Specialty drugs represent a growing concern for both health insurance issuers and beneficiaries given their exceedingly high (and growing) costs—representing almost half of all drug spend by 2017. Payers have sought to reduce their specialty drug spend by sharing more of the cost of these drugs with the beneficiaries who depend on them through the creation of specialty drug tiers. This has forced some patients to choose between forgoing other needs to pay for their medications or not take them at all. While several states have sought to outlaw the use of specialty drug tiers or limit pharmaceutical OOP cost-sharing, …

In this paper I am considering the numerous effects that hosting refugees can have on a host country. These effects can be seen when examining a host country’s health, economic, educational, and security sectors. In addition, many cases of refugee flows are associated with conflict contagion, which may cause a refugee population to become militarized. After reviewing the relevant literature on these topics, I study how these possible effects unfold in the context of the Syrian refugees currently escaping to Jordan from their civil war. The problem of nuclear waste disposal has existed since the time of the Manhattan Project in World War II. Although there exist a number of technological hurdles, the main cause that has consistently plagued a solution to nuclear waste has been the politics behind it. This thesis attempts to add to the political literature behind nuclear waste disposal by examining the nuclear waste disposal preferences of members of the United States House and Senate. It then compares and contrasts those preferences with a report by President Obama's Blue Ribbon Commission on America's Nuclear Future. The hope was to determine if …

The Global Recession of 2008 and ensuing austerity measures have renewed the urgency surrounding the call for fundamental tax reform. Before embarking on fundamental tax reform, this Article proposes adding a critical lens to existing US tax policy to ensure that any proposals for change are informed, transparent, and responsive to the needs (and abilities) of individual taxpayers. This Article makes the case for a specific method of inquiry – Critical Tax Policy – that is built on the articulation of difference rather than false assumptions of sameness. For approximately the past 40 years Republican Presidents have appointed younger Justices than have Democratic Presidents. Depending on how one does the accounting, the average age difference will vary, but will not go away. This Article posits that Republicans appointing younger justices than Democrats may have caused a rightward shift in the Supreme Court. We use computer simulations to show that if the trend continues the rightward shift will likely increase. We also to produce some very rough estimates of the size of the ideological shift, contingent on the size of the age differential. In addition, we show that the …

The Arab Spring, with a call for a more democratic system of governance, was a phenomenon that will continue to shape the political and social spheres of the Arab world for generations to come. This paper focuses on answering the question of to what extent Islamist political parties, having recently won majorities within the preliminary governments in the two countries, will use an ever-changing Islam religion within the formation of their fledgling governments and constitutions.

Despite some difficulties, state tort law can be argued to create a unique exception to patent law. Specifically, the prevented rescue doctrine suggests that charities and others can circumvent patents on certain critical medications when such actions are necessary to save individuals from death or serious harm. Although this Article finds that the prevented rescue tort doctrines is preempted by federal patent law, all hope is not lost. A federal substantive due process claim may be brought that uses the common law to demonstrate a fundamental right that has long been protected by our Nation’s legal traditions. This project examines the rise of religious parties in secular democracies. In both Turkey and India, religious parties have enjoyed electoral successes (and failures). While religion is a significant issue to voters, it is oftentimes the persistence of economic problems that leads to the rise and fall of religious parties. The impact of coalition governments, change in political rhetoric, and relationship between government and religion in both countries are also analyzed and contrasted.

After decades of struggling to gain the right to vote, women were finally granted that right with the passage of the Nineteenth Amendment on August 18, 1920. While it would seem that most, if not all, women would be in favor of gaining the right to vote, the women’s suffrage movement did not represent the wishes of all women within the United States. Scholarship in this area largely focuses on the historical developments of the suffrage movements, with the presence of female opponents of suffrage and anti-suffragist organizations receiving less attention.1 These anti-suffragists were vocal in their opposition to the …

Nigeria’s oil-rich Niger Delta region has seen little benefit from the billions of dollars earned from oil over the last four decades, prompting a growing but disorganized insurgency across the region. Irresponsible oil companies and government officials have reduced the Niger Delta to one of the most polluted environments on earth. Corrupt local and national politicians, many of whom came to power through rigged elections, have colluded to manipulate ethnic divisions amid poverty to loot the region’s wealth. Old New Hampshire Highway Number Four was incorporated by an act of the New Hampshire legislature in the autumn of 1800. It wound out of Portsmouth, a seaport that once rivaled Boston, drove west through Concord, north past Penacook, through Boscawen, Salisbury, Andover, and Wilmot on its way to Lebanon and the Connecticut River. These names string history like beads. The Penacook tribe assembled each year on the banks of the Merrimack at the site of the present town that bears their name. Devolution as practiced in much of the world is decentralization of program authority and responsibility to achieve greater administrative efficiency or program standards. Devolution as practiced by the Bush administration and the Republican Congress is not that, nor is it a diminution of federal power and the strengthening of states’ rights. Rather, it is a radical restructuring of government to prevent the expenditure of funds for traditional Democratic programs of the New Deal and the Great Society, and to prohibit states from being either more generous in social programs or more stringent in regulating industry than this administration desires.

This presentation explores the relationship between the funding and policy priorities established by presidential administrations and the financial resources provided to individual states and regions. Information gathered from a newly compiled database of all federal project grants from 1996-2008 helps illuminate the distribution of money across the 50 states. These data are complemented by field research in federal and state bureaucracies. Would you be surprised to learn that the executive branch delivers more money and grants to swing states than all other states? Furthermore, the proximity of a presidential election further enhances this preference to deliver funds to swing states. …

Jim A. Kuypers’ recent book, Press Bias and Politics, has made a significant advance in the methodology of inquiring into this issue—although it’s a safe bet that many in the scholarly community will be tempted to dismiss it out of hand. That’s a shame, if so, because even if one is disinclined to accept Kuypers’ conclusion that the press tends to favor ideas associated with the political left, his method can at least put the debate on a firmer footing.

Political involvement varies markedly across people. Traditional explanations for this variation tend to rely on demographic variables and self-reported, overtly political concepts. In this article, we expand the range of possible explanatory variables by hypothesizing that a correlation exists between political involvement and physiological predispositions. We measure physiology by computing the degree to which electrodermal activity changes on average when a participant sequentially views a full range of differentially valenced stimuli. Our findings indicate that individuals with higher electrodermal responsiveness are also more likely to participate actively in politics. This relationship holds even after the effects of traditional demographic variables …

Between the Civil War and World War II, every state and the federal government shifted toward codified versions of their statutes. Academia has so far ignored the systemic effects of this dramatic change. For example, the consensus view in the academic literature about rules and standards has been that precise rules present higher enactment costs for legislatures than would general standards, while vague standards present higher information costs for courts and citizens than do rules. Systematic codification – featuring hierarchical format and numbering, topical arrangement, and cross-references – inverts this relationship, lowering transaction costs for legislatures and increasing information costs …
