In 1907, Rabindranath Tagore delivered a lecture on world literature to an audience in Calcutta, the then capital of British India. Amid powerful and intersecting forces—colonialism and nationalism, industrial modernity and mass poverty—Tagore’s position on literature was neither disengaged nor defensive, insofar as he related it to the human condition and the capacity for world-making. Far from staking a representational claim to world literature on behalf of Indian or Bengali literature, I argue in this article, Tagore reconceptualized the idea from its earlier canonical formulation by Goethe. It is widely assumed that Karl Marx and Friedrich Engels regarded world literature as an epiphenomenal product of the capitalist world market, and therefore as a symptom of rather than potential cure to the crisis of modern society. However, this conflicts with the fact that they designated the Communist Manifesto itself as a world-literary production—the joint work of communists of various nationalities—and opposed it to the national limitations of German socialist literature. This article challenges existing interpretations by outlining how Marx and Engels incorporated the humanistic idealism of the Goethean Weltliteratur tradition into the theoretical framework of historical materialism. We herein employ multilevel technologies, including compression, encryption, barcoding, and steganography to secure a secret text message. Type I multilevel steganography is used with a two-level setup. Julius K Nyerere, the founding President of Tanzania, held office from 1962 to 1985. Much has been written about Nyerere's presidency, with the literature generally falling into two categories: strong advocacy for his decisions, actions, and ideas, and pointed criticism against him. Using narrative and new historicism theories, this article examines the recreation of the history of Nyerere’s presidency in local narratives, specifically Nyakyusa myths. The myths were collected using the oral history interviews from Kyela and Busokelo districts in Tanzania. This article is the first focused attempt to explore India–East Africa relationships in the Bronze Age and early Iron Age, approximately two to three millennia before the Common Era (3000–300 BCE) from a puranic perspective. While extensive scholarship exists on medieval and later Indo–African exchanges, the pre-Common Era period has remained underexplored. Drawing on Purāṇic cosmographies, Greco-Roman geographical accounts, African archaeology, and Indian Ocean trade studies, this research reconstructs possible networks of contact facilitated by monsoon navigation and long-distance exchange. While tea plantations brought good fortunes to some parts of Southern Highlands in Tanzania such as Mufindi and Rungwe during the British mandate, its production sites became centres of ethnic contestations in relation to work discipline. The colonial and post-colonial enterprises labelled some ethnic groups as “reliable labourers” and others “unreliable”. This article, uses the tea plantations in Mufindi district, Iringa, to debate the labour question and ethnic identity in tea plantations between 1920s and 2000s. This article explores the significance of collaboration in the spread of missionary Christianity in Africa through a historical study of The Apostolic Church of Nigeria (TACN). It examines how the partnership between British missionaries and Nigerian leaders produced a hybrid mission model that combined Western ecclesiastical structure with African spirituality. Drawing on historical records, church documents, and existing scholarship, the article adopts a narrative–analytical method to trace how figures such as Pastors George Perfect, Idris J Vaughan and DO Odubanjo negotiated issues of theology, finance and cultural identity. We analyze a multidimensional screening model in which a principal offers a menu of quality-price pairs to a consumer with multiple dimensions of private information and a quasilinear utility function. We derive necessary conditions for optimality, and use them to provide insight into optimal exclusion, positive trade, and screening. We then recast the problem in terms of incremental quality levels and prices, the so-called demand-profile approach (DPA). Under DPA, the problem decouples across increments and can be solved one at a time. Background: This study explores the integration of the social dimension of Environmental, Social, and Governance (ESG) principles within the banking sector, using the GRI 400 standards as a guiding framework. Method: Drawing on qualitative data from 18 employees at different levels ranging from outsourcing staff to Group Head level at one of Indonesian private bank. Findings: The findings reveal a clear gap between formal ESG metrics and employees’ real-life experiences. Employee awareness and perceptions differ notably by position, with higher level employees often showing greater responsiveness and a stronger intention to integrate sustainability into their daily work. This study employs a corpus-based critical discourse analysis (CDA) grounded in Halliday’s transitivity framework to investigate how China’s diplomatic stance is discursively constructed within conflict reporting. Focusing on media coverage of the Russian-Ukrainian War and the Palestinian-Israeli Conflict (2023), the study investigates how Chinese and Western mainstream media depict China’s stance. Based on a self-built corpus of 153 news reports and analyzed via AntConc, the study quantitatively and qualitatively identifies distinct patterns in the use of transitivity processes across the two corpora. "Creative constructions" are defined as patterns which deviate slightly but noticeably from grammatical, fully licensed structures in English (and are therefore sometimes branded as "wrong"), inviting specific cognitive associations to make sense of them. It is argued that such structures offer a window into the nature of the cognitive manipulation of linguistic innovations and change. The purpose of this study was to evaluate the effects of different class wide interdependent group contingencies on unsafe playground behavior and student preferences for each intervention. In Experiment 1, we assessed the effects of the Good Behavior Game (GBG) on unsafe behavior across three third-grade classes. The GBG effectively reduced unsafe playground behavior relative to baseline, though student-choice data indicated that students did not prefer the intervention. This finding prompted Experiment 2, in which we evaluated synchronous schedule of reinforcement (SSR) as a classwide interdependent group contingency and compared its effectiveness and preference to the GBG. This study examines the visibility and invisibility of sexuality-related terms in four Asian Englishes using data from the International Corpus of English (ICE). Drawing on Wilkinson’s (2022) sexuality-related lexical set and informed by scholarship on heteronormativity, the study analyzes the proportional visibility of 19 target lexemes across Englishes in Hong Kong, the Philippines, Singapore, and India. The findings show that only a small subset of terms (gay, lesbian, same sex, sexual preference, bisexual, and sexual orientation) appear in the corpora, and even these occur at low frequencies. Among these, gay emerges as the most recurrent. The remaining terms are not …

บทความนี้ศึกษาวิวัฒนาการของความรับผิดทางอาญาของนิติบุคคลในประเทศฝรั่งเศสผ่านแนวคิด personnes morales ซึ่งบัญญัติไว้ในมาตรา 121-2 แห่งประมวลกฎหมายอาญาฝรั่งเศส โดยศึกษาแนวคิดนี้ภายใต้กรอบของความรับผิดของนิติบุคคลต่ออาชญากรรมร้ายแรง โดยเฉพาะอย่างยิ่งในบริบทของกฎหมายอาญาระหว่างประเทศ ซึ่งโดยหลักแล้วกำหนดความรับผิดแก่บุคคลธรรมดาเท่านั้น คำถามวิจัยหลักของการศึกษานี้คือ แนวคิด personnes morales ของฝรั่งเศสช่วยอุดช่องว่างของความรับผิดทางอาญาในกรณีที่นิติบุคคลได้เข้ามามีส่วนร่วมในการกระทำความผิดอาญาร้ายแรงตามธรรมนูญกรุงโรมได้หรือไม่ และแนวคิดนี้สามารถนำมาใช้กับความรับผิดทางอาญาระหว่างประเทศได้เพียงใด บทความได้วิเคราะห์คดีสำคัญ เช่น คดีอื้อฉาวทางเภสัชกรรม Mediator คดี Lafarge S.A. ในซีเรีย และคำพิพากษา Association Sportive ซึ่งตัดสินโดยศาลอาญาของฝรั่งเศส โดยที่ศาลได้วางหลักเกี่ยวกับเจตนาของนิติบุคคล (corporate mens rea) ผสมผสานกับความรับผิดโดยอาศัยการเป็นตัวแทนและความรับผิดโดยอิสระขององค์กร รวมถึงวิธีที่ศาลฝรั่งเศสบังคับใช้บทลงโทษกับนิติบุคคลได้อย่างมีประสิทธิภาพ นอกจากนี้ ยังมีการอ้างอิงเปรียบเทียบกับสหราชอาณาจักรและสวีเดนเพื่อแสดงให้เห็นแนวทางทางเลือกอื่น ๆ และเน้นย้ำว่าระบบฝรั่งเศสมีส่วนช่วยในการพัฒนาแนวคิดความรับผิดทางอาญาของนิติบุคคลอย่างไร ท้ายที่สุด บทความนี้ชี้ให้เห็นว่าหลักคำสอนของ personnes morales ไม่เพียงแต่เป็นกรอบแนวคิดเชิงปฏิบัติเท่านั้น แต่ยังเป็นแนวทางเชิงทฤษฎีที่สามารถแก้ไขปัญหาช่องว่างของความรับผิดในกฎหมายอาญาระหว่างประเทศได้และเสนอข้อคิดสำคัญสำหรับการปฏิรูปในอนาคตเพื่อเสริมสร้างความรับผิดชอบของภาคธุรกิจในระดับข้ามเขตอำนาจศาล

บทความวิจัยนี้มุ่งศึกษาความสัมพันธ์ระหว่างหลักกฎหมายว่าด้วยหนี้ตามประมวลกฎหมายแพ่งและพาณิชย์ กับหลักเกณฑ์การเสนอคดีตามประมวลกฎหมายวิธีพิจารณาความแพ่ง อันเป็นกลไกสำคัญในการบังคับใช้สิทธิของเจ้าหนี้ในทางปฏิบัติ เนื่องจาก “หนี้” เป็นบุคคลสิทธิ เจ้าหนี้จึงไม่อาจบังคับชำระหนี้ได้ด้วยตนเอง แต่ต้องเสนอคดีต่อศาลเพื่อบังคับให้ชำระหนี้ การวิจัยนี้เป็นการวิจัยเชิงหลักกฎหมาย (Doctrinal Legal Research) โดยวิเคราะห์ประเด็นสำคัญเกี่ยวกับหนี้ 7 ประการ ได้แก่ การบอกกล่าวลูกหนี้กับอำนาจฟ้อง การบังคับชำระหนี้ การเรียกดอกเบี้ยกรณีลูกหนี้ผิดนัด การใช้สิทธิเรียกร้องของลูกหนี้ การโอนสิทธิเรียกร้อง การเพิกถอนการฉ้อฉล และอายุความบังคับจำนอง ทั้งนี้ ผู้วิจัยได้จำแนกบทบัญญัติว่าด้วยหนี้ออกเป็น 3 ประเภท ได้แก่ (1) บทบัญญัติที่มีเนื้อหาไม่ครอบคลุมเกี่ยวกับการเสนอคดี (2) บทบัญญัติที่กำหนดวิธีไว้แต่ไม่ครบถ้วนหรือมีปัญหาในการตีความ และ (3) บทบัญญัติที่ไม่สอดคล้องกับกฎหมายวิธีพิจารณาความแพ่ง แล้วนำมาวิเคราะห์เชื่อมโยงกับบทบัญญัติในประมวลกฎหมายวิธีพิจารณาความแพ่ง รวมถึงศึกษาจากตำราและแนวคำพิพากษาศาลฎีกา ผลการศึกษาพบว่า การบังคับใช้กฎหมายว่าด้วยหนี้ให้มีประสิทธิภาพ จำเป็นต้องตีความและบังคับใช้สอดคล้องกับกฎหมายวิธีพิจารณาความแพ่ง ซึ่งผลลัพธ์ของงานวิจัยนี้จะช่วยลดปัญหาทางปฏิบัติและเสริมสร้างความเข้าใจที่ถูกต้องแก่ผู้ศึกษากฎหมายและผู้ปฏิบัติงานในคดีแพ่ง

คำชี้ขาดที่เกิดจากกระบวนการอนุญาโตตุลาการระหว่างประเทศมักจะลงท้ายด้วยส่วนที่เป็นประกาศิต 2 ส่วน ส่วนแรกเป็นคำชี้ขาดที่ว่าด้วยจำนวนค่าเสียหาย ค่าสินไหมทดแทนที่ฝ่ายแพ้คดีจะต้องชำระหรือใช้คืนให้แก่ฝ่ายชนะคดีหรือปฏิบัติการชำระหนี้รูปแบบอื่นให้แก่ฝ่ายที่ชนะคดี รวมเรียกว่าเป็นคำชี้ขาดในเนื้อความแห่งคดี ส่วนที่สองเป็นคำชี้ขาดในเรื่องค่าใช้จ่ายซึ่งมักกำหนดจำนวนค่าใช้จ่ายในการอนุญาโตตุลาการที่ฝ่ายแพ้คดีต้องชำระหรือใช้คืนให้แก่ฝ่ายชนะคดี เรียกว่าคำชี้ขาดในส่วนค่าใช้จ่าย ค่าใช้จ่ายในการอนุญาโตตุลาการมีจำนวนสูงขึ้นอย่างสม่ำเสมอ แม้ว่าเทคโนโลยีจะได้รับการพัฒนาให้ก้าวหน้าอย่างต่อเนื่องและมีการนำเอาเทคโนโลยีมาใช้ในกระบวนการอนุญาโตตุลาการอย่างกว้างขวางก็ตาม คู่พิพาทฝ่ายที่แพ้คดีอนุญาโตตุลาการระหว่างประเทศนอกจากต้องแบกรับภาระค่าใช้จ่ายของตนแล้วยังจะถูกบังคับโดยคำชี้ขาดให้เข้ารับภาระหรือชดใช้ค่าใช้จ่ายของฝ่ายที่ชนะคดีด้วย ทั้งนี้เป็นไปตามหลักเกณฑ์ที่ว่า “Costs follow the event” หรือ “ผู้แพ้เป็นผู้รับผิดชอบค่าใช้จ่าย” ที่ถือปฏิบัติกันอยู่ในวงการอนุญาโตตุลาการระหว่างประเทศ หลักเกณฑ์นี้กำเนิดขึ้นในประเทศอังกฤษ ต่อมาถูกนำไปใช้กันอย่างแพร่หลายทั่วโลกทั้งในประเทศคอมมอนลอว์และประเทศซิวิลลอว์ คู่พิพาทที่หวั่นวิตกว่าจะต้องรับภาระค่าใช้จ่ายที่สูงลิ่วหากตนตกเป็นฝ่ายแพ้คดี สามารถนำเอาวิธีการยื่นคำเสนอปิดผนึกเพื่อประนอมข้อพิพาทมาใช้เป็นเครื่องมือจำกัดหรือลดค่าใช้จ่ายดังกล่าว หลักปฏิบัติในเรื่องการทำคำเสนอปิดผนึกเพื่อประนอมข้อพิพาทถือเป็นเรื่องใหม่สำหรับประเทศไทย ผู้เขียนมีความประสงค์ที่จะนำเสนอหลักกฎหมายและประเพณีปฏิบัติในเรื่องดังกล่าวที่แพร่หลายอยู่ในสถาบันอนุญาโตตุลาการหลักของโลกให้ผู้ประกอบธุรกิจและนักกฎหมายไทยได้รับทราบและนำไปใช้ให้เป็นประโยชน์หากต้องเข้าไปเกี่ยวพันกับการอนุญาโตตุลาการระหว่างประเทศ

บทความวิจัยนี้มุ่งศึกษาถึงแนวคิดและหลักความรับผิดเพื่อละเมิด โดยเฉพาะความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นอันเกิดจากข้อสันนิษฐานความรับผิดตามกฎหมายภายใต้แนวคิดที่ว่าบุคคลนั้นอาจมีส่วนผิดอยู่ด้วยในการที่เกิดความเสียหายแก่บุคคลอื่น หรือมีความบกพร่องในการควบคุมดูแลจึงเกิดความเสียหายขึ้น การศึกษาวิจัยครั้งนี้เป็นการวิจัยเชิงคุณภาพ โดยเน้นการวิจัยเอกสารโดยศึกษาค้นคว้าจากหนังสือ งานวิจัย วิทยานิพนธ์ ตลอดจนบทบัญญัติกฎหมายที่เกี่ยวข้องกับความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นทั้งภาษาไทยและภาษาต่างประเทศ โดยนำข้อมูลต่าง ๆ มาศึกษาและวิเคราะห์เพื่อนำมาพัฒนากฎหมายความรับผิดเพื่อละเมิด จากการศึกษาพบว่ากฎหมายได้กำหนดความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นเอาไว้หลายกรณีโดยพิจารณาจากความสัมพันธ์ตามกฎหมาย ตามสัญญา ตามหน้าที่ในฐานะพิเศษ เช่น ความรับผิดของนายจ้างลูกจ้าง ความรับผิดของตัวการตัวแทน ความรับผิดของบิดามารดา ความรับผิดของครูบาอาจารย์ แต่ไม่พบกรณีความรับผิดของคู่สมรส ซึ่งคู่สมรสนั้นถือว่าเป็นบุคคลที่มีนิติสัมพันธ์ระหว่างกันตามกฎหมายอันก่อให้เกิดสิทธิ หน้าที่ และความรับผิด ด้วยเหตุนี้ จึงสมควรแก้ไขปรับปรุงกฎหมายโดยเฉพาะในเรื่องความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นของคู่สมรสเพื่อให้พัฒนาและสอดคล้องกับสภาพสังคม เพิ่มความระมัดระวังของบุคคลที่มีความสัมพันธ์เกี่ยวข้องในการดำเนินชีวิตทางสังคม ตลอดจนมุ่งเยียวยาและเพิ่มโอกาสให้ผู้ที่ได้รับความเสียหายได้รับการชดใช้ค่าสินไหมทดแทนอย่างเป็นธรรมอันเป็นไปตามเจตนารมณ์ของกฎหมายละเมิด

ภาษีทรัมป์กับองค์การการค้าโลก: ระบบการค้าเสรีแบบพหุภาคีล่มสลายแล้ว? (Trump Tariffs And The World Trade Organization: Has The Multilateral Free Trade System Collapsed?), Sakda Thanitcul

แม้ว่าองค์การการค้าโลกจะไม่สามารถทำอะไรกับภาษีทรัมป์ได้และปล่อยให้สหรัฐอเมริกาขึ้นอัตราภาษีกับประเทศคู่ค้า 59 ประเทศ ในรูปแบบการเจรจาแบบทวิภาคีก็ตาม แต่ระบบการค้าเสรีแบบพหุภาคีก็อาจยังไม่ถึงขั้นล่มสลาย เนื่องจากเหตุผลสองประการ ประการแรก คือ ประเทศคู่ค้า (ยกเว้นจีนและแคนาดา) ไม่ได้ขึ้นอัตราภาษีนำเข้าตอบโต้และสัดส่วนการค้าของสหรัฐอเมริกาในการค้าโลกคิดเป็นเพียงร้อยละ 11 เท่านั้น ประการที่สอง คือ ภาษีทรัมป์ที่มีพื้นฐานแนวคิดของลัทธิกีดกันทางการค้ามีความขัดแย้งอย่างมากกับแนวคิดพื้นฐานของเศรษฐศาสตร์กระแสหลักที่เชื่อในการค้าเสรีแบบพหุภาคี ทำให้เชื่อได้ว่าภาษีทรัมป์จะไม่ยั่งยืนตลอดไป อย่างไรก็ตาม มี “การแตกร้าว” ในระบบการค้าเสรีแบบพหุภาคีที่มีองค์การการค้าโลกเป็นผู้กำกับดูแลและบริหารกฎเกณฑ์ กล่าวคือ การไม่มีผู้ตัดสินในองค์กรอุทธรณ์ ส่งผลให้กลไกการระงับข้อพิพาทขององค์การการค้าโลกกลายเป็นอัมพาตและสหรัฐอเมริกาเป็นประเทศเดียวที่มีสถานะเหนือประเทศสมาชิกอื่น ๆ อีก 165 ประเทศ เนื่องจากเป็นสมาชิกประเทศเดียวในองค์การการค้าโลกที่สามารถกำหนดอัตราภาษีนำเข้าได้ตามอำเภอใจโดยอ้างเหตุผลด้านความมั่นคงของชาติ

Protecting Graduate Students From Burnout With Self-Compassion And Authenticity, Michael S. Leeman, Joshua J. Castleberry, Anna A. Ellenson, Morgan Wallbrown

This study investigated whether practicing self-compassion and embracing one's authentic self could protect graduate students from burnout. Researchers also empirically examined the mediating effect of authenticity in the relationship between self-compassion and burnout. A total of 318 master's degree students in a helping profession completed surveys assessing their levels of self-compassion, authenticity, and burnout. Results found that graduate students with higher levels of self-compassion and authenticity tended to have lower levels of burnout. Additionally, authenticity mediated the relationship between self-compassion and burnout.
