O Poder Legislativo Municipal: Estrutura, Composição E Produção, Patrick Silva
O Poder Legislativo Municipal: Estrutura, Composição E Produção, Patrick Silva
Patrick Silva
Has Modernity Failed The Muslim World?, Muqtedar Khan
Has Modernity Failed The Muslim World?, Muqtedar Khan
Muqtedar Khan
Modernity had come to the Muslim World. But it did not deliver. There is no stability, no freedom, no real democracy and no earned prosperity and no scientific vitality in the Muslim World. Perhaps rather than continuing to ask the old question is Islam compatible with modernity, we need to ask has modernity failed Muslims.
The Death Penalty’S “Finely Tuned Depravity Calibrators” Fairness Follies Of Fairness Phonies Fixated On Criminals Instead Of Crimes, Lester Jackson
The Death Penalty’S “Finely Tuned Depravity Calibrators” Fairness Follies Of Fairness Phonies Fixated On Criminals Instead Of Crimes, Lester Jackson
LESTER JACKSON
It has been loudly and repeatedly proclaimed by opponents that capital punishment is “unfair.” In their view, it is unfair because (1) only some murderers receive the ultimate sentence and (2) they are not the most deserving. Underlying this view is the remarkable assumption that fairness is subject to “fine tuning” and “moral accuracy.” It is argued here that this assumption is indefensible both in theory and in practice. As a theoretical matter, it is insupportable to suggest that matters of conscience, right and wrong, are subject to calibration or “accuracy.” Right and wrong are not determined in the same …

Is Israel’S Operation Protective Edge Justified?, Raphael Cohen-Almagor
Is Israel’S Operation Protective Edge Justified?, Raphael Cohen-Almagor
raphael cohen-almagor
While I think it is too early to evaluate whether this round of hostilities is morally just in terms of jus in bello, the means employed in the conduct of war, I think Operation Protective Edge is justified in terms of jus ad bellum, i.e., the reasons that brought about this war. I presume a lot will be written about Israel’s conduct of war, enough to fill volumes. Here I clarify my position and its underlying principles.
The Problem Of Sovereignty, International Law, And Intellectual Conscience, Richard L. Lara
The Problem Of Sovereignty, International Law, And Intellectual Conscience, Richard L. Lara
Richard Louis Lara
The concept of sovereignty is a recurring and controversial theme in international law, and it has a long history in western philosophy. The traditionally favored concept of sovereignty proves problematic in the context of international law. International law’s own claims to sovereignty, which are premised on traditional concept of sovereignty, undermine individual nations’ claims to sovereignty. These problems are attributable to deep-seated flaws in the traditional concept of sovereignty. A viable alternative concept of sovereignty can be derived from key concepts in Friedrich Nietzsche’s views on human reason and epistemology. The essay begins by considering the problem of sovereignty from …

Reconciling Liberalism And Judaism? Human Rights In Israel, Raphael Cohen-Almagor
Reconciling Liberalism And Judaism? Human Rights In Israel, Raphael Cohen-Almagor
raphael cohen-almagor
This essay argues that mixing religion in politics is problematic. It becomes destructive when the religion is unyielding and coercive. Whenever religious powers are on the rise, the foundations of liberal democracy are shaken and its protective mechanisms are regressing. Indeed, in Israel egalitarianism is still in the making. Orthodox Judaism and liberal democracy are in conflict. The rise of one comes at the expense of the other in a situation where religion does not encompass the concept of freedom from religion. This essay further argues that Palestinians and Israelis are entitled to the same rights and liberties. Accommodations and …
Lincoln’S Vision Of Free Labor: Was Universal Opportunity, Education, And Economic Nationalism Enough To Enhance Freedmens’ Rights After The Civil War And Reconstruction?, Harry M. Hipler
Harry M Hipler
This paper will explore free labor, education, and universal opportunity – the latter being synonymous with equal opportunity – as described by Abraham Lincoln, and its connectivity to economic development and nationalism before, during, and after the Civil War era. First, I discuss Lincoln’s vision of free labor that defined his vision in 19th century America. Next, I explore the importance of universal opportunity and education as they relate to free labor as defined by white Republicans and Lincoln. The Republican Party and Lincoln strongly believed that free labor was the harbinger of success to obtain universal opportunity for all …

Candidate Selection In Bolivia’S Mixed-Member System: Determinants Of Candidate Selection In Bolivia’S 1993 And 1997 Legislative Elections, Miguel Centellas
Candidate Selection In Bolivia’S Mixed-Member System: Determinants Of Candidate Selection In Bolivia’S 1993 And 1997 Legislative Elections, Miguel Centellas
Miguel Centellas
Mixed-member electoral systems became a popular choice for “electoral engineers” in the 1990s. Countries as diverse as Venezuela, Hungary, Lesotho, and Italy adopted the system. The assumption was that introducing single-member districts (SMDs) in countries that used list proportional representation electoral systems would introduce “constituency” oriented legislators who could be more easily held accountable to voters. This paper explores any changes associated with the adoption of a mixed-member electoral system in Bolivia. It does so through a candidate-level analysis looking at differences in candidate profiles between two elections (1993 and 1997) and between two tiers (list and nominal) in the …

Global War, Biopower And The Rise Of Drone Warfare In The 21st Century, Durante Barringer
duranteb@ymail.com
In this senior project I assert that 9/11 was a turning point for the U.S. that changed the way it views warfare and security, which consequently allowed for the abuse of law and power around the globe, specifically in countries such as Yemen, Pakistan and Somalia. This abuse will be explained using three frameworks: constitutional and international law as defined in the Office of Legal Counsel white paper; philosophically through the lens of biopower and other concepts from Michel Foucault, Michael Hardt and Antonio Negri; and lastly I will discuss the issues of the drone campaign using case studies from …
Global And Regional Determinants Of Regime Type: Pakistan, Jakob A Friedman
Global And Regional Determinants Of Regime Type: Pakistan, Jakob A Friedman
Jakob A Friedman
Abstract: Traditional fields of study for international relations (IR) scholars have revolved around the question of how regimes interact with one another in the international sphere. This paper deals with answering the question of how regimes emerge in the first place. To this end, there are two competing narratives in IR, which seek to explain the origins of regime type. The first is that regimes are shaped entirely by a given nations regional security concerns, the other is that regimes emerge in response to global political paradigms. Throughout the exploration of the political history of Pakistan, this paper seeks to …

The Two-Seat Solution, Hippu Salk Kristle Nathan
The Two-Seat Solution, Hippu Salk Kristle Nathan
Hippu Salk Kristle Nathan
The article highlights the fallacy in the system of provisioning more than one constituency/seat to a single candidate in Lok Sabha or Assembly elections. It gives instances of how the veteran leaders have historically exploited this system. This is a violation of principle of equity, justice, and fairness as enshrined in the Constitution. This reminds the Orwellian saying: "All are equal, but some are more equal than others." The article proposes that the only way out is make a leader's candidature void if he or she files nomination from more than one constituency.
Transformative Conflict Resolution In An Unstable Neighbourhood: Turkey’S Conflict Resolution Efforts In The Middle East, Talha Kose
Talha Kose
Turkey had pursued a foreign policy in the Middle East that focused on transformative conflict resolution until the beginning of the “Arab Spring”. This transformative conflict resolution approach had aimed at bringing holistic and systemic change to the entire region. Turkish foreign policy had aimed at transforming the conflict producing structures, tried to engage positively with the actors and elites and attempted to change the securitydominated agenda into a multi-dimensional agenda. Despite the dominant discourse of the transformative conflict resolution, in practice the most effective conflict resolution methods and tools that Turkey utilised during this period fell under the management …
