This Technical Bulletin discusses FLSA administrative exemptions. One of the most difficult problems faced by local governments in complying with the Fair Labor Standards Act (FLSA) is in the area of administrative exemptions. Under section 213(a)(1) of the Act, administrative personnel may be exempted from the minimum wage and overtime provisions of the law. This Technical Bulletin discusses a Budget Reconciliation Bill designed to reduce the federal budget deficit by raising eighteen (18) billion dollars in the next three (3) years. The reconciliation legislation included a provision that required all state and local government employees hired after April 1, 1986 to be covered by the Medicare portion of the Social Security Tax. The new bill required both employers and employees to pay a tax of 1.45% on the first $42,000 of income earned by an employee.

MTAS issued this Technical Bulletin to inform municipalities of an opinion of the Attorney General of Tennessee that under T.C.A. section 8-4303, the Commissioner of Finance and Administration, the Chairman of the Finance, Ways and Means Committee of the Senate, and the Chairman of the Finance, Ways and Means Committee of the House are required to determine the qualifications of each company providing a deferred compensation plan established pursuant to the Government Employees Deferred Compensation Act (T.C.A. sections 8-4301, et seq.), and that this includes deferred compensation plans for municipal employees.

This Technical Bulletin discusses regulations related to employment reports. As required by Title 29, Chapter XIV, Part 1602, Code of Federal Regulations, all local and state governments with 100 or more employees must file employment reports with the U. S. Equal Employment Opportunity Commission (EEOC) by Oct. 31, 1973. The report form--EE0-4--requires reporting the race, sex, salary range and job classification of all employees. (See copy on reverse side.) The reporting regulations were mandated by the 1972 amendments to the Civil Rights Act of 1964, which brought local and state government under the anti-discrimination clauses of the Act.
