Efficient, Fair, And Incomprehensible: How The State “Sells” Its Judiciary, Keith J. Bybee, Heather Pincock

Socio-legal scholars often approach dispute resolution from the perspective of the disputants, emphasizing how the resources on each side shape the course of conflict. We suggest a different, “supply-side,” perspective. Focusing on the state's efforts to establish centralized courts in place of local justice systems, we consider the strategies that a supplier of dispute resolving services uses to attract disputes for resolution. We argue that state actors often attempt to “sell” centralized courts to potential litigants by insisting that the state's services are more efficient and fair than local courts operating outside direct state control. Moreover, we argue that state …
"American Dream" Or Global Nightmare?, Melanie E. L. Bush
"American Dream" Or Global Nightmare?, Melanie E. L. Bush
Journal of Global Initiatives: Policy, Pedagogy, Perspective
In the United States we are witnessing a period of heightened contestation about the parameters of nationalism, patriotism, and loyalty. The oft-heard phrase "Support the Troops" now signifies the desire both to send more soldiers to war and to bring home those already in combat. This "nation of immigrants" has spawned a new generation of "minute-men" to defend national borders while mainstream discourse touts the benefits of "diversity." Dreams of upward mobility present for some during the mid-20th century seem now hazy at best as the proportional income of those at top grows while the rest of the population increasingly …

"Globalization As The Ultimate Evil": Reading Turkey's Extreme Right And Extreme Left Political Parties' Views Of Globalization, H. Bahadir Turk
"Globalization As The Ultimate Evil": Reading Turkey's Extreme Right And Extreme Left Political Parties' Views Of Globalization, H. Bahadir Turk
Journal of Global Initiatives: Policy, Pedagogy, Perspective
Turkey has been witnessing multi-dimensional debates concerning the question of globalization. What is particularly striking is that Turkey's extreme right and extreme left wing parties, which are literally enemies of each other, have been meeting at the same anti-globalist point by using the same rhetoric. In this study, the central argument is that Turkey's new political context has given rise to this anomaly. Analyzing why these parties detest the globalization process, this article focuses on the dynamics of Turkey's political context through globalization debates and discusses the dimensions of the alliance between these anti-globalist political parties.
Islam, Globalization, And Freedom Of Expression, Muhammad Daiyabu Hassan
Islam, Globalization, And Freedom Of Expression, Muhammad Daiyabu Hassan
Journal of Global Initiatives: Policy, Pedagogy, Perspective
The exercise of freedom of expression by a segment of the secular establishment, mainly among members of the literary and intellectual elite in the West, in relation to Islam, constitutes a major obstacle in the search for common grounds between the Islamic world and the West. Due to historical factors, the church seems to have assented to the continuous secular attacks on Christianity. Some examples in this regard are Dan Brown's Da Vinci Code and Martins Scorsese's film adaptation of Nikos Kazanstzaki's The Last Temptation of Christ. To this segment of Western secular cultural thinkers, nothing is sacred. The …
From The Alliance Of Economies To The Alliance Of Civilizations: Turkey's Strategic Role And Importance, Murat Doral
From The Alliance Of Economies To The Alliance Of Civilizations: Turkey's Strategic Role And Importance, Murat Doral
Journal of Global Initiatives: Policy, Pedagogy, Perspective
In "The Clash of Civilizations;' Huntington hypothesized that the principal conflicts of global politics will occur between groups of different civilizations, and concluded that the "clash of civilizations" will dominate global politics in the future. In addition, Huntington declared Turkey as one of the "torn countries" and tried to make connections between its Muslim identity and its delayed ED membership. The growing trade and investments volume tell us that regardless of our differences, people around the world understand the benefits of economic cooperation and would prefer this route to starting a war of civilizations.
Turkey As A Catalyst For The Alliance Of Civilizations, Umut Uzer
Turkey As A Catalyst For The Alliance Of Civilizations, Umut Uzer
Journal of Global Initiatives: Policy, Pedagogy, Perspective
The Alliance of Civilizations (AoC) project offers opportunity spaces for the United Nations as well as for Spain and Turkey to tackle the issues of radicalism and animosities between different cultures. This article puts the AoC in its historical and political context by analyzing the relevance of Turkish foreign policy and the ruling Justice and Development Party)s (JDP) orientation to domestic and foreign affairs. The AoC fits within the framework of JDP's inclinations to solve all problems with its neighbors as well as with its manifest or latent Muslim identity. The major question is whether Turkey continues to perceive itself …
Turkey: Politics At The Crossroads Of Civilizations, Maia Carter Hallward
Turkey: Politics At The Crossroads Of Civilizations, Maia Carter Hallward
Journal of Global Initiatives: Policy, Pedagogy, Perspective
This article discusses how Turkey is often under-studied due to the fact that it does not fit neatly into the analytical "boxes" used to discuss international politics. Not only does Turkey straddle Europe and Asia, but it is one of few Middle Eastern countries that was not ruled by Western empires (and, in fact, controlled parts of Europe). It is a non-Arab secular democracy currently governed by a Muslim-oriented party. Because of these unique characteristics, scholars and policy makers have much to learn from Turkey and its approach to challenging issues of regional concern.
The Turkish Thesis: Dialogue Among Civilizations And Linguistic-Operational Corridors, Gökhan Bacık
The Turkish Thesis: Dialogue Among Civilizations And Linguistic-Operational Corridors, Gökhan Bacık
Journal of Global Initiatives: Policy, Pedagogy, Perspective
Turkey has occupied an attention-grabbing position in the lexicon on the dialogue among civilization. The mainstream discourse on this subject keeps citing Turkey as an important actor. Political elites in Turkey also present their country as an indispensable actor. But what is the philosophy behind Turkey's claim of importance? Is Turkey really a critical state that cannot be overlooked in dialogue among civilizations? Are there concrete facts to defend the Turkish thesis? If so, what are they? This article presents the inner logic of the Turkish thesis. It employs communication theory to test the Turkish thesis and also sheds light …
The Missed Dialogues Of The Euro-Turkish Relationships, Juliette Tolay
The Missed Dialogues Of The Euro-Turkish Relationships, Juliette Tolay
Journal of Global Initiatives: Policy, Pedagogy, Perspective
This paper attempts to assess the state of dialogue between Europe and Turkey. Using Thomas Risse's application of Habermas' theory of communicative action, it covers and analyzes four opportunity spaces for dialogue: the European Union-Turkish institutional relationship, the bilateral diplomatic relationships between European countries and Turkey, Turkish immigration to Europe, and European tourism in Turkey. Overall, most communicative interaction between Europe and Turkey is done under the logic of appropriateness (rule-guided behavior) as opposed to the logic of consequentialism (interest-guided behavior) or the logic of arguing (reasoning-guided behavior). As interactions remain superficial and one-sided, they merely are "missed dialogues."

On February 16, 2001, while George W. Bush, President of the United States (U.S.), attended a news conference in Mexico hosted by Vicente Fox, President of Mexico, a distinct difference between the two men became apparent when reporters asked questions about Iraq. President Fox hesitated to make a declaration regarding Iraq saying: “this is not the meeting in which decisions or details are going to be reached, because they do not belong in the power of—the executive power, as such, because they have to have the participation of other groups.” When another reporter asked about the then recent bombing of …
