The amount of deference due foreign governments’ statements regarding the meaning of foreign law has long plagued U.S. courts. Courts have applied a variety of approaches in answering this question, including reliance on doctrines of international comity, respectful consideration, and Rule 44.1 of the Federal Rules of Civil Procedure. The U.S. Supreme Court recently attempted to provide additional guidance to lower courts and litigants in Animal Science Products, Inc. v. Hebei Welcome Pharmaceutical Co., Ltd., where it created a new, five-factor test. However, application of this new test is likely to generate continued uncertainty and inconsistency in this area of …

Since the 1970s, the word "terrorism" has become a well-known term. Almost two decades after 9/11, it has become a part of everyday vocabulary and, at times, dominates the news cycle. However, the faces we see associated with terrorism are mainly men. When talking of a training camp or a video claiming responsibility for terrorist attacks, women are not a part of the majority. Intimate partner violence (IPV) by men against women is a devastating social problem that is experienced by over a quarter of women in their lifetimes (Tjaden & Thoennes, 2000). IPV in Asian American communities is a prevalent problem that is likely influenced by both patriarchal gender role norms as well as culturally salience factors that are distinct to Asian Americans. Most never-married young “Creole” (Afro-Caribbean) women in Bluefields, Nicaragua are raised in fundamentalist Protestant families and institutions that emphasize sexual abstinence before marriage. In this context, abstinence is required to maintain social standing and “respectability.” Nevertheless, women in Bluefields, the administrative center of Caribbean Nicaragua, exhibit what Creoles themselves understand to be high rates of sexuality and pregnancy among post-menarche unmarried teenaged women (USAID, 2012; Mitchell et al. 2015). Such young women’s pregnancies occur at an important developmental stage of their lives and have long been associated by social scientists with adverse social, emotional, and health situations. Analysis of literary sources shows that the sacred wooden architecture of Ukraine is a source of inspiration for artists, art historians, writers, and other people interested in church buildings made of wood. Recent literature on racial capitalism has overwhelmingly focused on the Atlantic settler-slave formation, sidelining the history of European imperialism in Asia. This article addresses this blind spot by recovering the aborted project of British settler colonialism in India through the writings of its most prominent advocate, John Crawfurd. It is argued that Crawfurd’s vision of a liberal empire in India rejected slavery and indigenous dispossession yet remained deeply racialized in its conception of capital, labor, and value. Crawfurd elaborated a “capital theory of race,” which derived racial categories from a civilizational spectrum keyed to the capitalist organization of production. His …

Antisemitism was not a new phenomenon in Slovakia and can be traced back to the Middle Ages and beyond. Looking at the more recent past, after the Austro-Hungarian Compromise in 1867, Jews became equal citizens in the eyes of the state. The Hungarian Parliament passed an Act of Emancipation for Jews that same year, mainly for the purpose of economic development, which was beneficial for the Jewish population. A year later, Hungary's Nationality Act was issued as part of an active policy of magyarization (Hungarianization). However, it did not affect Jews, who were considered a religious group and not a …

Background: Distrust, and more broadly, public perception of government's handling of a crisis, has been a widely studied topic within health crisis research and suggests that these perceptions are significantly associated with the behavior of its citizens. This thesis is about the politicization of hairstyles in imperial China. They indicated conformity with social norms, or rebellion against them. This was especially true under the country’s last dynasty. The Manchu conquerors imposed their own hairstyle, the queue, on their Han Chinese subjects to make their rule palpable to China’s illiterate millions. “Hair martyrs” who refused to accept this “barbarous” hairstyle were ruthlessly eliminated. The Manchus had feared assimilation into the much larger Han population. But the introduction of one uniform male hair style for both Manchus and Han blurred the lines between the two groups. Singapore’s adult guardianship law was derived from the Mental Capacity Act in England and Wales. This article explores the process of how Singapore’s Mental Capacity Act was adapted and fine-tuned to operate in a jurisdiction with different cultural conditions, religions, familial norms, and social institutions. The first part of the article demonstrates that despite its apparent similarities, the policymakers in Singapore have omitted crucial portions of the Mental Capacity Act which deal with the human rights of persons lacking capacity. This paper theorizes the rural restructuring in China today as a transition towards productivism – characterized by both a productivist agricultural regime and productivist rural spaces. The rise of the productivist agricultural regime has spearheaded this transition for two decades; now the residential restructuring programs implemented under various policy schemes are also producing spaces of productivism in the new concentrated settlements. This paper, employing Halfacree’s three-fold conceptual model of rural space and using the empirical case of residential restructuring in Chengdu, offers the first full analysis of the rise of productivism in all three facets of rural space. China's regulatory crackdowns have affected U.S. and Chinese companies, but protectionist trade policies implemented by the Trump administration and continued by the Biden administration have severely restricted the ability of the U.S. government to protect U.S. businesses in the Chinese market. Unless the U.S. government changes course, American companies will be increasingly less able to address perceived wrongs in Chinese government policies and will be placed at a significant economic disadvantage in much of Asia.
