Welfare reforms in the 1990s have shifted governments around the world towards financial assistance conditional on work. While large-scale rigorous research on welfare-to-work programs has demonstrated effectiveness towards employment in other countries, no such micro-level evaluation of a policy has ever been conducted in Singapore. This article describes the process of developing a large experimental evaluation of the Work Support Program, which the Ministry of Community Development, Youth and Sports started in 2006. The lessons learned from planning and implementing the research can be helpful to future researchers in negotiating long-term rigorous evaluations in an environment where collaborators lack sufficient …

Opportunity Lost? Revisiting Recordtv V Mediacorp Tv, Warren B. Chik, Cheng Lim Saw

Research Collection Yong Pung How School Of Law

Taking the Singapore Court of Appeal’s Decision in RecordTV Pte Ltd v MediaCorp TV Singapore Pte Ltd [2011] 1 SLR 830, this article seeks to argue that the copyright fair dealing defence would have been the more appropriate basis to exempt RecordTV, a digital recording service for recording television programmes, from primary copyright liability. This judicial approach towards legalising digital video recorder (“DVR”) services is more suitable taking into consideration the following: The role and objectives of copyright law in Singapore; the history and development of the fair dealing defence (including the latest amendments pursuant to the US-Singapore Free Trade …

Further, Hong Kong telecommunication company, PCCW Ltd has also offered a business trust via a stapled security structure in November 2011. Dissertations and Theses Collection (Open Access)

This paper surveys the recent literature on inflation forecasting and conducts an extensive empirical analysis on forecasting inflation in Singapore, Japan, South Korea and Hong Kong paying particular attention to whether the inflation-markup theory can help to forecast inflation. We first review the relative performance of different predictors in forecasting h-quarter ahead inflation using single equations. These models include the autoregressive model and bivariate Philips curve models. The predictors are selected from business activity, financial activity, trade activity, labour market, interest rate market, money market, exchange rate market and global commodity market variables. The Politics Of Human Development In India And China: It Pays To Invest In Women And Children, Devin K. Joshi

Research Collection School of Social Sciences

This article explores the attainments of China and India on measures of basic human development as ingredients of a long-term economic development strategy. It proposes that major differences in ideology and state capacity explain in part why India has fallen behind China. The analysis suggests that these relatively hidden political factors play an important role in transforming and advancing human development not only within India and China but also in other developing and emerging economies. The findings also support the notion that public investments in the capabilities of women and children have significant social and economic payoffs in both the …

Research Collection Yong Pung How School Of Law

This article examines the legal framework governing economic relations between the United States and the Association of Southeast Asian Nations (ASEAN) and outlines a roadmap for a US-ASEAN Free Trade Agreement (FTA). Notwithstanding ASEAN’s emerging centrality in Asian regionalism, America remains the only Pacific power that has not concluded any form of FTA with ASEAN.This article explains that limited progress in Washington’s efforts stemmed from the domestic politics of the US Trade and Investment Framework Agreement (TIFA) approach and the Myanmar dilemma. It further analyses the challenges that the Trans-Pacific Partnership (TPP) Agreement negotiations have encountered and contends that the …

Preface, Nirmalya Kumar

Research Collection Lee Kong Chian School Of Business

As late as 2001, Indian outward investment was less than US $1 billion. Instead, India, like all developing countries, was actively courting foreign investment into the country. By 2006, India had reached the tipping point. For the first time, Indian outward investment of US $10 billion had outstripped foreign investment into India. The spending spree continued unabated in 2007. Indian companies arranged or concluded US $21 billion in 40 foreign investment deals in January and February of 2007 alone. Moreover, Indian foreign investment in the financial year closing 31 March 2007 exceeded the cumulative total foreign investment by Indian companies …

The recent increase in bilateral investment treaties and free trade agreements entered into by Asian states has exposed them to increased commitments to foreign investors and the risk of investor-state arbitration. The rise in such arbitrations elsewhere has led to a considerable body of arbitral case law. This article examines the trend of such increased exposure of Asian states, salient issues that have emerged in arbitration case law and lessons for Asian treaty-makers and their legal advisors.

Singapore: Transitioning To A "New Normal" In A Post-Lee Kuan Yew Era, Eugene K. B. Tan

Research Collection Yong Pung How School Of Law

Politics in Singapore is generally marked by incremental change. When Singapore eventually becomes a two-party or multi-party democracy, the 2011 general election is likely to be regarded as the starting point of the epochal political transition. It was a boisterous year politically where political excitement and consciousness went up several notches due to the 7 May general elections and the 27 August presidential elections, both of which produced keenly contested hustings and outcomes. The aftermath of the general elections also saw the retirement of former Prime Ministers Lee Kuan Yew and Goh Chok Tong from the Cabinet.

At the end of 2011, the Singapore High Court in Re David Joseph QC [2011] SGHC 262 (per VK Rajah JA) permitted the admission of an English Queen’s Counsel, David Joseph QC, to represent eight entities of the Astro Group, a Malaysian broadcasting and media entity, in proceedings arising from an arbitration with three subsidiaries of Indonesia’s Lippo Group. Japan’S Love For Derivative Actions: Irrational Behaviour And Non-Economic Motives As Rational Explanations For Shareholder Litigation, Dan W. Puchniak, Masafumi Nakahigashi

Research Collection Yong Pung How School Of Law

Not long ago, there was a consensus in the legal academy that the Japanese were irrational litigants. As the theory went, Japanese people would forgo litigating for financial gain because of a cultural obsession with maintaining social harmony. Based on this theory, it made perfect (but economically irrational) sense that Japanese shareholders let their U.S.-transplanted derivative action lay moribund for almost four post-war decades, while at the same time the derivative action was a staple of shareholder litigation in the United States. The 1980s brought a wave of law and economics to the scholarship of Japanese law, which largely discredited the …

The Derivative Action In Asia: A Complex Reality, Dan W. Puchniak Jan 2012

The Derivative Action In Asia: A Complex Reality, Dan W. Puchniak

Research Collection Yong Pung How School Of Law

This Article uses the derivative action in Asia as a lens for re-evaluating the foundational theories of Asian and comparative corporate law. It begins by demonstrating that the cultural theory of “Asian non-litigiousness” provides scant explanatory or predictive value for either the evolution or function of the derivative action in Asia’s leading economies. As such, this Article suggests that the theory of Asian non-litigiousness should be relegated to the dustbin of academic history. Without the black box of Asian culture to erroneously explain away potential differences between “Asian” and “Western” derivative actions, the reality of the derivative action in Asia’s …

This paper focuses on the pivotal role played by the state in refashioning the Chinatown landscape as part of both nation-building and heritage tourism projects, and the ensuing cultural politics. After a brief history of the creation of Singapore’s Chinatown, the paper discusses, first, Chinatown’s place in Singapore’s post-independence nation-building project and, second, the reconfiguration of the Chinatown landscape as a tourism asset. The final section reflects on the changing politics of place as Chinatown gains legitimacy in state discourses on heritage, tourism and multiculturalism, as well as in the popular imagination as an ethnic precinct par excellence.

This study focuses on the uses of Twitter during the elections, examining whether the messages posted online are reflective of the climate of public opinion. Using Twitter data obtained during the official campaign period of the 2011 Singapore General Election, we test the predictive power of tweets in forecasting the election results. In line with some previous studies, we find that during the elections the Twitter sphere represents a rich source of data for gauging public opinion and that the frequency of tweets mentioning names of political parties, political candidates and contested constituencies could be used to make predictions about …

Beneath And Beyond The Chinese Miracle, Singapore Management University Dec 2011

Beneath And Beyond The Chinese Miracle, Singapore Management University

Perspectives@SMU

China’s rapid economic progress from an impoverished communist state to the world’s second largest economy within just three decades has enthralled many economists. That the country shifted from the classical centrally-planned command economy to one espousing free market practices while maintaining communist rule, has all given rise to this question: What exactly is the China model? Is it the hybrid of innovative state ownership and tight political control? Or is the rapid growth the result of liberal economic and political reforms?
