Natural disasters produce both community and individual trauma; Nepal’s 2015 and 2023 earthquakes exemplify this enduring impact. Previous literature has discussed the effects of PTSD and other mental health concerns post-disasters, providing some context to the difficulties in providing counseling services to those in need. However, little is known about unique psychological, cultural, and contextual factors in Nepal and how their influence and understanding may result in modifying traditional PTSD counseling interventions found in much of the existing professional literature. Public mass shootings occur most frequently in workplace settings, yet little is known about the experiences of survivors, co-victims, and first responders of these incidents and how they cope with this shared trauma. This collective case study examined the experiences of 14 survivors, co-victims, and first responders affected by a single workplace mass shooting. Reflexive thematic analysis revealed four main themes: (1) the spectrum of suffering, (2) ripple becomes wave: the spread of trauma, (3) forgotten in recovery, and (4) the healing power of shared experience. This paper explores how fashion served as a powerful political tool during the Civil Rights Movement of the 1950s-70s, tracing its evolution from the polished Sunday Best to the Afro and militant style of the Black Panther Party. By examining respectability politics, the rise of the Black is Beautiful movement, and the Black Panthers’ visual strategies, this research explores how clothing and style reflected shifting approaches to resistance. It argues that Black Americans used fashion to challenge Eurocentric standards, reclaim heritage, and express pride, leaving a legacy of empowerment that continues to influence social movements.

Leadership transitions in nonprofit organizations present both challenges and opportunities, particularly in rural community-based theatres where organizational identity is often deeply connected to individual leaders. This study employs narrative inquiry, guided by the lens of Feminist Pragmatism, to explore leadership change at Playhouse in the Park, a long-standing rural community theatre in Murray, Kentucky. Through interviews, reflections, and observations, the study identifies five emergent themes shaping directors’ experiences: expectations, programming content, personality, relational expectations, and the balance between cautiousness and freedom. Nonprofits operating in remote or low-infrastructure environments often encounter structural barriers that undermine social impact, especially for women and girls. This article presents preliminary findings from a global, cross-national study examining the accessibility, structure, and transparency of nonprofit registry systems across all countries worldwide. In addition to determining whether an online national nonprofit database exists in each country, the study evaluates who operates these systems—government authorities or civil society organizations—and identifies cases in which multiple registries are maintained. The analysis also incorporates national context indicators—such as population, human rights ratings, internet access, and governance—but these variables are not analyzed in this preliminary article. จากการศึกษาเปรียบเทียบการกำกับดูแลการผูกขาดในประเทศสหรัฐอเมริกาและประเทศญี่ปุ่น ผู้เขียนได้ค้นพบว่าวัตถุประสงค์ของกฎหมายต่อต้านทรัสต์ของประเทศสหรัฐอเมริกาคือ “ประสิทธิภาพ” และ “สวัสดิการผู้บริโภค” ทำให้ในยุคเศรษฐกิจดิจิทัล หน่วยงานบังคับใช้กฎหมายต่อต้านทรัสต์ของประเทศสหรัฐ อเมริกาประสบปัญหาในการกำกับดูแลการผูกขาดโดยบริษัทแพลตฟอร์มอิเล็กทรอนิกส์ที่มีอำนาจเหนือตลาด เนื่องจากผู้บริโภคได้ประโยชน์จากการผูกขาดดังกล่าว แม้ว่าผู้มีส่วนได้เสียอื่น โดยเฉพาะอย่างยิ่งคู่ค้าที่เป็นบริษัทขนาดกลางและขนาดย่อม (Small and Medium Enterprise: SME) จะถูกเอารัดเอาเปรียบก็ตาม ส่วนในประเทศญี่ปุ่น วัตถุประสงค์ของกฎหมายป้องกันการผูกขาด คือ การสนับสนุนและรักษาไว้ซึ่ง “การแข่งขันที่เสรีและเป็นธรรม” ซึ่งหมายความรวมถึงการปกป้อง SMEs จากการถูกเอารัดเอาเปรียบและพฤติกรรมการปฏิบัติทางการค้าที่ไม่เป็นธรรม (Unfair Trade Practices) ของบริษัทขนาดใหญ่ด้วย ส่วนวัตถุประสงค์ของกฎหมายแข่งขันทางการค้าในประเทศไทยมีความคล้ายคลึงกับประเทศญี่ปุ่น จึงมีบทบัญญัติเกี่ยวกับพฤติกรรมการปฏิบัติทางการค้าที่ไม่เป็นธรรมเช่นเดียวกัน ผู้เขียนจึงเสนอแนะให้หน่วยงานบังคับใช้กฎหมายป้องกันการผูกขาดของประเทศไทยออกกฎหมายลำดับรองเพื่อกำกับดูแลพฤติกรรมของผู้ประกอบธุรกิจแพลตฟอร์มตัวกลางการซื้อขาย (E-Commerce) ที่มีอำนาจเหนือตลาดในประเทศไทย

หลักความคาดหวังอันชอบธรรมเป็นกลไกสำคัญในระบบกฎหมายปกครองสมัยใหม่ที่มุ่งคุ้มครองความไว้วางใจของประชาชนต่อการกระทำของรัฐ บทความนี้ศึกษาพัฒนาการและสาระสำคัญของหลักการดังกล่าวในระบบกฎหมายเปรียบเทียบ ได้แก่ ระบบกฎหมายเยอรมนีที่หลักความคาดหวังอันชอบธรรมได้รับการยอมรับเป็น “หลักรัฐธรรมนูญทั่วไป” ภายใต้หลักนิติรัฐ และเชื่อมโยงกับหลักความมั่นคงแน่นอนทางกฎหมายและหลักความได้สัดส่วน ในอังกฤษหลักนี้มีจุดเริ่มต้นจากแนวคิดเรื่องความเป็นธรรมในกระบวนการก่อนขยายไปสู่การคุ้มครองผลประโยชน์เชิงเนื้อหาโดยใช้หลักการถ่วงดุลกับประโยชน์สาธารณะ ส่วนประเทศอื่น เช่น ออสเตรเลีย แคนาดา โปแลนด์ อินเดีย และฝรั่งเศส ต่างมีลักษณะการปรับใช้เฉพาะที่สะท้อนเป้าหมายร่วมกันในการจำกัดอำนาจรัฐและคุ้มครองความไว้วางใจของประชาชน สำหรับประเทศไทย ศาลปกครองไทยได้วางหลักการตีความสำคัญหลายประการทั้งการคุ้มครองเชิงเนื้อหาที่รับรองฐานะทางกฎหมายแม้คำสั่งจะถูกเพิกถอนในภายหลัง การชั่งน้ำหนักระหว่างความคาดหวังส่วนบุคคลกับประโยชน์สาธารณะ การเชื่อมโยงหลักความคาดหวังอันชอบธรรมกับหลักนิติรัฐ ข้อยกเว้นกรณีประมาทเลินเล่อร้ายแรงและการปกปิดข้อเท็จจริงที่มีสาระสำคัญ อย่างไรก็ตาม การปรับใช้ยังขาดความสม่ำเสมอในสาระสำคัญของการคุ้มครองความไว้วางใจของประชาชน บทความจึงนำเสนอแนวทางการพัฒนากฎหมายปกครองไทย ทั้งการปรับปรุงกฎหมายที่มีอยู่ให้ครอบคลุมรูปแบบความคาดหวังที่หลากหลาย การพัฒนาแนวทางการตีความของศาลที่ยอมรับการคุ้มครองทั้งในเชิงกระบวนการและเชิงเนื้อหา และการสร้างกลไกทางกฎหมายใหม่ เช่น คณะกรรมการไกล่เกลี่ยข้อพิพาท อันจะนำไปสู่การพัฒนาระบบกฎหมายปกครองไทยที่เป็นธรรม โปร่งใส และสอดคล้องกับหลักนิติรัฐอย่างแท้จริง

การรอการกำหนดโทษหรือรอการลงโทษจำคุกในฐานความผิดทางอาญาร้ายแรง (Suspension Of Sentence And Suspension Of Punishment For Serious Criminal Offenses), Natha Wichien

การรอการกำหนดโทษหรือรอการลงโทษ ตามประมวลกฎหมายอาญา มาตรา 56 เป็นมาตรการที่มีความสำคัญในกระบวนการยุติธรรมทางอาญา ซึ่งเป็นมาตรการที่บัญญัติขึ้นโดยมีวัตถุประสงค์ให้ศาลใช้ดุลพินิจรอการกำหนดโทษหรือรอการลงโทษสำหรับคดีที่มีอัตราโทษจำคุกระยะสั้นหรือโทษปรับ ตามทฤษฎีการลงโทษเพื่อแก้ไขพฤติกรรมของผู้กระทำความผิด กล่าวคือ ในคดีความผิดอาญาที่มีโทษจำคุกหรือปรับ และศาลจะลงโทษจำคุกไม่เกิน 5 ปี ทั้งนี้ เพื่อมิให้ผู้กระทำความผิดเล็กน้อยนั้นเข้าไปปะปนกับผู้กระทำความผิดเป็นอาจิณและเลียนแบบพฤติกรรมนั้นจนกลับมากระทำความผิดซ้ำอีก และเพื่อให้โอกาสผู้กระทำความผิดได้รู้สำนึกถึงสิ่งที่ได้กระทำลงไป รวมถึงสามารถกลับมาดำเนินชีวิตในสังคมได้อย่างเป็นปกติ แต่ในทางกลับกันเมื่อพิจารณาจากการบังคับใช้ประมวลกฎหมายอาญา มาตรา 56 ศาลสามารถใช้ดุลพินิจได้กับทุกฐานความผิด แม้ลักษณะของฐานความผิดนั้นจะกระทบกระเทือนต่อความปลอดภัยของสังคมมากเพียงใด แต่หากโทษจำคุกที่ศาลลงมีกำหนดไม่เกิน 5 ปี ศาลก็สามารถสั่งรอการกำหนดโทษหรือรอการลงโทษได้กับทุกกรณี ซึ่งอาจจะขัดหรือแย้งกับทฤษฎีการลงโทษทางอาญาประการอื่น กล่าวคือ ทฤษฎีการลงโทษเพื่อแก้แค้น การลงโทษเพื่อข่มขู่ยับยั้ง การลงโทษเพื่อตัดผู้กระทำผิดออกจากสังคมรวมถึงการลงโทษเพื่อป้องกันอาชญากรรม อันส่งผลกระทบต่อความรู้สึกและการได้รับความยุติธรรมของผู้เสียหาย หรือเหยื่อในคดีอาญารวมทั้งประชาชนในสังคม เนื่องจากในบางกรณีเป็นฐานความผิดที่มีความร้ายแรง และเป็นอันตรายต่อสังคม แต่ผู้กระทำความผิดกลับไม่ถูกลงโทษ ยิ่งไปกว่านั้นอาจทำให้ผู้เสียหายไม่ได้รับความยุติธรรม และบุคคลทั่วไปย่อมเข้าใจว่าการกระทำร้ายแรงเช่นนั้นสามารถกระทำได้โดยไม่ต้องรับผลใด ๆ จากการกระทำดังกล่าว ฉะนั้นจึงควรปรับปรุงแก้ไข และจัดทำคำแนะนำเกี่ยวกับวิธีการรอการลงโทษหรือรอการกำหนดโทษให้มีความชัดเจนยิ่งขึ้น โดยการกำหนดแนวทาง หรือข้อพิจารณาที่ผู้ใช้กฎหมายควรให้การคำนึง และให้ความสำคัญยิ่งขึ้นเกี่ยวกับฐานความผิดร้ายแรงที่ไม่ควรรอการกำหนดโทษหรือรอการลงโทษ เพื่อให้การลงโทษเป็นไปตามสัดส่วนของการกระทำความผิด และตรงตามทฤษฎีวัตถุประสงค์ของการลงโทษ

มาตรการคุ้มครองสิทธิในความเป็นส่วนตัวของเด็ก: กรณีศึกษาการโฆษณาโดยเจาะจงตัวบุคคลในประเทศไทย (Protective Measures On Children’S Right To Privacy: A Case Study Of Targeted Advertisement In Thailand), Janejira Daorueang

การโฆษณาโดยเจาะจงตัวบุคคลส่งผลกระทบต่อสิทธิในความเป็นส่วนตัวของเด็กทั้งในรูปแบบของการเฝ้ามองพฤติกรรมทางออนไลน์ การเก็บรวบรวม ใช้ หรือการเปิดเผยข้อมูลส่วนบุคคลโดยไม่ได้รับความยินยอมหรือไม่มีกฎหมายให้อำนาจไว้ การทำโปรไฟล์ หรือการนำเสนอโฆษณาที่ตอบสนองต่อความต้องการหรือลักษณะเฉพาะของตัวเด็ก สามารถชักจูงความคิดหรือกระตุ้นความต้องการของผู้รับโฆษณาได้โดยเฉพาะเพื่อแสวงหาประโยชน์ในทางเศรษฐกิจ สังคม การเมือง หรือวัตถุประสงค์อื่นใด การที่เด็กซึ่งเป็นบุคคลกลุ่มเปราะบางของสังคมอาจมีความรู้ความเข้าใจในการใช้งานเทคโนโลยีดิจิทัลและเครือข่ายออนไลน์และมีวิจารณญาณในการรับสื่อโฆษณาที่ไม่เพียงพอ ส่งผลให้เด็กมีความเสี่ยงจากการตกเป็นเป้าหมายของการแทรกแซงสิทธิในความเป็นส่วนตัวและการแสวงหาประโยชน์อันไม่ชอบจากการกระทำดังกล่าวได้โดยง่าย จากการศึกษาพิจารณาได้ว่า กฎหมายภายในของไทยในปัจจุบันอาจมีไม่เพียงพอสำหรับการคุ้มครองสิทธิในความเป็นส่วนตัวของเด็กจากการโฆษณาโดยเจาะจงตัวบุคคลตามมาตรฐานระหว่างประเทศ ดังนั้น บทความนี้จึงมีวัตถุประสงค์ในการศึกษาแนวทางการพัฒนามาตรการทางกฎหมายที่เหมาะสมกับสถานการณ์ในปัจจุบันเพื่อคุ้มครองสิทธิในความเป็นส่วนตัวของเด็กให้สอดคล้องกับพันธกรณีของประเทศไทยที่มีอยู่ตามกฎหมายระหว่างประเทศ

การพัฒนาที่ยั่งยืน (Sustainable Development) เป็นแนวคิดด้านการพัฒนาที่ได้รับการยอมรับในระดับสากลและมีบทบาทเป็นแนวทางการพัฒนาที่ทุกประเทศนำไปปรับใช้ โดยมีนิยามว่า การพัฒนาที่ตอบสนองความต้องการของคนรุ่นปัจจุบัน โดยไม่กระทบต่อความสามารถในการตอบสนองความต้องการของคนรุ่นอนาคต โดยมี สามเสาหลักแห่งการพัฒนาที่ยั่งยืน (The three pillars of sustainability) เป็นหัวใจสำคัญของหลักการ ซึ่งการบูรณาการมิติด้านการพัฒนาทั้งสามด้าน ได้แก่ เศรษฐกิจ สังคม และสิ่งแวดล้อม ให้สอดคล้องกัน ซึ่งประเทศไทยมีพันธกิจในระดับสากลในการนำหลักการพัฒนาที่ยั่งยืนมาปรับใช้กับการพัฒนาภายในประเทศทุกภาคส่วน รวมถึงการจัดการป่าไม้อันเป็นทรัพยากรธรรมชาติภายในประเทศ บทความฉบับนี้จึงเป็นการศึกษาและวิเคราะห์กฎหมายป่าไม้ของไทย โดยศึกษาในเชิงประวัติศาสตร์กฎหมายนับตั้งแต่ก่อนการก่อตั้งกรมป่าไม้ในสมัยรัชกาลที่ 5 ซึ่งเป็นช่วงแรกเริ่มของการตรากฎหมายป่าไม้ มาจนถึงกฎหมายป่าไม้ในช่วงเวลาปัจจุบัน เพื่อชี้ให้เห็นว่ากฎหมายป่าไม้ของไทยได้นำเอาหลักการพัฒนาที่ยั่งยืนมาปรับใช้จริงและมีความสอดคล้องกับพัฒนาการของหลักการพัฒนาที่ยั่งยืน โดยปรากฏผ่านหลักการของกฎหมายป่าไม้ในหลายภาคส่วนที่แสดงให้เห็นถึงการบูรณาการทางเศรษฐกิจ สังคม และสิ่งแวดล้อม ซึ่งเป็นหัวใจสำคัญของหลักการพัฒนาที่ยั่งยืน

Using sentiment analysis and qualitative content analysis, this research examines religious discourse in Indonesia, focusing on the impact of AI-driven content personalization, such as 'filter bubbles' and 'echo chambers'. This article showcases the results of one research question in a multi-question study, specifically, “How do interfaith hospital chaplains perceive themselves leaders or part of the leadership process?” To answer this question, researchers interviewed ten interfaith hospital chaplains and employed interpretive phenomenological analysis (IPA). The analysis revealed the participants’ views that interfaith hospital chaplains are part of the leadership processes in hospital systems.
