Most of the Canadian plains region is covered by the "Numbered Treaties" negotiated in the 1870s between the government of the Dominion of Canada, acting for the British Crown, and the nations whose territories encompassed the area. Even at the time that the treaties were negotiated, the various signatories had different assumptions about what they actually meant. During the ensuing century and more that the treaties have existed, their meanings have been reinterpreted. With the repatriation of the Canadian constitution in 1982, giving treaty rights constitutional status and protection from the Canadian Charter of Rights and Freedoms, the actual guarantees …

This is a penetrating analysis of the "complicated melange of war hysteria, fear of anarchy and Bolshevism, postwar anomie, nativism, pietism, populism, and progressivism" that prompted serious assaults on parochial schools during the years following the first World War. Fired by zealots who feared an America awash in a sea of immigrants whose schools and churches (and especially those operated by Germans) were bulwarks of ethnic identity, the era produced concerted efforts in Nebraska, Oregon, Michigan, Hawaii, and Washington to shut parochial schools, create compulsory attendance statutes, and outlaw foreign language instruction and use. This innovative work is an ethno-historical study of the Ojibwa migration from the Great Lakes region to the Plains. Building on earlier studies by Harold Hickerson (The Chippewa and Their Neighbors) and Charles Bishop (The Northern Ojibwa and the Fur Trade), particularly in the use of the Hudson's Bay Company Archives, Peers reconstructs processes of historical change over a ninety year period. She is not content, however, simply to document the historical record, but instead takes on a much broader challenge, and herein lies the major value of her study.

Y-Chromosome Effects On Drosophila Geotaxis Interact With Genetic Or Cytoplasmic Background, Scott F. Stoltenberg, Jerry Hirsch

Previously, all of the major fruit fly, Drosophila melanogaster, chromosomes (I, II, and III) have been shown to be associated with geotaxis, but the Y chromosome has not. Using two methods (back-crossing and chromosome substitution), Y chromosomes from lines that have evolved stable, extreme expressions of geotaxis were placed into different genetic and cytoplasmic backgrounds to test the resulting males for geotaxis. The results of the back-crossing do not support the interpretation of Y-chromosome effects on geotaxis. These tests do not have sufficient statistical power, however, to detect small genetic effects. Third Circuit Holds That Prayer At Graduation Is Unconstitutional Even If It Results From A Student Vote, Richard E. Moberly

Despite the Supreme Court's 1992 holding in Lee v. Weisman that state-sponsored prayer during a public school graduation ceremony violates the Establishment Clause, the issue of graduation prayer has recently resurfaced. Seeking to avoid Lee's prohibition, school boards have allowed students to decide by majority vote whether prayer will occur at graduation. The Third Circuit recently held, however, that these state-authorized student referenda regarding prayer violate the Establishment Clause. In ACLU v. Black Horse Pike Regional Board of Education, the court properly recognized the danger that popular votes could pose to the protections of the Establishment Clause, yet …

Is devolution of power to sub-national governments by the constitution of federal states or by delegation in other nations a threat to maximizing the benefits of free trade within the Americas? Conversely, is the drive towards regional free trade a threat to the goals of federalism and decentralization? These are two of the many questions that arise in revisiting NAFTA and eyeing the successful creation of a Free Trade Agreement of the Americas (FTAA) by the year 2005, an initiative launched by thirty-four nations within the region in December 1994.

Methylenetetrahydrofolate reductase catalyzes the reduction of methylenetetrahydrofolate to methyltetrahydrofolate, which serves as the methyl donor for the conversion of homocysteine to methionine in the reaction catalyzed by methionine synthase. Recent studies have provided evidence for association of a common polymorphism of methylenetetrahydrofolate reductase with elevated levels of blood homocysteine, a metabolite correlated with increased cardiovascular risk in humans. In this chapter, we review earlier studies on the properties of the mammalian enzyme, interpreting these observations in the light of the deduced amino acid sequence for the human enzyme. The Narrow And Shallow Bite Of Romer And The Eminent Rationality Of Dual-Gender Marriage: A (Partial) Response To Professor Koppleman, Richard F. Duncan

The Supreme Court's opinion in Romer has a very narrow and shallow bite. It does not hold that homosexuals are a suspect or quasi-suspect class under the Equal Protection Clause. It does not overrule or undermine the Court's landmark decision in Bowers v. Hardwick."° It does not hold that moral disapproval of homosexual conduct is invidious or irrational, nor does it in any way state or imply-as Professor Koppelman asserts-that laws that discriminate against homosexuals are always "constitutionally doubtful ... because they will always arouse suspicion that they rest on a bare desire to harm a politically unpopular group."

Wigstock And The Kulturkampf: Supreme Court Storytelling, The Culture War, And Romer V. Evans, Richard F. Duncan

It bears repeating that the Supreme Court's decision in Romer is of trivial doctrinal import. The Court did not recognize homosexuals as a suspect or quasi-suspect class, nor did it reverse or undermine its landmark decision in Bowers v. Hardwick. Moreover, the narrow holding of Romer suggests quite strongly that typical laws disadvantaging homosexuals--the military exclusion, the heterosexual paradigm of civil marriage, and perhaps even better-crafted and more narrow versions of Amendment 2--do not offend the Equal Protection Clause. These laws rationally advance legitimate government interests and should easily pass scrutiny under the rational basis test applied by the …

The technique of appending substantive provisions to appropriations bills has become a favorite tool of the legislative trade in recent years. Congress has employed appropriations riders to dictate the outcome of public policy issues ranging from abortion to oil development in pristine wilderness areas. Riders have been used with particularly destructive effect to circumvent long-standing environmental policies, especially those involving the use of natural resources and public lands. In many cases, the policies affected were the result of decades of activity in Congress and in the courts, and retain broad public and legislative support. Unlike the Native American tribes of the northern Plains-especially the Teton Sioux-the Indians of the southern Plains have been relatively neglected by historians. This is partially the result of these tribes' long, extensive dealings with the Spanish and French before interacting with representatives of the United States in the mid-nineteenth century. The nomadic buffalo hunting Comanches and Kiowas have had their share of chroniclers, due in part to the dramatic wars they fought in response to their being forced onto reservations following the Civil War. Will James (1892-1942) served as living proof that prison can reform a man. Convicted of rustling in 1915, he used his writing and drawing ability in prison to prove his social worth and rehabilitation. By the time alcohol abuse ended his life, he had illustrated and written twenty-four entertaining volumes.

Most of James's books have been long out of print. Thanks to joint efforts by the Will James Society (PO Box 8207, Roswell, MN 88202) and Mountain Press Publishing, all of his works will be reprinted. The Drifting Cowboy, first published in 1925, joins his first book, Cowboys North …

Richard White, the creator of the touring panel exhibition "The Frontier in American Culture," made his reputation promoting a product labeled "New Western History." James Ruppert discusses works by six Native American writers whom he believes "mediate" Indian and non-Indian world views. He argues convincingly that narratives by N. Scott Momaday, James Welch, Leslie Marmon Silko, Gerald Vizenor, D'Arcy McNickle, and Louise Erdrich are delivered from "an artistic and conceptual standpoint, constantly flexible, which uses the epistemological frameworks of Native American and Western cultural traditions to illuminate and enrich each other." In the year 1880 two brothers, William G. and Charles E. Conrad, organized the First National Bank at Fort Benton in north central Montana, capitalized at $50,000. They supplied at least $10,500 of this capital and gradually came to own a majority of the stock. From this modest start, the Conrad partnership expanded through involvement not only in the First National but also in other Montana banks until its emergence as a banking empire thirty-four years later with a paid-up capital of more than half a million dollars. The partnership grew by entering several geographical markets, becoming a regional partnership. …
