To meet the dire need for housing created by the devastation of Hurricane Katrina in August 2005, Mayor Ray Nagin of New Orleans and the staff of the Federal Emergency Management Agency (FEMA) worked to create lists of potential sites for trailer parks. This procedure took place within an environment of Not In My Back Yard-ism, or NIMBYism, where a number of communities and individuals expressed their opposition to hosting such trailer sites both publicly and privately. Griggs' Folly: An Essay On The Theory, Problems, And Origin Of The Adverse Impact Definition Of Employment Discrimination And A Recommendation For Reform, Michael Evan Gold

This Article examines the adverse impact theory of employment discrimination under Title VII. The author begins by discussing the development of adverse impact in the case law, and by scrutinizing its theoretical underpinnings. He demonstrates that Congress did not intend to mandate adoption of adverse impact theory when it established Title VII. The author then argues that the Courts have exceeded their authority under Title VII by embracing the theory of adverse impact. He concludes that the courts should therefore return to a narrower theory of employment discrimination, namely, a theory based on the legal concept of “intent.”

Multiple economic development theories suggest that research and innovation in emerging technologies will cluster in certain locations rather then distributing equally among all regions. If this is the case, this distributional pattern has implications for where future economic opportunities as well as future risks will be concentrated. In this paper, we probe nanotechnology (hereafter nano) research and commercialization at a regional level. The study examines the top 30 US “nanodistricts” or metropolitan areas which lead in nanotechnology research activity over the 1990-2006 timeframe. We explore the factors underlying the emergence of these 30 metropolitan areas through exploratory cluster analysis. We …

Because the operation and control of most critical infrastructures are highly dependent on electronics, it is important to understand the vulnerability of those electronics to intentional electromagnetic interference (EMI). The possibility of interference using readily available consumer devices is a particular concern. We investigated the feasibility and effectiveness of using compact stun guns to intentionally interfere with electronic systems. Test articles included individual computers and computers networked through a central hub. 60KV and 600KV devices were used in the experiments. Results indicate that stun guns are effective in disabling digital electronic systems.

The physical and social fabric of the United States is sustained by a system of systems; a complex and dynamic network of interlocking and interdependent infrastructures (“critical national infrastructures”) whose harmonious functioning enables the myriad actions, transactions, and information flow that undergird the orderly conduct of civil society in this country. Recent U.S. high consequence events have made clear the importance of government collaboration with industry. The benefits of such collaboration were clearly seen as a lesson from Hurricane Katrina. The resources owned and controlled by American industry dwarf those available to local, state and even the federal government departments. Better agreements and incentives to bring the full capabilities of industry squarely into the national response agenda will be indispensable in effectively responding to large-scale catastrophes. This paper contrasts the success and failure of two electronic payment systems in Hong Kong, Octopus and Mondex, during 1996-2002. The case illustrates the new properties of electronic currencies, and provides insights for product designers and regulators. Mondex was endowed with the full legal status of money, launched by a mammoth banking group, with Mondex cards given away for free to consumers. Yet the Mondex system went into oblivion within five years. Octopus started as a modest stored value transport ticket that required a deposit. It ended up as a city-wide multipurpose payment card used by 95% of the adult …

This short article is a follow-up to a piece I wrote two years ago on Hamdan v. Rumsfeld, SSRN No. 913822. While applauding the result in Hamdan, I critiqued the Supreme Court for missing a “teachable moment” and obscuring the great issues at stake in prolixity and mind-numbing technical detail.In this article, I applaud the Boumediene v. Bush Court not only for its result—that the Constitution’s Suspension Clause can require habeas corpus for aliens held abroad under certain circumstances—but for its reasoning and style as well. Dissertation Summary In this dissertation I have tried to map how the concept of “social engineering” has been used from its inception in the early 1890s to the beginning of its decline in the late 1940s. The study concentrates upon the 1930s. In particular, I have asked who used this concept, in what contexts, and against which adversaries. I have taken most of my material from Sweden and the USA since both of these countries have been seen as examples of successful “organization of modernity.” And social engineering is indeed often taken to be exactly that—an attempt at organizing modernity.

Of the Clean Development Mechanism projects that exist in Mexico, methane destruction projects from hog farms dominate the landscape with 56% of the projects developed and 49% of the Certified Emission Reductions (CERs) that will be generated within the country by 2012. These biodigesters, however, have experienced many technical difficulties that place their future viability for the production of CERs and continued development in question. Because of these challenges, future methane capture in the country may focus around other agro industries or landfills.

The flexicurity strategy in Netherlands and Denmark, i.e. flexible labour market and the reinforcement of social security institutions, successfully kept the unemployment rate from rising in the 1990s and has drawn attention from social policy scholars. Under the development of flexible labour market and destabilized employment pattern, the agenda of flexicurity strategy has been shifted to strengthen and facilitate the transitions in social security institutions. Drawing on institutional analysis on redistribution of time and income, this paper explores outcomes and development from recent flexicurity reforms.
