There were over 40 torts cases in 2019, of which just over half involved the tort of negligence. Unlike previous years, this year's review will deal only with the ten most significant judgments. A full list of torts cases is included at the end of this chapter for the convenience of readers. Of the ten cases, not surprisingly, five of them are claims in negligence. Of these, three involve medical negligence and two involve negligent misrepresentation causing economic loss. The remaining cases relate to claims under the tort of conspiracy, defamation, fraud (or deceit), malicious falsehood as well as nuisance …

Singapore As A Centre For International Commercial Litigation: Party Autonomy To The Fore, Adeline Chong, Man Yip

This article considers two recent developments in Singapore private international law: the establishment of the Singapore International Commercial Court and the enactment of the Hague Convention on Choice of Court Agreements 2005 into Singapore law. These two developments are part of Singapore’s strategy to promote itself as an international dispute resolution hub and are underscored by giving an enhanced role to party autonomy. This article examines the impact of these two developments on the traditional rules of private international law and whether they achieve the stated aim of positioning Singapore as a major player in the international litigation arena.

The year 2018 produced only a handful of cases on the law of unjust enrichment and restitution. However, two are seminal cases and of note to the entire common law world: Ochroid Trading Ltd v Chua Siok Lui1 (“Ochroid”) and Turf Club Auto Emporium Pte Ltd v Yeo Boong Hua2 (“Turf Club”). Ochroid dealt with the hotly debated topic of the illegality defence against a claim in unjust enrichment for the recovery of money paid pursuant to an illegal contract. “The Singapore Court of Appeal has recently affirmed the significance of giving effect to party autonomy in the enforcement of choice of court agreements under the common law in three important decisions handed down in quick succession, on different aspects of the matter: the legal effect of exclusive choice of court agreements, the interpretation and effect of non-exclusive choice of court agreements, and the effect of exclusive choice of court agreements on anti-suit injunctions.

Legal Area Classification: A Comparative Study Of Text Classifiers On Singapore Supreme Court Judgments, Jerrold Soh, How Khang Lim, Ian Ernst Chai

This paper conducts a comparative study on the performance of various machine learning(“ML”) approaches for classifying judgments into legal areas. Using a novel dataset of 6,227 Singapore Supreme Court judgments, we investigate how state-of-the-art NLP methods compare against traditional statistical models when applied to a legal corpus that comprised few but lengthy documents. All approaches tested, including topic model, word embedding, and language model-based classifiers, performed well with as little as a few hundred judgments. However, more work needs to be done to optimize state-of-the-art methods for the legal domain.

Current scholarship emphasises the correlation between enforcement of corporate and securities laws and strong capital markets. Yet, the issue of how private and public enforcement may achieve the objectives of compensation and optimal deterrence remains controversial. While enforcement strategies have been studied extensively in the US and the UK, comparatively less attention is placed on Asia, where concentrated shareholdings are the norm. Intellectual property rules have played an increasingly important role in international trade. Due to the problem in multilateral negotiations, free trade agreements (FTAs) of the US and EU may profoundly shape the future of world intellectual property law. The article analyses the following questions: what are the Chinese, US and EU approach to intellectual property under FTAs? Will China develop its own FTA model on intellectual property? Underneath the veneer of a homogenous state-approved Thai ethnicity,Thailand is home to a heterogeneous population. Only about one-thirdof Thailand’s inhabitants speak the national language as their mothertongue; multiple alternate ethnolinguistic groups comprise the remainderof the population, with the Lao in the northeast, often called Isan people,being the largest at 28 percent of the population. Expert commentary today typically focuses on the agendas and actions of the two big powers, the United States and China, which misses the bigger picture. During the Cold War, leaders of ASEAN (Association of Southeast Asian Nations) played a critical role in containing Chinese influence, shaping the terms of Sino-U.S. competition and rapprochement, and deepening the U.S. presence in Southeast Asia. The legacy of ASEAN’s foreign relations during and since the Cold War militates against the popular notion that Chinese hegemony in Asia is inevitable.

Scholars have argued that transitions to more sustainable and just mobilities require moving beyond technocentrism to rethink the very meaning of mobility in cities, communities, and societies. This paper demonstrates that such rethinking is inherently political. In particular, we focus on recent theorisations of commoning practices that have gained traction in geographic literatures. Drawing on our global comparative research of low‐carbon mobility transitions, we argue that critical mobilities scholars can rethink and expand the understanding of mobility through engagement with commons–enclosure thinking. The juxtaposition of a young city-state showing relative maturity as a rapidly aging society suffuses the population aging narrative in Singapore and places the “little red dot” on the spotlight of international aging. Singapore Management University’s (SMU) Li Ka Shing Library was renovated in 2014. During the renovation, the Investment Studio was created within the library to house high-end financial databases such as Bloomberg and Thomson Reuters (now Refinitiv). Usage of the space was assessed using quantitative and qualitative data, comparing the first academic terms across two academic years, 2017 and 2018. The data provided evidence to support anecdotal evidence and library staff’s knowledge and observation. The assessment resulted recommendations for further action. It also provided opportunity to engage with users and stakeholders of this unique space.

In this Cities viewpoint forum, we argue that there is a need to rethink U.S./U.K.-centric approaches to the urban university in policy and practice. The Singapore Management University undertook the second wave of the Public Cleanliness Satisfaction Survey (PCSS) with over 2000 Singapore resident respondents.
The 2018 wave of the PCSS continued to reflect the overall satisfaction with public cleanliness in Singapore. There was a slight increase in the proportion of Singaporeans satisfied with the overall cleanliness of public areas which they had recently used (82% in 2017 vs. 84% in 2018).
Significantly more Singaporeans are satisfied with the cleanliness of spaces after public events (63% in 2017 vs. 74% in 2018).
Satisfaction with the cleanliness of food outlets is still the lowest among …

In a commentary, SMU Associate Professor of Law Eugene Tan shared his views on the proposed Protection from Online Falsehoods and Manipulation Bill (POFMB). The study estimates the extent of spillover effects that India's real per capita gross domestic product (GDP) growth rate has on the growth rates of other countries in the South Asian Association for Regional Cooperation (SAARC) region for the period 2003–2016. It also identifies whether the conventional trade channel is the means through which growth is transmitted from India to her neighboring countries. Using a random effects model, we conclude that on average, a 1 percentage point increase in India's real per capita GDP growth rate results in 0.46 percentage point increase in the per capita GDP growth rates of …

We utilize data from the Singapore Life Panel© survey to empirically investigate the impact of housing equity on consumption of elderly households. Based on panel analysis, we find housing equity value has no significant impact on non-durable consumption for elderly people. The conclusion holds for a battery of robustness check. Moreover, heterogeneity analyses based on subsamples by age of household head, house type, and number of property possessed also show no significant impact of housing equity on consumption in general. Finally, we use scenario analysis to study the Lease Buyback Scheme (LBS), a novel housing equity monetization scheme which allows …

Political containers frame opinions. They play a formative role in establishing the terms ofinterpretation, in distinguishing between assent and dissent, and in determining the extent towhich dissent is publicly tolerated. Whilst it is by now widely acknowledged that the powerand influence of political containers has been relativised by interconnection, the effects ofmoving within and between containers – and thus mediating between different framings ofopinion – is undertheorised. How can ethnic tourism alleviate rural poverty? Due to the difficulty of simultaneously expanding tourism while promoting pro-poor tourism, most villages traverse one of two developmental pathways: 1) ensuring an inclusive structure before expanding, or 2) expanding before building an inclusive structure. This study compares four comparable cases in Southwestern China to understand the politics behind the decision to choose different pathways, and the impact each pathways has on local residents. This research article explores a text analyticsapproach to assess the prominence of corporate social responsibility in 554Singapore-listed firms through a content analysis of the news. Instead ofrelying on publications by the firms, third-party news coverage is used toreduce potential biases due to over-reporting. A dataset of news articles onthe included firms published during fiscal years 2015 and 2016 is crawled, andthe articles’ content is parsed to search for information related to corporatesocial responsibility. Despite being a small country-state, electricity consumption in Singa-pore is said to be non-homogeneous, as exploratory data analysis showed that the distributions of electricity consumption differ across and within administrative boundaries and dwelling types. Local indicators of spatial association (LISA) were calculated for public housing postal codes using June 2016 data to discover local clusters of households based on electricity consumption patterns. The Economic Governance Index (EGI) is a tool that has become widely accepted by governments to understand economic growth, attract investors, and engage in public-private sector dialogue. EGIs have been used in Indonesia, Sri Lanka, Bangladesh, Kosovo, El Salvador, Cambodia, Mongolia, and Vietnam to offer crucial insight into governance and help guide reform efforts.
