The Sec And Accounting: A Historical Perspective, Joel Seligman Jan 1985

The Sec And Accounting: A Historical Perspective, Joel Seligman

Scholarship@WashULaw

Joel Seligman argues that in the absence of regulatory oversight, managerial incentives and notions of efficient markets and competitive positioning have proven to be insufficient in ensuring full disclosure of material financial data. The SEC given express authority to regulate accounting practices, has, during the past fifty years, directly contributed to the standardization of financial statement disclosures. In establishing accounting standards, the SEC has exercised restraint, allowing private organizations such as the FASB to set standards subject to SEC oversight. Although the SEC could be more aggressive in initiating accounting standards (particularly with controversial practices such as pooling versus purchase …

Job Satisfaction And Job Performance: A Meta-Analysis, Michelle Iaffaldano [Graef], Paul M. Muchinsky Jan 1985

Job Satisfaction And Job Performance: A Meta-Analysis, Michelle Iaffaldano [Graef], Paul M. Muchinsky

Center on Children, Families, and the Law: Faculty Publications

The assumption that job satisfaction and job performance are related has much intuitive appeal, despite the fact that reviewers of this literature have concluded there is no strong pervasive relation between these two variables. The present meta-analytic study demonstrates that (a) the best estimate of the true population correlation between satisfaction and performance is relatively low (.17); (b) much of the variability in results obtained in previous research has been due to the use of small sample sizes, whereas unreliable measurement of the satisfaction and performance constructs has contributed relatively little to this observed variability in correlations; and (c) nine …

The Mmpi : A Subscale (Ic) For The Identification Of Male Incest Offenders, Mary S. Dolan Jan 1985

The Mmpi : A Subscale (Ic) For The Identification Of Male Incest Offenders, Mary S. Dolan

Dissertations and Theses

The MMPI has been used extensively for the clinical assessment of deviancy among sexual offenders. In order to derive a diagnostic scale for the specific identification of male incest offenders, an item analysis, using MMPI data from offenders, compared MMPI data from a nonoffending control sample. The item analysis results were cross validated with MMPI data from a separate sample of incest offenders. Eleven MMPI items were found to be critical in discriminating male incest offenders from nonoffenders, and these items comprise the Ic experimental scale. On the basis of the Ic scale, male incest offenders evidence characterological disturbances in …

Office for Policy Studies on Violence Against Women Publications

In a survey of 504 college students examining predictors of violence in heterosexual relationships, over half of both men and women had committed at least one physically violent act. Modest associations between physical violence and sexual aggression were uncovered. In a series of discriminant analyses, men who abused their partners were not readily distinguished from men who did not, but tended to by young, low in family income, traditional in attitudes toward women, abused as children, currently living with a women, and from Appalachian areas.

Tarasoff, The Doctrine Of Special Relationships, And The Psychotherapist's Duty To Warn, Robert F. Schopp, Michael R. Quattrocchi Jan 1984

Tarasoff, The Doctrine Of Special Relationships, And The Psychotherapist's Duty To Warn, Robert F. Schopp, Michael R. Quattrocchi

Nebraska College of Law: Faculty Publications

The California Supreme Court, in its controversial Tarasoff decision, ruled that a psychotherapist may be found negligent when he fails to prevent his patient from harming someone.

When a therapist determines, or pursuant to the standards of his profession should determine, that his patient presents a serious danger of violence to another, he incurs an obligation to use reasonable care to protect the intended victim against such danger. The discharge of this duty may require the therapist to take one or more of various steps, depending on the nature of the case. Thus it may call for him to warn …

Section 547(C)(1) And Delayed Perfection Of Security Interests In The Ninth Circuit: In Re Vance, 721 F.2d 259 (9th Cir. 1983), Richard F. Duncan Jan 1984

Section 547(C)(1) And Delayed Perfection Of Security Interests In The Ninth Circuit: In Re Vance, 721 F.2d 259 (9th Cir. 1983), Richard F. Duncan

Nebraska College of Law: Faculty Publications

The Bankruptcy Reform Act's treatment of belatedly perfected security interests in personal property is enigmatic, because it attempts to employ preference law to avoid a class of transfers, so-called "secret liens," that are not true preferences. When a security interest is granted in exchange for contemporaneous value, preference policy in bankruptcy is not offended, because the transaction does not cause a depletion of the debtor's estate for the benefit of a particular creditor. However, the effect of the timing rules of section 547(e) of the Bankruptcy Reform Act is to treat most security interests perfected during the preference period and …

Sexual Sterilization Of The Mentally Retarded, Nancy Ann Wallace Jan 1984

Sexual Sterilization Of The Mentally Retarded, Nancy Ann Wallace

Masters Theses

For more than 50 years, sterilization of mentally retarded persons was an accepted practice in many states as a way to reduce the number of persons born with mental defects. In recent years, the practice has come under heavy challenge, both medically and legally. In the United States between 1907 and 1963, approximately 12,500 sexual sterilizations were performed. In 1970, 27 states had particular grounds on which sterilization could be ordered. As of 1979, only 19 states still had statutes that allowed sterilization for eugenic reasons. This paper examines the history of the sterilization laws and the grounds for invoking …
