It is quite common to make the argument that a stable liberal democracy requires high levels of compliance with the law. Scholars disagree, however, how such reliable and widespread compliance can be achieved. Roughly, liberals have traditionally emphasized the importance of arriving at compliance by way of autonomous and critical reasoning, whereas others (communitarians and republicans chiefly) argue that autonomous motives are notoriously weak and can, therefore, not by themselves bring about a high enough rate of compliance. In Divergent Paths: The Academy and the Judiciary, Judge Richard Posner proposes a partnership between the federal judiciary and law schools.1 He provides a sweeping critique of the federal judiciary and suggests ways in which law schools can address these failings. His critiques fall under the headings of structural deformations (e.g., method of appointment, lifetime tenure), process deficiencies, (e.g., legal formalism in judicial opinion writing, lack of curiosity), and management deficiencies (e.g., poor staff management, lack of collegiality). Popularitas Mobile Instant Messaging (MIM) terus naik, termasuk dalam organisasi. Penelitian ini bertujuan untuk melihat faktor psikologis Penggunaan MIM dalam komunikasi informal organisasi menggunakan Theory of Reasoned Action (TRA). Menggunakan pendekatan kuantitatif dan metode survei, data dikumpulkan melalui kuesioner, kemudian dianalisis dengan Partial Least Square (PLS). Hasil penelitian dengan 89 responden dari Inspektorat Utama BPK RI, menunjukkan bahwa TRA tidak sepenuhnya terterapkan pada Penggunaan MIM dalam komunikasi organisasi. Berbeda dengan variabel sikap yang berpengaruh signifikan, variabel norma subjektif tidak berpengaruh signifikan terhadap intensi maupun perilaku.

This is a study of ambiguities and tensions that occur within the role of the bilingual/bicultural researcher in an ethnographic study. This manuscript presents an analysis of three instances from two interviews in a study on the acculturation of deaf students in deaf kindergarten classrooms in Japan and the US. This is an auto-ethnographic analysis of conflicts found in fluctuating between multiple roles: research assistant, interpreter, cultural mediator, and sociolinguistic consultant. In these examples my bicultural knowledge allowed me to identify “hidden” meanings overlooked by other members of the research team. However, my interpreter role at times made it awkward …

Preferred Leadership Communication Styles Across Cultures, Joy J. Cherfan

This thesis reports the results of a two-part study investigating preferred leadership communication styles across multiple cultural clusters. Utilizing a survey, part one identified the three most preferred leader communication styles (i.e., dominant, dramatic, contentious, attentive, animated, open, friendly, relaxed, impression leaving) in six cultural clusters. Using focus group data, the second part provides insight into subordinates’ perceptions of how these communication styles are enacted by leaders in each cluster. Guidelines on how to better communicate are offered to expatriates in hopes of helping them more successfully complete overseas tasks. Such guidelines are needed due to the high percentage of …

This article examines the oral communication training that took place in Eloqi, a virtual language-learning community. Eloqi (a pseudonym) was a for-profit start-up that built and operated a proprietary Web-based, voice-enabled platform connecting English-language learners in China with trainers in the United States. While it existed, Eloqi’s unique platform was used to deliver short, one-on-one lessons designed to improve students’ oral English communication skills. Using the ethnography of communication and speech codes theory, a theoretical–methodological approach, the author presents an analysis of the speech code, or code of communicative conduct, employed at Eloqi. This present case study explores how language styles and power distance led to miscommunication between an administrator and student via computer mediated communication. Email exchanges were examined using textual analysis between an administrator and an undergraduate student. Results indicate high-context and low-context communication and power distance roles led to problematic actions and decisions. Furthermore, divergent speech with regard to communication styles was an additional problematic. Implications of the results specific examples of how this interaction could have been prevented were discussed.
