Faces Of Immigration: The American Dream Is Not Dead, Megan E. Bright Jan 2016

Faces Of Immigration: The American Dream Is Not Dead, Megan E. Bright

Honors College Theses

Since the beginning of the history of the United States, we have been a nation not of one people but of many. Immigrants from across the globe have come to the U.S. bringing their cultures and histories with them; making this country the proverbial “melting pot” that it is today. This thesis looks at the United States’ immigration policy through featuring three people from Middle Eastern countries who are linked to the immigration process. These stories give insight into the immigration process of the US and the adjustment of Arab immigrants to life in America in a post 9/11 world.

Social Justice And Human Rights In Education Policy Discourse: Assessing Nelson Mandela's Legacy, Abrehet Gebremedhin, Devin Joshi Jan 2016

Social Justice And Human Rights In Education Policy Discourse: Assessing Nelson Mandela's Legacy, Abrehet Gebremedhin, Devin Joshi

Research Collection School of Social Sciences

Twenty years after South Africa's democratisation, Nelson Mandela's passing has prompted scholars to examine his legacy in various domains. Here we take a look at his legacy in education discourse. Tracing Mandela's thoughts and pronouncements on education we find two major emphases: a view of education as a practical means to economic development, and education as a means to social justice, human rights, and democracy. Assessing the legacy of these twin emphases, we conducted qualitative and quantitative content analysis of turning point documents in education policy and annual reports from the respective South African ministries of education over the last …

Education As The Weakest Institutional Link In Japan's Nuclear Regulation, Hiro Saito Jan 2016

Education As The Weakest Institutional Link In Japan's Nuclear Regulation, Hiro Saito

Research Collection School of Social Sciences

Debates over the Fukushima Daiichi Nuclear Disaster pointed to a set of institutional and organizational failures in Japan’s nuclear regulation as a primary cause of the disaster. While the Japanese government has implemented reforms to strengthen nuclear regulation, I argue that these reforms have largely left out the education system as a key institution that produces and distributes expertise necessary for nuclear regulation. First, the Japanese education system has traditionally produced only a small number of experts in the fields related to nuclear regulation, aligned top-ranked experts with the pro-nuclear government, and weakened the civil society’s capacity to mobilize counter-experts. …

Public Vs. Private Schooling As A Route To Universal Basic Education: A Comparison Of China And India, William C. Smith, Devin K. Joshi Jan 2016

Public Vs. Private Schooling As A Route To Universal Basic Education: A Comparison Of China And India, William C. Smith, Devin K. Joshi

Research Collection School of Social Sciences

This article examines whether focusing primarily on public schooling can lead to more rapid achievement of universal basic education (UBE) than relying on a mixture of public and private schooling. Through a structured, focused comparison, we find China's greater emphasis on public schooling has contributed to higher enrollment, attendance, graduation rates, gender parity, and proportion of students entering higher education than India, the country with the world's largest private sector in primary and secondary education. This comparison suggests that greater emphasis on public schooling in developing countries may lead to more rapid UBE attainment than encouraging privatization.

Corporate Reorganisation Of China's Listed Companies: Winners And Losers, Zinian Zhang Jan 2016

Corporate Reorganisation Of China's Listed Companies: Winners And Losers, Zinian Zhang

Research Collection Yong Pung How School Of Law

This article is the first empirical study investigating the corporate reorganisation of Chinese domestically-listed companies. Through examining these cases, it challenges the assertion made by most of these corporate reorganisation plans and by Chinese state-run media reports that creditors and general public shareholders were the major beneficiaries. Through an analysis of the data generated from all forth-three such cases, this articles reveals that: First, unsecured creditors could have, on average, received 61.37% more of their claims if the fundamental value distribution principle, the absolute priority norm, could have been complied with in these reorganisations; Second, if the general-public-shareholder-protection scheme issued …

The State Courts Centre For Dispute Resolution: Serving The Society With Quality Dispute Resolution Services, Dorcas Quek Anderson Jan 2016

The State Courts Centre For Dispute Resolution: Serving The Society With Quality Dispute Resolution Services, Dorcas Quek Anderson

Research Collection Yong Pung How School Of Law

Court Alternative Dispute Resolution (“ADR”) has its origins in a 1994 pilot project in the Subordinate Courts (as it was known then) to have selected District Judges assist in resolving civil disputes using ADR processes. Within two decades, Court ADR has been extended to the entire gamut of cases filed in court, including civil claims, minor criminal offences and family disputes. Court ADR services, which have been known as “Court Dispute Resolution”, have become integral to the delivery of justice in the State Courts. As the Honourable The Chief Justice Sundaresh Menon has observed, ADR has been promoted as the …

Ideas, Interests And Practical Authority In Reform Politics: Decentralization Reform In South Korea In The 2000s, Yooil Bae Jan 2016

Ideas, Interests And Practical Authority In Reform Politics: Decentralization Reform In South Korea In The 2000s, Yooil Bae

Research Collection School of Social Sciences

This paper explains the reason why the hitherto statist country, Korea, has carried out significant decentralization since the 2000s. In explaining the motivation for decentralization, extant literature has focused on the role of parties, bureaucratic politics, democratization, or territorial interests. Yet there is still limited explanation of how the decentralization laws in Korea could be successfully passed in the 2000s, while cental stakeholders still persisted. By tracing the process of decentralization reform in the 2000s, this article demonstrates how structural factors created favourable circumstances and discursive background for institutional change, and how the idea of decentralization, through the idea diffusion …

How The Eu Learned To Love Sanctions, Clara Portela Jan 2016

How The Eu Learned To Love Sanctions, Clara Portela

Research Collection School of Social Sciences

It is only recently that the European public has woken up to the sue of sanctions in EU foreign policy, though they have been employed since the early 1980s. They became more frequent following the 1992 establishment of the Common Foreign and Security Policy (CFSP), the EU's intergovernmental forum for foreign policy coordination.

Piling On: The Rise Of Sanctions Cooperation Between Regional Organizations, The United States, And The Eu, Inken Von Borzyskowski, Clar Portela

Research Collection School of Social Sciences

Of all the countries identified as rising powers on the world stage, Brazil appears to have drawn considerable economic and political strength from its engagement with various forms of regionalism during the expansionist years when Lula was president. Whether by helping create a local, intra-regional entity (Mercosul) or, later, proposing a continental one (UNASUL), Brasilia appeared to have the capacity to further its own economic and political interests by generating cooperative interactions with its smaller neighbors. Subsequently it took a leading role in inter-regional negotiations between Mercosul and the European Union in the global North and between Mercosul and ASEAN …

One Swallow Does Not Make Spring: A Critical Juncture Perspective On The Eu Sanctions In Response To The Arab Spring, Andreas Boogaerts, Clara Portela, Edith Drieskens Jan 2016

One Swallow Does Not Make Spring: A Critical Juncture Perspective On The Eu Sanctions In Response To The Arab Spring, Andreas Boogaerts, Clara Portela, Edith Drieskens

Research Collection School of Social Sciences

This article examines to what extent the Arab Spring constitutes a critical juncture – a major turning point – for the EU’s sanctions policy towards Egypt, Libya, Syria and Tunisia. Based on a multidimensional critical juncture operationalization, we find that the Arab Spring only constitutes such a turning point for the EU’s sanctions policy towards Syria. Both the level and nature of measures differ substantially from previous years. By contrast, the EU’s sanctions practice towards Libya, Egypt and Tunisia shows more resilience. More generally, changes in the nature of the measures are prominent, whereas changes in the level of the …

He noted that the critical issues for Parliament …

Research Collection Yong Pung How School Of Law

Despite its rich metallic mineral resources on land,1 the People’s Republic of China (China) has been actively exploring for deep seabed minerals in the international seabed area (the Area).2 The legal framework is provided by the United Nations Convention on the Law of the Sea (LOSC).3 China and the Russian Federation are the only States currently sponsoring exploration of all three types of deep seabed mineral deposit in the Area (polymetallic nodules in the Clarion-Clipperton Fracture Zone, seafloor massive sulphides in the South West Indian Ridge, the Central Indian Ridge, and the Mid-Atlantic Ridge, and cobalt-rich ferromanganese crusts in the …

Capacity Building For International Development Practitioners Through An Off-Campus Graduate Education Program, Ralph Charles Wood Jan 2016

Capacity Building For International Development Practitioners Through An Off-Campus Graduate Education Program, Ralph Charles Wood

Dissertations

Problem

Andrews University offers a graduate off-campus program in international development, the Master of International Development Administration (MIDA). The stimulus for this study came from the fact that there had never been an extensive investigation of the capacity building impact on the graduates of the off-campus Master of International Development Administration of Andrews University. Coupled with this, there was a very limited body of research on the importance and effect of education in international development when it comes to building the capacity of the practitioners of international development. This study determined the alumni’s perceptions of experiencing individual capacity building and …

Convergence? The Incursion Of Technology In The United States - Mexico Remittance Corridor, Sam Wilner Simon Jan 2016

Convergence? The Incursion Of Technology In The United States - Mexico Remittance Corridor, Sam Wilner Simon

Open Access Theses & Dissertations

The United States-Mexico remittance corridor finds itself at a crossroads, exacerbated by an amalgam of factors including tapering migration levels, a more mature Mexican economy and higher levels of technological permeation. I identify the individual, governments and service providers as the three main actors in the United States - Mexico Remittance Corridor. I deploy an interdisciplinary set of sources, ranging from academic journals to World Bank datasets to illustrate the logistical hurdles that are delaying changes to what many experts believe, is an unsustainable status-quo. I explore the idea of a Galtung inspired mutually reinforcing triangle as a means of …

Embera Drua: The Impact Of Tourism On Indigenous Village Life In Panama, Amy Lethbridge Jan 2016

Embera Drua: The Impact Of Tourism On Indigenous Village Life In Panama, Amy Lethbridge

Antioch University Dissertations & Theses

This case study examines the experience of residents of the Indigenous village of Embera Drua, Panama with 20 years of tourism. It addresses the lack of Indigenous voices in tourism literature by telling the story of Embera Drua through the lens of the villagers themselves. The study uses a mix of ethnographic observation and narrative inquiry and finds that the experience of Embera Drua mirrors the experience of other Indigenous villages offering tourism around the globe, particularly the impact of lack of community capacity on management and growth of such tourism initiatives. Findings of this study are relevant to the …

Indigenous Rights Policy And Terrorist Discourse: A Strategy To Stifle Mapuche Self-Determination In Chile, Reyna Mckinnon Jan 2016

Indigenous Rights Policy And Terrorist Discourse: A Strategy To Stifle Mapuche Self-Determination In Chile, Reyna Mckinnon

Scripps Senior Theses

When President Sebastián Piñera entered office in 2010 the Mapuche indigenous people were receiving two contrasting messages from the Chilean State. On the one hand, the government ratified ILO Convention 169, pledging to protect the indigenous right to prior consultation in programs that affect their communities. On the other hand, the government was involved in the oppression of Mapuche communities in the region of the Araucanía through militarisation and the application of the Anti-Terrorist Law to punish radical Mapuche activists that protest corporate encroachment on their land. While Piñera had the opportunity to legitimize the Mapuche demand for self-determination by …

Maya Women Organising In The Margins: A Post Decolonial Feminist Approach, Jennifer Manning Jan 2016

Maya Women Organising In The Margins: A Post Decolonial Feminist Approach, Jennifer Manning

Doctoral

The work and lives of marginalised indigenous women in the Global South are located outside of the dominant Western discourse of management and organisation. There is limited empirical engagement with marginalised indigenous women in the Global South within the organisation studies discipline. As a result, we know little about how they construct their identity as women and their organisation/organising experiences in the context of their social, cultural and historical location. My ethnographic research takes us into the lives of Maya women community weaving groups in the rural Highlands of Sololá, Guatemala, and explores the everydayness of their work and lives …

The Discretionary Death Penalty For Drug Couriers In Singapore: Four Challenges, Siyuan Chen Jan 2016

The Discretionary Death Penalty For Drug Couriers In Singapore: Four Challenges, Siyuan Chen

Research Collection Yong Pung How School Of Law

In 2012, Singapore amended its Misuse of Drugs to give courts hearing capital drug trafficking cases the discretion to replace the default death penalty with life imprisonment and caning, provided that the accused person can show that he was merely a drug courier and the prosecution certifies that he had substantively assisted the authorities in disrupting drug trafficking activities. The Singapore High Court and Court of Appeal have since made important pronouncements on the 2012 amendments, but several challenges remain: first, whether the privilege against self-incrimination has been further eroded; secondly, whether an accused person can invoke the statutory relief …
