How do pathways between childhood victimization, drug use, and offending behavior vary for recordholders of different races and genders? Prior literature and theory indicates that there are distinct processes that can link childhood victimization to drug use and other offending behavior. These processes are rooted at least partially in experiences of racism/discrimination, placement relative to sociocultural power structures, and norms established over one’s childhood through peer and familial influences. However, less is known about how these differ by race, gender, and the intersection thereof. Fear Across The Map: A Cross-Municipal Analysis Of Fear Of Crime In Canada, Muhammad Ali

This study examines the predictors of fear of crime (FOC) across three Canadian municipalities: Hamilton, Ontario; Brantford, Ontario; and North Battleford, Saskatchewan. Data from 1,956 survey responses were analyzed to understand how certain factors shape FOC across different municipal contexts in Canada. This study uses descriptive statistics, reliability analyses, correlation matrices, and Ordinary Least Squares regression models to examine whether FOC, and the predictors of FOC, operate consistently across municipalities. The findings indicate that the predictors of FOC are relatively reliable across municipal contexts. However, the influence of the predictors of FOC can vary across municipalities. Indigenous Peoples across Turtle Island experience disproportionately high rates of violence and homicide compared to other racial groups. Rooted in coloniality and sustained by Western institutions, this epidemic is recognized as the Missing and Murdered Indigenous Relatives (MMIR) crisis. In response, Indigenous women have mobilized the MMIR Movement to raise awareness and advocate for institutional change. Although scholarship on MMIR has expanded, limited research has explored the experiences of MMIR advocates. This study interrogates the institutional landscapes that shape MMIR advocacy and explores the resistance strategies advocates employ to address the crisis. Lawmakers looking to foster technological innovation on the European market are adopting laws they hope will promote consumer trust in digital products. Their strategy can be broken down into three components. First, they aim to empower consumers to choose how much data they want to share with companies through an express consent framework. Second, they seek to avoid harms from digital products through product safety law such as adapting the Product Safety Regulation to digital products or adopting the AI Act. Third, they endeavor to prevent manipulation of consumers through digital means.

Family law scholarship is replete with calls for reform. Yet gender-, race-, and class-based inequalities within and across families remain intractable. So what if, instead of reforming the family, we abolish it?
Abolishing the family might sound like a startling idea for a family-law analysis, especially after decades of efforts to expand the legal understanding of “family.” But the proposal is hardly new. In this Article, we lay the groundwork for integrating family abolitionist ideas, which have until now mostly taken place outside of law, into family law scholarship.

Traditional historical accounts posit that federal bankruptcy specialization in the United States first developed under the system established by the Bankruptcy Act of 1898. That view assumes that the structural and temporal conditions necessary to foster specialization did not exist under the nation’s earlier federal bankruptcy systems—those created by the Bankruptcy Acts of 1800, 1841, and 1867. This Article theorizes that federal bankruptcy specialization very likely occurred under the pre-1898 systems and marshals evidence to that effect, primarily focusing on the Bankruptcy Act of 1841 (the 1841 Act). A robust literature examines sustainability disclosures by public corporations, but legal scholarship has largely overlooked the role of third-party assurance—or verification—of such disclosures. This is a notable omission given the extensive literature on the auditing of financial statements, a related form of assurance.
This article responds by examining the role of assurance in sustainability reporting. In keeping with the theme of this symposium volume, it draws on US and EU law. Our discussion begins in Part I with sustainability disclosures, focusing on the requirements and practices of public companies. We consider how tax regulations should be reviewed in a post-Chevron world. In 2011, the Supreme Court’s Mayo Foundation decision subjected Treasury regulations to ordinary Chevron deference, rejecting National Muffler’s tax-specific standard of review and declaring that the Court was “not inclined to carve out an approach to administrative review good for tax law only.” In 2024, Loper Bright overruled Chevron. This Article asks what Loper Bright means for Mayo—and, in turn, for National Muffler.

Private entities are influencing the development of international space law. Space enterprises need regulatory certainty and consistent standards to attract capital and develop their plans for space. Yet, states have lagged in their capacity to make multilateral international space law in traditional public fora. Private entities have responded to this legal lag by attempting to create, develop, and nudge international space law in commerce-friendly ways. Teaching Constitutional Law in the present era presents unique pedagogical challenges. My students arrive skeptical of the field, doubtful of the Supreme Court’s authority, questioning the relevance of legal methods in determining case outcomes, and perceiving constitutional adjudication as irreducibly political. Rather than dismiss these concerns, I argue that constitutional law professors must acknowledge them directly. Our task is not to restore naïve faith in judicial neutrality (an impossible ideal), but to present students with a vision of constitutional meaning-making—one grounded in politics, history, and democratic politics—in which they can recognize themselves as engaged participants in the future of our …

จากการศึกษาเปรียบเทียบการกำกับดูแลการผูกขาดในประเทศสหรัฐอเมริกาและประเทศญี่ปุ่น ผู้เขียนได้ค้นพบว่าวัตถุประสงค์ของกฎหมายต่อต้านทรัสต์ของประเทศสหรัฐอเมริกาคือ “ประสิทธิภาพ” และ “สวัสดิการผู้บริโภค” ทำให้ในยุคเศรษฐกิจดิจิทัล หน่วยงานบังคับใช้กฎหมายต่อต้านทรัสต์ของประเทศสหรัฐ อเมริกาประสบปัญหาในการกำกับดูแลการผูกขาดโดยบริษัทแพลตฟอร์มอิเล็กทรอนิกส์ที่มีอำนาจเหนือตลาด เนื่องจากผู้บริโภคได้ประโยชน์จากการผูกขาดดังกล่าว แม้ว่าผู้มีส่วนได้เสียอื่น โดยเฉพาะอย่างยิ่งคู่ค้าที่เป็นบริษัทขนาดกลางและขนาดย่อม (Small and Medium Enterprise: SME) จะถูกเอารัดเอาเปรียบก็ตาม ส่วนในประเทศญี่ปุ่น วัตถุประสงค์ของกฎหมายป้องกันการผูกขาด คือ การสนับสนุนและรักษาไว้ซึ่ง “การแข่งขันที่เสรีและเป็นธรรม” ซึ่งหมายความรวมถึงการปกป้อง SMEs จากการถูกเอารัดเอาเปรียบและพฤติกรรมการปฏิบัติทางการค้าที่ไม่เป็นธรรม (Unfair Trade Practices) ของบริษัทขนาดใหญ่ด้วย ส่วนวัตถุประสงค์ของกฎหมายแข่งขันทางการค้าในประเทศไทยมีความคล้ายคลึงกับประเทศญี่ปุ่น จึงมีบทบัญญัติเกี่ยวกับพฤติกรรมการปฏิบัติทางการค้าที่ไม่เป็นธรรมเช่นเดียวกัน ผู้เขียนจึงเสนอแนะให้หน่วยงานบังคับใช้กฎหมายป้องกันการผูกขาดของประเทศไทยออกกฎหมายลำดับรองเพื่อกำกับดูแลพฤติกรรมของผู้ประกอบธุรกิจแพลตฟอร์มตัวกลางการซื้อขาย (E-Commerce) ที่มีอำนาจเหนือตลาดในประเทศไทย

หลักความคาดหวังอันชอบธรรมเป็นกลไกสำคัญในระบบกฎหมายปกครองสมัยใหม่ที่มุ่งคุ้มครองความไว้วางใจของประชาชนต่อการกระทำของรัฐ บทความนี้ศึกษาพัฒนาการและสาระสำคัญของหลักการดังกล่าวในระบบกฎหมายเปรียบเทียบ ได้แก่ ระบบกฎหมายเยอรมนีที่หลักความคาดหวังอันชอบธรรมได้รับการยอมรับเป็น “หลักรัฐธรรมนูญทั่วไป” ภายใต้หลักนิติรัฐ และเชื่อมโยงกับหลักความมั่นคงแน่นอนทางกฎหมายและหลักความได้สัดส่วน ในอังกฤษหลักนี้มีจุดเริ่มต้นจากแนวคิดเรื่องความเป็นธรรมในกระบวนการก่อนขยายไปสู่การคุ้มครองผลประโยชน์เชิงเนื้อหาโดยใช้หลักการถ่วงดุลกับประโยชน์สาธารณะ ส่วนประเทศอื่น เช่น ออสเตรเลีย แคนาดา โปแลนด์ อินเดีย และฝรั่งเศส ต่างมีลักษณะการปรับใช้เฉพาะที่สะท้อนเป้าหมายร่วมกันในการจำกัดอำนาจรัฐและคุ้มครองความไว้วางใจของประชาชน สำหรับประเทศไทย ศาลปกครองไทยได้วางหลักการตีความสำคัญหลายประการทั้งการคุ้มครองเชิงเนื้อหาที่รับรองฐานะทางกฎหมายแม้คำสั่งจะถูกเพิกถอนในภายหลัง การชั่งน้ำหนักระหว่างความคาดหวังส่วนบุคคลกับประโยชน์สาธารณะ การเชื่อมโยงหลักความคาดหวังอันชอบธรรมกับหลักนิติรัฐ ข้อยกเว้นกรณีประมาทเลินเล่อร้ายแรงและการปกปิดข้อเท็จจริงที่มีสาระสำคัญ อย่างไรก็ตาม การปรับใช้ยังขาดความสม่ำเสมอในสาระสำคัญของการคุ้มครองความไว้วางใจของประชาชน บทความจึงนำเสนอแนวทางการพัฒนากฎหมายปกครองไทย ทั้งการปรับปรุงกฎหมายที่มีอยู่ให้ครอบคลุมรูปแบบความคาดหวังที่หลากหลาย การพัฒนาแนวทางการตีความของศาลที่ยอมรับการคุ้มครองทั้งในเชิงกระบวนการและเชิงเนื้อหา และการสร้างกลไกทางกฎหมายใหม่ เช่น คณะกรรมการไกล่เกลี่ยข้อพิพาท อันจะนำไปสู่การพัฒนาระบบกฎหมายปกครองไทยที่เป็นธรรม โปร่งใส และสอดคล้องกับหลักนิติรัฐอย่างแท้จริง

การรอการกำหนดโทษหรือรอการลงโทษ ตามประมวลกฎหมายอาญา มาตรา 56 เป็นมาตรการที่มีความสำคัญในกระบวนการยุติธรรมทางอาญา ซึ่งเป็นมาตรการที่บัญญัติขึ้นโดยมีวัตถุประสงค์ให้ศาลใช้ดุลพินิจรอการกำหนดโทษหรือรอการลงโทษสำหรับคดีที่มีอัตราโทษจำคุกระยะสั้นหรือโทษปรับ ตามทฤษฎีการลงโทษเพื่อแก้ไขพฤติกรรมของผู้กระทำความผิด กล่าวคือ ในคดีความผิดอาญาที่มีโทษจำคุกหรือปรับ และศาลจะลงโทษจำคุกไม่เกิน 5 ปี ทั้งนี้ เพื่อมิให้ผู้กระทำความผิดเล็กน้อยนั้นเข้าไปปะปนกับผู้กระทำความผิดเป็นอาจิณและเลียนแบบพฤติกรรมนั้นจนกลับมากระทำความผิดซ้ำอีก และเพื่อให้โอกาสผู้กระทำความผิดได้รู้สำนึกถึงสิ่งที่ได้กระทำลงไป รวมถึงสามารถกลับมาดำเนินชีวิตในสังคมได้อย่างเป็นปกติ แต่ในทางกลับกันเมื่อพิจารณาจากการบังคับใช้ประมวลกฎหมายอาญา มาตรา 56 ศาลสามารถใช้ดุลพินิจได้กับทุกฐานความผิด แม้ลักษณะของฐานความผิดนั้นจะกระทบกระเทือนต่อความปลอดภัยของสังคมมากเพียงใด แต่หากโทษจำคุกที่ศาลลงมีกำหนดไม่เกิน 5 ปี ศาลก็สามารถสั่งรอการกำหนดโทษหรือรอการลงโทษได้กับทุกกรณี ซึ่งอาจจะขัดหรือแย้งกับทฤษฎีการลงโทษทางอาญาประการอื่น กล่าวคือ ทฤษฎีการลงโทษเพื่อแก้แค้น การลงโทษเพื่อข่มขู่ยับยั้ง การลงโทษเพื่อตัดผู้กระทำผิดออกจากสังคมรวมถึงการลงโทษเพื่อป้องกันอาชญากรรม อันส่งผลกระทบต่อความรู้สึกและการได้รับความยุติธรรมของผู้เสียหาย หรือเหยื่อในคดีอาญารวมทั้งประชาชนในสังคม เนื่องจากในบางกรณีเป็นฐานความผิดที่มีความร้ายแรง และเป็นอันตรายต่อสังคม แต่ผู้กระทำความผิดกลับไม่ถูกลงโทษ ยิ่งไปกว่านั้นอาจทำให้ผู้เสียหายไม่ได้รับความยุติธรรม และบุคคลทั่วไปย่อมเข้าใจว่าการกระทำร้ายแรงเช่นนั้นสามารถกระทำได้โดยไม่ต้องรับผลใด ๆ จากการกระทำดังกล่าว ฉะนั้นจึงควรปรับปรุงแก้ไข และจัดทำคำแนะนำเกี่ยวกับวิธีการรอการลงโทษหรือรอการกำหนดโทษให้มีความชัดเจนยิ่งขึ้น โดยการกำหนดแนวทาง หรือข้อพิจารณาที่ผู้ใช้กฎหมายควรให้การคำนึง และให้ความสำคัญยิ่งขึ้นเกี่ยวกับฐานความผิดร้ายแรงที่ไม่ควรรอการกำหนดโทษหรือรอการลงโทษ เพื่อให้การลงโทษเป็นไปตามสัดส่วนของการกระทำความผิด และตรงตามทฤษฎีวัตถุประสงค์ของการลงโทษ

การโฆษณาโดยเจาะจงตัวบุคคลส่งผลกระทบต่อสิทธิในความเป็นส่วนตัวของเด็กทั้งในรูปแบบของการเฝ้ามองพฤติกรรมทางออนไลน์ การเก็บรวบรวม ใช้ หรือการเปิดเผยข้อมูลส่วนบุคคลโดยไม่ได้รับความยินยอมหรือไม่มีกฎหมายให้อำนาจไว้ การทำโปรไฟล์ หรือการนำเสนอโฆษณาที่ตอบสนองต่อความต้องการหรือลักษณะเฉพาะของตัวเด็ก สามารถชักจูงความคิดหรือกระตุ้นความต้องการของผู้รับโฆษณาได้โดยเฉพาะเพื่อแสวงหาประโยชน์ในทางเศรษฐกิจ สังคม การเมือง หรือวัตถุประสงค์อื่นใด การที่เด็กซึ่งเป็นบุคคลกลุ่มเปราะบางของสังคมอาจมีความรู้ความเข้าใจในการใช้งานเทคโนโลยีดิจิทัลและเครือข่ายออนไลน์และมีวิจารณญาณในการรับสื่อโฆษณาที่ไม่เพียงพอ ส่งผลให้เด็กมีความเสี่ยงจากการตกเป็นเป้าหมายของการแทรกแซงสิทธิในความเป็นส่วนตัวและการแสวงหาประโยชน์อันไม่ชอบจากการกระทำดังกล่าวได้โดยง่าย จากการศึกษาพิจารณาได้ว่า กฎหมายภายในของไทยในปัจจุบันอาจมีไม่เพียงพอสำหรับการคุ้มครองสิทธิในความเป็นส่วนตัวของเด็กจากการโฆษณาโดยเจาะจงตัวบุคคลตามมาตรฐานระหว่างประเทศ ดังนั้น บทความนี้จึงมีวัตถุประสงค์ในการศึกษาแนวทางการพัฒนามาตรการทางกฎหมายที่เหมาะสมกับสถานการณ์ในปัจจุบันเพื่อคุ้มครองสิทธิในความเป็นส่วนตัวของเด็กให้สอดคล้องกับพันธกรณีของประเทศไทยที่มีอยู่ตามกฎหมายระหว่างประเทศ

การพัฒนาที่ยั่งยืน (Sustainable Development) เป็นแนวคิดด้านการพัฒนาที่ได้รับการยอมรับในระดับสากลและมีบทบาทเป็นแนวทางการพัฒนาที่ทุกประเทศนำไปปรับใช้ โดยมีนิยามว่า การพัฒนาที่ตอบสนองความต้องการของคนรุ่นปัจจุบัน โดยไม่กระทบต่อความสามารถในการตอบสนองความต้องการของคนรุ่นอนาคต โดยมี สามเสาหลักแห่งการพัฒนาที่ยั่งยืน (The three pillars of sustainability) เป็นหัวใจสำคัญของหลักการ ซึ่งการบูรณาการมิติด้านการพัฒนาทั้งสามด้าน ได้แก่ เศรษฐกิจ สังคม และสิ่งแวดล้อม ให้สอดคล้องกัน ซึ่งประเทศไทยมีพันธกิจในระดับสากลในการนำหลักการพัฒนาที่ยั่งยืนมาปรับใช้กับการพัฒนาภายในประเทศทุกภาคส่วน รวมถึงการจัดการป่าไม้อันเป็นทรัพยากรธรรมชาติภายในประเทศ บทความฉบับนี้จึงเป็นการศึกษาและวิเคราะห์กฎหมายป่าไม้ของไทย โดยศึกษาในเชิงประวัติศาสตร์กฎหมายนับตั้งแต่ก่อนการก่อตั้งกรมป่าไม้ในสมัยรัชกาลที่ 5 ซึ่งเป็นช่วงแรกเริ่มของการตรากฎหมายป่าไม้ มาจนถึงกฎหมายป่าไม้ในช่วงเวลาปัจจุบัน เพื่อชี้ให้เห็นว่ากฎหมายป่าไม้ของไทยได้นำเอาหลักการพัฒนาที่ยั่งยืนมาปรับใช้จริงและมีความสอดคล้องกับพัฒนาการของหลักการพัฒนาที่ยั่งยืน โดยปรากฏผ่านหลักการของกฎหมายป่าไม้ในหลายภาคส่วนที่แสดงให้เห็นถึงการบูรณาการทางเศรษฐกิจ สังคม และสิ่งแวดล้อม ซึ่งเป็นหัวใจสำคัญของหลักการพัฒนาที่ยั่งยืน

Child abuse and neglect are prevalent problems, affecting an estimated one million children worldwide each year. The purpose of this paper is to evaluate and analyze three potential solutions to reduce the rates of child abuse and neglect. The three programs that were suggested were: improving overall access to healthcare, therapy and counseling, and other support services for children and families who need them, implementing more Nurse-Family Partnerships across the United States for first time mothers with visits from a registered nurse, and increasing parent’s access to economic resources and improving families overall financial security. The Controlled Substances Act (CSA) is the primary regulatory and criminal legislation surrounding drugs in the United States. Passed in the 1970s, the CSA established the drug classification scheduling system we use today. Despite being over 50 years old today, the CSA has not achieved its goal of eliminating or even significantly reducing drug use and offenses. The purpose of this paper is to examine the continued concern about substance abuse/misuse and limited access to treatment in rural areas. Rural areas lack the adequate treatment needed to combat substance use disorder (SUD), mainly due to the lack of sufficient providers trained to identify, treat, and support those dealing with SUD. This thesis examines the persistence of high-profile sexual violence in the global music industry through a comparative analysis of Seung-hyun “Seungri” Lee’s Burning Sun scandal in South Korea and Sean “Diddy” Combs’ legal proceedings in the United States. Suicide and attempted suicide remain a major concern in correctional facilities. Jail personnel have developed unique ways of responding to incarcerated individuals who display signs of suicidal ideation, but may be less equipped to identify who may be suicidal upon arrival at the facility. Among potential markers for suicidal behaviors are incarcerated individuals struggling with feelings of thwarted belongingness, or a feeling of disconnection and lack of closeness. A major challenge for abolitionist teaching is uprooting the assumption that carceral systems are natural and inevitable. This essay describes strategies for teaching about the colonial capitalist origins and white cisheteropatriarchal development of the police, and the critical theorization and abolition of policing, in a hyper-politicized minefield.
