Nebraska Supreme Court Decides Pumpkin Creek Case, J. David Aiken
Nebraska Supreme Court Decides Pumpkin Creek Case, J. David Aiken
Cornhusker Economics
On January 21, 2005 the Nebraska Supreme Court handed down its decision in Spear T Ranch v Knaub, deciding for the first time how conflicts between surface water irrigators and ground water irrigators will be resolved. The case is one of the most important Nebraska Supreme Court decisions in a generation, and will have significant legal impacts for years. This article, which appeared in the March 2005 Nebraska Farmer magazine, provides a brief overview of the Spear T Ranch decision.

All children hope that they will someday make more money than their parents; just as parents hope their children will live more fulfilling lives than they did. These goals imply economic growth for the society as a whole. If the country expands its economic pie, there is more to go around for everyone. But economic growth could lead to excessive use of natural resources and other environmental amenities. If this is the case, there may be conflicts between growth and environmental protection, both of which are important social objectives. Exactly what is the relationship between economic growth and the use …

Trends In Organizational Communication Research: Sustaining The Discipline, Sustaining Ourselves, Kathleen J. Krone
Department of Communication Studies: Faculty Publications
This paper began as a keynote address delivered at the 16th annual Organizational Communication Mini-Conference hosted by Western Michigan University. In it, I identify topical trends in organizational communication research, noting ways in which these trends are flexible, enduring, diverse, and problem-centered. I go on to invite current doctoral students to join us in developing these trends further. Specifically, I discuss how we might engage research in ways that sustain the vitality of the discipline as well as our own personal vitality. I conclude by offering a list of key articles that could serve as starting points in the ongoing …

Collectors, Collecting, & Collections: A Symposium Sponsored By The International Quilt Study Center
Collectors, Collecting, & Collections: A Symposium Sponsored By The International Quilt Study Center
International Quilt Museum: Resources
Welcome… to the 2005 Biennial Symposium of the International Quilt Study Center. Like all of the IQSC undertakings, the goal of this gathering is to celebrate quilts and quiltmaking. The focus of this Symposium is “Collectors, Collecting, & Collections.” Selection of this theme made good sense, since the IQSC is built around a wonderful collection. At the same time, selecting this theme was something of a risk since quilts and collecting go together in ways that are undeniable, but not always comfortable. Collecting and quilting are activities that people can find satisfying, even fun. They involve routines and exploration. They …
Beef Demand Increased In 2004, Dillon Feuz
Beef Demand Increased In 2004, Dillon Feuz
Cornhusker Economics
Beef demand increased about 8-10 percent in 2004. What does that really tell us and how is beef demand measured? For cattle producers, how does an increase in beef demand impact the price for fed cattle, feeder cattle and calves? The objective of this article is to answer those questions.
The Future Of Scholarly Communications, Paul Royster
The Future Of Scholarly Communications, Paul Royster
University of Nebraska-Lincoln Libraries: Presentations
I have seen the future arrive several different times and in a number of different settings. It arrives in the form of new technologies. Initial progress is slow, and accompanied by a certain amount of frustration. But new conveniences emerge, and they eventually change the most basic levels and details of how things get done. Continuity is key. You have to have a good strong sense of what you are trying to get done. If you don’t, the technology threatens to take over. You cannot direct it towards your own purposes and goals if it is not always clear to …
Ethanol In Nebraska, Richard K. Perrin
Ethanol In Nebraska, Richard K. Perrin
Cornhusker Economics
Ethanol production in the U.S. has mushroomed at the rate of nearly 20 percent per year in this young century. In Nebraska, ethanol production increased from about 500 million gallons in 1999 to over 700 million gallons in 2004. Furthermore, recent Nebraska plant construction suggests that it can be expected to increase by at least another 40 percent within the next year or two.

Is There A Successor To Your Business?, David J. Goeller
Cornhusker Economics
Andrew Errington, a professor at the University of Plymouth, United Kingdom, surveyed farmers in England in 1997. He found that 66.3 percent of those farmers surveyed plan to never or only partially retire from farming, leaving only 33.7 percent who planned to someday fully retire. John Baker, Director of the Beginning Farmer Center at Iowa State University, replicated this survey in Iowa in 2000. The same survey was also taken in Virginia in 2001. Iowa results indicated 65 percent of those responding planned to never or only partially retire from their farming business. Results from Virginia indicate 76 percent of …

Irrigation Development Continues In Nebraska, Aaron C. Raymond, Bruce B. Johnson
Cornhusker Economics
Attribute it to the multi-year drought, the threat of future well-drilling moratoriums or an increase in farm income. Whatever the case, there has been a significant swell in new irrigation wells in Nebraska over the past eight years. This increase has been nothing less than tremendous for the last three years.

Productivity And Welfare, Lilyan E. Fulginiti, Richard K. Perrin
Department of Agricultural Economics: Faculty Publications
Technical change is generally characterized by a rate and biases, both evaluated for given producer prices. This paper examines the potential discrepancy between this rate and the corresponding rate of consumer welfare change as measured by Allais distributable surplus. We postulate a general equilibrium context with various market failures (taxes, quotas, imperfect competition, and “poorly priced” commodities), and use comparative statics to express the rate of welfare change in terms of the rate and biases of the technical change. An elementary simulation model of a taxed economy suggests that the rate of welfare change may differ from the rate of …

Nebraska Farm Real Estate Market Developments 2004-2005, Bruce B. Johnson, Aaron C. Raymond
Nebraska Farm Real Estate Reports
During a period of record-level farm incomes, Nebraska farmland values rose an average of 11.9 % for the year ending February 1, 2005, the largest annual percentage increase of the past 16 years. The increase followed the sizable advances of the previous year, in contrast to several recent years of fairly stable to moderate value increases. While increases were reported by UNL survey respondents across the entire state, there was considerable variability in magnitude of percentage gains. Largest gains were recorded in southeast and eastern Nebraska, with changes of 18.8 % and 13.5 % respectively. Much smaller annual gains were …
The Long Reach Of Divorce: Divorce And Child Well-Being Across Three Generations, Paul R. Amato, Jacob Cheadle
The Long Reach Of Divorce: Divorce And Child Well-Being Across Three Generations, Paul R. Amato, Jacob Cheadle
Department of Sociology: Faculty Publications
We used data from the study of Marital Instability Over the Life Course to examine links between divorce in the grandparent generation and outcomes in the grandchild generation (N = 691). Divorce in the first generation (G1) was associated with lower education, more marital discord, weaker ties with mothers, and weaker ties with fathers in the third generation (G3). These associations were mediated by family characteristics in the middle generation (G2), including lower education, more marital discord, more divorce, and greater tension in early parent- child relationships. In supplementary analyses, we found no evidence that the estimated effects of divorce …

Child Neglect And Adolescent Violence: Examining The Effects Of Self-Control And Peer Rejection, Constance L. Chapple, Kimberly A. Tyler, Bianca E. Bersani
Department of Sociology: Faculty Publications
Child maltreatment researchers have often suggested that experiences with child neglect have long-term, negative effects. Child neglect is thought to have particularly adverse effects on self-control, peer relations, and delinquency. In this research, we examine the relationship of child neglect with adolescent violence via self-control and peer rejection. Using prospective, longitudinal data from a community sample, we find that child neglect adversely affects peer rejection and violence. Neglected children were more likely to be rejected by their peers in early adolescence and were more likely to be violent later in adolescence. Contrary to theoretical predictions, child neglect was not a …

College of Journalism and Mass Communications: Faculty Publications
It's the new year, and you might have resolved to change some things in 2005. By March, you may have given up on the whole thing. Just like every other year.
Why is that we always start off with the best of intentions, but .soon forget our resolve? The truth is, we're not very SMART about setting goals. This column aims to change that.
First, let's define "goal." You may have beard a goal is a dream with a deadline. I define goals as "golden opportunities at living sensationally." A goal is simply a lost opportunity if you don't pursue …

The Charles J. Kappler Indian Affairs: Laws And Treaties Internet Site At The Oklahoma State University, Charles D. Bernholz, Suzanne L. Holcombe
University of Nebraska-Lincoln Libraries: Faculty Publications
Indigenous nations and issues are a worldwide concern and a number of WWW resources that support multidisciplinary research in this area have been previously identified. The availability of such tools is a boon to cost-effective collection development. One of the previously selected electronic resources was the Indian Affairs: Laws and Treaties Internet site at the Oklahoma State University. This commentary describes more fully the use of this collection of treaties created between the Indian Nations and the U.S. federal government. Research examples are used to demonstrate the relationship of these documents to various indigenous issues.

The prices established by the Risk Management Agency (RMA) used to calculate the premiums and indemnities for the standard APH/MPCI program for 2005 are: Corn $2.20 per bu. Grain Sorghum $2.15 per bu. Soybeans $5.00 per bu. The spring base prices for Crop Revenue Coverage (CRC) and Revenue Assurance (RA) are the averages of the closing prices during February for the December and November CBOT contracts for corn and soybeans, respectively. At the close on January 21, 2005, the DEC corn contract was at $2.28 and the NOV soybean contract was at $5.33. These are both significantly lower than the …

Remarks On Metadata Management, Elaine L. Westbrooks
University of Nebraska-Lincoln Libraries: Faculty Publications
Purpose: As digital resources proliferate, libraries plan to grant easy access to a distributed set of resources from one single entry point inside and outside the OPAC. The quest to manage the metadata about these resources becomes more important than ever. Thus, the term, “metadata management” is being used by various communities creating spatial data, enterprise applications, data warehouses, legacy environments, and bibliographic data. Unfortunately, metadata management is sparsely mentioned in the traditional information technology journals, grey literature, information technology company web sites, and the library science literature. The purpose of this viewpoint is to examine the limited use of …
Nebraska Beef Industry Development Act Of 2004, J. David Aiken
Nebraska Beef Industry Development Act Of 2004, J. David Aiken
Cornhusker Economics
Over the past thirty-five years, Congress has authorized promotion programs, known as checkoff programs, for a variety of agricultural commodities. In 2001 the U.S. Supreme Court invalidated the mushroom checkoff, concluding that the generic advertising infringed upon the free speech rights of producers who disagreed with the promotional message. In separate 2002 Federal District Court decisions the beef checkoff was invalidated, the pork checkoff was invalidated, and the legality of the beef checkoff has been upheld. The two cases invalidating checkoff programs relied on U.S. Supreme Court rulings that checkoff programs violated the producers free speech rights. (In 2003, two …

Becoming A Professional Engineering Educator: A New Role For A New Era, L. Dee Fink, Susan Ambrose, Daniel W. Wheeler
Department of Agricultural Leadership, Education, and Communication: Faculty Publications
Engineering education faces significant challenges as it seeks to meet the demands on the engineering profession in the twenty-first century. Engineering faculty will need to continue to learn new approaches to teaching and learning, which in turn will require effective professional development for both new and experienced instructors alike. This article explores approaches to effective professional development and provides a conceptual framework for responding to the challenge of becoming a professional engineering educator. The "cycle of professional practice" is introduced as a prelude for identifying what individual professors and their institutions can do to generate more powerful forms of engineering …
Carbon Market Trading In A “State Of Fear”, Gary D. Lynne
Carbon Market Trading In A “State Of Fear”, Gary D. Lynne
Cornhusker Economics
Newspaper columnist George F. Will (“Crichton’s New Book Punctures Certitude About Global Warming,” Omaha World Herald (OWH), January 5, 2005, p. 7B) recently applauded a new novel, State of Fear, which proclaims global warming and the possibility for catastrophic changes in the climate as less than certain, if not an outright attempt to unduly stir fear in people. (I have not yet read the novel, so am relying here on those who have)! George Will sees the novel as helping us become “wholesomely skeptical” about global warming and climate change. On the same page in the Herald (thank-you, OWH, for …
Perceptions Of Attachment Style And Marital Quality In Midlife Marriage, Cody S. Hollist, Richard B. Miller
Perceptions Of Attachment Style And Marital Quality In Midlife Marriage, Cody S. Hollist, Richard B. Miller
Department of Child, Youth, and Family Studies: Faculty Publications
Based on attachment theory, Emotionally Focused Therapy (EFT) theorizes that attachment styles influence marital quality. Although research supports this relationship among young couples, no research has examined attachment styles and marital quality in midlife marriages. We examined this issue using data from 429 married people between the ages of 40 and 50. Results indicated that insecure attachment styles were associated with marital quality, whereas secure attachment was not. These results suggest that EFT therapists can help midlife couples in distressed relationships move from insecure to secure attachment styles. However, the use of EFT to help these couples who have secure …
Agricultural Subsidies And Overweight America, Glenn A. Helmers
Agricultural Subsidies And Overweight America, Glenn A. Helmers
Cornhusker Economics
In recent months there has been increased public attention directed to federal farm subsidies and their role in causing consumers to be overweight. The problems caused by an overweight population centers on health problems and increased health costs. Heart problems, diabetes and other health problems are associated with overweight individuals. Other difficulties arise from an overweight nation, such as those observed in air travel with increased fuel costs, less seat room and lift-off concerns. The issue is also apparent by observing the attention given to diets and new diet programs.

20th Century Black Women's Struggle For Empowerment In A White Supremacist Educational System: Tribute To Early Women Educators, Safoura Boukari
Women's and Gender Studies Program: Information and Materials
The goal in this work is to provide a brief overview of the development of Black women‟s education throughout American history and based on some pertinent literatures that highlight not only the tradition of struggle pervasive in people of African Descent lives. In the framework of the historical background, three examples will be used to illustrate women's creative enterprise and contributions to the education of African American children, and overall racial uplift. In doing so, I will refer to how those women struggled to set up schools in a totally hostile society where, race, patriarchy, class and gender, interlocking issues …

Free Exercise And Individualized Exemptions: Herein Of Smith, Sherbert, Hogwarts, And Religious Liberty, Richard F. Duncan

In Employment Division v. Smith, the Supreme Court revised its jurisprudence of religious liberty by declaring that, as a general rule, the free exercise of religion may be prohibited by government so long as it does so by means of a neutral law of general application. However, in Church of the Lukumi Babalu Aye, Inc. v. City of Hialeah, the Court made clear that "[a] law burdening religious practice that is not neutral or not of general application" violates the Free Exercise Clause unless the government justifies the restriction on religious liberty by passing a surpassingly strict compelling …

Shooting Kennedy: Jfk And The Culture Of Images [Book Review], Kristen Hoerl

Forty years after his assassination, the memory of President Kennedy continues to grip the popular imagination. Recently, media and scholarly attention to the memory of John F. Kennedy has been evidenced in television documentaries and books that have recalled his presidency, his personal life, and his assassination. In Shooting Kennedy: JFK and the Culture of Images, David M. Lubin explores photographs of Kennedy to understand Kennedy’s popularity with the American public. Lubin, a professor of art, argues that Kennedy was significant not only for his political role as president but because he became an icon of twentieth-century postwar America. …
