Offences Against Foreign Domestic Workers In Singapore: Vindicating The Victim’S Right To Dignity, Benjamin Joshua Ong
Offences Against Foreign Domestic Workers In Singapore: Vindicating The Victim’S Right To Dignity, Benjamin Joshua Ong
Research Collection Yong Pung How School Of Law
The High Court of Singapore recently increased the sentences of two employers who had starved their foreign domestic worker, causing serious physical injury. In so doing, the court affirmed the victim’s right to human dignity despite the relative leniency of the charge. This case prompts reflection not only on the vulnerability of foreign domestic workers and the courts’ role in protecting their basic dignity, but also on the prosecutors’ role in framing charges that accurately and completely reflect the infringement of rights.

Banko: Reshaping The Philippines Rural Banking System, Peter Williamson, Havovi Joshi
Asian Management Insights
In 2009, eight out of ten Filipinos did not have access to a bank. A few informal moneylenders provided about 40 percent of small-scale business lending in the market, at interest rates that could touch around 240 percent per annum. Additionally, the population living in 40 percent of the Philippines’ municipalities did not have easy access to a physical bank branch. It was then that the Ayala Group, the oldest business house and one of the largest conglomerates in the country, identified and explored an opportunity to develop a business model capable of meeting the needs of the unbanked in …

Heineken's Acquisition Of Asia Pacific Breweries: Accounting For Business Combinations And Ownership Interests, Pearl Hock Neo Tan, Chu Yeong Lim
Research Collection School Of Accountancy
On July 20, 2012, Heineken, a Dutch brewery offered S$5.125 billion (Singapore dollars; approximately US$4.1 billion) to buy Asia Pacific Breweries Ltd (APB; formerly, Malayan Breweries Limited) from its Singapore-based joint venture partner, Fraser and Neave, Limited. (F&N). At that point, Heineken and F&N had joint control over APB through the joint venture vehicle Asia Pacific Investments Pte Ltd (APIPL). Brewery business under the joint arrangement had moved on quite predictably from the time APB was formed in 1931. However, the calm changed to high drama when Thai Beverage, owned by one of Thailand's tycoons, made a bid for F&N …
A Wide Anticommunist Arc: Britain, Asean, And Nixon's Triangular Diplomacy, Wen-Qing Ngoei
A Wide Anticommunist Arc: Britain, Asean, And Nixon's Triangular Diplomacy, Wen-Qing Ngoei
Research Collection School of Social Sciences
President Richard Nixon’s triangular diplomacy succeeded because a “wide anticommunist arc” of U.S. allies in Southeast Asia had confined the influence of both China and the USSR to the Indochinese states. Beijing and Moscow welcomed détente with Washington in order to accommodate to de facto U.S. hegemony in the region.

Towards New Weather And Climate Baselines For Assessing Weather And Climate Extremes, Impacts, And Risks, Fiona Williamson, Rob Allan, Roseanne D'Arrigo
Research Collection College of Integrative Studies
Initiatives to recover (sourcing, imaging, digitizing) historic datasets for generating more accurate longterm climate models have only gained momentum over the last decade, despite a long precedent of compelling arguments as to the value of historic weather observations (Le Roy Ladurie, 1972; Lamb, 1977). Although such work is relatively well established in Europe, the United States, China, and Japan; Southeast Asia currently has a dearth of data rescue initiatives with a long historical focus. The reasons behind this include a perception of the paucity of surviving data; the scattered nature of data due to shifts between colonial rule and independence …

The Evolution Of Singapore Citizenship, Tan K. B. Eugene
The Evolution Of Singapore Citizenship, Tan K. B. Eugene
Research Collection Yong Pung How School Of Law
In a commentary, SMU Associate Professor of Law Eugene Tan noted that Singaporeans must continue to embrace citizenship as not just a bundle of rights and privileges but to embrace it as an overarching civic identity that unites Singaporeans regardless of their backgrounds. It is this sense of unity that will make citizenship more than a legal status but a powerful unifying force in a turbulent world marked by identity politics. He also believed that allowing dual citizenship should be a matter of last resort. Even then, the legalisation of dual citizenship should only occur when Singapore is confident that …

Doctor's Duty Of Disclosure And The Singapore Court Of Appeal Decision In Hii Chii Kok: Montgomery Transformed, Kee Yang Low
Research Collection Yong Pung How School Of Law
The subject of a doctor’s duty of care to his patient, especially as regards the giving of advice, is a controversial one. In recent times, the courts and the medical professions in several jurisdictions have given their varying responses. In the Hii Chii Kok case, the Singapore Court of Appeal was faced with the difficult challenge of whether to and, if so, how to change the law. The judgment is as complex as it is important.

Urban Rail Transit Ppps: Lessons From East Asian Cities, Zheng Chang, Sock Yong Phang
Research Collection School Of Economics
Private sector participation in urban rail transit has proliferated in the past two decades. The large metropolises of East Asia have had decades of experience with private sector participation in the provision of heavy metro services. The design of these public–private partnerships (PPP) are varied. The diverse experiences of Tokyo, Hong Kong, Singapore and Beijing contain valuable lessons for other cities. Using a case study approach, this paper discusses three features of urban rail transitdevelopments in the context of East Asian cities, viz., farebox recovery, land value capture mechanisms, and vertical structure of the industry. Super vertical integration between rail …

Diebold-Yilmaz spilloverindexes are computed for weekly return volatilities based on daily benchmarkstock indexes of US, UK and ten Asian countries. We found (i) the strengthening ofoverall volatility spillovers is not a temporary surge but persisted after thecrisis; (ii) the susceptibility ofindividual Asian stock markets to inward volatility transfers is linked to itsdegree of openness; and (iii) the Asian bourses are becoming more importantemitters of financial shocks since the crisis. Rolling regressions on volatilitylinkages reveal the relative dominance of the US over the Japanese and Chinesebourses, and the level of influence on Asian stock markets from the Chinesebourse has risen to …

The Singapore government increasingly conducts a wide-rangingvariety of community engagement, which involve some degree ofpublic participation in government decision-making. These range fromOur Singapore Conversation, a wide-ranging discussion of whatSingaporeans want for their future, to the Colour Your Busescampaign in which citizens could vote on whether public buses shouldbe red or green. While these engagement processes typically informand consult, or occasionally involve deliberation and co-creation, theyrarely — if ever — empower citizens to make consequential decisionsin the manner of Archon Fung and Erik Olin Wright’s concept ofEmpowered Participatory Governance (2003).

The Rcep And Its Investment Rules: Learning From Past Chinese Ftas, Heng Wang
Research Collection Yong Pung How School Of Law
China’s free trade agreements (FTAs) reveal malleability as the most striking feature. The paper analyzes the following questions: what is the trend of China’s fta approach to investment concerning malleability? Is China a rule follower, shaker or maker? How may China approach the Regional Comprehensive Economic Partnership (RCEP) regarding investment? It argues first that the malleability will probably expand from investment protection to investment liberalization. China converges with deep ftas regarding investment protection and may incrementally move to investment liberalization. Second, increased malleability of China’s ftas exists in regulatory autonomy and investor-state dispute settlement. Third, China is likely to be …

Board Independence As A Panacea To Tunneling? An Empirical Study Of Related Party Transactions In Hong Kong And Singapore, Christopher C. H. Chen, Wai Yee Wan, Wei Zhang
Research Collection Yong Pung How School Of Law
This article examines the effect of imposing higher board independence requirements on private benefit extraction by corporate management or controlling shareholders in Hong Kong and Singapore. This article shows that higher board independence negatively correlates with fewer related-party transactions (RPT), though in a nonlinear relationship with the marginal effect of higher board independence diminished. However, we find no clear causal effect of Hong Kong's imposition of a minimum board independence threshold in 2012 on reducing tunneling. Our data also show that higher concentration of ownership might not be associated with more tunneling by RPTs. Overall, this research lends support to …

Lord Denning’S Influence On Contract Formation In Singapore: An Overdue Demise?, Chia Ming Lee, Kenny Chng
Research Collection Yong Pung How School Of Law
In a series of inconsistent decisions by the Singapore courts on contract formation in continuing negotiations cases, Lord Denning’s broad approach—which does away with the traditional offer and acceptance analysis—appears to have been simultaneously adopted and rejected. This article suggests that the continued uncertainty in Singapore regarding the scope of application of the traditional approach and Lord Denning’s approach arises from a conflation of both as being substantially similar. This article further argues that both approaches are conceptually and practically distinct. A better way forward for Singapore law in the area of contract formation in continuing negotiations cases, having regard …

He believed that “confidence-building and trust are needed to ensure Singapore and Singaporeans build its stock of adequate social capital and resilience to withstand threats to its social fabric.” Associate Prof Tan noted that it is important that top-down and bottom-up approaches be taken to ensure continuous dialogue and engagement in order to promote such trust. “The role of civil society is crucial. Civil society can be meaningfully inducted to enhance a society's capacity to …

A number of developments in the luxury market have been attributed to the arrival of luxury products in Asian markets. The modernisation of Japan some decades back paved the way for a growing trend towards imbibing western lifestyles in Asia. Japan’s economic success after the Second World War was a key factor responsible for the introduction of luxury marketing in Asia. In the 1970’s, Japanese tourist-shoppers became a noticeable phenomenon in Europe. The European luxury houses were quick to recognise the opportunity and began setting up branches and luxury outlets in Japan. The Japanese were not only the driving force …
