The public’s perception of individuals who commit sexual offenses is much different than for other types of offenders. This can be seen in the passing of legislation targeting interventions specific to this population as a way to protect the public and reduce recidivism. In some states, sex offenders are required to participate in treatment as a condition for early release from prison. The impact of this policy is not well understood, and mandatory treatment is growing in popularity. This dissertation explores the impact of mandatory treatment for individuals incarcerated for sexual offenses on their recidivism over time. Missouri statute establishes …

The balance between benefit and risk is central to the work of all those involved in aquatic services. The Hippocratic exhortation of Primum non nocere, “First, do no harm,” has a history of over 2000 years. Superficially, all would support this dictum, but harm can result from inaction. The balance between no or little intervention on the one hand and proactive intervention with iatrogenic risk on the other is complex and enduring. For several decades time studies have been used as a decision-making tool in criminal justice settings to assist in staffing allocation decisions. Despite their prevalence, these studies have rarely been documented in empirical journals or subjected to peer-review. Publication bias is a likely issue, with only those providing favorable results reaching a public audience. This study reviews the literature and documents a time study of probation and parole officer workloads conducted in a rural Western state. Results reveal probation and parole rely heavily on office-based interactions with probationers and parolees. An over-reliance on compliance enforcement, substantiated by other research in …

“I’Ve Risen Up From The Ashes That I Created”: Record Clearance And Gendered Narratives Of Self-Reinvention And Reintegration, Elsa Chen, Ericka Adams

Record clearance allows some individuals to redesignate or remove certain minor convictions from their criminal records. This interview-based study finds that both men and women seek opportunities for personal gain through record clearance, but women are more motivated by moral and religious influences and concern about reputation. Women are also more likely than men to acknowledge personal flaws, and to desire to replace criminal identities with law-abiding identities. As women redefine their identities, caregiving is especially important as a personal obligation and professional aspiration. Record clearance is particularly compatible with women’s motivations, willingness to change, and personal and professional goals.

The research and scholarship of gendered violence on university campuses is growing; however, there is currently limited to no research exploring the experiences of Indigenous peoples, particularly women and two-spirit, non-binary and transgender students. To advance the knowledge of the interconnectedness of violence, I conducted two focus groups with six Indigenous women staff at Wilfrid Laurier University. This research, informed by Indigenous feminism and storytelling methodologies, shares their understandings of how colonial and gendered violence cannot be understood independent from one another. Participants also provide insight into the needed supports on campus for Indigenous students who have experienced gendered violence. …

This research study focuses on sexual violence (SV) in Canada, which one in three women will experience during their lives. Yet, even though the prevalence of violence against women in Canada is so significant, only one in ten survivors will report their experience of SV to the criminal justice system (CJS). Previous literature has identified the limited number of reports to authorities in Canada as being related to rape mythology. Due to the influence of rape mythology, a notion of a “good versus bad victim” is often used to deem which survivors are innocent and credible versus responsible or blamed …

American veterans have long struggled with the aftereffects of combat exposure, repeated deployments to hostile countries, and extended time spent away from their families and loved ones. Historically, when veterans struggling with issues such as mental illness and substance abuse, which can be related back to their military service, came into contact with the criminal justice system, they were processed without regard to their unique military experience. Beginning in 2008, however, a new type of problem-solving court, veterans’ treatment courts (VTCs), have been increasingly adopted to target justice-involved veterans to address the distinct issues and challenges they face. This Article discusses the bifurcated notions on the purpose of working as an attorney—whether the purpose is to attain wealth or whether the work in and of itself is the purpose. This Article explores the sentiments held by distinguished and influential nineteenth-century lawyers—particularly David Hoffman and George Sharswood—regarding the legal ethics surrounding attorney’s fees and how money in general is the root of many ethical dilemmas within the arena of legal practice. Through the texts of Hoffman and Sharswood, we find the origins of the ethical rules all American attorneys are subject to in their various jurisdictions.

Hunters and poachers often use commercially-available, nutrient-rich baits to attract wildlife game animals. We used atomic absorption spectroscopy and ion selective electrochemical analysis techniques to determine whether two common proprietary baits (Deer Cane and Acorn Rage) would leave detectable chemical signatures in soil (i.e., Na+, Cl-, and Ca+2). Our goal was to evaluate low cost tests which could be replicated by wildlife conservation officers in the field. Blood is a commonly encountered biological fluid in criminal investigations concerning a violent incident, and visual traces of the fluid on a suspect’s clothing can be diminished through laundering. This study aims to analyze the effects of laundering and the application of commercially available blood enhancement reagents commonly used to improve visualization of dilute bloodstains and their impact on DNA recovery. Enhancement reagents Hungarian Red, Coomassie Blue, Amido Black, luminol, Bluestar® Forensic Magnum, and aqueous Leuco Crystal Violet (LCV) were used to enhance human blood on cotton, polyester, denim, and wool following laundering. Justice exists in and through interpretations of past laws and legal procedures. Justice for sex crimes, however, is particularly complex due to the differences between victim needs and the operations of the criminal justice system. This study, using 70 semi-structured interviews and 2 focus groups from Canadian police departments, shows procedural and distributive justice as the two most prevalent forms of justice police officers use when dealing with sex crimes. It is a common belief among law enforcement and prosecutors that serial sex offenders maintain a consistent modus operandi (MO), or offending pattern. The standard investigative practices in many law enforcement agencies are to either investigate a sexual assault allegation as an isolated event or use the offender’s MO to link other sexual assaults possibly committed by that offender. The labor of enslaved Africans and Black Americans played a large part in the history of colonial America, with the American plantation being the epicenter for all that was to be produced. While the two have never been completely tied together, capitalism and modern day slavery have been linked with one another. Some analysis sees slavery as a remote form of capitalism, a substitute, to an antiquated form of labor in the modern world.

Intense demand for cheap labor in the United States has resulted in a widespread effect of employing high skilled immigrants in STEM fields. Examining how companies use high-skilled visa categories to create a flexible cheaper immigrant workforce, this paper demonstrates that skilled immigrants from Asia are being exploited through neutral skills-based criteria that are de facto racially biased. The purpose of this paper is to raise awareness of how, from the perspective of law and society, skills-based immigration works primarily to benefit the technological industry rather than skilled immigrants.

Criminal responsibility (CR; i.e., sanity) has garnered significant research attention over the years. While some variables predicting insanity outcomes are consistent, others are not. Study-level characteristics, such as sample selection, variability in the operational definition of insanity, or other unknown influences may explain discrepant findings. It is critical to consolidate these variables and systematically assess differences in methodology to understand the state of the literature and to guide future research. As such, I conducted the first meta-analysis and study space analysis (see Malpass et al., 2008) in this area. Only 16 studies met inclusion criteria for the meta-analysis. Summary effects …

Research indicates that the annual incidence of child maltreatment is around 10% and that more than one-quarter of children have, at least indirectly, experienced some form of violence. Prospective studies find that in high-income countries, like the United States, there are moderate correlations between childhood maltreatment and low educational achievement, low skilled employment, depression, suicide attempts, and alcohol problems, as well as strong correlations with obesity, behavior problems in childhood and adolescence, and criminal behavior. Prosecuting Buyers In Human Trafficking Cases: An Analysis Of The Implications Of United States V. Jungers And United States V. Bonestroo, Andrea J. Nichols, Erin Heil

This article provides a review and analysis of United States v. Jungers and United States v. Bonestroo, important court cases providing precedent for charging buyers of sex as traffickers in cases involving minors. The decisions in these court cases, and in subsequent cases, further solidify the presence of end-demand efforts in the form of prosecution. Yet, the decisions in these cases raise additional questions about their implications for state-level prosecution, the prosecution of buyers in cases involving adults who experience sex trafficking, and the buyers of trafficked labor.
