Arbitration clauses in consumer contracts have been subject to controversy in many jurisdictions; recent U.S. and Canadian Supreme Court case law have been used as examples. European Union (E.U.) law, which originally excluded arbitration in general from the Brussels/Rome regimes, has recently taken a mixed, and to some extent limited, approach by including Alternative Dispute Resolution (ADR) entities “imposing” a solution in its recent ADR Directive 2013/11. There seems to be an indirect encouragement to develop consumer arbitration schemes in E.U. Member States as a second route to justice. The Case For The International Governance Of Immigration, Javier S. Hidalgo

Jepson School of Leadership Studies articles, book chapters and other publications

States have rights to unilaterally determine their own immigration policies under international law and few international institutions regulate states’ decision-making about immigration. As a result, states have extensive discretion over immigration policy. In this paper, I argue that states should join international migration institutions that would constrain their discretion over immigration. Immigration restrictions are morally risky. When states restrict immigration, they risk unjustly harming foreigners and restricting their freedom. Furthermore, biases and epistemic defects pervasively influence states’ decision-making about immigration policy. States should transfer some of their decision-making authority over immigration to more reliable institutions in order to mitigate the …

One reason that attracts international student-athletes to American universities could be the interest in earning high quality education with the possibility of playing high performance sports. However, when compared to other international students, differences are seen: Other foreign students who look for a degree in the US desire not only an international education, but also potentially staying in the country. The University of San Francisco, where a cosmopolitan city meets education, fits it best. At USF, 82 countries are represented, reaching a number of 1708 students. This thesis examines the German civil-military relationship and the challenges the country is facing amidst modernizing reforms to the German armed forces.
