Comparative lawyers and economists have often assumed that traditional Chinese laws and customs reinforced the economic and political dominance of elites and, therefore, were unusually “despotic” towards the poor. Such assumptions are highly questionable: Quite the opposite, one of the most striking characteristics of Qing and Republican property institutions is that they often gave significantly greater economic protection to the poorer segments of society than comparable institutions in early modern England. In particular, Chinese property customs afforded much stronger powers of redemption to landowners who had pawned their land. In recent years, national attention has been drawn to the issue of sexual assault in the military. This is largely in part due to the number of reported offenses increasing each year, jumping 50% between 2012 and 2013 alone (DoD, 2013). Research has shown sexual assault offenses are greatly underreported and that the victimization rates among service members are higher than those of civilians (Turchik & Wilson, 2010). The polygraph in postconviction sex offender testing is used to assist in the treatment and supervision of convicted sex offenders by more than 70% of the jurisdictions that supervise these offenders in the United States. Prior researchers have failed to convincingly demonstrate how the polygraph can be used to target risk behaviors and reduce recidivism. Consequently, the use of the sexual history polygraph examination (SHPE) has not been demonstrated to reduce recidivism. In this work, a survey was conducted to help quantify the relevance of nineteen types of evidence (such as SMS) to seven types of digital investigations associated with mobile devices (MD) (such as child pornography). 97 % of the respondents agreed that every type of digital evidence has a different level of relevance to further or solve a particular investigation. From 55 serious participants, a data set of 5,772 responses regarding the relevance of nineteen types of digital evidence for all the seven types of digital investigations was obtained. In this introduction to the issue on New Trends in Latin American Constitutionalism, Santiago Legarre offers his remarks at the opening of the conference on New Trends in Latin American Constitutionalism held at Notre Dame Law School in 2013. After briefly recounting the origins of the conference, Legarre summarizes some of the key modern challenges in Latin America and the role of constitutionalism in addressing these challenges. Jailhouse snitch testimony is inherently unreliable. Snitches have powerful incentives to invent incriminating lies about other inmates in often well-founded hopes that such testimony will provide them with material benefits, including in many cases substantial reduction of criminal charges against them or of the time they are required to serve. At the same time, false snitch testimony is difficult, if not altogether impossible, for criminal defendants to impeach. Because such testimony usually pits the word of two individuals against one another, both of whose credibility is suspect, jurors have little ability to accurately or effectively assess or weigh the evidence. …

While lead exposure during childhood has been linked to criminal activity later in life, prior research has failed to develop a theoretical foundation explaining why lead and crime rates are positively related at the aggregate level. Utilizing tract-level data, I examine the relationship among elevated blood lead level rates, levels of concentrated disadvantage, and crime rates. Through a biosocial approach, I explore the lead-crime relationship using a measure of concentrated disadvantage to account for the variations across tracts. Finally, I discuss the results of this study as well as implications for public policy and future research.

Concealed weapon permit issuance is one of the most contentious topics debated in modern politics today. The primary point of disagreement within this debate hinges on whether these permits serve to increase violence by those who possess them, or whether they decrease crime through the deterrent effect of their presence in society. Florida is one of 12 states that have a no-fault law. The first party benefit coverage is known as personal injury protection (PIP). Every policy sold in the state must include at least $10,000 in personal injury protection. This law went into effect in 1971 and is now being challenged. Changes in consumer, lawyer, and doctor behavior as well as changes in the legal and economic environment have diminished the positive impact of the no-fault law. The following document is a capstone thesis project focusing on the unique experiences of graduate forensic coaches through lens of liminality, a performance theory used to describe a sense of being between social identities when going through a rite of passage. The author contends that this liminal experience has unique characteristics which are important to consider in the context of identity and forensic culture. This study explores the associations between the independent variables of organizational motivations and culture with the dependent variable of organizational commitment to local jail reentry partnerships. A cross-sectional, mixed methods design was used based primarily on a quantitative survey mailed to organizational informants involved in jail reentry activities within three central Florida counties. Qualitative data was also collected by observing conveniently sampled reentry meetings and analyzing the content of social artifacts, such as meeting handouts, minutes, e-mails, and other related documents. This research explores whether commercially sexually exploited children (CSEC) abuse drugs or face greater histories of abuse than their delinquent peers. This research will evaluate whether girls who are CSEC victims experience more abuse of drugs or experience more physical, emotional, or sexual abuse. The study also explores whether CSEC victims witnessed more abuse than non-CSEC victims. A survey of needs and issues facing delinquent girls was given to 130 girls between the ages of 13 to 18. Questions asked about their drug use, abuse history, and whether they witnessed abuse. This research found that many girls who are CSEC …

Idiographic digital profiling (IDP) is the application of behavioral analysis to the field of digital forensics. Previous work in this field takes a nomothetic approach to behavioral analysis by attempting to understand the aggregate behaviors of cybercriminals. This work is the first to take an idiographic approach by examining a particular subject's digital footprints for immediate use in an ongoing investigation. IDP provides a framework for investigators to analyze digital behavioral evidence for the purposes of case planning, subject identification, lead generation, obtaining and executing warrants, and prosecuting offenders.

Some of these identifiers are stable, e.g., logins used to access a specific service, some are only temporary, e.g., dynamically assigned IP addresses.
