Inside/Outside: A Model For Social Support And Rehabilitation Of Young Black Men, Harold Adams, Castellano Turner

This paper first identifies some of the most important problems facing incarcerated young black males. Next, we present an historical analysis that pinpoints the War on Drugs as the primary origin of mass incarceration of that group. Then we describe the major consequences for prisoners as well as collateral problems for their families, friends, and communities. We then outline the types of programs created to address these problems. We summarize research that shows the key to solving high recidivism rates is social support during incarceration and after release. This study explores the attitudes of college-level criminal justice students as to their perception of sexualized advertising in Las Vegas, and if these attitudes have any correlation with the participant’s length of residency. The study also correlates college-level student’s attitudes toward sexualized advertising and how religious they rate themselves. Female participants who lived in Las Vegas for 5 years or more on average agreed advertisements in Las Vegas are too sexualized. In contrast, female participants who were either born in Las Vegas or lived there less than 5 years neither agreed nor disagreed that advertising was too sexualized. As for …

It is well known that Hans Kelsen and Jürgen Habermas invoke realist arguments drawn from social science in defending an international, democratic human rights regime against Carl Schmitt’s attack on the rule of law. However, despite embracing the realist spirit of Kelsen’s legal positivism, Habermas criticizes Kelsen for neglecting to connect the rule of law with a concept of procedural justice (Part I). I argue, to the contrary (Part II), that Kelsen does connect these terms, albeit in a manner that may be best described as functional, rather than conceptual. Following the establishment of the European Parental Leave Directive (96/34/EC), the female employment rate in Italy is still ranked the third lowest in the European Union (EU) and Italian women continue to do twice as much household work as Italian men. Parents, especially women, struggle to find a balance between professional work and their family lives in a society that encourages the traditional gendered roles of the housewife and the breadwinner. This essay is a response to Ian Ayres's, "Regulating Opt-Out: An Economic Theory of Altering Rules," 121 Yale L.J. 2032 (2012). Ayres identifies an important question: How does the law decide when parties have opted-out of a contractual default? Unfortunately, his article tells only half of the story about such altering rules. Ayres cares about rules designed to instruct parties on how to get the terms that they want. By focusing on such rules he ignores altering rules designed instead to interpret the nonlegal meaning of the parties' acts or agreement. This doctoral dissertation explores the history of capital punishment in Oklahoma using a systematic case-by-case examination of the death penalty as it has been used in the Sooner state. The author hopes that better knowledge of the extensive history of that institution in Oklahoma's past will provide insight into the reasons why Oklahoma currently kills its residents at a higher rate than any other politically distinct area in the world for which accurate records are available. Following World War I and the Bolshevik Revolutions, America's Red Scare began, inciting fanatical patriotism and an alleged threat of anarchy that gripped a nation with fear. Paranoia about communists, Socialists, and anarchists divided the country and resulted in many states, including Arkansas, passing criminal anarchy laws. Since a majority of those accused of anti-American activities were involved in labor disputes, Arkansas makes for an interesting case study; not only did it have a relative lack of labor disputes, it still passed anti-Bolshevik laws. In recent years, a growing proportion of the population has moved into gated communities in response to an increasingly pandemic fear of crime. While a sizable body of research has addressed fear of crime and perceived safety in gated communities, few studies have investigated actual rates of victimization. The studies that do compare victimization in gated and non-gated communities tend to be localized assessments and present mixed findings on the effectiveness of community gating as a form of protection from crime.

Sexual homicide is a rare occurrence. Little is known about the offending perspective of sexual homicide from a criminological standpoint. Recently, Chan, Heide, and Beauregard (2011) proposed an integrative theoretical framework using concepts and propositions of Social Learning Theory (differential association, definitions, differential reinforcement or punishment, and imitation) and Routine Activities Theory (a motivated offender, an attractive and suitable target, and the absence of a capable guardian or guardianship) to elucidate the sexual homicide offending dynamics. The paper analyzes the rise of get-tough crime legislation to the American public policy agenda and examines the effects of these policies on crime and inmate populations. Get-tough policies analyzed include sentencing reform, the War on Drugs and collateral consequences. Because there is no empirical literature on the effect of collateral consequences on crime, the paper employed an OLS regression model partly derived from institutional anomie theory to test for criminogenic effects. The study then employed OLS regression analysis to determine the affect of these independent variables on crime rates in each of the 50 states. The study concluded that …

The distinctive aspect of phenomenological theories of crime is that they are based upon a stated epistemology: how things are known and a specific ontology—the nature of social reality. This specificity aligns itself with neo-Kantian concern with forms of knowing, interpretation, and meaning, as well as with 20th-century concern with perception, cognition, and the framing of events. While there are influences of phenomenological thinking on varieties of theorizing, such as symbolic interactionism, critical theory, queer theory, and gender-based theories of crime, these ideas are refractions and are inconsistent in their reference to and understanding of the foundational phenomenological works. This article discusses the effect of US and international support for local laws to combat child trafficking in sub-Saharan African states. The annual ranking of African anti-trafficking measures, produced by the US State Department’s Office to Monitor and Combat Trafficking in Persons (OMCTP) in conjunction with the UN Office on Crime and Drugs, not only provides an important source of data but also creates a powerful incentive for African states to effect legislative change.

Despite the increased social recognition, law and policy changes within the criminal justice system, and the widespread use of court mandated batterer intervention programs (BIPs) domestic violence continues to be a persistent problem. The lack of significant decline in incidence rates along with a growing body of empirical evidence that indicates BIPs are, at best, only moderately effective raises serious concern. Al-Shabaab's American Recruits: A Comparative Analysis Of Two Radicalization Pathways, Matthew Wade Richardson

From 2005 to 2011, at least 41 Americans joined, or attempted to join, al-Shabaab, Somalia's preeminent terrorist organization. This thesis examines the radicalization process for al-Shabaab's American recruits by dividing the sample into two groups: non-Somali and Somali. The author employs causal flow diagramming as a means of visualizing each group's unique radicalization pathway. While most of the non-Somali recruits were motivated by political grievances and Salafism, most of the Somali recruits were motivated by identity conflict and nationalism. Considering al-Shabaab is both a religious and an ethno-nationalist terrorist organization, these results make sense. Radicalization within diaspora communities is a …

This dissertation examines the influence of competing risks in shaping individuals' choices about potential intimate relationships. According to Ulrich Beck's "risk society" theory, the individualization of social risks has direct and measurable consequences for the ways people organize and evaluate potential intimate relationships (Beck & Beck-Gernsheim, 1995, 2002, 2004; Giddens, 1994; Lupton, 2006). This study investigates the ways in which subjective or identity-related risks hypothesized by scholars of late modernity shape the perception and the actual risk of dating violence. In this article, we refine a politics of thinking from the margins by exploring a pedagogical model that advances transformative notions of service learning as social justice teaching. Drawing on a recent course we taught involving both incarcerated women and traditional college students, we contend that when communication among differentiated and stratified parties occurs, one possible result is not just a view of the other but also a transformation of the self and other. More specifically, we suggest that an engaged feminist praxis of teaching incarcerated women together with college students helps illuminate the porous nature of fixed markers that …
