แนวทางในการกำหนดความรับผิดทางอาญาและวิธีการเพื่อความปลอดภัยต่อผู้กระทำความผิดซึ่งมีสภาวะจิตผิดปกติ (Guideline For Determining The Criminal Liability And Security Measures For Insane Offenders), Natchapol Jittirat

หลักเกณฑ์ในการพิจารณาความรับผิดทางอาญาของผู้กระทำความผิดที่มีสภาวะจิตผิดปกตินับเป็นปัญหาสำหรับศาลและนักกฎหมายมาช้านานในอดีต เนื่องจากผู้กระทำความผิดบางรายอาจกระทำความผิดไปโดยไม่รู้สึกตัว เพราะมีสาเหตุมาจากความบกพร่องทางประสาท สมอง จิตใจ อารมณ์และความเครียด ซึ่งความผิดปกติทางจิตขนาดใดจึงจะนำมาพิจารณาว่าผู้นั้นไม่มีความผิด หรือมีความผิดแต่ควรยกเว้นโทษหรือลดโทษนี้ ศาลของประเทศอังกฤษได้วางหลักสำคัญไว้ในการพิจารณาคดี McNaghten’s (1843) ว่าต้องสันนิษฐานไว้ก่อนว่ามนุษย์ทุกคนมีจิตปกติ เว้นแต่จะมีข้อสันนิษฐานซึ่งสามารถพิสูจน์ได้ว่าขณะกระทำความผิดจำเลยได้รับความเจ็บปวดจากโรคทางจิตจนไม่ทราบเนื้อหาและสาระสำคัญของการกระทำ กล่าวคือไม่สามารถรู้ได้ว่าสิ่งนั้นถูกหรือผิด หลักเกณฑ์ดังกล่าวนี้ได้ถูกนำไปใช้อย่างแพร่หลายทั้งในสหรัฐอเมริกาและประเทศในภูมิภาคยุโรป ซึ่งนำไปสู่การตัดสินว่าจำเลยไม่มีความผิดโดยศาลจะมีคำสั่งให้ควบคุมตัวจำเลยไปรับการบำบัดรักษาที่สถานพยาบาล สำหรับการพิจารณาถึงความรับผิดของผู้ที่มีจิตบกพร่อง โรคจิต หรือจิตฟั่นเฟือน ตามแนวทางในการพิจารณาคดีของศาลนั้นหากผู้กระทำไม่รู้สำนึกของการกระทำย่อมไม่มีความผิดตามประมวลกฎหมายอาญา มาตรา 59 ถ้าหากผู้กระทำรู้สำนึกแต่ไม่สามารถรู้ผิดชอบ หรือไม่สามารถบังคับตนเองได้ถือเป็นเหตุยกเว้นโทษ และถ้าผู้กระทำความผิดยังสามารถรู้ผิดชอบอยู่บ้าง หรือยังสามารถบังคับตนเองได้บ้าง ผู้นั้นต้องรับโทษสำหรับความผิดนั้น โดยศาลจะลงโทษน้อยกว่าที่กฎหมายกำหนดไว้สำหรับความผิดนั้นเพียงใดก็ได้ตามมาตรา 65 ซึ่งจะเห็นได้ว่าในกรณีที่ศาลตัดสินว่าจำเลยไม่มีความผิดนี้อาศัยความตามมาตรา 59 ถือว่าผู้กระทำความผิดไม่รู้สำนึกซึ่งใช้หลักเกณฑ์เดียวกับบุคคลทั่วไปซึ่งหากไม่รู้สำนึกในการกระทำก็ย่อมไม่มีความผิด ดังปรากฏตามคำพิพากษาฎีกาที่ 8743/2544 คำพิพากษาฎีกาที่ 2590/2562 แต่สำหรับผู้กระทำความผิดที่มีจิตบกพร่อง โรคจิต หรือจิตฟั่นเฟือนนั้นได้กระทำความผิดไปโดยไม่รู้ถึง “สภาพ” และ “สาระสำคัญ” ของการกระทำจึงควรบัญญัติแยกไว้เป็นอีกมาตราหนึ่งให้ผู้นั้นไม่มีความผิดและหากผลของการกระทำความผิดมีความร้ายแรงต่อชีวิต ร่างกายหรือทรัพย์สินของผู้อื่นก็ควรให้เป็นดุลพินิจของศาลในการมีคำสั่งให้ส่งตัวผู้นั้นเข้ารับการบำบัดรักษาในสถานพยาบาลได้เช่นเดียวกับที่บัญญัติความไว้ใน มาตรา 48 นอกจากนี้ หากผู้กระทำความผิดยังสามารถรู้ผิดชอบหรือยังสามารถบังคับตนเองได้บ้างก็ควรมีเกณฑ์ลดโทษตามความร้ายแรงของการกระทำความผิดดังเช่นหลักเกณฑ์ตามประมวลกฎหมายอาญาของสาธารณรัฐฝรั่งเศสเพื่อให้เกิดความเป็นธรรมต่อผู้เสียหาย ทั้งยังควรนำวิธีการคุมประพฤติมาใช้บังคับหลังจากที่จำเลยพ้นโทษในกรณีที่ผู้นั้นได้กระทำความผิดร้ายแรงดังเช่น สาธารณรัฐฝรั่งเศสและประเทศอังกฤษ เพื่อป้องกันมิให้ผู้นั้นกลับมากระทำความผิดซ้ำขึ้นอีก

Enduring Impacts Of Child Development Accounts: Increased Parental Expectations And College Preparation, Jin Huang, Sicong Sun, Michael Sherraden

Parental educational expectations exert a substantial influence on children’s educational achievement. Elevated parental expectations can move families to prepare for a child’s education beyond high school, both by intentional planning and financial steps to increase the likelihood of attending higher education. This Research Brief explores findings from a detailed study of long-term positive impacts of Child Development Accounts on parental educational expectations and college preparation. Drawing upon analyses of the pre-COVID data collected in 2020 as part of Wave 3 of the SEED for Oklahoma Kids experiment, the brief highlight effects sustained over 13 years.

Background: The economic crisis from 2008 to 2009 was due to the collapse of the housing price bubble, which increased the default rate or non-performing loans of mortgages. Background: This research investigates the impact of corporate governance elements and corporate investment activity on ESG disclosure in companies from Asia Pacific Emerging Markets. Methods: The study analyzes a sample of 150 companies from Asia Pacific Emerging Market countries over the period 2015–2022, yielding a total of 1200 observations. The Generalized Method of Moments-Difference (GMM-DIFF) is employed to test the hypothesis. Hypertension is characterized by increased blood pressure due to various risks that do not function normally in stabilizing blood pressure. According to WHO, the number of hypertension patients worldwide in 2020 reached 972 million (26.4%) and increased in 2021 to 1.2 billion (29.2%). Hypertension treatment must be carried out long, requiring a substantial aggregate treatment cost. Based on BPJS data, in 2014, hypertension accounted for approximately Rp2.8 trillion in healthcare costs, which increased annually until 2016, reaching around Rp4.2 trillion. The need for healthcare services due to illness is unpredictable, thus burdening patients economically and posing a risk of catastrophic events. The percentage of households with catastrophic health expenditures is defined as out-of-pocket payments exceeding 10% of the household’s capacity to pay for healthcare. Increasing catastrophic expenditure costs can further deteriorate the household’s financial condition. This study analyzes the determinants of catastrophic health expenditures in Indonesian households. A total of 12,892 household samples from the cross-sectional Indonesian Family Life Survey (IFLS) wave 5 (2014) were used in this study. On average, graduate students consume eight drinks per week, meeting criteria for heavy drinking and highlighting the need for a cost-effective intervention. The current study examined the efficacy of personalized normative feedback (PNF) for reducing heavy drinking in graduate students. Study 1 examined the feasibility and acceptability of the intervention content to inform a randomized controlled trial (RCT) of the intervention. Results from qualitative interviews with 13 graduate students who interacted with the intervention content preferred to receive feedback about peers enrolled in the same type of degree program. บทความนี้มีวัตถุประสงค์เพื่อศึกษาประสบการณ์ของระบบกฎหมายฝรั่งเศสในการจัดกลุ่มกฎหมายที่มีคุณค่าในระดับรัฐธรรมนูญ โดยอาศัยคณะตุลาการรัฐธรรมนูญเป็นองคาพยพในการจัดกลุ่มและพัฒนาหลักการทางรัฐธรรมนูญที่มีความเป็นพลวัตให้เกิดความชัดเจนภายใต้ทฤษฎีการจัดลำดับศักดิ์ของกฎหมาย โดยผลการศึกษาพบว่า คณะตุลาการรัฐธรรมนูญได้อาศัยบทบัญญัติของรัฐธรรมนูญแห่งสาธารณรัฐฝรั่งเศส ค.ศ. 1958 ที่กำหนดให้คำวินิจฉัยของคณะตุลาการรัฐธรรมนูญมีผลผูกพันทุกองค์กรมาใช้ในการพัฒนากลุ่มกฎหมายที่มีคุณค่าในระดับรัฐธรรมนูญ โดยการวินิจฉัยให้เอกสารทางกฎหมายอื่น ๆ ถือเป็นส่วนหนึ่งของกลุ่มกฎหมายที่มีคุณค่าในระดับรัฐธรรมนูญ ซึ่งประสบการณ์ดังกล่าวสามารถนำมาปรับใช้กับระบบกฎหมายไทยได้ในกรณีที่ต้องมีการตีความเอกสารทางกฎหมายที่มีมาก่อนการประกาศใช้รัฐธรรมนูญให้มีสถานะดังเช่นรัฐธรรมนูญ รวมถึงการตีความหลักการทางกฎหมายที่เคยปรากฏในรัฐธรรมนูญฉบับก่อนแต่ไม่ปรากฏในรัฐธรรมนูญฉบับปัจจุบัน

อำนาจของผู้จัดการมรดกตามกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายเป็นเรื่องที่มีความสำคัญ โดยเฉพาะอย่างยิ่งในสภาพการณ์ปัจจุบันที่โลกได้ก้าวเข้าสู่ยุคแห่งความไร้พรมแดนจึงอาจทำให้ทรัพย์สินของเจ้ามรดกกระจัดกระจายอยู่ได้ในหลายประเทศ การที่จะพิจารณาว่ากฎหมายของประเทศใดเป็นกฎหมายที่ใช้บังคับกับนิติสัมพันธ์ในเรื่องอำนาจของผู้จัดการมรดกนั้นย่อมเป็นหน้าที่ของกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมาย สำหรับระบบกฎหมายขัดกันว่าด้วยอำนาจของผู้จัดการมรดกนั้นอาจแบ่งได้เป็น 2 ระบบ กล่าวคือ ระบบที่แยกเรื่องผู้จัดการมรดกออกจากเรื่องทรัพย์มรดก และระบบที่ไม่แยกเรื่องผู้จัดการมรดกออกจากเรื่องทรัพย์มรดก ในขณะที่เมื่อพิจารณาถึงกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายนั้น กฎหมายขัดกันของแต่ละประเทศได้ให้การยอมรับจุดเกาะเกี่ยวในการค้นหากฎหมายที่ใช้บังคับกับเรื่องอำนาจของผู้จัดการมรดกไว้แตกต่างกัน โดยกฎหมายขัดกันของอังกฤษได้อาศัยกฎหมายภายในกำหนดถึงอำนาจของผู้จัดการมรดก ในขณะที่กฎหมายขัดกันของประเทศจีนได้อาศัยกฎหมายแห่งถิ่นที่ทรัพย์นั้นตั้งอยู่เป็นจุดเกาะเกี่ยวส่วนภายใต้ระบบกฎหมายขัดกันของไทยนั้นไม่ได้มีการกำหนดกฎเกณฑ์ในการเลือกกฎหมายเพื่อใช้บังคับกับเรื่องอำนาจของผู้จัดการมรดกไว้เป็นการเฉพาะ จึงต้องใช้กลไกการอุดช่องว่างของกฎหมายตามมาตรา 3 พระราชบัญญัติว่าด้วยการขัดกันแห่งกฎหมาย พุทธศักราช 2481 ซึ่งกำหนดให้ใช้กฎเกณฑ์ทั่วไปแห่งกฎหมายระหว่างประเทศแผนกคดีบุคคลบังคับ

This paper examines a specific case of fictive motion conceptualization—non-standard motion metaphors identified in texts from the Kazakh subcorpus of the Russian Learner Corpus (http://www.web-corpora.net/RLC). The texts were written by students from several universities in Almaty who are native speakers of Kazakh (L1) and second-language speakers of Russian (L2). This study examines exposure, vulnerability, and resilience across three consecutive extreme events in the Portland metro area: the September 2020 wildfire-related air pollution, the February 2021 snowstorm, and the June 2021 heatwave. We used geographically weighted regression and Spearman rank correlation analysis to investigate relationships between hazard impacts, the social vulnerability index (SoVI), Baseline Resilience Indicators for Communities (BRIC), and proximity to community-based organizations (CBOs) in 416 census tracts. Interprofessional education is a new movement that is being adopted more by educators in higher education. In other words, it has come to stay. This is the story of a collaboration across five disciplines at the University of Texas Rio Grande Valley to implement a Primary Care Behavioral Health certificate program that benefits both the students and the community of Rio Grande Valley. Tuckman and Jensen’s (1977) model of group development frames this narrative, with its stages of Forming, Storming, Norming, Performing, and Adjourning.

Unprefixed Russian motion verbs present unique challenges for second language (L2) learners as they encode distinct types of motion events. Traditional, directionality-based methods of teaching these verbs have faced criticism, prompting the adoption of alternative, cognitively informed approaches. This paper examines L2 acquisition of directionality of Russian motion verbs by L1-Korean speakers in terms of Slobin’s (1996) Thinking-for-Speaking (TFS) hypothesis and the markedness principle. Although directionality is lexically encoded in the verb in both Korean and Russian, the organization of this concept differs. In Russian, directionality is categorized solely by the feature [+/- directional], whereas in Korean, motion event expressions are distinguished not only by [+/-directional] but also by [+/-multi]. To contextualize the contributions to the issue, in this Introduction, I will give an overview of how this trend has evolved from its inception until the present time, delineating within it two successive stages called the Cognitive Turn and Instructional Turn.

This paper examines the impact of institutional quality on public debt dynamics in Sub-Saharan Africa (SSA) from 2010 to 2023. Using the system Generalized Method of Moments (GMM)estimator, the study investigates how key governance dimensions (control of corruption, government effectiveness, political stability, regulatory quality, rule of law, and voice and accountability) affect public debt dynamics across 41 SSA countries. GDP growth, debt servicing, population growth, trade openness, inflation, unemployment, and government expenditure, are used to capture broader debt drivers. The results indicate that a one-unit improvement in overall institutional quality reduces debt-to-GDP ratio by approximately 0.92%. Control of corruption, government …

Informal public transport, as a mode of transportation, offers flexibility to users by allowing them to access services conveniently. However, its mode of operation poses significant challenges, particularly regarding safety, thereby undermining the core objective of ensuring safe travel. This study employs a survey research design to investigate passengers' safety perceptions in informal public transport along the Lokoja-Okene transport corridor. African American/Black (AA/B) women are more likely than other women in the United States to give birth prematurely. Experiencing premature birth and infant hospitalization in the neonatal intensive care unit (NICU) during the COVID-19 pandemic may have negatively affected AA/B mothers’ mental health and led them to experience elevated rates of increased posttraumatic stress disorders, depression, anxiety, and postpartum depression. Despite the critical role of teaching practicums in teacher education, little is known about how pre-service teachers navigate emotional tensions in Indonesia. In this study, we aim to explore the nature of tensions and emotional struggles pre-service teachers face and their coping mechanisms. Seven pre-service teachers from the English Education department at an Indonesian public university were purposefully selected. Flash floods are especially hazardous hydrological phenomena, noted for their abrupt occurrence and capacity to inflict severe damage on infrastructure, farmlands, and residential zones, often leading to substantial socio-economic upheaval and fatalities. A flash flood struck the Upper Brantas watershed on November 4, 2021, at 14:00, precipitated by intense rainfall over a short duration, leading to significant hydrological impacts. The event manifested at six critical points within Batu City, with Sambong Hamlet and Beru Hamlet experiencing severe inundation. Government Information Clarity And Digital Engagement As Driving Forces Behind Digital Resilience On The Jepin Smart City Platform, Winda Chelsea Meisari, Muliawati -, Siti Fatimah

This study examines the influence of information clarity and government digital engagement on the digital resilience of urban communities, using the case study of the Jendela Pontianak Integrasi (JEPIN) platform. The research employs a quantitative approach using Partial Least Squares Structural Equation Modeling (PLS-SEM) with WarpPLS 7.0, involving 100 respondents from the city of Pontianak. The results indicate that information clarity (β = 0.49; p < 0.001) and government digital engagement (β = 0.37; p < 0.001) have a positive and significant effect on digital resilience. The model demonstrates strong reliability (Composite Reliability: 0.847–0.914; Cronbach’s Alpha: 0.772–0.882), good validity (factor loading > 0.5; AVE > 0.5), and a high level of model fit (GoF = 0.569). The R² value of 0.517 shows that the model explains 51.7% of the variance in digital resilience, while the Q² value of …
