Lee Kong Chian School Of Business Year In Review 2019-2020, Singapore Management University

SMU Corporate Reports

We all knew that 2020 would be an extraordinary year for the Lee Kong Chian School of Business. It marks our 20th anniversary of our first entering cohort of undergraduates! Smu Libraries Annual Report 2019 / 2020, Singapore Management University

SMU Corporate Reports

Since joining SMU Libraries in March 2020, I have been impressed with the SMU community’s interest in the Libraries and the Libraries’ staff’s dedication, enthusiasm, and flexibility. While 2020 has brought uncertainty and great challenges, there are occasions to celebrate as well, including SMU’s 20th anniversary. 2020 also marks the 10th anniversary of InK, the SMU institutional repository. InK has been an integral part of making SMU research available to …

As the world learns to manage Covid-19, focus must be given to sustainable living. Here SMU can contribute to driving solutions to manage climate change and sustainable city living.

Accrual Of Cause Of Action In Negligence: Ipp Financial Advisers Pte V Saimee Bin Jumaat, Gary Kok Yew Chan

Singapore Law Journal (Lexicon)

Damage is the gist of the action in negligence. An action in negligence is said to accrue only when damage arises. The precise timing of the damage is an important factor in an application to strike out a claim in negligence on the ground that it was filed out of time contrary to the Limitation Act. Consequently, the lawsuit may have to be initiated within a specified period from the accrual of the cause of action.

Do Algorithms Dream Of Mistaken Contracts? Supreme Court Case Summary: Quoine Pte Ltd V B2c2 Ltd, Lokman Bin Mohamed Rafi Hakim

Singapore Law Journal (Lexicon)

Can an agreement which is formed purely through the operation of algorithms be considered a binding contract? If so, can such a contract be unilaterally cancelled because of a mistake, where such mistake resulted in trades being concluded at 250 times the market rate? This was the question before the Court of Appeal (“CA”) in the case of Quoine Pte Ltd v B2C2 Ltd [2020] SGCA(I) 2.

The Limits To Freedom To Contract: Supreme Court Case Summary: Leiman, Ricardo V Noble Resources Ltd, Jia Xin Tan

Singapore Law Journal (Lexicon)

In line with the principle of freedom to contract, the courts will give effect to the intention of the parties in creating their contract, and also hold them to their duty to perform their primary obligations under such contract. However, where the contracting parties agree to vest certain decision-making powers to a specific (non-judicial) entity, to what extent may a court review the exercise of powers by such entity?

The mixed ownership reform (hereinafter referred to as the “mixed reform”) introduces flexible market response mechanisms and innovative management systems from private enterprises into state-owned enterprises to enhance the market awareness of state-owned enterprises, to increase their own competitiveness, vitality and creativity. It aims to build a system that conforms to modern corporate governance and …

Spandeck: A Relational View Of The Duty Of Care, Kian Peng Soh Jan 2021

Spandeck: A Relational View Of The Duty Of Care, Kian Peng Soh

Research Collection Yong Pung How School Of Law

The use of a general framework in the determination of a duty of care has seemingly fallen out of favour following the UK Supreme Court’s decision in Robinson. Relying on the example of the Spandeck framework in Singaporean jurisprudence, this piece presents the argument that such frameworks, being consistent with a relational conception of tort law, can provide a useful means of determining whether a duty of care exists. In so doing, this piece addresses some criticisms of the relational view and re-emphasises the important role the duty of care plays in the tort of negligence.

Understanding International Immobility Through Internal Migration: ‘Left Behind’ Nurses In The Philippines, Yasmin Y. Ortiga, Romeo Luis A. Macabasag Jan 2021

Understanding International Immobility Through Internal Migration: ‘Left Behind’ Nurses In The Philippines, Yasmin Y. Ortiga, Romeo Luis A. Macabasag

Research Collection School of Social Sciences

Migration scholars have tended to portray internal mobility as a step toward broader cross-border movement, reinforcing the notion of ongoing progress toward international migration. This article argues for a need to recognize how internal mobility can also explain international immobility, or why people do not move across national borders. Using the case of Filipino nurses, we argue that while internal migration does allow aspiring migrants to build the potential ability to emigrate, individual trajectories are much more diverse and multi-directional, often prolonging or reinforcing their international immobility. As a result, and in our case study, the costs and burdens of …

Ai Weiwei And The Global Art Of Politics, William A. Callahan Jan 2021

Ai Weiwei And The Global Art Of Politics, William A. Callahan

Research Collection School of Social Sciences

In the past decade, Ai Weieiwei has burst out from his limited role of a Chinese artist to become an artist-activist who has “gone global.” Ai first gained international fame as the consultant for Beijing’s “Bird’s Nest” Olympic stadium, which was designed by the Swiss architectural firm Herzog and de Meuron. Just before the 2008 Olympics, however, Ai became infamous for denouncing the stadium as China’s “fake smile” to the world. In October 2010, Ai fascinated the art world with his Sunflower Seeds exhibit at London’s Tate Modern art gallery; before the exhibit closed in May 2011, Ai became a …

Becoming Citizens: Policy Feedback And The Transformation Of The Thai Rice Farmer, Jacob Ricks, Thanapan Laiprakobsub Jan 2021

Becoming Citizens: Policy Feedback And The Transformation Of The Thai Rice Farmer, Jacob Ricks, Thanapan Laiprakobsub

Research Collection School of Social Sciences

Over the past twenty years, Thailand’s rice farmers have become one of the country’s most important and active political constituencies, a sharp contrast from the previous decades wherein they were treated with neglect or even derision by the Thai political elite. These “political peasants” now actively advocate for and successfully receive extensive subsidies from both authoritarian and democratic governments. What has driven this change? In this essay, we draw on theories of the policy feedback loop wherein policies yield both material and cognitive benefits, which change the political behavior of populations. We argue that the Thaksin Shinawatra government’s (2001-2006) paddy …

With at least half of humanity under lockdown to arrest the spread of COVID-19 (Sandford, 2020), adults have been working from home and children engaging in home schooling for months on end. Competing for scarce resources such as digital devices, bandwidth, as well as physical and personal space, families have had to contend with rising tensions around the quality of digital engagement, children’s learning abilities, parent-child relationships and overall familial wellbeing. This fraught situation shone the spotlight on the household context of technology use but also enabled us to marshal academic insights to advance advocacy and public education. The pandemic …

Evolution Of International Investment Agreements In Africa: Features And Challenges Of Investment Law “Africanization”, Makane Moïse Mbengue, Stefanie Schacherer

Research Collection Yong Pung How School Of Law

African States, African Regional Economic Communities (RECs), and the African Union have adopted a number of new investment instruments in recent years. Many of these instruments are highly innovative and mark a clear departure from old European-styled IIAs. The Africanization of international investment law or, in other words, the prise en main of African States and organizations to design the regulation of international investment according to their policy and development priorities has become an evident contemporary phenomenon. At the same time, the most innovative approaches can be found in intra-African IIAs, i.e., in IIAs concluded between two or more African …

Tax Law And The Digital Economy In Singapore, Vincent Ooi

Research Collection Yong Pung How School Of Law

This chapter is divided into three main parts: 1) international tax law, 2) domestic tax law, and 3) tax and regulation. The first part deals with the international tax system and the way it has been affected by technology. This part will focus on income tax. Existing rules of nexus, characterisation of income and treatment of data are increasingly being challenged, leading to changes in the OECD Model Convention and the implementation of the Base Erosion and Profits Shifting (“BEPS”) project. These in turn have had a considerable impact on Singapore tax law, as Singapore is an active participant in …

Strong people-to-people ties can help temper political histrionics, moderate negative impact on political ties. The tantalising prospect of being able to leave Singapore and arrive in Kuala Lumpur in just 90 minutes remains a pipe dream after the High Speed Rail (HSR) agreement was terminated last Friday, along with what could have been an important confidence booster to bilateral ties between Singapore and Malaysia.

The authorities previously assured citizens that the TT data "will only be used for contact tracing", but subsequently indicated that the data may be used for criminal investigations. TT is the vital tool in our fight against the pandemic as it helps with contact tracing. It is in the government's interest to ensure optimal usage of TT. Some are now feeling that the government has "betrayed" their trust, so public confidence in using TraceTogether must be restored.

Rethinking China Trade Policy: Lessons Learned And Options Ahead, Henry S. Gao Jan 2021

Rethinking China Trade Policy: Lessons Learned And Options Ahead, Henry S. Gao

Research Collection Yong Pung How School Of Law

Looking back at the China trade policy of the Trump administration, the biggest lesson is that unilateralism simply doesn’t work, at least not against a major power like China. Despite the tumultuous two-and-half-year trade war and the Phase 1 deal hailed as an “unprecedented” deal promising “a more balanced trade relationship and a more level playing field for American workers and companies,” there has been little progress on the issues U.S. businesses and the Trump administration objected to in China’s trade and economic policies. It is not only the U.S. government that needs a more viable approach. Many companies would …

Governing Science And Technology Under The International Economic Order: Regulatory Divergence And Convergence In The Age Of Megaregionals By Shin-Yi Peng, Han-Wei Liu And Ching-Fu Lin, Henry S. Gao, Weihuan Zhou

Research Collection Yong Pung How School Of Law

Trade and technology have a long history of interdependence. It was the trade along the ancient silk road that helped to spread the technologies of China – such as paper-making, gun power, compass, and moveable type printing – to Europe. These technologies helped to launch the Renaissance, the Reformation, and the Great Discoveries, which in turn set in motion globalization as we know today. As we enter the third decade of the twenty-first century, the role of science and technology grows even stronger in international trade. For example, the advancement of information and communications technology (ICT) has greatly facilitated the …

This curated special issue asks how history can be used as a lens into disaster and disaster management. It takes as its premise the idea that approaches from different disciplines - including the humanities and social sciences – can offer new perspectives on understanding disaster, managing disaster and disaster risk. The concept is not new, historically focussed studies have long provided meat for hazard investigations and modelling, especially those focused on geological or hydrological time-series analyses; multi-hazard interactions and identifying historical underliers for contemporary risk. It has become increasingly common, for example, to include historians in collaborative efforts to better …

Global Stablecoins And China’S Cbdc: New Moneys With New Impacts On The Financial System?, Wei Shen, Heng Wang Jan 2021

Global Stablecoins And China’S Cbdc: New Moneys With New Impacts On The Financial System?, Wei Shen, Heng Wang

Research Collection Yong Pung How School Of Law

Digital currencies are reshaping the financial, monetary, and regulatory landscape. There are at least two routes for the development of digital currencies. One is global stablecoins (e.g., Diem that is previously named Libra), issued by private players, while the other is central bank digital currency (CBDC) issued by central banks, with China’s CBDC as an example and possibly the first CBDC that will be issued by a major economy. Albeit in their rudimentary stages, global stablecoins and China’s CBDC are likely to disrupt the current financial system and challenge existing financial regulation. This article examines two crucial but under-explored questions: …

Retirement Preparedness In Singapore, Junxing Chay, Seonghoon Kim Jan 2021

Retirement Preparedness In Singapore, Junxing Chay, Seonghoon Kim

Research Collection School Of Economics

This chapter presents empirical evidence on a variety of measures to assess the social and economic well-being of near-retirees and retirees in Singapore based on rich data from the Singapore Life Panel, a nationally representative monthly panel survey of 50- to 70-year-old adults in Singapore. Large differences in retirement behaviour and household financial conditions related to retirement preparedness across education and wealth groups are documented. This suggests the importance of a retirement-related policy that focuses on the low-skilled and low-wealth groups. In addition, we discuss and evaluate current public policy designed to increase the employment of older workers and propose …

'Fraught' Chineseness: 'Chinese Christians' In The Vancouver Sun, Justin Kh Tse Jan 2021

'Fraught' Chineseness: 'Chinese Christians' In The Vancouver Sun, Justin Kh Tse

Research Collection School of Social Sciences

This chapter explores the ways in which Douglas Todd, a journalist for the Vancouver Sun, has covered stories about Chinese churches in Vancouver, BC, for over three decades. It shows how Todd has focused on Chinese Christians as a way to offer a particular perspective on religion and cultural diversity in Vancouver, and as a window into their relationship with the civil society. Ultimately, this chapter highlights the ways in which Todd essentializes “Chineseness” and reinforces a problematic public narrative of homogeneity among Vancouver’s Chinese Christians.

High-Intensity Monsoon Rainfall Variability And Its Attributes: A Case Study For Upper Ganges Catchment In The Indian Himalaya During 1901-2013, Alok Bhardwaj, Robert J. Wasson, Winston T. L. Chow, Alan D. Ziegler Jan 2021

High-intensity monsoon rainfall in the Indian Himalaya generates multiple environmental hazards. This study examines the variability in long-term trends (1901–2013) in the intensity and frequency of high-intensity monsoon rainfall events of varying depths (high, very high and extreme) in the Upper Ganges Catchment in the Indian Himalaya. Using trend analysis on the Indian Meteorological Department (IMD) rainfall dataset, we find statistically significant positive trends in all categories of monsoon rainfall intensity and frequency over the 113-year period. The majority of the trends for both intensity and frequency are spatially located in the Higher Himalayan region encompassing upstream sections of the …

Public Health Insurance And Pharmaceutical Innovation: Evidence From China, Xuan Zhang, Huihua Nie Jan 2021

Public Health Insurance And Pharmaceutical Innovation: Evidence From China, Xuan Zhang, Huihua Nie

Research Collection School Of Economics

Developing countries are characterized by low levels of pharmaceutical innovation. A likely reason is their small market size, which is not because of the population size but because of low levels of income and lack of health insurance coverage. This study exploits a natural experiment from the implementation of a public health insurance program for rural residents in China (New Cooperative Medical Scheme [NCMS]) to examine whether the pharmaceutical industry increases innovation regarding diseases covered by the NCMS that are prevalent in rural areas. We examine the 1993–2009 patent data to gauge pharmaceutical innovation in China. Diseases with a 10% …
