Indigenous Sovereignty In State-Native Conflicts: A Comparative Study Of Process And Outcomes, Christina Farnsworth

Using the United Nations Declaration on the Rights of Indigenous Peoples, this study was designed to understand how indigenous groups assert their sovereign rights in conflict situations, and how they can be most successful in doing so.

Two instances of indigenous-state conflict were analyzed and compared both to each other and to a baseline of what sovereignty in conflict is, based on the United Nations Declaration. Data to be analyzed and compared was gathered through extensive archival research and interviews with tribal members and other interested parties.

The Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), adopted by the United Nations in 1979, has now been ratified by 185 countries, consisting of more than ninety percent of all UN members. The United States, however, has never ratified the Convention. The history of the Convention provides evidence of global support for women’s rights. While there are complex reasons behind the United States’ failure to ratify CEDAW, the United States’ commitment to unilateralism, an attitude of “American exceptionalism” and the long-term inequality and discrimination against women in the U.S. all contribute to the stifling of …

The Convention on Cluster Munitions bans all use, production, transfer and stockpiling of cluster munitions. Cluster munitions do not distinguish between civilians and combatants and can leave behind unexploded ordnance which can harm civilians and be detrimental to economic and social development for decades after use. The Convention aids in clearance of contaminated areas in order to prevent future disasters. It also provides risk reduction education and establishes a framework for cooperation and assistance for survivors.

Over the last three decades, countries all over the world, supported by the international community of nations, have been moving toward more equitable treatment of women. In 1979, the United Nations adopted the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), often referred to as the international bill of rights for women. CEDAW has been ratified by more than 90 percent of the nations in the world, with the United States the only industrialized nation in the world that has yet to ratify it.

There is much to commend in Morton Abramowitz and Thomas Pickering’s article “Making Intervention Work.” They propose to reform the United Nations’ capacity for intervention with the creation of an autonomous U.N. force largely constituted with forces contributed by the Security Council’s member-states. If such a force were kept to a minimal operational mission, “a small rapid-deployment force with special engineering, logistical, medical, and police skills,” as the authors suggest, then I think this is a good idea. World Summit in 2005, the nations of the world approved the “responsibility to protect.” This emerging principle of international law, charges each individual state with the responsibility to protect its population from genocide, war crimes, ethnic cleansing and crimes against humanity. Commentators on global politics frequently observe the abject failure of states and global institutions to respond to local, regional, and global crises ranging from dramatic climatic events, humanitarian crises, warfare and violence, to the continuation of unsavoury rights-abusive regimes. In my own work in the field of the comparative politics of human rights, the types of observations that Abramowitz and Pickering make in this piece are all too common, and have led many in the past to make similar such observations that powerful states constantly engage in a grand human rights “double standard.”

I agree with the broad thrust of Abramowitz and Pickering’s article. They rightly highlight the failings of the current agents and mechanisms of humanitarian intervention. The problem, however, is twofold. First, all the currently-existing interveners possess notable, and well-known, flaws. The U.N. and regional organizations suffer from serious shortfalls in funding and equipment. States frequently lack the commitment and willingness to act. And, although NATO’s operations in Bosnia and Kosovo raised hopes that it would be a willing and powerful humanitarian intervener, the reluctance of many of its members to commit troops in Afghanistan (where member states have clear interests) …

The Economist writes in an April 24th edition that the U.N.’s Human Rights Council, the predecessor to the sixty-year-old U.N. Commission on Human Rights, is a “one-sided Israeli-bashing” organization. The Economist argues that the inclusion of second- and third-tier countries from the Organization of Islamic Conference (OIC) and the Non-Aligned Movement (NAM) makes it a forum for targeting offenses committed by the Israeli government against the Palestinian people.

The purportedly new-and-improved Human Rights Council is, by most accounts, failing to live up to its promise. Critics accuse the Council of following in the footsteps of its predecessor the U.N. Human Rights Commission because it permits rights abusers among its ranks and it focuses overwhelmingly on Israel. The dominant assumption, articulated by the United States, is that this is a problem of membership; more stringent criteria would result in a less biased body. This, however, is wishful thinking. “The UN and Human Rights: A Screaming Start,” makes several valid points of concern in regards to the recently formed Human Rights Council. As the article stipulates, in many ways the Council does not look radically different from its predecessor, the Human Rights Commission, in that it fails to provide membership regulations that would keep “not free” states of the Council (with only twenty-three out of forty-seven states defined as free) and it lacks the clout in the political hierarchy to truly accomplish anything of substance. On March 11th, 2000, two children who were playing in the neighborhoods of Mitrovica, Kosovo, got hurt by an “unexploded ordnance”. One of them died in the explosion, the other was severely injured. An inquire clarified that the ordnance was a “bomblet”, a part of a cluster bomb dropped during the 1999 NATO air campaign against the Federal Republic of Yugoslavia.

The United Nations Office for Disarmament Affairs is the global community’s chief authority on the issues of weapons reduction. Among its responsibilities UNODA acts as the U.N. Secretary-General’s liaison in fulfilling the obligations established by both the Ottawa Convention and the Convention on Certain Conventional Weapons. The Office for Disarmament Affairs’ Geneva branch oversees these activities and is responsible—in accordance with the Ottawa Convention—for collecting Article 7 reports, maintaining the list of Article 8 experts and organizing meetings of States Parties, as well as organizing meetings pertaining to the CCW.

The United Nations Development Fund for Women (UNIFEM) has taken several measures to promote gender equality in all areas of life. These include not only several operational programs around the world but also a number of important areas of information collection and dissemination through various publications. These areas of work have been invaluable for organizations attempting to further gender equality in mine action. They have provided a starting line of information on how women are disproportionately affected by armed conflict and ERW as well as how women can be better integrated into solving the problems following a mine- accident.

Current odious debt doctrine– using the term “doctrine” loosely, since it has never formally been adopted by a court or international decision maker– dates back to a 1927 treatise by a wandering Russian academic named Alexander Sack. Sack suggested that debt obligations are odious and therefore unenforceable if 1) they were incurred without the consent of the populace; 2) they did not benefit the populace; and 3) the lender knew or should have known about the absence of consent and benefit. The tripartite Sack definition, which quickly became the foundation of odious debt analysis, contemplates a debt-by-debt approach to questionable …
