"A landowner free to develop his land as he wishes before the imposition of public controls, finds himself prohibited fromdoing so as a consequence of the controls. The title to his ownership of an estate or interest in the land is not disturbed orcalled into question in any fundamental way—he owns what he had previously … Nevertheless, the powers of ownershipare not what they were in all their fullness. He cannot legally do now what before he was at law and at liberty to do. Hisrights have been curtailed. He has lost something. What is it?"

The Impact Of Human Trafficking In Asean: Singapore As A Case-Study, Jaya Anil Kumar Jan 2018

The Impact Of Human Trafficking In Asean: Singapore As A Case-Study, Jaya Anil Kumar

Research Collection Yong Pung How School Of Law

Southeast Asia remains a notorious hotbed for human trafficking. The seriousness of the problem has led to the emergence of various initiatives to combat human trafficking. This paper seeks to address why human trafficking in Southeast Asia remains a contentious issue despite the various initiatives put in place for its eradication. ASEAN Member States, including Singapore, can only resolve the current inertia when it comes to combatting trafficking-in-persons (TIP) by adopting a multidimensional, and multistakeholder approach to the problem. Within Singapore, it is recommended that the Prevention of Human Trafficking Act should be amended such that it provides greater protection …

An Assessment Of The Chafta And Its Implications: A Work-In-Progress Type Fta With Selective Innovations, Heng Wang Jan 2018

An Assessment Of The Chafta And Its Implications: A Work-In-Progress Type Fta With Selective Innovations, Heng Wang

Research Collection Yong Pung How School Of Law

This chapter explores two questions of the recent China-Australia FTA (ChAFTA): what is the approach of the ChAFTA? What are the challenges to the ChAFTA? It argues first that the ChAFTA adopts a problem-solving approach to harvest “low-hanging fruit” (e.g. tariff cuts). Containing WTO-based and WTO-friendly rules, it focuses on trade and investment facilitation through market liberalization and carefully written good governance norms. In spite of its short form investment chapter, the agreement is not as shallow as one may first think. It stimulates development concerning, among other things, regulatory issues (e.g. regulatory transparency and cooperation in financial services, regulatory …

Peace In Abstract: Re-Integration Of Internally Displaced Persons In Northeastern Nigeria And Its Emerging Socio-Economic Challenges, Abiola Ruth Adimula

Asian Review

This study examines the challenges associated with the re-integration of internally displaced people in Boko Haram insurgency-ravaged Northeast Nigeria. It traces the root cause of socio-political and ethno-religious conflicts in Nigeria to 1914, when the British colonial administration merged the incompatible Protectorate of Northern Nigeria and the Colony and Protectorate of Southern Nigeria as one entity. After the return to democracy in 1999, the country witnessed growing insecurity, culminating in the growth of ethno-religious militias and separatist groups, including the dreaded Boko Haram terrorist sect, whose activities led to the deaths of many and the displacement of about two million …

From “Burmese Brides” To Burmese Wives : Analyzing Transnational Marriages Of Women From Myanmar To Chinese Men Along The Myanmar-Yunnan Frontier, Xuanyi Luo

Chulalongkorn University Theses and Dissertations (Chula ETD)

Since around 2000, there has a growth of Myanmar women who have married men in Yunnan, China. Media reports from China, Myanmar and the West typically call these women "Burmese brides" and link them to human trafficking, fake marriages, HIV-AIDS, among other issues. This gives the public a negative impression of these women, and views them as mostly vulnerable victims caught in a faceless transnational marriage process. This thesis seeks to correct this limited view and provide a fuller picture of these women and to stress the role of their choice or "agency" in forming their transnational marriages beyond the …

Major themes in these studies include the identification of the Chinese migrants (who they were or where they had come from), various Chinese associations, big families of Chinese entrepreneurs and etc. On the contrary, the study …

The Effect Of Tranforming From A Colony To A Nation-State On Chinese Diaspora Identity In Southeast Asia : Case Study Of The Chinese Emigration From The Malay Peninsula, 1945-1979, Huiwen Xue

Chulalongkorn University Theses and Dissertations (Chula ETD)

During the period between 1945 and 1979, the Malay Peninsula was under a chaotic and turbulent social situation. Decolonization, ideological confrontation, and ethnic conflict all happened in this period. This research adopts the documentary research method to analyze how the turbulent social situation affected Chinese society in Malaya/Malaysia and how the problems that the ethnic Chinese of the Malay Peninsula faced affected the Chinese emigration from the Malay Peninsula. During the anti-colonial period, part of the ethnic Chinese of Malaya identified with China and sympathized with the Chinese Communist Party. Hence, China was the most important destination for them. Afterward, …

The Adaption Of Phở In Vietnam After 1986, Kunyarat Saengul

Chulalongkorn University Theses and Dissertations (Chula ETD)

Phở is known as a national dish of Vietnam. It is originated in the north of Vietnam as a labour food. With its popularity, phở spread all over the country adapted to ingredients and way of cooking in each place. After the socio-economic reform (Đổi Mới) in 1986, Vietnam's economy was shifted from centrally planned to market-based. As a result, there are changes in the growth of 3 groups of people; the middle-income class, the overseas Vietnamese, and the rural-urban migrants and low-income class in urban Vietnam. Meanwhile, the reform encouraged the growth of tourism in which pho has been …

Chulalongkorn University Theses and Dissertations (Chula ETD)

This study attempts to explore the development of tea planting and producing, and tea culture tourism in Mae Salong in Thailand and Thai Nguyen in Vietnam. The findings reveal that tea planting in Mae Salong is derived from KMT villagers in northern Thailand who initially planted tea for livelihood, later developed as a cash crop for substituting opium and reducing soil erosion under the cooperation between the Royal Project and Taiwanese organizations. Nowadays, tea in Mae Salong is selected as "OTOP" and marketed as tourism resources to attract tourists. The tea culture tours in Mae Salong are usually organized with …

The Doctrine Of Severability In Constitutional Review: A Perspective From Singapore, Benjamin Joshua Ong Jan 2018

The Doctrine Of Severability In Constitutional Review: A Perspective From Singapore, Benjamin Joshua Ong

Research Collection Yong Pung How School Of Law

The Singapore Court of Appeal’s decision in Prabagaran a/l Srivijayan v Public Prosecutor represents a substantial development in Singapore’s law on the doctrine of severability in constitutional review. An examination of Prabagaran reveals rich theoretical underpinnings relating to the nature of legislative intent. The case rightly locates the crux of the severability inquiry in secondary legislative intention, i.e. the legislature’s intention, at the time a statute was enacted, as to what should happen in the event that part of the statute is later held to be unconstitutional. This approach is preferable to the approach of asking whether excision of unconstitutional …

China’S Rise: How It Took On The U.S. At The Wto, Greg Shaffer, Henry S. Gao Jan 2018

China’S Rise: How It Took On The U.S. At The Wto, Greg Shaffer, Henry S. Gao

Research Collection Yong Pung How School Of Law

This Article builds from original fieldwork to show what lies behind China’s remarkably successful use of international trade law to take on the United States and Europe. The World Trade Organization (“WTO”) is unique in China’s international relations as it is the only forum where China, with its anti-legalist traditions, has resolved its disputes through law and the use of third-party dispute settlement. After China acceded to the WTO in 2001, it invested massively in building trade law capacity to transform itself and defend itself externally. Through these investments and its increased market power, China became a serious rival to …

China's "Mercantilist" Government Subsidies, The Cost Of Debt And Firm Performance, Chu Yeong Lim, Jiwei Wang, Cheng (Colin) Zeng Jan 2018

China's "Mercantilist" Government Subsidies, The Cost Of Debt And Firm Performance, Chu Yeong Lim, Jiwei Wang, Cheng (Colin) Zeng

Research Collection School Of Accountancy

China has been adopting a “mercantilist” policy by lavishing massive government subsidies on Chinese firms. Using hand-collected subsidy data on Chinese listed companies, we find that firms receiving more subsidies tend to have a lower cost of debt. However, such firms fail to have superior financial performance. Instead, firms with more subsidies tend to be overstaffed, which demonstrates higher social performance. These results are mainly driven by non-tax-based subsidies rather than tax-based subsidies. Overall, our results suggest that the Chinese government uses non-tax-based subsidies to achieve its social policy objectives at the expense of firms’ profitability.

Regulating Squeeze-Out Techniques By Controlling Shareholders: The Divergence Between Hong Kong And Singapore, Christopher C. H. Chen, Wei Zhang, Wai Yee Wan Jan 2018

Regulating Squeeze-Out Techniques By Controlling Shareholders: The Divergence Between Hong Kong And Singapore, Christopher C. H. Chen, Wei Zhang, Wai Yee Wan

Research Collection Yong Pung How School Of Law

Squeeze-out transactions are controversial as the controlling shareholders may expropriate the minorities’ shareholdings at unattractive prices. Existing scholarship has focused on the optimal approach towards regulating such transactions in the US and the UK, which have widely dispersed public shareholdings, but little attention is placed on jurisdictions with concentrated shareholdings, which may necessitate a different approach given that the prospects of expropriation are very high. This article fills the gap by examining Hong Kong and Singapore, which have concentrated shareholdings. Notwithstanding the fact that they have adapted their corporate and securities laws from the UK, Hong Kong ultimately provides greater …

The Emergence Of Global Regulatory Coherence: A Thorny Embrace For China?, Han-Wei Liu, Ching-Fu Lin Jan 2018

The Emergence Of Global Regulatory Coherence: A Thorny Embrace For China?, Han-Wei Liu, Ching-Fu Lin

Research Collection Yong Pung How School Of Law

The last two decades have witnessed various governance initiatives across institutions, domestic and international, in response to mushrooming regulatory trade barriers. Among the efforts to balance regulatory autonomy and international cooperation, “regulatory coherence” or “good regulatory practices” seems a promising solution that centers upon bottom-up domestic regulatory rationalization. While existing literature has documented how recent mega-regional trade blocs seek to harness regulatory barriers through mechanisms of international cooperation, it has arguably overlooked certain crucial issues. In particular, how has regulatory coherence emerged as a new global norm vis-à-vis the default international economic and legal order? What are the limits to …

Singapore Approach To Develop And Regulate Fintech, Sai Fan Pei Jan 2018

Singapore Approach To Develop And Regulate Fintech, Sai Fan Pei

This paper starts with a brief introduction of the recent organizational support established by The Monetary Authority of Singapore (MAS) to promote the fast developing FinTech (financial technology) sector. Basing on its existing “balanced” approach in promoting financial development and ensuring a safe and sound financial sector, and in sync with its objective to harness technology to improve the efficiency of the financial markets, the paper elaborates on the insights of MAS' policy intent in regulating the FinTech sector. The paper then focuses on MAS' proposed “Regulatory Sandbox” – an innovative regulatory framework which helps to strike a good balance …

The Impact Of The Cost Of Car Ownership On House Price Gradient In Singapore, Naqun Huang, Jing Li, Amanda Ross Jan 2018

The Impact Of The Cost Of Car Ownership On House Price Gradient In Singapore, Naqun Huang, Jing Li, Amanda Ross

Research Collection School Of Economics

This paper examines the extent to which a change in the cost of car ownership affects the house price gradient with respect to distance from the central business district (CBD). Theory suggests that if the cost of car ownership increases, then people will shift towards other modes of transportation, thus reducing house prices farther away from the CBD. However, the cost of car ownership is likely to be endogenous and correlated with various unobserved factors that also contribute to a change in the house price gradient. To obtain causal effects, we exploit a unique feature of Singapore’s car registration process. …

Contributors Of Singaporean Youths' Wellbeing: Life Goals, Family-Community-Nation Capitals, Opportunity And Social Mobility, Kong Weng Ho Jan 2018

Contributors Of Singaporean Youths' Wellbeing: Life Goals, Family-Community-Nation Capitals, Opportunity And Social Mobility, Kong Weng Ho

Research Collection School Of Economics

Life goals induce one’s current investment and set one’s expectations of future outcomes, affecting one’s current state of subjective wellbeing. Using National Youth Survey (NYS) 2016, which has a representative sample of Singaporean youths, we find that non-zero-sum life goals such as family-oriented life goals and altruism-oriented life goals enhance happiness and life satisfaction of Singaporean youths while career-oriented life goals, zero-sum in nature, reduce subjective wellbeing. Apart from personal motivations or life aspirations, perceived social mobility (in terms of career opportunity and meritocracy) matters positively in the subjective wellbeing of both youths in school and in the workforce. Family …

The Indigenization Of Crisis Response Strategies In The Context Of China, Augustine Pang, Yang Hu Jan 2018

The Indigenization Of Crisis Response Strategies In The Context Of China, Augustine Pang, Yang Hu

Research Collection Lee Kong Chian School Of Business

Crisis communication, which has been dominated by a practical perspective, has become a nexus where theory meets application. Despite mounting interest in theoretical studies, crisis communication lacks cultural contextualization. Asian communication researchers have advocated for the need to indigenize communication, drawing relevance to cultural influences. In this study, the authors explored indigenous corporate crisis response strategies in the context of China through nine cases. Three Chinese indigenous strategies were identified through qualitative content analysis of corporate crisis responses. These strategies are “barnacle,” “third-party endorsement,” and “setting up new topics.” The differences with Western frameworks were also discussed.

The Effect Of Localized Density On Housing Prices In Singapore, Eric Fesselmeyer, Kiat Ying Sky Seah, Jonathan Ci Yi Kwok Jan 2018

The Effect Of Localized Density On Housing Prices In Singapore, Eric Fesselmeyer, Kiat Ying Sky Seah, Jonathan Ci Yi Kwok

Research Collection College of Integrative Studies

This paper measures how localized residential density impacts housing prices in Singapore. Using exogenous variation in residential density, we find that an increase in density causes non-trivial decreases in property values: a 10% increase in density decreases price per square foot by between 1.3% and 2%. To the best of our knowledge, ours is the first paper to measure this effect.Further, we find that the negative effect of density is biggest in magnitude for low density apartment projects and the magnitude is decreasing in the density of the project, and that the negative effect of density is increasing in magnitude …

Japan's Employment 'Catch-22': The Impact Of Working Conditions For Women In Japan On Japan's Demographic Population Crisis, Mary Perkins

Master's Theses

This thesis examines Japan’s aging population crisis and gender inequalities in the workplace. This topic presents an interesting and challenging phenomenon for Japan, as Japan’s economy and technology have developed more rapidly than almost any other country, establishing Japan as one of the Group of Seven industrialized nations. Yet Japan still significantly lags behind other industrialized nations when it comes to women’s rights and opportunities for advancement in the workplace. This is in turn hampering efforts for Japan to address a population crisis, with an older population growth rate far outpacing the growth of demographic groups that would support the …

A Way Of Reflecting On Identity: The Five Stories Of The Conflicting Relationships In Nepal, Tomoki Yamanaka Dec 2017

A Way Of Reflecting On Identity: The Five Stories Of The Conflicting Relationships In Nepal, Tomoki Yamanaka

Capstone Collection

Conflict studies show that the components of identity are interrelated to sources and dynamics of conflict in intricate ways. This study self-reflectively explores a way of reflecting on identity from the links between conflict and identity through a qualitative study of the five stories of the conflicting relationships in Nepal. By analyzing the stories collected through in-depth interviews with Nepali peace workers, an element of power in group differences was noted. This illustrated the challenge of having the voices of those being marginalized heard amongst conflicting issues around them. Those that were interviewed also struggled with the challenge of having …
