Contractual And Procedural Effects Of Non-Exclusive Jurisdiction Agreements, Darius Chan

In Orchard Capital I Ltd v Ravindra Kumar Jhunjhunwala, a respondent’s attempt to stay Singaporean proceedings on forum non conveniens grounds in favour of a non-exclusive jurisdiction (Hong Kong) was denied. In doing so, the Singapore Court of Appeal set out important principles concerning the legal effects of a non-exclusive jurisdiction agreement. This note makes a comparative analysis of the decision with English case law. It will be seen that the decision has taken a bold and firm step in a direction where English case law had previously tiptoed but still not fully embarked.

What causes marital conflict, and which marital conflicts are more likely to result in men’s violence against their wives? It has long been argued that men’s jealousy over women’s infidelity is the strongest impetus to men’s lethal and non-lethal violence against female partners. Less is known about the extent to which women’s jealousy over men’s infidelity precipitates men’s violence against female partners. Husbands are more likely than wives to commit infidelity, and men and women report a similar frequency and intensity of jealous emotions during recalls of potential infidelity. In this paper I wish to illuminate the life of historian and author Rashīd al-Dīn Fadhl-allāh Hamadānī, a Jewish vizier during the rule of the Mongol Ilkhans in Iran. By gaining a better grasp of the man’s personal biography, I hope to give insight into his life’s most notable work: the Jami al-Tawarikh, or the Compendium of Chronicles (ca. 1305-06), the first comprehensive world history of its kind ever produced and Rashid al-Din’s greatest contribution to Ilkhanid literary space. The bottom line is that the crisis in Syria is tragic and extremely complicated. Some of its more complex issues include the threat of ethnic conflict, refugee flows, Iran's regional influence, and the impact of this uprising on other protests in the Arab world, ongoing and in the future. However, there are also several incontrovertible facts: the regime of Bashar al-Assad, in the name of putting down a protest movement that turned violent, is responsible for at least 7,500 deaths and shows no signs of relenting.

African extreme poverty is probably a function (although not solely) of the balkanized post-colonial geopolitics of Africa. It is also probably a function (although not solely) of the income distribution generated by a typically perverse African political economy, through its effect on the allocation of resources to development. As between these two causes, the second is probably much the more important. This reinterpretation puts considerably more of the blame for African poverty on the Western great powers than does the “poverty trap” analytic that is a common contemporary way of thinking about the African economic situation.

The variables used in this study include Gross Domestic Product (GDP), Tax Revenue as Percent of GDP, and current account balance to name a few. Recent studies on causes of intergovernmental transformation in old and new democracies have found that decentralization is often the outcome of negotiations between national and local political interests. South Korea is commonly believed to be an exception because local elections and institutions introduced in the early 1990s were, by and large, the product of negotiations among political elites at the centre, without significant inclusion of local actors. The political reforms that have occurred from August 2011 in Myanmar have captured international attention due in part to the overwhelming desire for the pariah of ASEAN to move toward better governance and greater political liberalization. The unexpected changes began in August 2011 when the current president Thein Sein rallied reformers in his Cabinet and sat down with the country’s de facto opposition leader Aung San Suu Kyi to move the country toward national reconciliation. Over the last seven months, Myanmar’s military leadership has begun a process of liberalization that is unprecedented.

More recently, in July 2011, the Financial Advisers Regulations (Cap 110, Rg 2, 2004 Rev Ed) was amended and an important new provision – reg 18B – was added. A noted Singapore-based cultural geographer and specialist on Asia analyzes the emergence and functioning of a unique artistic cluster in Hong Kong's Fotan light industrial district. The objective of the research is to understand how artistic work in the cluster, despite some challenges, has thus far proven sustainable in cultural, social, and economic terms. The findings of this case study permit further clarification of several dimensions of an emerging theory of cultural/creative clusters, which should be considered as distinct from business and industrial clusters. As a long-time human rights advocate I find myself uncomfortably sharing Rieff's central concern over the link between military intervention and human rights advocacy, forged through the Responsibility to Protect (R2P) doctrine. This common concern is uncomfortable because I don't share his broader sentiments. However, it is also uncomfortable because it involves me swimming against the human rights tide, which seems to have embraced R2P.

The purpose of this article is to analyse relevant judicial decisions in Taiwan regarding structured notes sold to retail investors. Regarding pre-sale disputes, one issue was that investors failed to read contractual documents properly before signing contracts, so there was a question whether they could later claim a bank’s violation of its duty to explain. This article favours the view that an investor’s signature may exempt a bank’s duty, provided that investors are made aware of relevant warnings. In addition, for suitability assessment, relevant judgments show that customers were too easily classified as active investors based on a simple questionnaire. …

Party politics in the European Parliament (EP) consists of competition between transnational party groups, each consisting of multiple national member parties from the 27 member states of the European Union (EU). Identifying the policy space that these parties inhabit and their ideological positions is both practically and conceptually challenging. In this article we characterize this policy competition by tracking EP political groups from three separate, original expert surveys taken in 2004, 2007 and 2010. This study explores the effectiveness of a game-based mobile learning model for children living in underdeveloped regions with significant contextual variations. Data for this study came from a total of 210 children between the ages of 6-14 years old from six marginalized communities in India. The findings reveal that children with little or no previous exposure to technology were able to not only figure out the given mobile learning technology, but also solve a series of incrementally challenging problems by playing math games without specific intervention or instruction by adults.
