China's Contradictory Grand Strategy Manifestations: Examining The Rare Earths Export Restrictions And The One Belt, One Road Initiative, Lukas K. Danner Jun 2016

China's Contradictory Grand Strategy Manifestations: Examining The Rare Earths Export Restrictions And The One Belt, One Road Initiative, Lukas K. Danner

Dr. Lukas K. Danner

In the past few years, China has exhibited a rising assertiveness in international relations, including trade, although its official grand strategy remains "Peaceful Development." Examples of this contradictory trajectory are China's rare earth elements export restrictions (assertive) and the One Belt, One Road initiative (peaceful). This article seeks to establish, on the one hand, whether or not these examples are conforming to or diverging from "Peaceful Development," and therefore actually a manifestation of the alleged rising assertiveness on China's part, and on the other hand, identify the reason why China is acting ambivalently. To accomplish this, this article gives historical-cultural …

Policy Change And Coups: The Role Of Income Inequality And Asset Specificity, Taeko Hiroi, Sawa Omori Dec 2014

Policy Change And Coups: The Role Of Income Inequality And Asset Specificity, Taeko Hiroi, Sawa Omori

Taeko Hiroi

Building on the models developed by Boix, Acemoglu, and Robinson on the relationship between economic structures and regime change, we develop a theory that emphasizes structural characteristics of societies and the effects of policy change in such circumstances. We posit that significant policy change in an unequal or asset-specific society induces coups against the incumbent political leader by the losing faction of the elites seeking to prevent or cut losses associated with the policy shifts. Our empirical analysis indicates that the risk of a coup rises considerably during a period of a significant policy change in a society with a …

Syllabus Inr 3061 (U01): Conflict, Security, And Peace In International Relations (Fall 2015), Lukas K. Danner

Dr. Lukas K. Danner

War and peace are two intermittent outcomes of the continuous and dynamic nature of social interactions in world politics. In turn, these social events are connected by social conflicts that may, or may not degenerate into a crisis situation and war. Thus, this course will explore the genesis of social conflicts, their possible resolution, or their ultimate degeneration into crisis and war. Since the conflict-crisis-war cycle is born out and nurtured during times of “peace,” we will focus on that tract of time in order to understand the nature of social conflicts, the evolution into crisis, and the conditions for …

National Contexts Matter: The Co-Evolution Of Sustainability Standards In Global Value Chains, Stephan Manning, Frank Boons, Oliver Von Hagen, Juliane Reinecke Mar 2013

National Contexts Matter: The Co-Evolution Of Sustainability Standards In Global Value Chains, Stephan Manning, Frank Boons, Oliver Von Hagen, Juliane Reinecke

Stephan Manning

In this paper, we investigate the role of key industry and other stakeholders and their embeddedness in particular national contexts in driving the proliferation and co-evolution of sustainability standards, based on the case of the global coffee industry. We find that institutional conditions and market opportunity structures in consuming countries have been important sources of standards variation, for example in the cases of Fairtrade, UTZ Certified and the Common Code for the Coffee Community (4C). In turn, supplier structures in producing countries as well as their linkages with traders and buyers targeting particular consuming countries have been key mechanisms of …

Los Acuerdos De Libre Comercio Norte-Sur Desde La Perspectiva Del Análisis Económico Del Derecho De Los Contratos, Iván A. Rojas V, José Manuel Alvarez

Challenges Of The Cooperative Movement In Addressing Issues Of Human Security In The Context Of A Neoliberal World: The Case Of Argentina, Stefan Ivanovski Mar 2012

Challenges Of The Cooperative Movement In Addressing Issues Of Human Security In The Context Of A Neoliberal World: The Case Of Argentina, Stefan Ivanovski

Stefan Ivanovski

The response of some Argentine workers to the 2001 crisis of neoliberalism gave rise to a movement of worker-recovered enterprises (empresas recuperadas por sus trabajadores or ERTs). The ERTs have emerged as former employees took over the control of generally fraudulently bankrupt factories and enterprises. The analysis of the ERT movement within the neoliberal global capitalist order will draw from William Robinson’s (2004) neo-Gramscian concept of hegemony. The theoretical framework of neo-Gramscian hegemony will be used in exposing the contradictions of capitalism on the global, national, organizational and individual scales and the effects they have on the ERT movement. The …

You Say You Want A (Nonviolent) Revolution, Well Then What? Translating Western Thought, Strategic Ideological Cooptation, And Institution Building For Freedom For Governments Emerging Out Of Peaceful Chaos, Donald J. Kochan Mar 2012

You Say You Want A (Nonviolent) Revolution, Well Then What? Translating Western Thought, Strategic Ideological Cooptation, And Institution Building For Freedom For Governments Emerging Out Of Peaceful Chaos, Donald J. Kochan

Donald J. Kochan

With nonviolent revolution in particular, displaced governments leave a power and governance vacuum waiting to be filled. Such vacuums are particularly susceptible to what this Article will call “strategic ideological cooptation.” Following the regime disruption, peaceful chaos transitions into a period in which it is necessary to structure and order the emergent governance scheme. That period in which the new government scheme emerges is particularly fraught with danger when growing from peaceful chaos because nonviolent revolutions tend to be decentralized, unorganized, unsophisticated, and particularly vulnerable to cooptation. Any external power wishing to influence events in societies emerging out of peaceful …

Legal Mechanization Of Corporate Social Responsibility Through Alien Tort Statute Litigation: A Response To Professor Branson With Some Supplemental Thoughts, Donald J. Kochan Jul 2011

Legal Mechanization Of Corporate Social Responsibility Through Alien Tort Statute Litigation: A Response To Professor Branson With Some Supplemental Thoughts, Donald J. Kochan

Donald J. Kochan

This Response argues that as ATS jurisprudence “matures” or becomes more sophisticated, the legitimate limits of the law regress. The further expansion within the corporate defendant pool – attempting to pin liability on parent, great grandparent corporations and up to the top – raises the stakes and complexity of ATS litigation. The corporate social responsibility discussion raises three principal issues about how a moral corporation lives its life: how a corporation chooses its self-interest versus the interests of others, when and how it should help others if control decisions may harm the shareholder owners, and how far the corporation must …

Avanzando En La Integración De América Latina: Elementos Jurídico - Económicos Para La Construcción De Una Propuesta En Materia De Convergencia, Iván A. Rojas V

Economic Size And The Changing International Political Economy Of Trade: The Development Of Western Hemispheric Ftas, Gaspare M. Genna Nov 2010

Economic Size And The Changing International Political Economy Of Trade: The Development Of Western Hemispheric Ftas, Gaspare M. Genna

Gaspare M Genna

Why are some free trade agreements (FTAs) in the western hemisphere successfully negotiated and implemented while others seem to stagnate during negotiations? FTAs are more likely to develop when there is an asymmetrical power relationship and potential partners are satisfied with projected trade patterns. The European Union (EU) and United States have been successful in negotiating agreements with the Caribbean and Central American (CCA) countries. However, current bilateral and multilateral trade talks between the EU, the Common Market of the South (MERCOSUR), and United States are at a standstill. Although all four sets of trade negotiations include dissatisfactory conditions for …

Is The European Union Ready For Fdi From Emerging Markets?, Judith Clifton, Daniel Díaz-Fuentes Dec 2009

Is The European Union Ready For Fdi From Emerging Markets?, Judith Clifton, Daniel Díaz-Fuentes

Judith Clifton

This chapter asks whether the European Union Member States are ready for inward Foreign Direct Investment from the Emerging Markets. It concludes that European Union Member States have relatively open Foreign Direct Investment regimes in the international context, and yet instances of protectionism have been apparent in the recent period. However, protectionism has occurred both vis-a-vis Foreign Direct Investment from the Global South as well as from within the European Union, particularly in the so-called 'strategic' industries.

The Political Economy Of The Production Of Customary International Law: The Role Of Non-Governmental Organizations, Donald J. Kochan Dec 2003

The Political Economy Of The Production Of Customary International Law: The Role Of Non-Governmental Organizations, Donald J. Kochan

Donald J. Kochan

Increasingly, United States courts are recognizing various treaties, as well as declarations, proclamations, conventions, resolutions, programmes, protocols, and similar forms of inter- or multi-national “legislation” as evidence of a body of “customary international law” enforceable in domestic courts, particularly in the area of tort liability. These “legislative” documents, which this Article refers to as customary international law outputs, are seen by some courts as evidence of jus cogens norms that bind not only nations and state actors, but also private individuals. The most obvious evidence of this trend is in the proliferation of lawsuits against corporations with ties to the …
