Treatment Of Different Non-State Actors In Detention: A Legal, Moral, And National Security Analysis, Alison P. Raedel

This thesis analyzes state behavior regarding the treatment of non-state actors through three major frameworks: international law, ethical theory, and national security. Two cases are compared: the treatment of al-Qaeda detainees by the United States after the attacks of September 11th, 2001, and the treatment of the Angolan liberation movements by the Portuguese during the Angolan War of Independence. These cases were chosen to assess how the three frameworks apply across different non-state actors, which include terrorist organizations and liberation movements. International law provides a baseline for rights and protections, but it is often selectively interpreted. Just war theory gives …

Splitting Shores: Comparative Analysis Of Italy’S And Spain’S Reactions To Immigration, William E. Montgomery V

International and Global Studies Undergraduate Honors Theses

The divergence in public immigration sentiment between Italy and Spain, two countries with striking historical, geographic, and demographic similarities, is seen as a mystery for popular theoretical frameworks. Although both nations transitioned from net emigration to net immigration beginning in the 1970s and 1980s, Italy has consistently exhibited more negative attitudes toward immigration relative to the European average, while Spain has seen sustained improvement in immigration sentiment despite receiving immigrants at historically unprecedented levels. Employing a Most Similar Systems Design and drawing on quantitative demographic and survey data, primary legislative texts, and secondary scholarly literature, this thesis tests Group Threat …

This reflection explores the crane-and-nopal motif in Talavera Poblana ceramics as a lens for understanding artisan knowledge, cultural identity, and the impacts of globalization on Indigenous communities. Through my own painting of a Talavera-style vase, I trace the layered colonial history embedded in this motif — including the quiet resistance of Indigenous artisans who encoded Aztec memory into colonial art forms by replacing the eagle with the crane. The reflection examines how globalization threatens artisan traditions through fast-fashion appropriation, the limitations of Mexico's 2022 cultural heritage protection law, and the displacement of Indigenous artisans in Mexico City. Immigration and Human Rights Law Review

Gender-based violence (“GBV”) remains a pervasive human rights issue throughout Botswana. When it comes to gender equality, Botswana’s dual constitutional and customary legal system is a paradox. Despite its commitment to equality and nondiscrimination, Botswana’s Constitution allows customary courts to discriminate freely to preserve traditional practices that disadvantage women. These traditional practices affect women’s right to property, inheritance, marriage, legal representation, and personal safety. Customary law continues to constrain women’s right to economic autonomy and access to justice, leaving many women dependent on the men who abuse them. In many university campuses in Nigeria, undergraduates living with disability are visible and functionally involved in academic, political, social, and religious activities. However, the social life of these students is hardly the focus of scholarly research. Therefore, this study explored dating behaviours among undergraduates of selected public universities in south-western Nigeria living with disability. The social disability model was employed as the conceptual framework. According to virtue jurisprudence, good laws can be conducive to virtuous living; poor laws can contribute to character vices and entrench prejudices. This article focuses on what lies beyond the strict categorization of virtue and vice simpliciter—the ethos and mindset of a people. Using a case study of Singapore, this article examines how law, conceived of in the broadest sense as including policies chosen in a legal regime that leaves the concretization of policies to government bodies, can diminish the capacity and desire of individuals to live examined lives in pursuit of eudaimonia or flourishing. The courts occasionally claim that the limits to the power to prosecute are different from the limits to other executive powers. They say that prosecutorial decisions are subject to judicial review on a reduced set of grounds compared to other executive decisions. I have previously argued that this approach is wrong, and aim to elaborate on the argument in this blog post. The focus will be on the laws of the UK and of Singapore, but it is hoped that the reflections here will be of some use in other common-law jurisdictions as well.

This study analyzes the construction of Russian cultural diplomacy in news media coverage of art exhibitions. Russia-Indonesia: Within the Framework of Art. The research uses the method Critical Discourse Analysis with Norman Fairclough's model and concept soft power Joseph Nye and the skeleton Taxonomy of Soft Power from Ohnesorge to map actor relations in cultural diplomacy practices.
