This paper aims to outline the existing policies aimed at providing protection for sexual abuse survivors in the Democratic Republic of the Congo. In an attempt to provide justice for the survivors of sexual abuse, an analysis of the 1992-1995 Bosnia and Herzegovina post-conflict reconstruction is included. In particular, prosecution of sexual violence and rape as a weapon of war will be provided in order to weigh the benefits and weaknesses of international criminal law. The conflict in eastern Democratic Republic of the Congo witnesses widespread and systematic sexual violence abuses. With over 60 armed groups at any given day, …

Of all the countries identified as rising powers on the world stage, Brazil appears to have drawn considerable economic and political strength from its engagement with various forms of regionalism during the expansionist years when Lula was president. Whether by helping create a local, intra-regional entity (Mercosul) or, later, proposing a continental one (UNASUL), Brasilia appeared to have the capacity to further its own economic and political interests by generating cooperative interactions with its smaller neighbors. This article examines to what extent the Arab Spring constitutes a critical juncture – a major turning point – for the EU’s sanctions policy towards Egypt, Libya, Syria and Tunisia. Based on a multidimensional critical juncture operationalization, we find that the Arab Spring only constitutes such a turning point for the EU’s sanctions policy towards Syria. Both the level and nature of measures differ substantially from previous years. By contrast, the EU’s sanctions practice towards Libya, Egypt and Tunisia shows more resilience. More generally, changes in the nature of the measures are prominent, whereas changes in the level of the …

This thesis investigates under which conditions do authoritarian Member States exist in International Organizations that require democratic governance in their treaty law. The European Union is used as a case study along with two of its Member States that are in the process of transitioning to democracy from previous authoritarian regimes—Hungary and Romania. This thesis employs stealth authoritarian theory to analyze how a democratizing Member State may violate these laws and revert to authoritarian governance. This paper examines the main legal elements of corporate criminal responsibility for involvement in serious human rights violations, focusing specifically on the mens rea, or mental element requirement of a crime. It analyzes in detail what it means for a business to be complicit, the degree of knowledge corporations and their officials must have to be implicated in accomplice liability, and a case study demonstrating the consequences of such liability on corporations.

The foundation of preserving and enhancing global nuclear security rests on three fundamental pillars: nuclear disarmament; preventing further proliferation of nuclear weapons; and international cooperation aimed at safeguarding nuclear materials. Today, experts argue that the recent decision of Russian president Vladimir Putin to cut cooperative efforts to secure nuclear materials are placing in peril the future of international efforts to promote global nuclear security. We argue that in addition to the clear erosion of the third pillar of nuclear security, there are more threatening ramifications resulting from the recent actions of Russia in Ukraine.

All international sanctions are embedded in larger contexts of overlapping policy instruments and other sanctions regimes. Yet we tend to look at sanctions and evaluate their effectiveness from the vantage point of a single sender of sanctions – whether it is the UN, the EU, or an individual country like the United States – rather than consider the combined and interactive effects of different, co-existing sanctions regimes. EU sanctions tend to be imposed in conjunction with measures by other actors: their interplay deserves closer analysis in terms of sequencing, objectives, complexity and legitimacy. The establishment of peace in post-genocidal states is vital, as the experience of extreme division and violence can scar a population, contributing to violence and inequality moving forward. Existing literature on post-conflict transition and governance argues that two main systems are typically used: consociationalism and assimilationism. While consociationalism argues for heterogeneity in the state and assimilationism for homogeneity, both of these systems use the institutionalization of identity as a step in post-conflict recovery, through such means as proscribing or privileging particular identities. This paper tells the true story of a Hungarian refugee who's family fled the communist regime there in 1971. Gabriella Bercze's story reflects on what it was like to live in Hungary under communist rule, and her family's experience in escaping the country, and fleeing to Italy, where they lived in a refugee camp for months before immigrating to the United States in the early 70s.

Specifically, it accounts for the level of cooperation between the two jurisdictions in their efforts to improve oversight of the financial system. This paper uses soccer as a lens to look at governance structures and how they affect labor markets and economic outcomes in major European countries. It looks at three different models of soccer governance: “coordinated,” “liberal,” and “neutral,” found in the five major European soccer leagues (England, Germany, Spain, Italy, and France) and suggests that coordinated structures may have a comparative advantage over liberal structures.

In August of 2010, the French government began a program of deporting those Roma who lived within the country. Under European Union (EU) law, mass expulsions based on ethnicity are forbidden, as are mass examinations of peoples as opposed to individual assessments in the case of a crime. However, in the spirit of egalitarianism, France does not acknowledge the idea of racial or ethnic minorities. The European Union (EU) represents a quintessential example of regional economic integration, but not the sole case meriting consideration. This paper uses a comparative regional approach to analyze economic integration in the EU and the Association of Southeast Asian Nations (ASEAN). Excluding colonialism’s role in Asian regionalism, the EU and ASEAN had similar roots and goals for economic integration including creating stability in a post war era, gaining a stronger collective voice, and fostering economic growth. This paper explores the European Union’s (EU) security relationship with the North Atlantic Treaty Organization (NATO) and the United States (US) through the framework of the Common Security and Defense Policy (CSDP). Skeptics have decried the rise of CSDP as a new security pillar, arguing that it is an attempt to balance against NATO and the US. I argue that this criticism is false. This paper considers the mutually beneficial relationship of German and Austrian foreign direct investment (FDI) in Central and Eastern Europe (CEE) between 2004 and 2007, and the impact that the CEE states' belated membership in the Schengen Area had on further economic integration. Human trafficking is an international problem that plagues every country in the world. Although no reliable concrete data exist on the extent of human trafficking internationally, it is estimated that thousands of women are trafficked into the European Union every year. According to research conducted by the European Roma Rights Centre in 2010, a disproportionately high percentage of these victims are of Roma ethnicity. Research from service providers, law enforcement and international organizations estimates that Roma comprise between 50 to 80 percent of human trafficking victims in Bulgaria with similar levels across Central and Eastern Europe.
