This Review examines the influence of foreign legal actors on jurisdictions that are not their own. Rachel Stern, a scholar of China, reflects on this point in her groundbreaking book published in 2013. In her penultimate chapter, Stern discusses how such foreign legal actors wield influence in China because of their presence on the ground. Building off of Stern's research, this Review proceeds to ask whether foreign legal actors can influence a domestic environment when that environment prohibits them from permanently working there. Militancy inspired by Islamists is escalating globally, and government action is necessary to protect vulnerable populations. Security professionals generally agree that governance may complement the use of force to defeat militants; however, current doctrine does not address the concurrent integration of governance in a comprehensive strategy. This interpretive case study explored Pakistan's application of governance during the 2009 Khyber operation in Swat Valley, code-named Operation Rah-e-Rast. The central research question focused on how governance activities were integrated with military operations to subdue militancy. South Asian same-sex attracted women in the United States experience discrimination and marginalization that puts them at an increased risk for mental health issues. Research shows their rates of counseling and psychotherapy use are low due to perceptions of stigma, lack of knowledge, and concerns about culturally insensitive treatment plans. Mental health providers lack the literature needed to inform culturally sensitive treatment plans to address these concerning gaps in services, and an extensive literature review found no studies on the lived experiences of this population. Although Filipinos are becoming one of the largest Asian groups in the U.S there is limited research regarding mental health challenges Filipino women experience specifically regarding body satisfaction and self-image. The goal of this explorative qualitative study was to explore the relationship between objectified images of women in the media and the reported levels of body dissatisfaction in a sample of 8 American-born Filipino women and 8 Philippine-born Filipino women. In 2012, Singapore amended its Misuse of Drugs to give courts hearing capital drug trafficking cases the discretion to replace the default death penalty with life imprisonment and caning, provided that the accused person can show that he was merely a drug courier and the prosecution certifies that he had substantively assisted the authorities in disrupting drug trafficking activities. Debates over the Fukushima Daiichi Nuclear Disaster pointed to a set of institutional and organizational failures in Japan’s nuclear regulation as a primary cause of the disaster. While the Japanese government has implemented reforms to strengthen nuclear regulation, I argue that these reforms have largely left out the education system as a key institution that produces and distributes expertise necessary for nuclear regulation. First, the Japanese education system has traditionally produced only a small number of experts in the fields related to nuclear regulation, aligned top-ranked experts with the pro-nuclear government, and weakened the civil society’s capacity to mobilize counter-experts. …

Public Vs. Private Schooling As A Route To Universal Basic Education: A Comparison Of China And India, William C. Smith, Devin K. Joshi

This article examines whether focusing primarily on public schooling can lead to more rapid achievement of universal basic education (UBE) than relying on a mixture of public and private schooling. Through a structured, focused comparison, we find China's greater emphasis on public schooling has contributed to higher enrollment, attendance, graduation rates, gender parity, and proportion of students entering higher education than India, the country with the world's largest private sector in primary and secondary education. This comparison suggests that greater emphasis on public schooling in developing countries may lead to more rapid UBE attainment than encouraging privatization.

This article is the first empirical study investigating the corporate reorganisation of Chinese domestically-listed companies. Through examining these cases, it challenges the assertion made by most of these corporate reorganisation plans and by Chinese state-run media reports that creditors and general public shareholders were the major beneficiaries. Through an analysis of the data generated from all forth-three such cases, this articles reveals that: First, unsecured creditors could have, on average, received 61.37% more of their claims if the fundamental value distribution principle, the absolute priority norm, could have been complied with in these reorganisations; Second, if the general-public-shareholder-protection scheme issued …

Court Alternative Dispute Resolution (“ADR”) has its origins in a 1994 pilot project in the Subordinate Courts (as it was known then) to have selected District Judges assist in resolving civil disputes using ADR processes. Within two decades, Court ADR has been extended to the entire gamut of cases filed in court, including civil claims, minor criminal offences and family disputes. This paper explains the reason why the hitherto statist country, Korea, has carried out significant decentralization since the 2000s. In explaining the motivation for decentralization, extant literature has focused on the role of parties, bureaucratic politics, democratization, or territorial interests. Yet there is still limited explanation of how the decentralization laws in Korea could be successfully passed in the 2000s, while cental stakeholders still persisted. What role have foreign financial institutions (FFIs) played in China’s financial evolution since the early 1990s? My research finds that FFIs, which include foreign commercial and investment banks, as well as private equity (PE) firms, have played a role in China’s financial evolution in three respects. First, US financial institutions have leveraged their influence in the US government, their ties to other business groups, and mobilized connections with the Chinese elite, to help China to join the World Trade Organization in 2001. This paper explores the contrast of China’s spectacular economic development and the low scores of trust for the Chinese Communist Party’s (CCP) legitimacy among the Chinese people. The sharp contrast may reflect flaws in the shaping of de facto authority of the Chinese government. The de facto authority is examined in connection to the notion of the Mandate of Heaven from the Confucian tradition. In this working paper, I argue that disaster management in high Qing period can be better understood by simultaneously considering the historiographies of how governing elites understood disasters at the metaphysical level and the administration of disaster relief. During High Qing late imperial China, the regime encountered rapid changes in population, economy, and environment. Through a study of China’s wind turbine sector, this paper demonstrates how China liberally implements industrial policies and then removes them when the WTO disputes them. China’s convenient compliance with the WTO rulings reflects Beijing’s realpolitik navigation through the organization’s dispute-resolution process, rather than socialization to international norms.

Objective: We examine the association between poverty, economic inequality, and health among elderly in Myanmar. Method: We analyze 2012 data from Myanmar’s first representative survey of older adults to investigate how health indicators vary across wealth quintiles as measured by household possessions and housing quality. Results: Poverty and poor health are pervasive. Self-assessed health, sensory impairment, and functional limitation consistently improve with higher wealth levels regardless of socio-demographic controls. Differentials in self-rated health and sensory impairment between the bottom and second quintiles are clearly evident, suggesting that relative economic inequality matters even among very poor elders and that a small …

A State-Stewardship View On Executive Compensation, Hao Liang, Luc Renneboog, Sunny Li Sun

We take a state-stewardship view on corporate governance and executive compensation in economies with strong political involvement, where state-appointed managers act as responsible ‘stewards’ rather than ‘agents’ of the state. We test this view on China and find that Chinese managers are remunerated not for maximizing equity value but for increasing the value of state-owned assets. Managerial compensation depends on political connections and prestige, and on the firms’ contribution to political goals. These effects were attenuated since the market-oriented governance reform. In a social welfare perspective, such compensation stimulates not the maximization of shareholder value but the preservation of the …
