Of Generality And Specificity – A Suggested Approach Toward The Development Of An Autochthonous Singapore Legal System, Andrew B.L. Phang Jan 1989

Of Generality And Specificity – A Suggested Approach Toward The Development Of An Autochthonous Singapore Legal System, Andrew B.L. Phang

Research Collection Yong Pung How School Of Law

This very brief essay seeks to sketch out as well as consider an approach toward legal analysis and reasoning that would aid in the development of an autochthonous Singapore legal system, ' and that, in any event, would probably also be relevant even in more generalized ad hoc situations. It is assumed that many, if not most, of those involved in the discipline of Singapore law desire the construction of an autochthonous legal system, although the skeptic might find - as just mentioned - the approach suggested here of some utility as well.

An Economic Analysis Of Fertility, Market Participation And Marriage Behaviour In Recent Japan, David K. C. Lee, Chin Lee Gan Jan 1989

An Economic Analysis Of Fertility, Market Participation And Marriage Behaviour In Recent Japan, David K. C. Lee, Chin Lee Gan

Research Collection Lee Kong Chian School Of Business

This is the 1st attempt in modelling fertility, labor force participation and marriage rate using Japanese data. The authors use Butz and Ward's model and extend it to a simultaneous equation system as in the case of Winegarden. Although the estimates obtained by Full Information Maximum Likelihood and Three Stage Least Squares of the model are statistically significant, some of the signs of the estimates are not consistent to a priori predictions. The crux of the model is that an increase in the wages of men has an unambiguous positive effect on fertility, whereas an increase in wages of women …

Voting Behaviour In Singapore: A Preliminary Investigation From A Multi-Attribute Attitudinal Perspective, S. M. Leong, Chin Tiong Tan, K. C. Wong Jan 1989

Voting Behaviour In Singapore: A Preliminary Investigation From A Multi-Attribute Attitudinal Perspective, S. M. Leong, Chin Tiong Tan, K. C. Wong

Research Collection Lee Kong Chian School Of Business

The multi-attribute attitude model is employed to study voter behaviour in Singapore. Specifically, a set of beliefs of the personal attributes of political candidates considered important to voters was examined. Results indicated that such beliefs did predict voters' affective evaluation and intention to vote for a typical political candidate reasonably well. Implications of the findings are discussed and suggestions for future research provided.

The Opening Skies: Third-Party Imaging Satellites And U.S. Security, Ann Florini Sep 1988

The Opening Skies: Third-Party Imaging Satellites And U.S. Security, Ann Florini

Research Collection School of Social Sciences

Earth observation satellites, long a mainstay of U.S. intelligence-gathering, are now presenting new challenges for U.S. national security. The United States and the Soviet Union have long since reconciled themselves to being spied on by each other from space. Now, however, the advent of imaging satellite systems owned and operated by a variety of third parties, including governments other than the superpowers (France, Canada, the European Space Agency, India, and China) and private companies, is raising new concerns for U.S. peacetime foreign relations and military activities, and for crisis management and war- time operations. These new satellites, primarily civilian remote-sensing …

'Small Profits': Strukturmerkmale Und Entwicklungsprobleme Der Urbanen Individualwirtschaft In Der Vr China, Wolfgang Jamann, Thomas Menkhoff Jan 1988

'Small Profits': Strukturmerkmale Und Entwicklungsprobleme Der Urbanen Individualwirtschaft In Der Vr China, Wolfgang Jamann, Thomas Menkhoff

Research Collection Lee Kong Chian School Of Business

This article intends to analyse recent structural patterns, development problems and the reasons for rehabilitation of the urban private economy in the People’s Republic of China since 1978. The authors start from the thesis that the so-called “private sector” in China is not comparable with its “out”-differentiated counterpart in Western industrial countries, but is interlaced, in a complex way, with informal, partly illegitimate activities, interpersonal relation-networks (“guanxi”) or economic transactions of state/collective factories. The article illustrates the subordinate situation of the individual labourers in terms of their political regulation by (sometimes restrictive) licence procedures, taxes and fees; resource supply problems …

Value-Added Per Worker, Capital Accumulation And Technical Progress In A Small, Open Economy: An Explanation, Hian Teck Hoon Jan 1988

Value-Added Per Worker, Capital Accumulation And Technical Progress In A Small, Open Economy: An Explanation, Hian Teck Hoon

Research Collection School Of Economics

Within the context of industrial restructuring, it is not uncommon to use terms, such as 'higher value-added per worker', or 'low or high value added activities', and 'high technology' industries. The present note attempts to use the theoretical work in the field of international trade to sharpen our understanding of the relationships among the concepts of value added per worker, capital accumulation, and technical progress. We show that for a large country, capital accumulation raises the real value added per worker in both industries. With neutral technical progress occurring in the L-intensive industry, it is possible for the terms of …

Theoretical Conundrums And Practical Solutions In Singapore Commercial Law: A Review And Application Of Section 5 Of The Civil Law Act, Andrew B.L. Phang

Research Collection Yong Pung How School Of Law

Singapore plays an important role as a centre of trade and finance. For that reason, therefore, commercial law is arguably the most important branch of law in this island republic.

Conservatism, Liberalism And Ideology, Chandran Kukathas Jun 1987

Conservatism, Liberalism And Ideology, Chandran Kukathas

Research Collection School of Social Sciences

All societies are more or less complex systems of rules, of symbols andsigns directing and constraining individual behavior. The task of thesocial theorist is to analyze and uncover what order may underlie suchstructures. In this regard he faces at least two major problems. First, hehas to determine how far the rules or norms which govern human action define the distribution of power, responsibility and resources, andso determine the relative value placed upon such goods as education, art and scientific inquiry, and how far the existing structure of distribution of power and resources is itself responsible for the prevalence ofparticular rules. …

A Note On Sargan Densities, Yiu Kuen Tse

Research Collection School Of Economics

This note reexamines the general class of Sargan densities analyzed by Goldfeld and Quandt (1981), Kafei and Schmidt (1985), and others in the context of approximating normal densities in certain econometric models. It suggests a third-order Sargan density which complies with the Goldfeld and Quandt criteria, is unimodal, and is the best approximation to the normal for orders less than or equal to 3. Some errors in Goldfeld and Quandt paper are corrected.

The Impact Of Cultural Patterns On Cognition And Intention In Singapore, Chin Tiong Tan, John U. Farley Mar 1987

The Impact Of Cultural Patterns On Cognition And Intention In Singapore, Chin Tiong Tan, John U. Farley

Research Collection Lee Kong Chian School Of Business

Ethnicity of models used in advertisements and the advertised product's country of origin are manipulated experimentally to study how attitudes toward advertising and products lead to behavioral intention. A sample of Singaporean students' traditional Eastern values about family and conformity are also examined. Patterns of results for three products are consistent with theoretical predictions of cognitive processes, and attitude-intention links appear stronger than do those in similar tests in the West. Culture has mixed effect.

The Linguistic Relativity Of Person Cognition: An English-Chinese Comparison, Curt Hoffman, Ivy Yee-Man Lau, David R. Johnson Dec 1986

The Linguistic Relativity Of Person Cognition: An English-Chinese Comparison, Curt Hoffman, Ivy Yee-Man Lau, David R. Johnson

Examined the possibility that distinct languages are capable of exerting language-specific effects on people's impressions of and memory for other individuals. Parallel English- and Chinese-language descriptions were created of 2 characters exemplifying personality schemas with economical labels in English but not in Chinese, and 2 characters exemplifying personality schemas with economical labels in Chinese but not in English. Three groups of 12 undergraduates participated as Ss-English monolinguals, Chinese-English bilinguals who read and responded in English, and Chinese-English bilinguals who read and responded in Chinese. It was predicted that Ss processing the target descriptions in English would show greater evidence of …

Of ‘Cut-Off’ Dates And Domination: Some Problematic Aspects Of The General Reception Of English Law In Singapore, Andrew B.L. Phang Dec 1986

Of ‘Cut-Off’ Dates And Domination: Some Problematic Aspects Of The General Reception Of English Law In Singapore, Andrew B.L. Phang

Research Collection Yong Pung How School Of Law

This article deals with some problematic aspects of the general reception of English law in Singapore. It examines, first, the concept of the 'cut-off' date for statutes and the common law. The second substantive part deals with the concepts of suitability and modification, analysing their theoretical cogency as well as their application in the local context. The third and final part of the article examines the relationship between reception and stare decisis, indicating and examining potential contradictions as well as other allied issues.

Organised Crime As Terrorism, Mark Findlay Apr 1986

Organised Crime As Terrorism, Mark Findlay

Research Collection Yong Pung How School Of Law

In a somewhat belated incursion into the international debate about the threat of organised crime, Federal and State governments in Australia have chosen to represent the 'menace' as an attack on the institution of the state as much as a physical and financial danger to society. This is consistent with the approaches of governments in the United States and Italy in constructing the reality of the Mafia.

Positivism, Empiricism And Criminology Theory, Don Weatherburn, Mark Findlay Jul 1985

Positivism, Empiricism And Criminology Theory, Don Weatherburn, Mark Findlay

Research Collection Yong Pung How School Of Law

The discipline of criminology has been dominated since the turn of the century by an explanatory paradigm' known as 'positivism'. The distinctive features of that paradigm have been both substantive and methodological. On the substantive side 'positivist criminology' has been marked by a commitment to the explanation of criminal behaviour (and deviance generally) in terms of characteristics of the individual. Thus positivist criminology has been notable for its explanations of criminal behaviour in terms of gross bodily features, patterns of child-rearing, genetic defect, and idiosyncratic personality traits. On the methodological side positivist criminology has been marked by a preference for …

Hunger Strikes And The State's Right To "Force Feed": Recent Australian Experience, Mark Findlay Dec 1984

Hunger Strikes And The State's Right To "Force Feed": Recent Australian Experience, Mark Findlay

Research Collection Yong Pung How School Of Law

Whether or not it is the nature of the protest itself which makes it unsuitable for resolution in a court-room situation, the case law relating to "hunger strikes" (and State's response) is both sparse and insignificant. Perhaps on the basis of its uniqueness alone, the case of Schneidas v. Corrective Services Commission(New South Wales) and Others should be of particular interest to jurists on both sides of the Irish border.

Does Capitalism Infringe Property Rights: A Reply To Peter Morriss, Chandran Kukathas Dec 1984

Does Capitalism Infringe Property Rights: A Reply To Peter Morriss, Chandran Kukathas

Research Collection School of Social Sciences

In a research note on 'How Capitalism Infringes Property Rights' {PoliticalStudies, XXXI (1983), pp. 656-61), Peter Morriss attempts to demonstratethat a Nozickian version of rights theory is incompatible with that account ofcapitalism which emphasizes the importance (and value) of entrepreneurialrisk-taking and entrepreneurial failure. Because bankruptcy is an acceptedconsequence of entrepreneurial failure, capitalism, which condonesbankruptcy, in fact condones the violations of the rights of creditors. Thusthose who, like Nozick, defend property rights as sacred and inviolable, 'shouldbe in the vanguard of capitalism's opponents' (p. 657) Since the rights-basedargument for capitalism is that rights can never be legitimately violated, 'oncethe rights theorist …

Intertemporal Extraction Of Mineral Resources Under Variable Rate Taxes, Robert F. Conrad, Bryce Hool Nov 1984

Intertemporal Extraction Of Mineral Resources Under Variable Rate Taxes, Robert F. Conrad, Bryce Hool

A Physical Interpretation Of The Maximum Likelihood Estimation Of A Linear Functional Relationship Model, Y. V. Hui, Yiu Kuen Tse

Research Collection School Of Economics

This paper presents a physical interpretation of estimating the parameters of a linear functional relationship model. The estimates are determined from the stable equilibrium position of a mechanical system. It is found that the estimates obtained from the physical model coincide with the maximum likelihood estimates.

Organised Resistance, Terrorism And Criminality In Ireland: The State's Construction Of The Control Equation, Mark Findlay Jan 1984

Organised Resistance, Terrorism And Criminality In Ireland: The State's Construction Of The Control Equation, Mark Findlay

Research Collection Yong Pung How School Of Law

Despite the reality of partition that created "two Irelands," comparative analysis of the state's reactions to terrorism in the Province and in the Republic is rare. The struggle over reunification, which permeates society on both sides of the border, is usually viewed by the populist press not from the Irish viewpoint, but rather from the perspective of the British government. Given this bias, organized resistance -- most notably in the North of Ireland -- is represented as an assault on a majority-supported state. Because the legitimacy of the state under attack is rarely questioned, and the motivations for the resistance …

Layoffs, Wages And Unemployment Insurance, Kenneth Burdett, Bryce Hool Aug 1983

Layoffs, Wages And Unemployment Insurance, Kenneth Burdett, Bryce Hool

Research Collection School Of Economics

The influence of unemployment insurance on wage and layoff behavior is analyzed in the context of optimal labor contracts. Responses of contract terms to changes in economic parameters are shown to depend in general on the nature of the initial contract, the degree of workers' risk aversion, and the resolution of bargaining conflict. Layoffs are not necessarily reduced by an increase in experience rating or a reduction in the UI benefit. Product demand fluctuations tend to induce procyclical employment fluctuations but not wage fluctuation. An implication of optimal contracts with private insurance suggests a reason for government intervention in UI …

Jury Trial In Singapore And Malaysia: The Unmaking Of A Legal Institution, Andrew B.L. Phang Jul 1983

Jury Trial In Singapore And Malaysia: The Unmaking Of A Legal Institution, Andrew B.L. Phang

Research Collection Yong Pung How School Of Law

THE main task of this article is to inquire into the reasons for the general decline and final abolition of the jury system 1 in Singapore.2 It also seeks to discover why the decline and fall of a major legal institution aroused so little public debate, let alone outcry. To this end, the focus must necessarily be historical, but, in the context of a nation still in the process of discovering its legal heritage, it is hoped that the account which follows will contribute in some small way towards the development of our legal

Stare Decisis In Singapore And Malaysia: A Sad Tale Of The Use And Abuse Of Statutes, Andrew B.L. Phang Jan 1983

Stare Decisis In Singapore And Malaysia: A Sad Tale Of The Use And Abuse Of Statutes, Andrew B.L. Phang

Research Collection Yong Pung How School Of Law

A study of the cases and literature with regard to stare decisis in Singapore and Malaysia will reveal at least one salient characteristic - the propensity, primarily of the Courts, to misread statutes and twist them (whether inadvertently or otherwise) in order to justify a particular conclusion. Ironically enough, at the end of the day, similar (though not identical) conclusions could have been reached without the need to resort to any particular statutory provision. In this short article, I shall not endeavour to retrace ground already well covered by others, but will set out, in rather summary form, further reflections …

Vertical Linkages And Multinational Enterprises In Developing Countries, Linda Y. C. Lim, Eng Fong Pang Jul 1982

Vertical Linkages And Multinational Enterprises In Developing Countries, Linda Y. C. Lim, Eng Fong Pang

Research Collection Lee Kong Chian School Of Business

Many studies have concluded that multinational firms do not create significant technical and other vertical linkages in developing host countries. This case study of three multinational firms in the export-oriented electronics industry in Singapore shows that under certain conditions multinational firms can lead in creating local vertical linkages. It suggests that restrictive government policies to increase local purchases may not be necessary, effective or desirable in promoting local linkages by export-oriented multinational firms that respond primarily to international market conditions. The Singapore experience poinst to the importance of a healthy investment climate and rapid economic growth in encouraging multinational firms …

Resource Taxation With Heterogeneous Quality And Endogenous Reserves, Robert F. Conrad, Bryce Hool Aug 1981

Resource Taxation With Heterogeneous Quality And Endogenous Reserves, Robert F. Conrad, Bryce Hool

Research Collection School Of Economics

This paper analyzes the impact of mining taxation on the intertemporal extraction profile for a heterogeneous ore body. The extraction profile specifies both quantities and qualities extracted in each period. Total extraction is thus endogenously determined. The taxes explicitly considered are severance taxes (ad valorem or per unit; on metal or on ore), property taxes, and profits taxes (with depletion allowance). The intertemporal framework integrates economic and geological factors, generating new results on extraction distortions and providing qualification or reconciliation of previous diverse results in this area.
