The Advisory Jurisdiction Of The Constitutional Tribunal Under Article 100 Of The Constitution, Don Jia Hao Ho

Singapore has a Constitutional Tribunal as provided for under Article 100 of the Constitution. The Tribunal is vested with advisory jurisdiction which ordinary courts do not have. This article explores the constitutional basis for the Tribunal’s existence, jurisdictional issues surrounding the Tribunal, as well as the legal effect of the Tribunal’s opinion. Moreover, this article evaluates the continued relevance of the Tribunal. In doing so, a comparative approach is adopted where appropriate.

It is well-understood that for most crimes to be established, the requirements of actus reus (the physical element) and mens rea (the mental element) need to be proven beyond a reasonable doubt. However, in situations involving joint offenders, if one of the offenders dealt the fatal blow, while the other offender acted as a lookout, can the other offender really be said to have the actus reus of the particular offence?

Limitation periods refer to the period within which a claimant who has a right to claim against another person, i.e., the defendant, must begin court proceedings to establish that right. Once that period has passed, the defendant can no longer be sued on that particular action. This is to prevent the threat of an action from continually hanging over the defendant such that once the limitation period has passed, the defendant can be sure that the claimant is no longer able to sue.

In cases of alleged child sexual abuse, information about the timing of events is often needed to establish a timeline, determine specific charges, or establish witness credibility (Lyon et al., 2017). However, past developmental laboratory research has demonstrated that children struggle to provide accurate and reliable testimony about time, and there is currently a lack of field research examining how attorneys actually question child witnesses about time in court (Friedman, 1991; Wandrey et al., 2012). Few studies address the experiences of caregivers of adolescents in foster care. This study highlights a range of caregiver attitudes about contraception for adolescents in care. Provider training regarding contraception should include strategies to manage caregiver beliefs and extreme reactions to contraception use among youth in care.

This paper examines the prevalence of Cantonese-English code mixing in Hong Kong through an under-researched digital medium. Prior research on this code-alternation practice has often been limited to exploring either the social or linguistic constraints of code-switching in spoken or written communication. Our study takes a holistic approach to analyzing code-switching in a hybrid medium that exhibits features of both spoken and written discourse. We specifically analyze the code-switching patterns of 24 undergraduates from a Hong Kong university on WhatsApp and examine how both social and linguistic factors potentially constrain these patterns. Despite being widely used in health economics, dynamic models of health and healthcare typ ically assume that the persistence in these outcomes is the same for every individual. This paper explores individual-level heterogeneity in the persistence of health outcomes. Using simple re gression methods that do not place any restriction on the distribution of the heterogeneity in persistence, the paper documents substantial heterogeneity in health, medical expenditures, and healthcare use. We show that neglecting this heterogeneity leads to estimates that overstate the average persistence and can bias the coefficients of covariates. We find that between 75% and 87% of individuals …

A growing literature has revealed a notable electoral advantage for congressional and gubernatorial candidates with deep local roots in their home districts or states. However, there is a dearth of research on the presence and impact of local roots in state legislative races. In this paper, we close that gap by demonstrating the consistent and significant electoral impacts that state legislators’ local roots have on their reelection efforts. Acoustic communication is a process that involves auditory perception and signal processing. Discrimination and recognition further require cognitive processes and supporting mechanisms in order to successfully identify and appropriately respond to signal senders. Although acoustic communication is common across birds, classical research has largely disregarded the perceptual abilities of perinatal altricial taxa. Chapter 1 reviews the literature of perinatal acoustic stimulation in birds, highlighting the disproportionate focus on precocial birds (e.g., chickens, ducks, quails). Chapter 1 summarizes what is currently known about typical infant sleep development and the way that sleep impacts learning throughout infancy. Chapter 2 describes two experiments showing the importance of napping and night sleep in the consolidation of gross motor learning. Climate change is one of the greatest threats facing humanity in the 21st century. This study investigated people’s observations of climate change in the United States Virgin Islands (USVI). A qualitative study was used with a Grounded Theory approach to better understand how people witnessed climate change events, what people’s emotional responses were, and what calls for action they had to respond to climate change in the USVI. Impostor phenomenon refers to an experience of hidden feelings of intellectual fraudulence held in achievement domains. While research on the subject is limited, impostors are reasoned to use dysfunctional performance strategies marked by overworking and withdrawing (Clance & Imes, 1988). In the present studies, the relationship between impostorism and the use of overworking strategies (i.e., overpreparation, unnecessary rework) and withdrawing strategies (i.e., procrastination, self-handicapping) were explored among a sample of college students with work experience. Chapter 1: In this chapter, I replace the Cobb–Douglas production function in Acemoglu and Guerrieri (2008) with a two-sector model using the CES production technology to analyze how the U.S. capital deepening process must cause unbalanced growth. The U.S. economy is classified into labor- and capital-intensive sectors. My model shows that due to the difference in the two sectors' elasticities of substitution between capital and labor, capital deepening leads to a growing concentration of labor in the labor-intensive sector, but a continuous reallocation of capital away from this sector. Indigenous Maya in Guatemala lived through one of Latin America’s most intense conflicts during the second part of the twentieth century. This research focuses on Maya politics, kinship relations, and interethnic experiences in multifarious mobilization through social democratic parties, rural unions, and cooperatives (1966-1974), and the intricacies of Maya indigenous participation in peasant organizations and insurgencies during the war escalation (1976–1982). Of the nearly 6 million people monitored by the prison and immigration enforcement complex in the US, a little over 4 million, or 70%, are under community supervision. If we narrow in on the nearly 350,000 people being monitored by the immigration system, the figure goes up to 93%. Yet, most studies on criminalization conducted in the US, prioritize confined individuals, neglecting community supervision. In this dissertation, I present the first theoretically driven, historical and sociological analysis that comprehensively targets fundamental questions about the political history of electronic monitoring in the US -- a practice also known as tagging.
