Adjudicating Atrocity: Reading Hitesh Verma V State Of Uttarakhand As A "Landmark" Case In The Judicial Discourse On Caste Violence, Tejaswi Chhatwal

This article critically examines the Supreme Court’s judgment in Hitesh Verma v State of Uttarakhand (2020) and argues for reading it as a “landmark trial” in the judicial undoing of reform—namely, the statutory changes introduced by the 2016 Amendment to the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act 1989. Existing socio-legal scholarship on atrocity jurisprudence has shown that the judicial understanding of caste violence and doctrinally instituted evidentiary standards have historically operated to invisibilise caste from crime’s framework. This study explores how the media narratives and political perspective of pretrial publicity (PTP) can influence jurors’ perceptions in sexual assault cases, raising significant concerns about justice in courtrooms. Specifically, it examines whether media framing of a real-life sexual assault case — through varying media narratives, with media that either challenges or endorses rape myths, and media source (liberal vs. conservative) — affects mock jurors’ rape myth acceptance (RMA), views of victim credibility, and judgements of perpetrator guilt. Street harassment is a widespread harm that disproportionately affects women. While research suggests links between racial inequality, street harassment, and mental health outcomes, it is less understood how the severity of harassment experienced is shaped by their demographic characteristics, and how the severity of the harassment shapes mental health outcomes. Thus, we ask two questions. First, which demographic characteristics are associated with a greater risk of “complementary” and “hostile” forms of street harassment? Second, are complementary and hostile forms of street harassment both associated with higher levels of negative emotion, psychological distress, and post-traumatic maladaptive beliefs? Bride abduction in rural Ethiopia is a harmful traditional practice that often goes unchallenged by both communities and law enforcement. This paper provides a multilevel analysis of legal frameworks, cultural influences, and socioeconomic factors sustaining the practice, and discusses the far-reaching impact on affected individuals and communities. Examining interventions that have successfully addressed gender-based violence in other contexts suggests that multicomponent community mobilization, improved procedural frameworks, and engagement with local leaders are essential to effectively addressing bride abduction in rural Ethiopia.

This study, conducted through the Global Center on Human Trafficking, explores the underexamined role of public and academic libraries in addressing human trafficking across the state of New Jersey. Despite limited formal guidance on their role in anti-trafficking efforts, libraries are increasingly acting as informal hubs for access to resources, education, and social service referrals. Through a statewide survey and qualitative responses from library professionals, this research examines how libraries are currently engaging in training, social work partnerships, programming, and public awareness initiatives. Decolonizing re-entry programs require rethinking traditional approaches in supporting formerly incarcerated individuals and challenging colonial and deficit frameworks embedded in the criminal legal system, which often has an exclusive focus on punishment. This article names the risk factors and systemic barriers faced by equity-denied individuals during reintegration with a focus on the Canadian context. Two community-led programs in Ontario are highlighted as innovative case studies for effectively supporting reintegration of individuals exiting carceral institutions. Key characteristics of these programs which are offered by the Youth Association for Academics, Athletics, and Character Education (YAAACE) and Walls to Bridges (W2B) are outlined. …

งานวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาความรับผิดทางแพ่งของบริษัทแม่ต่อผู้เสียหายที่ได้รับผลกระทบจากพื้นที่ปนเปื้อนสารอันตรายของบริษัทลูก โดยเป็นการศึกษาวิจัยเอกสารจากบทบัญญัติกฎหมาย คำพิพากษาศาล หนังสือตำรา และบทความเชิงวิชาการที่เกี่ยวข้อง ทั้งในประเทศและต่างประเทศ ผลการศึกษาพบว่า ปัจจุบันพระราชบัญญัติส่งเสริมและรักษาคุณภาพสิ่งแวดล้อมแห่งชาติ พ.ศ. 2535 ยังไม่มีบทบัญญัติให้บริษัทแม่เข้ามารับผิดชอบในความเสียหายจากพื้นที่ปนเปื้อนสารอันตรายของบริษัทลูก หากบริษัทแม่มีส่วนร่วมในแหล่งกำเนิดมลพิษหรือกำกับดูแลบริษัทลูก แต่ขาดการยึดถือแหล่งกำเนิดมลพิษทางกายภาพหรือเจตนาเพื่อตนอย่างใดอย่างหนึ่งไป อันไม่ครบองค์ประกอบของการเป็นผู้ครอบครองที่ต้องรับผิดตามมาตรา 96 หากบริษัทแม่มีการกระทำที่ไม่คำนึงถึงความเป็นนิติบุคคลของบริษัทลูกที่ไม่ใช่การกระทำละเมิด หากแต่เป็นการใช้โครงสร้างความเป็นนิติบุคคลของบริษัทลูกในทางมิชอบ อันได้แก่ การใช้นิติบุคคลเป็นเครื่องมือเพื่อหลบเลี่ยงหรือรับหน้าที่หรือความรับผิด และการมีทรัพย์สินปะปนกัน ดังนั้น จึงสมควรกำหนดบทบัญญัติที่เกี่ยวกับความรับผิดของบริษัทแม่ภายใต้พระราชบัญญัติดังกล่าว เพื่อให้ผู้เสียหายในคดีมลพิษจะได้รับความเป็นธรรมในการเยียวยา

วิธีการทางกฎหมายอันเหมาะสมและบทบัญญัติของกฎหมายที่เพียงพอต่อการลงโทษนิติบุคลคลซึ่งละเลยหน้าที่อันต้องกระทำการหลังการขุดเหมืองแร่นั้นถือเป็นประเด็นในทางกฎหมายที่หลายประเทศทั่วโลกไม่ได้ให้ความสนใจเท่าไรนัก นอกจากการละเว้นหน้าที่ดังกล่าวโดยประมาทจะส่งผลร้ายทั้งทางตรงและทางอ้อมต่อสิ่งแวดล้อมและชุมชน บริเวณรอบพื้นที่แล้ว การกระทำดังกล่าวยังส่งผลเสียต่อตัวนิติบุคคลด้วย ในอินโดนีเซียมีผู้เห็นว่าการบังคับใช้มาตรการบังคับทางปกครองเพียงอย่างเดียวก็สามารถป้องปรามการกระทำดังกล่าวได้อย่างเพียงพอ แต่อย่างไรก็ตาม เมื่อได้ศึกษาเปรียบเทียบกฎหมายของอินโดนีเซียกับประเทศไทยและแอฟริกาใต้แล้ว พบว่ามีการใช้มาตรการทางอาญาควบคู่ไปกับมาตรการบังคับทางปกครอง ดังนั้น กรณีดังกล่าวจึงนำมาสู่ปัญหาของงานวิจัยฉบับนี้ว่า การบังคับใช้มาตรการทางอาญาควบคู่ไปกับมาตรการบังคับทางปกครองต่อความผิดฐานละเลยหน้าที่ที่พึงต้องกระทำหลังการขุดเหมืองแร่โดยประมาทจะมีผลสัมฤทธิ์มากกว่าการใช้มาตรการบังคับทางปกครองเพียงอย่างเดียวหรือไม่ และการใช้โทษทางอาญาในความผิดฐานดังกล่าวนั้นขัดต่อหลักความได้สัดส่วนและหลักการกำหนดความผิดในทางอาญาหรือไม่ บทความวิจัยนี้จึงมุ่งศึกษาปัญหาดังกล่าวโดยเน้นการวิเคราะห์หลักเกณฑ์ทางทฤษฎีที่เกี่ยวข้อง และเปรียบเทียบกฎหมายของประเทศไทยและแอฟริกาใต้

บทความวิจัยนี้ศึกษาพัฒนาการของการตีความมาตรา XXI(b) ขององค์การการค้าโลก (WTO) เกี่ยวกับข้อยกเว้นด้านความมั่นคง ตั้งแต่ยุค GATT จนถึงปัจจุบัน โดยวิเคราะห์แนวปฏิบัติและคำวินิจฉัยในการยกอ้างข้อยกเว้นนี้ ผลการศึกษาพบว่า ในยุค GATT และ WTO ตอนต้น การตีความมาตรา XXI ยังขาดความชัดเจน โดยมีการอ้างอิงข้อยกเว้นนี้น้อยมาก และในกรณีที่มีการอ้างอิง ส่วนใหญ่มักยุติด้วยการเจรจา ตกลงกันโดยไม่ผ่านกระบวนการวินิจฉัยที่จะก่อให้เกิดบรรทัดฐานหรือแนวปฏิบัติ อย่างไรก็ตาม นับตั้งแต่ยุคสงครามการค้า การอ้างอิงข้อยกเว้นนี้ตามมาตรา XXI(b) ได้แพร่หลายมากขึ้น และคณะกรรมการวินิจฉัยข้อพิพาทแห่ง WTO ได้แสดงแนวโน้มที่ชัดเจนยิ่งขึ้นในหลายประเด็น เช่น การให้รัฐใช้ดุลพินิจในส่วนของบทนำและเป็นอำนาจพิจารณาของคณะกรรมการวินิจฉัยข้อพิพาทในบทเฉพาะ การแบ่งองค์ประกอบของบทบัญญัติและการตีความ “ผลประโยชน์สำคัญในด้านความมั่นคง” แต่ยังคงมีประเด็นที่ไม่ชัดเจน โดยเฉพาะในเรื่องการตีความ “สถานการณ์ฉุกเฉินในความสัมพันธ์ระหว่างประเทศ” และขอบเขตการใช้ดุลพินิจของรัฐที่จะถูกตรวจสอบโดยคณะกรรมการวินิจฉัยข้อพิพาท

การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาแนวทางการกำกับดูแลบริษัทโฮลดิ้งภายใต้พระราชบัญญัติการแข่งขันทางการค้า พ.ศ. 2560 โดยเปรียบเทียบกับกฎหมายและแนวปฏิบัติของต่างประเทศ เพื่อเสนอแนะแนวทางการปรับปรุงกฎหมายที่เหมาะสมสำหรับประเทศไทย การวิจัยใช้วิธีการศึกษาเชิงเอกสาร โดยวิเคราะห์เปรียบเทียบบทบัญญัติของกฎหมาย แนวปฏิบัติ และคำพิพากษาที่เกี่ยวข้องกับการกำกับดูแลบริษัทโฮลดิ้งตามกฎหมายการแข่งขันทางการค้าของสหรัฐอเมริกา สหภาพยุโรป และสาธารณรัฐเกาหลี ผลการศึกษาพบว่า กฎหมายการแข่งขันทางการค้าของไทยมีข้อจำกัดสำคัญในการกำกับดูแลบริษัทโฮลดิ้ง เนื่องจากนิยาม “ผู้ประกอบธุรกิจ” มีขอบเขตจำกัดเฉพาะผู้ที่ประกอบธุรกิจโดยตรง ทำให้ไม่ครอบคลุมถึงบริษัทโฮลดิ้งที่แม้จะมีอำนาจควบคุมบริษัทในเครือแต่มิได้ประกอบธุรกิจด้วยตนเอง ในขณะที่กฎหมายต่างประเทศมีการตีความอย่างกว้างให้ครอบคลุมถึงบริษัทที่มีอิทธิพลต่อการดำเนินธุรกิจของบริษัทอื่น หรือมีบทบัญญัติเฉพาะในการกำกับดูแลบริษัทโฮลดิ้ง การวิจัยนี้จึงเสนอให้แก้ไขนิยาม “ผู้ประกอบธุรกิจ” ให้ครอบคลุมถึงบริษัทที่มีอำนาจควบคุมหรือมีอิทธิพลอย่างมีนัยสำคัญต่อผู้ประกอบธุรกิจอื่น ปรับปรุงประกาศเกี่ยวกับหลักเกณฑ์การพิจารณาความสัมพันธ์ทางนโยบายหรืออำนาจสั่งการ และออกแนวปฏิบัติที่ชัดเจนในการพิจารณาอำนาจควบคุมและความรับผิดของบริษัทโฮลดิ้ง เพื่อให้การกำกับดูแลมีประสิทธิภาพและสอดคล้องกับมาตรฐานสากล

การวิจัยนี้เป็นงานวิจัยเอกสารซึ่งมีวัตถุประสงค์เพื่อศึกษาประเด็นหลักดังต่อไปนี้ 1) บทบัญญัติกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายสามารถเป็นวัตถุแห่งการควบคุมความชอบด้วยรัฐธรรมนูญของไทยได้หรือไม่ 2) บทบัญญัติกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายซึ่งกำหนดให้ใช้สัญชาติของสามีเป็นจุดเกาะเกี่ยวในความสัมพันธ์ระหว่างคู่สมรสและให้ใช้สัญชาติของบิดาในความสัมพันธ์ระหว่างบิดามารดาและบุตรขัดหรือแย้งกับหลักความเสมอภาคระหว่างเพศตามรัฐธรรมนูญของไทยหรือไม่ จากการศึกษาพบว่า พระราชบัญญัติว่าด้วยการขัดกันแห่งกฎหมาย พุทธศักราช 2481 ไม่ควรอยู่นอกขอบเขตของการควบคุมความชอบด้วยรัฐธรรมนูญ เนื่องจากการเลือกกำหนดจุดเกาะเกี่ยวของแต่ละลักษณะข้อกฎหมายล้วนได้รับอิทธิพลจากข้อความคิดที่ปรากฏอยู่ในกฎหมายแพ่งและระบบคุณค่าของสังคมในขณะที่ตรากฎหมาย นอกจากนี้ ยังไม่เคยปรากฏในคำวินิจฉัยของศาลรัฐธรรมนูญไทยที่เกี่ยวกับหลักความเสมอภาคระหว่างเพศว่า ศาลอาศัยเหตุผลที่ว่าระบบคุณค่าที่อยู่เบื้องหลังบทบัญญัติของกฎหมายขัดต่อหลักความเสมอภาคระหว่างเพศเพื่อวินิจฉัยว่าบทบัญญัติกฎหมายใดขัดต่อหลักการดังกล่าว แต่จะต้องเป็นกรณีซึ่งกฎหมายบัญญัติให้ปฏิบัติแตกต่างกันและส่งผลให้บุคคลเสียไปซึ่งสิทธิบางประการอย่างเป็นรูปธรรมด้วยเหตุแห่งเพศ ดังนั้น ผู้วิจัยเห็นว่าการวินิจฉัยความชอบด้วยรัฐธรรมนูญของบทบัญญัติกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมาย ควรนำระบบคุณค่าที่อยู่เบื้องหลังการบัญญัติกฎหมายมาพิจารณาประกอบด้วย นอกจากนี้ ควรแก้ไขจุดเกาะเกี่ยวในกฎหมายขัดกันของไทยให้เป็นกลางทางเพศโดยให้สามารถรองรับการก่อตั้งครอบครัวในบริบทของความหลากหลายทางเพศ

The Brookings Institution report, “The state of police reform: measuring progress in each state,” tracks the total number of killings by police and the number of killings by police per one million residents in all 50 U.S. states and the District of Columbia. This fact sheet reports data on the total number of people killed by police and the rate of police killings per capita for each Mountain West state.

With increasing efforts to expand correctional education college programs, previous research has primarily explored the experiences of instructors teaching in face-to-face settings. However, little is known about the experiences of faculty teaching in online correctional education programs within the United States. This qualitative, transcendental phenomenological study addresses this gap by examining the experiences of five online English composition correctional education instructors. Data collection methods included semi-structured interviews, document analysis, and a focus group. Findings revealed that instructors adapted their teaching practices to accommodate the online format, faced challenges in building relationships with students, and desired more professional development. Examining The Effects Of Firearm Lethality And Aggressors’ Intentions To Kill On Injurious Firearm Violence At American Schools: A Research Note, Brent R. Klein, Cory Schnell, Steven M. Chermak, Joshua D. Freilich

This study examined firearm lethality and aggressors’ lethal intent on injurious fatal and nonfatal school shootings using data from The American School Shooting Study, which covers 329 school shootings in the United States from 1990 to 2016. We developed a new multidimensional construct for measuring shooters’ determination to kill and examined firearm characteristics while considering confounding factors. We identified 11 distinct categories of shooters’ intent, with most showing a strong desire to kill. Both intent and weapon lethality significantly impacted school shooting homicides. Overall, we recommend that prevention and theoretical models should address both factors.

"Little is known about the content of conspiratorial posts on social media, specifically regarding active shooter events. This study explores the content of conspiracy theory tweets during the six months following the active shooter event at Robb Elementary School in Uvalde, Texas. 194 tweets were analyzed. The analysis resulted in two main themes: False Flag and Hypothesized Reasoning. These themes represent the similarities and variations in content among the tweets. "Studies demonstrate that LGBTQ+ college students experience explicit and covert discrimination with research documenting various microaggressions reported by university students whose gender and/or sex identities are minoritized. Building off existing models of LGBTQ microaggressions, the current study adds to this literature by utilizing focus groups to explore campus safety perceptions among a sample of U.S. undergraduate students who identify as LGBTQ+. Findings highlight the diverse microaggressions experienced by students at the interpersonal and environmental level. "Community based participatory research (CBPR) centers the voices of community members in the research process. Long used in the field of healthcare, criminal justice researchers have employed CBPR only in limited contexts, and never in the context of prosecution research. This paper reports on findings from a CBPR study that employed focus groups with justice-involved individuals to identify their perceptions of the pre-trial process, prosecutors’ priorities, and recommended directions for research. "Community partnerships between police departments, social services, and healthcare providers continue to struggle in various ways, with mental health crisis response remaining a primary yet fragmented service delivery. Using the nodal governance perspective, this paper provides qualitative insight into the existing communication and resource barriers between law enforcement personnel and social service providers in a large urban county in Texas. Four key themes are presented: staff and resource availability, continuity of care, staff personnel and characteristics, and communication efficiency. This report assesses the current workloads and staffing of California public defense providers. The report concludes that California’s public defense attorneys are almost universally burdened by workloads that far exceed nationally recommended standards. Additionally, compared to district attorneys’ offices in the same jurisdictions, public defender offices typically have 20-45% fewer attorneys.

This report also details how public defense providers in California also lack the appropriate support staff – investigators, social workers, paralegals, and administrative assistants – necessary to efficiently and effectively represent their clients. This thesis examines parole revocation hearings in New York as complex performances that extend carceral control beyond prison walls. Drawing on a composite vignette from the Bronx parole court, it analyzes the interplay between procedural reform, constitutional due process, and neoliberal governance. Using a dramaturgical framework informed by Michel Foucault’s discourse analysis and Judith Butler’s theory of performativity, the study identifies four interrelated processes: the judge as director, who orchestrates hearings according to institutional priorities; normalization, where repetition embeds structural inequality as routine; type-marking, the classification of parolees into predefined roles through accumulated records and cues; and the extension of …

The field of organizational studies has extensively examined factors influencing the turnover and succession of public officers, yet limited attention has been given to chiefs of police. Using institutional theory as a framework, this study explores police chief turnover by focusing on the institutional environment and the relationships between police chiefs and key individuals and entities within their communities. Utilizing survey data collected from police chiefs attending mandatory training programs designed for new appointees, the analysis reveals that police chief turnover is substantially associated with the quality of relationships with key stakeholders within the institutional environments, both individually and collectively. …
