Treatment Of Multi-Courts Jurisdiction Agreements, Seow Hon Tan

Research Collection Yong Pung How School Of Law

An increasingly popular manner of drafting jurisdiction clauses in cross-border contracts involves the selection of the courts of more than one jurisdiction. Traditionally, parties would submit all disputes to the courts of a particular country under an exclusive jurisdiction agreement or agree that the transaction is subject to a particular jurisdiction without intending to create an obligation to proceed there and nowhere else. Of late, the Singapore courts have encountered litigation over multi-courts jurisdiction agreements. A common form involves the naming of a particular court with one of the parties being given the option to proceed anywhere else.

This paper examines the roles played by employees of the Dutch United East India Company (VOC) in late seventeenth and in eighteenth century Ayutthaya Society. The Dutch were in Siam primarily to trade, but they were also given formal standing in court society by the Siamese. The head of the Dutch community in Ayutthaya, a European merchant with Siamese rank and title, therefore had social functions to attend within the pluralistic society of the Siamese capital, both at court and outside the court. This study examined whether early movers and technology leaders attained superior performance in emerging economic regions. We assessed the determinants and performance consequences of two key aspects of entry strategy, resource commitment to technology transfer and timing of entry, using survey data from over 220 Sino-Japanese joint ventures (JVs) in China. Both high commitment and early entry had positive impacts on the perceived economic performance of the JVs. Yet these relationships were found to be significantly contingent on several internal and external factors, such as the strategic importance of an investment, parental control of a JV, and the availability of …

In this paper, we use the case of Chinese religion in Singapore to examine the relationships between religion and modernity, and between social processes, on the one hand, and spatial conceptions, forms and structures and temporal practices, on the other. Specifically, we look at how traditional Chinese rituals are being modified, reinterpreted and invented to fit with modern living. Such ritual transformations entail reconstructed notions of space and time. Through such transformations, modernity does not simply lead to the demise of religious beliefs and practices but allows for a continued role for religion in providing a meaning system for Chinese …

The purpose of this article is to study the adaptation of the Tai- Lao people's traditional beliefs to Buddhism. The study is based on 5 important Lan Xang literary works, namely Khun Bourom , Thao Ba Jueng , Phaya Khankhak , Khu Lu- Nang Oua and Pha Daeng - Nang Ai. The result of the study reveals that these works are traditionally oral tales of the Tai-Laos people, which were composed in written form only after the reign of King Vixul of the Lan Xang Kingdom ( A.D.1500- 1520). Religious contacts between Sri Lanka and Thailand began during the pre-colonial period in the late thirteenth century up until the colonial period in the nineteenth and the early twentieth centuries as each country conducted its relationship with the other on a reciprocal basis . Sri Lanka, as the first giver of Theravada Buddhism to Thailand, had a cultural influence on Thailand in terms of Buddhism. However, Thailand was able to harmoniously integrate Sri Lanka's influences with traditional Thai culture.
