Although most of Southeast Asia is home to religions and cultures carrying significant Indic influence, Vietnam alone is the mainland’s only Sinicised culture. Chinese emperors directly ruled northern Vietnam for most of the period spanning 111 BCE to 938 CE. The next eight hundred years saw a series of independent Vietnamese kingdoms administered by Chinese-style mandarins gradually extend control over and supplant the Indic Champa civilisation to the south—even as French incursions began chipping away at Vietnamese territory as early as 1858.

The authors of the handbook conclude that efforts to address poverty, inequality and unmet social needs in Singapore would be greatly enhanced by: (a) the development of locally relevant and nuanced monetary and non-monetary measures of poverty that are made publicly available; and (b) more sharing of disaggregated data from government studies and surveys. These steps would enable academics, VWOs and the public at large become more aware of the issues related to poverty and inequality in Singapore, and be placed in a better position to weigh in on debates and solutions.

This paper presents a concise overview of Japan’s economic development since World War II, with a particular emphasis on the speculative boom of the 1980s known as the “bubble economy” and the subsequent period of economic stagnation known as the “Lost Decade.” The essay is largely descriptive. It provides an historical contextualization and interdisciplinary synthesis accessible to readers from a wide range of backgrounds, including those with limited formal expertise in economics.

This occasional paper has three essays written by professors from Pace University and Nanjing Normal University that address a host of structural challenges facing China and India in pursuit of sustainable development in the early twenty-first century. Pan Zhen gives a critical overview of China’s economic policies, and finds the top-down development model to be fraught with tensions. Joseph Tse-Hei Lee argues that the ability of China to pursue sustainable growth and social betterment is largely contingent upon many circumstantial factors, especially the negative attributes of globalization and the rise of domestic discontents. The ninja is a well known phenomenon in Japanese military culture. The popularity of the tradition is centered on the neighboring areas of Iga and Kōka where ninja are a profitable tourist attraction. This paper examines the historical sources on which the ninja tradition is based to see if the pre-eminence claimed by Iga and Kōka is justified. It is shown that they were no different from several other places in their geography or their politics and that only one reliable account of secret warfare can be identified before 1581, the year when Iga Province ceased to exist as an …

She Who Laughs Loudest: A Meditation On Zen Humor, Andrew Whitehead

Articulating a Zen Buddhist perspective on humor, this paper examines the Japanese Zen Buddhist response of humor in the face of the suffering of situated existence and the motivations for this response. The examination will take the school of Rinzai Zen Buddhism as its exemplar. I argue that in order to appreciate the function of humor in Zen a number of cultural and historical influences must be considered: correlative ontology; the Buddhist notion of emptiness; the impotence of language; sense and nonsense; and the senselessness of transgression.

Japan’s food self-sufficiency ratio is remarkably low compared to other industrialized nations. Growing world population, food, water, and energy shortages in combination with climate change and the rising competition for the world’s limited resources are the transnational dimensions of food and nutrition security related risks that are already affecting Japan. This paper analyzes the development and institutional context of Japanese policies related to its food security, particularly in relation to its commitments to support developing countries and to promote food security in Africa. Based on estensive Fieldwork, this paper explores the needs of people and communities in hard hit areas of Japan's 3.11 triple disasters including Sendai, Fukushima, Ishinomaki, Kesennuma, Kamaishi, and Yoriage to commemorate the event and their dead, while redirecting efforts to the future. It discusses the activities of Sendai's Wasuren! (We Won't Forget!) Center to document the disaster and Project Fukushima! organized by Fukushima residents to consider the city's future after the nuclear disaster as well as examining memorials (as memoryscapes and mourning work) created by other communities in the region where the disaster occurred. Following Donald Richie’s observation that the “Japanese film is richest in mood or atmosphere, in presenting characters in their own surroundings,” I introduce undergraduate students to the cinematic art of Akira Kurosawa and Hayao Miyazaki emphasizing each director’s use of mise-en-scène or the way in which the elements of the scene are arranged. For the purposes of the two courses (ASIA 4490/FILM 3220 and HONORS 4490: The Films of Kurosawa and Miyazaki), mise-en-scene was used strictly in reference “to the elements within a scene” or sequence of scenes “which places greater emphasis on pictorial values within a shot” or sequence …

Decentralized disaster governance has been gaining much attention with the rising global urbanization rate and the complex nature of the disasters occurring in densely urbanized areas today. This paper studies the case of South Korea, a highly urbanized country with relatively recent decentralization reforms, in order to analyze the evolution of its disaster management system and to draw out implications from its experience. Specifically, it traces the national-level institutional changes in its disaster management, and then closely examines a hydrofluoric gas leakage in the industrial city of Gumi. New forms of communication technology often pose challenges to the copyright regime and have necessitated the rewriting of the scope of the exclusive rights and exceptions by the legislature, and, in some cases, by the courts in common law countries (as well as the Court of Justice of the European Union). These issues have arisen in different categories of digital technology, albeit with the same objective of streamlining and simplifying the delivery of copyright works to consumers. This 111-page judgement has highlighted a number of significant points of law relating to the treatment of Facebook postings, emails and SMS texts in the tort of defamation. They relate primarily to the legal requirements of establishing defamatory meaning, reference to the plaintiff and defences. In addition, the case examines the awards of general and special damages as well as the viability of awarding aggravated damages to corporate plaintiffs. Apart from the plaintiff’s actions in defamation and malicious falsehood, the defendant successfully counterclaimed for copyright infringement but failed in the action based on passing off. The article examines the liberalization of trade in legal services in the Association of the Southeast Asian Nations (ASEAN) and its reform prospects to meet the challenges of multi-jurisdictional practice. It argues that while the ten-country bloc pledges to progressively liberalize the legal sector, ASEAN commitments under free trade agreements (FTAs) constitute merely ‘paper commitments’. To achieve the goal of the ASEAN Economic Community to form a single market and production base, a feasible, incremental roadmap is imperative to integrate the legal services market. We present an in-depth case study of GVK Emergency Management and Research Institute, an Indian public–private partnership (PPP), which successfully brought emergency medical response to remote and urban settings. Drawing insights from the case, we investigate how the organization established itself through institutional entrepreneurship using a process conceptualized as opportunity framing, entrenchment, and propagation. The case and context highlight the need for innovation in organizational design and governance modes to create a new opportunity that connects state actors, private healthcare providers, and the public at large. On The Effectiveness Of Housing Purchase Restriction Policy In China: A Difference In Difference Approach, Jerry X. Cao, Bihong Huang, Rose Neng Lai

The Chinese government imposed the purchase restriction policy to rein in the housing bubble in 2010. Using a two-stage difference-in-difference approach and a comprehensive dataset covering the real estate markets across 70 cities, we find that the policy triggered substantial decline in the property price and transaction volume. Cities having higher reliance on real estate sector for fiscal revenue and economic growth experienced greater decline in housing prices following the policy implementation. However, the policy had no measurable effects on the nationwide construction boom, hinting the ineffectiveness of the policy to correct the housing bubble.

The Changing And Unchanged Nature Of Inequality And Seniority In Japan, Ken Yamada, Daiji Kawaguchi

Wage inequality declined in the 1990s, while it increased in the 2000s for full-time male workers in Japan. We find that a decreased return to firm-specific human capital, which has been neglected in previous empirical analyses of inequality, is a key factor preventing a rise in wage inequality during the prolonged period of economic stagnation, known as Japan’s lost decades. We also find that, while changes in returns to general and specific human capital contributed to narrowing wage inequality in the 1990s and widening wage inequality in the 2000s, a significant fraction of the increase in wage inequality in the …

This article surveys the use of foreign precedents in constitutional adjudication by the Supreme Court of Singapore for over a half century during the terms of the first three Chief Justices—Wee Chong Jin (1963–1990), Yong Pung How (1990–2006), and Chan Sek Keong (2006–2012)—and the first year in office of the fourth Chief Justice, Sundaresh Menon (2012–2013). It concludes that while judges have always cited foreign case law, they have only actually applied foreign cases where the wording of the Constitution and the constitutional arrangements in Singapore are fairly analogous to the constitutional texts and arrangements upon which the cases were …

The so-called infrastructure of the private law of these jurisdictions is rooted in theRoman-Germanic basis, which adopts dichotomous system in respect of that area of privatelaw dealing with property: the law of property and that of obligation. This Article examines the evolution of international law as a professional and intellectual discipline in the Republic of China (ROC), which has governed Mainland China (1912–1949) and post-1949 Taiwan. The ROC’s centennial development fundamentally shaped modern China’s course of foreign relations and postwar global governance. The Article argues that statism, pragmatism, and idealism define the major features of the ROC’s approach to international law. These characteristics transformed the law of nations into universally valid normative claims and prompted modern China’s intellectual focus on the civilized nation concept. As Ming Wan writes in his commentary in The Asan Forum on the “China Dream,” Chinese leaders use New Year’s celebrations as an opportunity to sum up the achievements of the recent past and to chart new directions for the future. Here, I discuss such New Year’s activity to argue that soft power works in interesting and unexpected ways in China. Joseph Nye famously defines soft power as “the ability to get what you want through attraction rather than coercion or payments.” Soft power, thus, is framed as a positive attractive force that is useful for a state’s foreign policy. …
