Trademark law recognizes that the same word can mean different things in different commercial contexts. Legal protection might extend to two or more owners who use the same symbol (like Delta) to indicate different sources of disparate goods or services, such as airlines and faucets. Generally, only those uses that threaten to confuse consumers-the use of similar symbols on identical or related goods-are subject to legal sanction.
But the law extends special protection to famous trademarks, not only against confusing use, but also against dilution: non-confusing use that blurs or tarnishes the distinctiveness of the famous mark. The result of …

Cultivating Culturally Responsive, Equity-Centered, And Trauma-Informed Attitudes Among Educators, Jasmine Haynes

This qualitative study explored the influence of implementing a culturally responsive and equity-centered trauma-informed professional development series with educators. Seven middle school educators from various regions of the U.S. participated in a culturally responsive and equity-centered trauma-informed professional development series in the 2021-2022 academic year. Educators participating in the series received three live virtual two-hour trauma-informed modules highlighting racial trauma, race-related trauma triggers, and deficit versus asset-based perspectives of racially diverse students, along with case studies and critical discourse. Data collection included pre-and post-interviews (n = 14), participant journal reflections (n = 14), and intervention module case study reflection transcripts …

While physical and mental chronic health conditions (CHCs) may be rising in university populations and are associated with diminished health and academic performance, less is known about how students with co-occurring mental and physical CHCs compare to students with only physical and only mental CHCs on stigma, health, and academic performance. This cross-sectional study of 201 university students examined Fall 2020 baseline data from a longitudinal investigation of the effects of stigma on health and academic performance in university students with CHCs. For more than 40 years, the relocation of meatpacking from urban to rural communities and the related change of who works in these high-risk, modestly compensated positions has brought Spanish-speaking and African and Asian refugee populations to communities like the seven focal Nebraska communities we consider here. These seven, five rural and two part of multi-county metropolitan areas, all have majority Latinx school enrollments and they all have been particularly hard hit by both the first and third waves of the COVID-19 pandemic. Counterproductive work behavior (CWB) costs U.S. organizations billions annually (e.g., Bennett & Robinson, 2000). Any behavior that goes against the goals of an organization and is intended to harm either the organization or its members can fit the definition of CWB. To properly address these problems an accurate understanding of CWB and its’ determinants is necessary. Employee perceptions of fairness (organizational justice) is linked to CWB because employees reciprocate unfair treatment with CWB (e.g., Shaw et al., 2003), and the personality traits honesty-humility and self-control are also strong determinants of CWB because high levels of these traits will suppress the …

It is essential for environmental protection that private actors be able to anticipate government regulation. If, for instance, the Biden Administration is planning to tighten regulations of greenhouse gas emissions, it is imperative that private companies anticipate this regulatory change now, not a few years from now after they have constructed even more coal- and gas-fired power plants. Those additional power plants will mean more irreversible greenhouse gases, and these plants can be politically challenging to shutter once built. The point is general to private actors making decisions in the shadow of potential government regulation. Better information about future government …

The science is clear: the United States and the world must take dramatic action to address climate change or face irreversible, catastrophic planetary harm. Within the U.S.—the world’s largest historic emitter of greenhouse gas emissions—this will require passing new legislation or turning to existing statutes and authorities to address the climate crisis. Doing so implicates existing and prospective delegations of legislative authority to a large swath of administrative agencies. Yet congressional climate decision-making delegations to any executive branch agency must not dismiss the newly resurgent nondelegation doctrine. Climate change is an existential phenomenon, which entails a wide variety of physical risks as well as sizeable but underappreciated economic risks. In March 2022, the U.S. Securities and Exchange Commission (SEC) moved to address some of the information gaps related to the effects of climate change on firms by proposing a rule that requires public companies to report detailed and standardized information about important climate-related matters for the benefit of investors and markets. Global governance architecture, crafted by wealthy nations, has perpetuated the subordination of developing jurisdictions. The Article offers a novel and surprising analysis of governance tools used by wealthy countries and inter-governmental organizations to constrain offshore financial centers (OFCs) by focusing on the tools’ disparate impacts on tax havens whose populations comprise predominantly Black and Brown people. With tax haven issues garnering increasing attention, this Article provides a pathbreaking conceptual framework for examining the international tax, crime, and business discourse on OFCs. "With All The Majesty Of The Law": Systemic Racism, Punitive Sentiment, And Equal Protection, Darren L. Hutchinson

United States criminal justice policies have played a central role in the subjugation of persons of color. Under slavery, criminal law explicitly provided a means to ensure White dominion over Blacks and require Black submission to White authority. During Reconstruction, anticrime policies served to maintain White supremacy and re-enslave Blacks, both through explicit discrimination and facially neutral policies. Similar practices maintained racial hierarchy with respect to White, Latinx, and Asian-American populations in the western United States. While most state action no longer explicitly discriminates on the basis of race, anticrime policy remains a powerful instrument of racial subordination. Indeed, social …

Beliefs, Information, And Institutions: Public Perception Of Climate Change Information Provided By Government Versus The Market, Cherie Metcalf, Jonathan R. Nash

Despite scientific consensus over the threat posed by climate change, governmental actions remain modest or stalled, often because of profound societal polarization: more liberal individuals tend to accept climate change as real, anthropogenic, and as posing a substantial (if not existential) threat, while more conservative individuals tend to doubt such assertions. The standard explanation for this phenomenon is that liberals tend to believe government-provided information—as information about climate change tends to be—while conservatives tend to doubt it. Commentators suggest that market-generated climate change information would more likely sway conservatives.
But this assertion lacks any empirical support. This Article explores this …

This Article peels through these layers of founding documents before exploring the final sixteen words of the First Amendment religion clauses. Part I explores the founding generation’s main teachings on religious freedom, identifying the major principles that they held in common. Part II sets out a few representative state constitutional provisions on religious freedom created from 1776 to 1784. Part III reviews briefly the actions by the Continental Congress on religion and religious freedom issued between 1774 and 1789. This dissertation examines change and innovation of Khon and Sendratari Ramayana performance in the context of cultural heritage tourism. It argues that the process of change and innovation implemented in Khon and Sendratari Ramayana is conditioned by the tourists’ demands. It leads to the production and development of “authentic” culture for tourists’ consumption in the dynamic environment that is persistently changing. The finding shows that the presentations of Khon Sala Chalermkrung and Sendratari Ramayana Prambanan in the domain of cultural heritage tourism, as a case study, have bridged the notion of tradition and modernity, highlighting the idea of constructive authenticity. …

Examining A Mediation Model Of Body Image-Related Cognitive Fusion, Intuitive Eating, And Eating Disorder Symptom Severity In A Clinical Sample, Jennifer L. Barney, Tyson S. Barrett, Tera Lensegrav-Benson, Benita Quakenbush, Michael P. Twohig

Purpose: This study sought to explore the associations between Intuitive Eating (IE), eating disorder (ED) symptom severity, and body image-related cognitive fusion within a clinical sample. IE was also examined as a possible mediator in the relationship between body image-related fusion and ED symptoms.
Methods: This study includes cross-sectional analyses with data from 100 adult females and 75 adolescent females seeking residential treatment for an ED. Self-reported demographic information, ED symptoms, IE behaviors, and body image-related cognitive fusion were collected from participants within the first week of treatment following admission to the same residential ED treatment facility.

งานวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาการปรับตัวให้สามารถปฏิบัติงานรับ-ส่งเอกสารราชการด้วยระบบสารบรรณอิเล็กทรอนิกส์ (E-SARABAN) ของบุคลากรสำนักงานจังหวัดนครศรีธรรมราช ผ่านทฤษฎีการบริการเปลี่ยนแปลง ของ Kurt Lewin ทฤษฎีกรอบความคิดของมนุษย์ ของ Dweck และ Leggett และทฤษฎีการเรียนรู้ของ Peter Senge งานวิจัยนี้เป็นการวิจัยเชิงปฏิบัติการ โดยมีกลุ่มตัวอย่างที่เข้าร่วมการวิจัยประกอบด้วยข้าราชการ และลูกจ้างเหมาบริการ ผลการวิจัยพบว่า สำนักงานจังหวัดนครศรีธรรมราช เป็นองค์กรที่มีโครงสร้างแบบลำดับชั้น (Hierarchy) และแยกส่วนการทำงานออกจากกัน (Silo) จึงเป็นองค์กรที่ขาดพลวัตร รวมทั้งบุคลากรมีกรอบความคิดแตกต่างกัน ระหว่างกรอบความคิดแบบเติบโต (Growth Mindset) และกรอบความคิดแบบจำกัด (Fixed Mindset) ดังนั้น การที่องค์กรมีผู้นำที่สามารถสร้างวิสัยทัศน์ร่วม (Shared Vision) รวมทั้งมีผู้เชี่ยวชาญเฉพาะด้าน (Technocrat) ที่คอยให้คำปรึกษาและแนะนำองค์กรให้สามารถขับเคลื่อนนโยบายให้เป็นไปตามวัตถุประสงค์ของรัฐบาลอย่างต่อเนื่อง ซึ่งส่วนผสมดังกล่าวจะทำให้บุคลากรสามารถทำงานร่วมกัน (Team Learning) เกิดการผสานคุณค่า (Shared Value) และส่งผลให้การทำงานในองค์กรเกิดพลวัตร ตอบสนองต่อสภาพแวดล้อมที่เปลี่ยนแปลงไปอย่างรวดเร็วในอนาคต

การวิจัยครั้งนี้เป็นการวิจัยแบบผสม Mix Method ใช้การวิจัยเชิงปริมาณ การวิจัยเชิงคุณภาพ ร่วมกับ SWOT Analysisมีวัตถุประสงค์เพื่อ 1) เพื่อศึกษาความเห็นของนักศึกษาต่อหลักสูตร “กัญชาและกัญชงศึกษาเพื่อใช้เป็นยาอย่างฉลาด”และ “หลักสูตรอาชีพโภชนาการจากส่วนของพืชกัญชาและกัญชง ที่ได้รับยกเว้นจากการเป็นยาเสพติด” ของนักศึกษาในระบบ การศึกษานอกโรงเรียนจังหวัดยะลา 2)เพื่อศึกษาการใช้ประโยชน์ทางยา การสร้างรายได้ การพัฒนาส่งเสริมคุณภาพชีวิต จากความรู้ที่ได้รับการศึกษา เพื่อจะได้ได้ทราบถึงประโยชน์ที่ นักศึกษาได้รับจากการศึกษาต่อการศึกษาตาม หลักสูตร และเสนอแนะแนวทางในการปรับปรุงหลักสูตร ผลการวิจัยพบว่า นักศึกษาโดยส่วนใหญ่ เลือกเรียนวิชา“กัญชาและกัญชงศึกษาเพื่อใช้เป็นยาอย่างฉลาด” ความคิดเห็นมีความพึงพอใจในหลักสูตรที่ศึกษาแต่ในด้านการใช้ประโยชน์ทางยาและการสร้างรายได้ยังไม่สามารถใช้ความรู้ที่ได้จากการศึกษานำไปสร้างรายได้หรือใช้งานทางการแพทย์ได้อย่างเป็นรูปธรรม เนื่องจากในพื้นที่ยังมีความกังวลในเรื่องหลักศาสนาอิสลาม รวมถึงหลักสูตรที่มีการสอนเฉพาะภาคทฤษฎี ยังขาดการเรียนในภาคปฏิบัติ อย่างไรก็ตามนักศึกษาส่วนใหญ่สามารถที่จะพัฒนาตนเองจากวิชาที่ศึกษารวมถึงได้รับหน่วยกิตในการเรียนระดับมัธยมปลาย ของหลักสูตรการศึกษานอกโรงเรียนอันเป็นเป้าประสงค์หลักในการเข้ารับการศึกษา ข้อเสนอแนะทางบริหาร: ให้มีวิชาต่อเนื่องทางภาคปฏิบัติของหลักสูตร“กัญชาและกัญชงศึกษาเพื่อใช้เป็นยาอย่างฉลาด” และหากมีการปรับปรุงหลักสูตร ควรใช้แนวคิด Bottom up ในการปรับปรุงหลักสูตรโดยให้ข้าราชการฝ่ายปฏิบัติในท้องถิ่นร่วมกันแสดงความคิดเห็นในการออกแบบและมีส่วนร่วมในการปรับปรุงหลักสูตร

วิทยานิพนธ์ฉบับนี้มีจุดมุ่งหมายเพื่อศึกษาความสัมพันธ์ระหว่างพฤติกรรมการสูบบุหรี่และการดื่มเครื่องดื่มแอลกอฮอล์ในประเทศไทย โดยใช้กลุ่มตัวอย่างจากการสำรวจพฤติกรรมการสูบบุหรี่และการดื่มสุราของประชากร พ.ศ. 2560 ที่ตอบสัมภาษณ์ข้อมูลพื้นฐานทางด้านประชากร ข้อมูลรายละเอียดเกี่ยวกับพฤติกรรมการสูบบุหรี่ และข้อมูลเกี่ยวกับพฤติกรรมการดื่มสุราหรือเครื่องดื่มที่มีแอลกอฮอล์ ซึ่งจัดเก็บและสำรวจโดยสำนักงานสถิติแห่งชาติ จำนวนทั้งสิ้น 89,154 ตัวอย่าง มาวิเคราะห์ด้วยแบบจำลองทางเศรษฐมิติ Bivariate Probit Model โดยกำหนดให้ ตัวแปรอัตราส่วนจำนวนนักดื่มรายจังหวัด ตัวแปรดัชนีราคาเครื่องดื่มแอลกอฮอล์รายจังหวัด และตัวแปรอัตราส่วนจำนวนการเกิดความรุนแรงในครัวเรือนรายจังหวัดเป็นตัวแปรเครื่องมือ (Instrumental Variables) ของพฤติกรรมการดื่มเครื่องดื่มแอลกอฮอล์เพื่อบรรเทาปัญหา Endogeneity Bias ที่เกิดขึ้น ผลการศึกษาพบว่าคนที่เป็นนักดื่มในปัจจุบันจะทำให้มีโอกาสในการเป็นผู้ที่สูบบุหรี่ในปัจจุบันด้วยสูงขึ้นอย่างมีนัยสำคัญทางสถิติ กล่าวคือคนที่มีพฤติกรรมการดื่มเครื่องดื่มแอลกอฮอล์จะทำให้มีโอกาสในการมีพฤติกรรมการสูบบุหรี่ร่วมด้วย และนอกจากนี้ ผลการศึกษายังพบว่ามีปัจจัยที่ส่งผลต่อการมีพฤติกรรมการสูบบุหรี่ ได้แก่ เพศ, ภูมิภาคที่อาศัย, อายุ, ระดับการศึกษา, สถานภาพสมรส, สถานภาพการทำงาน, ราคาผลิตภัณฑ์ยาสูบโดยเปรียบเทียบ และรายได้โดยเฉลี่ยต่อเดือน ซึ่งจากผลการศึกษาที่กล่าวมานั้น สะท้อนให้เห็นว่าการมีพฤติกรรมการดื่มเครื่องดื่มแอลกอฮอล์ที่แตกต่างกันทำให้มีพฤติกรรมการสูบบุหรี่ที่แตกต่างกันเช่นกัน รวมถึงยังชี้ให้เห็นถึงลักษณะการเป็นสินค้าที่ใช้ประกอบกันระหว่างบุหรี่และเครื่องดื่มแอลกอฮอล์อีกด้วย

การวิจัยในหัวข้อ ปัจจัยที่มีผลต่อประสิทธิภาพในการปฏิบัติงานของบุคลากรในสังกัดสำนักงานคณะกรรมการข้าราชการครูและบุคลากรทางการศึกษา มีวัตถุประสงค์เพื่อศึกษาแนวคิด ทฤษฎี เกี่ยวกับประสิทธิภาพในการปฏิบัติงานของบุคลากร ศึกษาปัจจัยที่มีผลต่อประสิทธิภาพในการปฏิบัติงาน และศึกษาปัญหาและอุปสรรคที่มีผลต่อประสิทธิภาพในการปฏิบัติงานของบุคลากรในสังกัดสำนักงานคณะกรรมการข้าราชการครูและบุคลากรทางการศึกษา เป็นการวิจัยเชิงปริมาณ โดยการเก็บแบบสอบถามจากบุคลากร ซึ่งมีผู้ตอบแบบสอบถามทั้งสิ้น 189 คน วิเคราะห์ข้อมูลด้วยสถิติความถี่ ร้อยละ ส่วนเบี่ยงเบนมาตรฐาน การทดสอบ T-Test, One-way ANOVA และ Multiple regression ผลการวิเคราะห์ปัจจัยส่วนบุคคลที่ส่งผลต่อประสิทธิภาพในการปฏิบัติงานของบุคลากรในสังกัดสำนักงานคณะกรรมการข้าราชการครูและบุคลากรทางการศึกษา โดยวิเคราะห์ปัจจัยส่วนบุคคล ได้แก่ เพศ อายุ ระดับการศึกษา ตำแหน่งงาน ระยะเวลาที่ปฏิบัติงาน (อายุราชการ) และรายได้เฉลี่ยต่อเดือน พบว่า เพศ ตำแหน่งงาน ระยะเวลาปฏิบัติงานและรายได้ต่อเดือนที่แตกต่างกันไม่ส่งผลต่อประสิทธิภาพในการปฏิบัติงานอย่างมีนัยสำคัญทางสถิติที่ระดับ 0.05 ส่วนอายุและระดับการศึกษาที่แตกต่างกันส่งผลต่อประสิทธิภาพในการปฏิบัติงานอย่างมีนัยสำคัญทางสถิติ ที่ระดับ 0.05 ส่วนผลการวิเคราะห์ปัจจัยที่มีผลต่อประสิทธิภาพในการปฏิบัติงานแตกต่างกันส่งผลต่อประสิทธิภาพในการปฏิบัติงานของบุคลากรในสังกัดสำนักงานคณะกรรมการข้าราชการครูและบุคลากรทางการศึกษาแตกต่างกัน โดยวิเคราะห์ปัจจัย ได้แก่ ด้านนโยบายและการบริหาร ด้านลักษณะงานที่รับผิดชอบ ด้านโอกาสความก้าวหน้าในหน้าที่การงาน ด้านสภาพแวดล้อมในการทำงาน ด้านการได้รับการยอมรับนับถือ ด้านสัมพันธภาพกับเพื่อนร่วมงาน/ผู้บังคับบัญชา และด้านการได้รับค่าตอบแทนในการทำงาน พบว่า ด้านลักษณะงานที่รับผิดชอบ ด้านสภาพแวดล้อมในการทำงาน ด้านการได้รับการยอมรับนับถือ ด้านสัมพันธภาพกับเพื่อนร่วมงาน/ผู้บังคับบัญชา และด้านการได้รับค่าตอบแทนในการทำงาน ส่งผลต่อประสิทธิภาพในการปฏิบัติงานของบุคลากรอย่างมีนัยสำคัญทางสถิติที่ระดับ 0.05
