To Advise And Consent: The Senate And Lower Federal Court Nominations, 1977-1998, W. L. Martinek, Mark Kemper, S. R. Van Winkle

Political Science Faculty Publications

Using nominations to Article III district and appeals court judgeships, we test a model of senatorial treatment of presidential nominations to the lower federal bench, looking both at outcome (whether or not a nomination culminates in confirmation) and process (the length of time it takes the Senate to process a nomination). We find evidence that nominee quality matters, as does composition of the Judiciary Committee and pending judicial nominations. Contrary to charges made in the popular press, however, neither race nor gender makes a difference for ultimate success or failure of a nomination. Duration analysis reveals that race (though not …

A Role For Natural Resource Social Science In Biodiversity Risk Assessment, Philip J. Nyhus, Frances R. Westley, Robert C. Lacey, Philip S. Miller

Biologists have made considerable progress in developing realistic simulation models to predict extinction risks for threatened species. Social scientists have to date had a more limited role in these efforts. This limited involvement comes despite the growing acknowledgment by population biologists and simulation modelers that this additional input is necessary for these models to accurately reflect the impact of humans and human-dominated landscapes on wildlife populations. We argue that collaborations among social and biological scientists can provide unparalleled opportunities to develop new conceptual and simulation tools for biodiversity risk assessment. Celling Black Bodies: Black Women In The Global Prison Industrial Complex, Julia Sudbury

The 1980s and 1990s have witnessed an explosion in the population of women prisoners in Europe, North America, and Australasia, accompanied by a boom in prison construction. This article argues that this new pattern of women's incarceration has been forged by three overlapping phenomena. The first is the fundamental shift in the role of the state that has occurred as a result of neo-liberal globalization. The second and related phenomenon is the emergence and subsequent global expansion of what has been labelled a 'prison industrial complex' made up of an intricate web of relations between state penal institutions, politicians and …

Through characters like farmer McElligot and the Lorax, who spoke out against the greedy Once-ler and his destructive clear-cutting practices, Theodor Geisel, a.k.a. Dr. Suess, vividly depicted the plight of many private lands and waterways in the twentieth century. Although the message still resonates with children (and adults) today, the ecological health of private land has not improved a whole lot since Geisel wrote McElligot's Pool in 1947. Discusses the termination of desegregation decrees and the elusive meaning of unitary status, first introducing the topic and then covering Jenkins III and providing an overview of desegregation scholarship including discretion, capacity, and legitima. Also discusses the evolution of equity, including English equity, American equity, and equity and desegregation. Explores the concepts of relevant rights and interests, focusing on Hohfeld, the interest theory of rights, and the application of the rights theory. There are three or four general categories of "waste." There is "municipal solid waste" (the waste that comes out of households, hotels, restaurants, businesses, etc.), "hazardous waste," and "nuclear waste," the latter of which is sometimes divided into low-level and high-level nuclear waste. (My remarks today will focus almost exclusively on municipal solid waste and hazardous waste).

All of us are most familiar with municipal solid waste. Where does municipal solid waste end up? The vast majority of U.S. municipal solid waste - 57 percent - goes to landfills. Twenty-two percent of U.S. municipal solid waste is recycled, fifteen percent …

Justifying Capital Punishment In Principle And In Practice: Empirical Evidence Of Distortion In Application, Robert F. Schopp

Some Supreme Court opinions overturn capital sentences or reason that such sentences should be overturned due to inappropriate patterns of application, although the Justices writing these opinions apparently accept capital punishment ("CP") as constitutional in principle. In a widely-recognized opinion, Justice Blackmun announced that he would no longer accept CP as constitutional under the Eighth Amendment by stating, "I no longer shall tinker with the machinery of death." He previously accepted CP as constitutional, however, and apparently continued to see it as constitutional in principle. Three of five concurring Justices in Furman overturned the capital sentences at issue in that …

The Roadless Area Controversy: Past, Present, And Future, Sandra Zellmer

On January 5, 2001, after more than a year of public deliberations but only a few days before leaving office, the Clinton Administration issued the Roadless Area Conservation Rule (Roadless Rule), placing one-third of all national forest lands off-limits to road construction. Opponents argue that this prohibitation creates "de facto" wilderness preserves, locking up the affected lands -- nearly 60 million acres lying almost entirely within 12 western states -- to mineral development, timber harvest, and other extractive industries.

The Roadless Rule is the subject of both ongoing litigation and reconsideration by the Bush Administration. Regardless of the outcome of …

From October 2000 to February 2001, personnel from Prewitt and Associates, Inc., conducted National Register of Historic Places eligibility testing of nine sites located at Waco Lake in McLennan County, Texas. The U.S. Army Corps of Engineers, Fort Worth District, sponsored the project as a result of the proposed plan to raise the conservation pool level of the lake by 7 ft to 462 ft above mean sea level. The objectives of this exploratory pollen analysis of selected samples from a sediment core taken at Hargrove Lake, Davy Crockett National Forest, Houston County, Texas, are to ascertain the quality of pollen preservation in the lake bottom matrix and to evaluate the potential of the pollen spectra deposited in the lake for providing information about former environmental conditions on Davy Crockett National Forest. Knowledge of early Caddo culture comes from both archaeological and ethnographic sources. Enough archaeological research had been completed by the early 1970s to provide a fairly thorough chronology for the major pre-Columbian developments in the Caddoan area. and archaeological research has been extensive since that time.

Accounts of the DeSoto expedition of 1541-1542 constitute the earliest source of ethnohistoric data on the Caddo. Translations of the De Soto documents may be found in Bourne, Robertson, Varner and Varner, and more recently, Clayton. Some scholars think it likely that Coronado reached the edge of Caddo territory in 1541, but the consensus …
