway & Conway (2011) have examined terrorists' conceptual complexity before attacks, this study generates a more extensive analysis by examining weapon types and target types. This research explored the connection between a terrorist leader's level of conceptual complexity and the violent attacks their organizations commit, arguing that complexity lowers before an attack and after the 9/11 terrorist attacks. In 1991, Albania shifted from severe communist rule to a regime claiming to be democratic. However, to this day, Albania maintains undemocratic elements. This paper analyzes the impact of hybrid state capacity in the context of state-led justice and the implications for citizen compliance. Albanian culture possesses a deep history of reliance on Kanun and traditional justice in conjunction with the state's inconsistency and unreliability. It further establishes the disconnect between people and the state. Despite attempts to progress towards modernity, traditions of blood feuds reemerged with the movement away from communism. The Lasting Impact Of Deinstitutionalization: Policing And The Mental Health Crisis, Ruqayyah Sorathia

Society is combating the detrimental effects of the deinstitutionalization policy, which transferred the treatment of mentally ill patients from state-run psychiatric hospitals to community-run psychiatric facilities. These patients frequently fall into relapses and are more likely to experience risky encounters with law enforcement officials who have no formal training in dealing with them. The paper analyzes the criminalization of mentally ill people, many with substance abuse and alcohol addictions, receiving treatment in jails and state prisons. Monetary sanctions are an integral and increasingly debated feature of the American criminal legal system. Emerging research, including that featured in this volume, offers important insight into the law governing monetary sanctions, how they are levied, and how their imposition affects inequality. Monetary sanctions are assessed for a wide range of contacts with the criminal legal system ranging from felony convictions to alleged traffic violations with important variability in law and practice across states. Investigations in Ferguson, Missouri, revealed that many individuals, particularly Black people, entered the criminal justice system for relatively minor offenses, missed court appearances, or failure to pay fines. Municipal courts were focused on revenue generation, which led to aggressive enforcement of municipal codes. Although subsequent reforms were passed, little is known about whether and how the legislative changes influenced the law-in-action in the municipal courts. Using data from qualitative interviews with St. Louis area residents and regional court actors, as well as court observations, this article documents the legal structure of municipal courts in the region after Ferguson. Probation is the most commonly imposed correctional sanction, is often accompanied by supplementary costs, and can be operated by the state or private companies. Private probation is a unique sanction used in lower courts, most often for misdemeanor offenses, and is managed by third-party actors. We focus on documenting the process and unique costs of private probation, including the rituals of compliance and proportionality of punishment. We use data from interviews with individuals on private probation and local criminal justice officials as well as evidence from court ethnographies in Georgia and Missouri. Monetary sanctions are a ubiquitous part of court systems. Previous studies have focused largely on these sanctions at the state level or solely on large urban jurisdictions. However, court systems differ considerably across communities of varying population size, composition, and density. This article examines how differences in court structure and organizational dynamics in communities across the rural-urban continuum lead to differences in how court actors consider the role of monetary sanctions. Using interviews with court actors and ethnographic observations in communities across four states, we find that the practical and symbolic nature of monetary sanctions varied by the acquaintanceship density …

The Trump Administration brought substantive changes to United States immigration policies, and labeled undocumented immigrants as predisposed towards criminal behavior. This paper presents a brief historical perspective of three major waves of Mexican immigration to the United States: The Early 1900s – Before World War I, Post-World War I – World War II, End of Bracero Accord – Present, and considers the relationship between immigrants and crime. Domestic violence and intimate partner violence against women affects all aspects of their health, including physical, mental, emotional, and economic health. When social programs, support networks, and better opportunities exist to improve the lives of female survivors, the financial impact of their abuse can be addressed and reduced in a significant, sustainable manner. Reviewing existing literature on this financial impact of abuse makes it apparent what women want and need to recover from their former, or even ongoing, situations. The LGBTQ community in the US, while experiencing great strides in social equality, continues to suffer disproportionately in the criminal justice system. Historical precedents of criminalizing the LGBTQ community are rife within the criminal justice system; the establishment of anti-sodomy laws, belief of inherent criminality, and a heteronormative perspective have all fostered a greater anti-queer regime. The criminalization and incarceration of the LGBTQ community remain steadfastly in place, with little to no reprieve. This research investigates intimate partner cyber abuse (IPCA), physical, sexual, and psychological intimate partner violence (IPV) in which the abuser is on active duty, reserve, or a veteran service member within the United States Armed Forces. Using an online survey, I gathered quantitative and qualitative data. I also presented a case study of a woman who experienced IPV within her relationship with a United States Armed Forces member. งานวิจัยชิ้นนี้ เป็นการสำรวจความสัมพันธ์แบบอุปถัมภ์ (clientelism) ภายใต้ระบอบ คสช. (ปี พ.ศ. 2557-2562) เป็นการศึกษาเครือข่ายที่ไม่เป็นทางการ ระหว่างตัวแสดงต่าง ๆ ทางการเมือง โดยใช้กรอบความสัมพันธ์แบบอุปถัมภ์กับระบอบการเมือง คำถามหลักของงานวิจัยนี้วางไว้ในระดับรัฐกับประชาชน เพื่อดูว่าเครือข่ายระหว่างผู้มีอำนาจรัฐกับประชาชน และเครือข่ายระหว่างนักการเมืองกับประชาชนนั้นได้ถูกเปลี่ยนแปลงไปอย่างไรในระบอบ คสช. ความสัมพันธ์ในด้านนี้ ไม่ได้เป็นเพียงเครื่องมือทางการเมืองในการระดมคะแนนเสียงเท่านั้น แต่มันคือตัวกำหนดแบบแผนความสัมพันธ์ของตัวแสดงต่าง ๆ ทางการเมือง กำหนดความเป็นองค์กรของพรรคการเมือง และแบบแผนการปฏิบัติที่ส่งผลต่อพลวัตทางการเมือง ผู้วิจัยได้ใช้ข้อมูลจากเอกสาร การสัมภาษณ์เชิงลึก และการสังเกตการณ์ในพื้นที่จังหวัดต่าง ๆ พบว่าภายใต้ระบอบนี้ได้ใช้ความสัมพันธ์แบบอุปถัมภ์ในหลากหลายรูปแบบ เพื่อทำลายความสัมพันธ์ระหว่างนักการเมืองกับประชาชน และพรรคการเมือง ซึ่งเป็นความสัมพันธ์เชิงสถาบันที่สำคัญอันหนึ่ง การเมืองเช่นนี้ส่งผลให้เกิดการกลับคืนสู่การเมืองแบบเก่าที่ใช้ความสัมพันธ์ระหว่างตัวบุคคลและการพึ่งพาระบบราชการ อันทำให้การพัฒนาประชาธิปไตยเกิดขึ้นได้ยากยิ่งขึ้น

การวิจัยครั้งนี้มุ่งศึกษาการพัฒนาระบบนิเวศที่เอื้อต่อการส่งเสริมความเป็นผู้ประกอบการสังคมในมหาวิทยาลัย ใช้รูปแบบของการวิจัยเชิงคุณภาพ ได้แก่ การสัมภาษณ์เชิงลึกกับผู้มีส่วนได้ส่วนเสียในระบบนิเวศผู้ประกอบการสังคมทั้งในเชิงนโยบายและในเชิงปฏิบัติ และปัจจัยแวดล้อมเกื้อหนุน ผลการวิจัยพบว่าระบบนิเวศที่เอื้อต่อการส่งเสริมความเป็นผู้ประกอบการสังคมในมหาวิทยาลัยไทย คือการเชื่อมโยงกันของห่วงโซ่ทางคุณค่าที่มีความสลับซับซ้อนเช่นเดียวกันกับระบบนิเวศทางธรรมชาติ เชื่อมโยงความสัมพันธ์ระหว่างปัจจัยต่าง ๆ ที่มีหน้าที่แตกต่างกันแต่มีการพึ่งพาอาศัยกันเป็นเรื่องสำคัญ โดยองค์ประกอบและปัจจัยเกื้อหนุนต่าง ๆ จำเป็นจะต้องมีควบคู่กันไปอย่างสมดุล ได้แก่ การบูรณาการประเด็นการประกอบการทางสังคมเข้าสู่การเรียนการสอนในมหาวิทยาลัย การสร้างงานวิจัยเพื่อส่งเสริมความเป็นผู้ประกอบการสังคม การสร้างเครือข่ายวิจัยเป็นกลไกเชื่อมต่อการสร้างผลกระทบทางสังคมผ่านกลุ่มผู้ประกอบการสังคม การให้คำปรึกษาและระบบพี่เลี้ยง การเชื่อมต่อความช่วยเหลือจากภาครัฐและภาคเอกชน การเข้าถึงแหล่งเงินทุนสนับสนุน และการสร้างพื้นที่การทำงานร่วมกันสำหรับส่งเสริมความเป็นผู้ประกอบการสังคม และองค์ประกอบหลักที่เป็นหัวใจของระบบนิเวศที่เอื้อต่อการส่งเสริมความเป็นผู้ประกอบการสังคมในมหาวิทยาลัยไทย คือทรัพยากรบุคคลในฐานะผู้ขับเคลื่อน ผู้ให้กำเนิด และผลักดันส่งเสริมความเป็นผู้ประกอบการสังคมในมหาวิทยาลัยให้ประสบความสำเร็จ

การวิจัยในครั้งนี้มีวัตถุประสงค์เพื่อ 1) ทบทวนบริบทและแนวคิดระบบเตือนภัยล่วงหน้าสำหรับอุทกภัยที่มีในประเทศไทยและต่างประเทศ 2) ศึกษาการบริหารจัดการของระบบเตือนภัยล่วงหน้าสำหรับอุทกภัยของประเทศไทยในเหตุการณ์อุทกภัยจากอิทธิพลพายุโซนร้อนปาบึกในพื้นที่จังหวัดนครศรีธรรมราช 3) ข้อเสนอแนะเชิงนโยบายต่อการเสริมสมรรถนะกลไกเชิงสถาบันของระบบเตือนภัยล่วงหน้าสำหรับอุทกภัยของประเทศไทยในพื้นที่จังหวัดนครศรีธรรมราช โดยใช้วิธีการวิจัยแบบผสมผสาน ซึ่งมีการใช้เครื่องมือการวิเคราะห์เครือข่ายทางสังคมและการสัมภาษณ์เชิงลึก วิธีเชิงปริมาณโดยใช้แบบสอบถาม ผลจากการวิเคราะห์ข้อมูล พบว่า 1) ประเทศไทยมีหน่วยงานที่มีอำนาจหน้าที่ตามกฎหมายเพื่อดำเนินการด้านการเตือนภัยจำนวนมาก แต่มีการดำเนินการเตือนภัยที่สอดคล้องกับมาตรฐานสากลโดยเฉพาะในหน่วยงานระดับส่วนกลาง 2) ภาพรวมของเครือข่ายการเตือนภัยล่วงหน้าอยู่ในลักษณะการผสมผสานระหว่างเครือข่ายตารางแบบบางส่วนกับเครือข่ายที่เข้าถึงได้หลายช่องทางที่ไม่สมบูรณ์ บ่งชี้ว่า 2.1) เครือข่ายขาดการกำหนดบทบาทหน้าที่และทิศทางอย่างเป็นทางการจึงทำให้สมาชิกในเครือข่ายมีปฏิสัมพันธ์กันในระดับต่ำ 2.2) สมาชิกในเครือข่ายไม่มีการดำเนินกิจกรรมด้านการเตือนภัยล่วงหน้าเป็นการเฉพาะพอที่จะก่อให้เกิดการปฏิสัมพันธ์ระหว่างกัน ส่งผลให้เครือข่ายขาดความเหนียวแน่น และ 2.3) เครือข่ายในระดับท้องถิ่นขาดการเชื่อมโยงกับกลไกการเตือนภัยล่วงหน้าอย่างเป็นระบบ 3) เสนอให้มีการกำหนดให้มียุทธศาสตร์การเตือนภัยล่วงหน้าเป็นการเฉพาะที่กำหนดความสัมพันธ์เชิงอำนาจอย่างเป็นทางการของหน่วยงานต่าง ๆ ให้สอดคล้องกัน ตลอดจนกำหนดกลไกการติดตาม การประเมินผล และการพิจารณางบประมาณด้านการเตือนภัยที่มีเอกภาพทั้งประเทศ ตลอดจนกำหนดกลไกและการเตรียมพร้อมด้านการเตือนภัยในระดับพื้นที่อย่างเป็นรูปธรรมในแผนการจัดการภัยพิบัติท้องถิ่น และจัดให้มือคู่มือมาตรฐานปฏิบัติการด้านการเตือนภัย

Abstract
The present study investigated the impact of departmental procedural fairness on officers' psychological well-being and engagement in citizenship behaviors. An additional variable considered was the mediating impact of psychological safety on officers' psychological well-being and citizenship behaviors. The findings of this study identify internal operations of police departments as fertile ground for systemic improvements within policing.

Criminal defendants unable to afford an attorney are entitled to one for free in the United States, but how and when they obtain access to that lawyer is another question. We examine judicial attitudes and behavior in granting access to counsel in areas where logistics are particularly forbidding. Based on survey responses from 1,091 magistrate judges presiding in lower criminal courts in suburban and rural jurisdictions in upstate New York, we describe both the procedures used to determine defendants' financial eligibility for free counsel, and the logistical challenges that surround securing the physical presence of a lawyer at the first …

While researchers have attempted to estimate the prevalence of and identify risk factors for sexual assault, less is understood about the relationship among populations at high risk for sexual assault and their perceptions of survivors’ services organizations and justice. The purpose of this investigation is to contribute to existing research through exploratory qualitative analyses of 43 undergraduate sorority women’s perceptions of survivors’ services and justice on a large, urban campus in the Pacific Northwest in the United States. Bail reform is an urgent topic in the United States and internationally, but what constitutes reform and how to accomplish reform goals is contested. Jails are a modern epicenter of incarceration, with a stunning growth in American jail populations over the past four decades despite declines in both arrests and crime. As many as sixty percent of the half million people currently in jails have not been convicted but are instead detained pretrial. Prior waves of bail reform produced a system largely reliant on secured bonds, which require up-front cash payments to avoid jail time before trial. More recent reform …

งานวิจัยเรื่อง “แนวทางการเพิ่มประสิทธิภาพของการบังคับใช้พระราชบัญญัติป้องกันและปราบปรามการมีส่วนร่วมในองค์กรอาชญากรรมข้ามชาติ พ.ศ. 2556” มีวัตถุประสงค์เพื่อศึกษาแนวทางการบังคับใช้กฎหมายของต่างประเทศในการป้องกันปราบปรามองค์กรอาชญากรรมข้ามชาติ ประเมินผลการดำเนินงานและผลกระทบของการบังคับใช้ รวมทั้งปัญหาอุปสรรคของหน่วยงานในกระบวนการยุติธรรมและหน่วยงานที่เกี่ยวข้องต่อการบังคับใช้พระราชบัญญัติป้องกันและปราบปรามการมีส่วนร่วมในองค์กรอาชญากรรมข้ามชาติ พ.ศ. 2556 อันนำมาสู่การเสนอแนะแนวทางการเพิ่มประสิทธิภาพของการบังคับใช้พระราชบัญญัติฉบับนี้ โดยเป็นการวิจัยเชิงผสมผสานระหว่างการวิจัยเชิงปริมาณและการวิจัยเชิงคุณภาพ ผลการศึกษาพบว่าการบังคับใช้พระราชบัญญัติฉบับนี้มีประสิทธิภาพในด้านคุณภาพของการนำมาใช้ โดยสามารถเป็นเครื่องมือในการป้องกันและปราบปรามการกระทำผิดขององค์กรอาชญากรรมข้ามชาติขนาดใหญ่ที่ส่งผลกระทบมูลค่ามหาศาล บรรลุเจตนารมณ์ของกฎหมายในการลงโทษองค์กรอาชญากรรมข้ามชาติ ข้อเสนอแนะที่สำคัญ ได้แก่ การกำหนดนโยบายในการนำพระราชบัญญัติฉบับนี้มาใช้อย่างจริงจัง การจัดทำคู่มือการปฏิบัติงานควบคู่กับการสร้างความรู้ความเข้าใจแก่เจ้าหน้าที่ผู้เกี่ยวข้อง และการจัดตั้งหน่วยงานกลางทำหน้าที่ใน การตรวจสอบคดีที่เกี่ยวข้องกับองค์กรอาชญากรรมข้ามชาติ เป็นต้น

When a defendant is arrested, they can choose to either hire a private attorney to represent them, have appointed counsel such as a public defender, or have no representation. While the Sixth Amendment guarantees the right to counsel regardless of a defendant’s ability to pay, this counsel is not always required at first appearance. In fact, only 14 states have made it a requirement to have counsel at first appearance, and even in those states, counsel is not always appointed immediately. This thesis explores how the COVID-19 pandemic has impacted wildlife rangers with an emphasis on the influences of tourism rates. Two sets of data are used: one is a survey of rangers around the world and the other looks at global governmental tourism data. While coming from a routine activities perspective, the problem of decreased capable guardianship becomes apparent in the form of massively decreased tourism arrivals and troubling ranger perceptions.
