Introduction: Seeking legal redress for sexual violence (SV) is a daunting process for survivors. They must navigate their personal trauma societal stigma, and flawed systems, creating an arduous path to justice. This study was conducted to assess patterns of SV within Mombasa County, Kenya, and details the legal follow-up post-SV care.

Methods: A retrospective cross-sectional study was conducted using data from SV survivors attending the Gender-Based Violence and Recovery Centre (GBVRC) at the Coast General Teaching and Referral Hospital (CGTRH) between 2017 and 2023. This paper examines the rise of Digital Economy Agreements (DEAs) in the Indo-Pacific as a strategic response to digital trade fragmentation and great power competition. Focusing on Singapore’s leadership, we introduce the ‘Singapore Effect’ – a model of regulatory influence distinct from others, such as the ‘Brussels Effect’ and ‘Beijing Effect.’ Unlike market-driven regulatory diffusion, the Singapore Effect emphasizes interoperability, norm entrepreneurship, and mini-lateralism, enabling middle powers to shape digital trade governance. Abstract. The Draa Oasis in southeastern Morocco is experiencing severe water scarcity, driven by climate change and intensified by the expansion of watermelon agribusiness and desert tourism. This article explores how external investors, empowered by national agricultural policies, have disrupted traditional water governance systems rooted in collective management. Through ethnographic fieldwork involving interviews, focus groups, and spatial mapping, the study examines the socio-environmental consequences of groundwater depletion and land commodification. It argues that investors fail to assume ethical accountability for the ecological degradation they cause, despite being aware of the oasis’s fragile ecosystem. When Otto Habsburg – son of the last emperor of the Austria-Hungarian Empire Karl I – died in 2011, among those who prayed at the funeral was Mustafa Efendi Cerić, the Reis-ul-ulema of Bosnia and Herzegovina – the highest Islamic office in the country. บทความนี้มีวัตถุประสงค์เพื่อศึกษาประสบการณ์ของระบบกฎหมายฝรั่งเศสในการจัดกลุ่มกฎหมายที่มีคุณค่าในระดับรัฐธรรมนูญ โดยอาศัยคณะตุลาการรัฐธรรมนูญเป็นองคาพยพในการจัดกลุ่มและพัฒนาหลักการทางรัฐธรรมนูญที่มีความเป็นพลวัตให้เกิดความชัดเจนภายใต้ทฤษฎีการจัดลำดับศักดิ์ของกฎหมาย โดยผลการศึกษาพบว่า คณะตุลาการรัฐธรรมนูญได้อาศัยบทบัญญัติของรัฐธรรมนูญแห่งสาธารณรัฐฝรั่งเศส ค.ศ. 1958 ที่กำหนดให้คำวินิจฉัยของคณะตุลาการรัฐธรรมนูญมีผลผูกพันทุกองค์กรมาใช้ในการพัฒนากลุ่มกฎหมายที่มีคุณค่าในระดับรัฐธรรมนูญ โดยการวินิจฉัยให้เอกสารทางกฎหมายอื่น ๆ ถือเป็นส่วนหนึ่งของกลุ่มกฎหมายที่มีคุณค่าในระดับรัฐธรรมนูญ ซึ่งประสบการณ์ดังกล่าวสามารถนำมาปรับใช้กับระบบกฎหมายไทยได้ในกรณีที่ต้องมีการตีความเอกสารทางกฎหมายที่มีมาก่อนการประกาศใช้รัฐธรรมนูญให้มีสถานะดังเช่นรัฐธรรมนูญ รวมถึงการตีความหลักการทางกฎหมายที่เคยปรากฏในรัฐธรรมนูญฉบับก่อนแต่ไม่ปรากฏในรัฐธรรมนูญฉบับปัจจุบัน

ความตกลงที่ครอบคลุมและก้าวหน้าสำหรับหุ้นส่วนทางเศรษฐกิจภาคพื้นแปซิฟิก (Comprehensive and Progressive Agreement for Trans-Pacific Partnership: CPTPP) กำหนดนิยามของสินค้าใช้แล้วที่ผ่านกระบวนการผลิตซ้ำ ว่าเป็นสินค้าที่มีส่วนประกอบของวัสดุเดิมที่มีการนำมาปรับแก้บางส่วนหรือทั้งหมด ทั้งมีอายุการใช้งานเท่าสินค้าใหม่และสามารถใช้งานได้เหมือนกับหรือใกล้เคียงกับสินค้าใหม่ และมีการรับประกันจากโรงงานเช่นเดียวกับสินค้าใหม่ อย่างไรก็ดี CPTPP ได้กำหนดห้ามมิให้ประเทศสมาชิกเลือกปฏิบัติต่อสินค้าดังกล่าว ซึ่งกฎหมายเกี่ยวกับเครื่องมือแพทย์มิได้กำหนดหลักเกณฑ์เกี่ยวกับเครื่องมือแพทย์ลักษณะดังกล่าวไว้ ดังนั้น หากประเทศไทยเข้าร่วมเป็นสมาชิกเป็นข้อผูกพันจะต้องยอมรับเครื่องมือแพทย์ใช้แล้วที่ผ่านกระบวนการผลิตซ้ำ ก็จำเป็นต้องพิจารณาตัวอย่างการกำกับดูแลเครื่องมือแพทย์ของต่างประเทศประกอบกับการบริหารจัดการความเสี่ยง ไม่ว่าจะเป็นความเสี่ยงต่อผู้รับบริการสาธารณสุข บุคลากรด้านสาธารณสุข ผู้ใช้แรงงานในอุตสาหกรรมการผลิตเครื่องมือแพทย์ ตลอดจนความเสี่ยงด้านสิ่งแวดล้อม ทั้งนี้ เพื่อจัดทำมาตรการทางกฎหมายในการกำกับดูแลเครื่องมือแพทย์ใช้แล้วที่ผ่านกระบวนการผลิตในประเทศไทยตั้งแต่ขั้นตอนการผลิตก่อนออกสู่ตลาด ระบบเฝ้าระวังและการติดตามตรวจสอบ รวมทั้งการจัดการขยะเครื่องมือแพทย์ที่เหมาะสม

แนวทางในการกำหนดความรับผิดทางอาญาและวิธีการเพื่อความปลอดภัยต่อผู้กระทำความผิดซึ่งมีสภาวะจิตผิดปกติ (Guideline For Determining The Criminal Liability And Security Measures For Insane Offenders), Natchapol Jittirat

หลักเกณฑ์ในการพิจารณาความรับผิดทางอาญาของผู้กระทำความผิดที่มีสภาวะจิตผิดปกตินับเป็นปัญหาสำหรับศาลและนักกฎหมายมาช้านานในอดีต เนื่องจากผู้กระทำความผิดบางรายอาจกระทำความผิดไปโดยไม่รู้สึกตัว เพราะมีสาเหตุมาจากความบกพร่องทางประสาท สมอง จิตใจ อารมณ์และความเครียด ซึ่งความผิดปกติทางจิตขนาดใดจึงจะนำมาพิจารณาว่าผู้นั้นไม่มีความผิด หรือมีความผิดแต่ควรยกเว้นโทษหรือลดโทษนี้ ศาลของประเทศอังกฤษได้วางหลักสำคัญไว้ในการพิจารณาคดี McNaghten’s (1843) ว่าต้องสันนิษฐานไว้ก่อนว่ามนุษย์ทุกคนมีจิตปกติ เว้นแต่จะมีข้อสันนิษฐานซึ่งสามารถพิสูจน์ได้ว่าขณะกระทำความผิดจำเลยได้รับความเจ็บปวดจากโรคทางจิตจนไม่ทราบเนื้อหาและสาระสำคัญของการกระทำ กล่าวคือไม่สามารถรู้ได้ว่าสิ่งนั้นถูกหรือผิด หลักเกณฑ์ดังกล่าวนี้ได้ถูกนำไปใช้อย่างแพร่หลายทั้งในสหรัฐอเมริกาและประเทศในภูมิภาคยุโรป ซึ่งนำไปสู่การตัดสินว่าจำเลยไม่มีความผิดโดยศาลจะมีคำสั่งให้ควบคุมตัวจำเลยไปรับการบำบัดรักษาที่สถานพยาบาล สำหรับการพิจารณาถึงความรับผิดของผู้ที่มีจิตบกพร่อง โรคจิต หรือจิตฟั่นเฟือน ตามแนวทางในการพิจารณาคดีของศาลนั้นหากผู้กระทำไม่รู้สำนึกของการกระทำย่อมไม่มีความผิดตามประมวลกฎหมายอาญา มาตรา 59 ถ้าหากผู้กระทำรู้สำนึกแต่ไม่สามารถรู้ผิดชอบ หรือไม่สามารถบังคับตนเองได้ถือเป็นเหตุยกเว้นโทษ และถ้าผู้กระทำความผิดยังสามารถรู้ผิดชอบอยู่บ้าง หรือยังสามารถบังคับตนเองได้บ้าง ผู้นั้นต้องรับโทษสำหรับความผิดนั้น โดยศาลจะลงโทษน้อยกว่าที่กฎหมายกำหนดไว้สำหรับความผิดนั้นเพียงใดก็ได้ตามมาตรา 65 ซึ่งจะเห็นได้ว่าในกรณีที่ศาลตัดสินว่าจำเลยไม่มีความผิดนี้อาศัยความตามมาตรา 59 ถือว่าผู้กระทำความผิดไม่รู้สำนึกซึ่งใช้หลักเกณฑ์เดียวกับบุคคลทั่วไปซึ่งหากไม่รู้สำนึกในการกระทำก็ย่อมไม่มีความผิด ดังปรากฏตามคำพิพากษาฎีกาที่ 8743/2544 คำพิพากษาฎีกาที่ 2590/2562 แต่สำหรับผู้กระทำความผิดที่มีจิตบกพร่อง โรคจิต หรือจิตฟั่นเฟือนนั้นได้กระทำความผิดไปโดยไม่รู้ถึง “สภาพ” และ “สาระสำคัญ” ของการกระทำจึงควรบัญญัติแยกไว้เป็นอีกมาตราหนึ่งให้ผู้นั้นไม่มีความผิดและหากผลของการกระทำความผิดมีความร้ายแรงต่อชีวิต ร่างกายหรือทรัพย์สินของผู้อื่นก็ควรให้เป็นดุลพินิจของศาลในการมีคำสั่งให้ส่งตัวผู้นั้นเข้ารับการบำบัดรักษาในสถานพยาบาลได้เช่นเดียวกับที่บัญญัติความไว้ใน มาตรา 48 นอกจากนี้ หากผู้กระทำความผิดยังสามารถรู้ผิดชอบหรือยังสามารถบังคับตนเองได้บ้างก็ควรมีเกณฑ์ลดโทษตามความร้ายแรงของการกระทำความผิดดังเช่นหลักเกณฑ์ตามประมวลกฎหมายอาญาของสาธารณรัฐฝรั่งเศสเพื่อให้เกิดความเป็นธรรมต่อผู้เสียหาย ทั้งยังควรนำวิธีการคุมประพฤติมาใช้บังคับหลังจากที่จำเลยพ้นโทษในกรณีที่ผู้นั้นได้กระทำความผิดร้ายแรงดังเช่น สาธารณรัฐฝรั่งเศสและประเทศอังกฤษ เพื่อป้องกันมิให้ผู้นั้นกลับมากระทำความผิดซ้ำขึ้นอีก

บทความวิชาการนี้มุ่งเน้นศึกษาบทบาทของศาลกฎหมายทะเลระหว่างประเทศในการให้ความเห็นแนะนำเกี่ยวกับการเปลี่ยนแปลงสภาพภูมิอากาศ โดยเป็นการวิเคราะห์สาระสำคัญของความเห็นแนะนำ Request for an Advisory Opinion submitted by the Commission of Small Island States on Climate Change and International Law (Request for Advisory Opinion submitted to the Tribunal) Case No.31 และวิเคราะห์และสังเคราะห์ผลประโยชน์ที่ประเทศไทยในฐานะรัฐภาคีของอนุสัญญาสหประชาชาติว่าด้วยกฎหมายทะเล ค.ศ. 1982 จะได้รับจากความเห็นของศาล โดยผลการศึกษาพบว่าประเทศไทยจะได้รับผลประโยชน์ทั้ง 2 ด้าน คือ 1. ผลประโยชน์ในแง่กระบวนการพิจารณาของศาล และ 2. ผลประโยชน์เกี่ยวกับการออกนโยบายและมาตรการเกี่ยวกับการป้องกัน ลด และควบคุมภาวะมลพิษของสิ่งแวดล้อมทางทะเลและการปกป้องและรักษาสิ่งแวดล้อมทางทะเลจากการเปลี่ยนแปลงสภาพภูมิอากาศ

อำนาจของผู้จัดการมรดกตามกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายเป็นเรื่องที่มีความสำคัญ โดยเฉพาะอย่างยิ่งในสภาพการณ์ปัจจุบันที่โลกได้ก้าวเข้าสู่ยุคแห่งความไร้พรมแดนจึงอาจทำให้ทรัพย์สินของเจ้ามรดกกระจัดกระจายอยู่ได้ในหลายประเทศ การที่จะพิจารณาว่ากฎหมายของประเทศใดเป็นกฎหมายที่ใช้บังคับกับนิติสัมพันธ์ในเรื่องอำนาจของผู้จัดการมรดกนั้นย่อมเป็นหน้าที่ของกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมาย สำหรับระบบกฎหมายขัดกันว่าด้วยอำนาจของผู้จัดการมรดกนั้นอาจแบ่งได้เป็น 2 ระบบ กล่าวคือ ระบบที่แยกเรื่องผู้จัดการมรดกออกจากเรื่องทรัพย์มรดก และระบบที่ไม่แยกเรื่องผู้จัดการมรดกออกจากเรื่องทรัพย์มรดก ในขณะที่เมื่อพิจารณาถึงกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายนั้น กฎหมายขัดกันของแต่ละประเทศได้ให้การยอมรับจุดเกาะเกี่ยวในการค้นหากฎหมายที่ใช้บังคับกับเรื่องอำนาจของผู้จัดการมรดกไว้แตกต่างกัน โดยกฎหมายขัดกันของอังกฤษได้อาศัยกฎหมายภายในกำหนดถึงอำนาจของผู้จัดการมรดก ในขณะที่กฎหมายขัดกันของประเทศจีนได้อาศัยกฎหมายแห่งถิ่นที่ทรัพย์นั้นตั้งอยู่เป็นจุดเกาะเกี่ยวส่วนภายใต้ระบบกฎหมายขัดกันของไทยนั้นไม่ได้มีการกำหนดกฎเกณฑ์ในการเลือกกฎหมายเพื่อใช้บังคับกับเรื่องอำนาจของผู้จัดการมรดกไว้เป็นการเฉพาะ จึงต้องใช้กลไกการอุดช่องว่างของกฎหมายตามมาตรา 3 พระราชบัญญัติว่าด้วยการขัดกันแห่งกฎหมาย พุทธศักราช 2481 ซึ่งกำหนดให้ใช้กฎเกณฑ์ทั่วไปแห่งกฎหมายระหว่างประเทศแผนกคดีบุคคลบังคับ

Abstract

This study encompasses the following urban wetlands: "La Kisst," situated in the city center, and "María Eugenia," located in the southern part of the city of San Cristóbal de las Casas. There are four wetlands within the municipality, all of which have been protected as natural areas by a Ramsar decree since 2008. The research aims to assess the socio-environmental vulnerability of the two wetlands using indicators in the environmental, social, and legal dimensions, thereby establishing the degree of vulnerability of the urban population exposed to flooding. In recent years, consumption rates among South African youth have increased while the average age of first use has decreased. During the Global Financial Crisis (GFC), Miguel Carcaño served as head of the Spanish Treasury’s Fund for Orderly Bank Restructuring, the authority in charge of managing the restructuring process of the country’s credit institutions. The fund, known today as the Spanish Executive Resolution Authority, is integrated into the European network led by the Single Resolution Board (SRB) of the European Union’s banking union. Carcaño has held a number of posts within the SRB and in 2022 became head of the Single Resolution Fund, the SRB’s emergency fund, which serves as backstop for institutions across the banking union’s 21 countries.

It is well known that Silicon Valley Bank (SVB) failed in March 2023 because of a toxic combination of uninsured deposits and underwater securities. This article argues that the bank’s failure could have been avoided if SVB had been subject to two global standards established by the Basel Committee on Banking Supervision. First, the interest-rate risk in the banking book (IRR-BB) standard, never fully implemented in the United States, would have identified the bank’s extremely risky asset-liability management strategy and required remedial action 10 quarters before it failed. In the European Union (EU), primary EU treaty law prohibits central banks from engaging in monetary financing, which includes lending to insolvent firms. This legal prohibition exists alongside, and in parallel to, various regulatory provisions of the Eurosystem. As a result, EU Member State central banks face unique legal limitations when acting in their roles as lenders of last resort, providing emergency liquidity assistance (ELA). In 1990, the Rhode Island Share and Deposit Indemnity Corporation (RISDIC) was a private mutual deposit insurance corporation funded by member institutions. Late that year, after the failures of two of its insured institutions in July and October, other RISDIC member institutions faced large depositor withdrawals, as concerns began to focus on the financial health of RISDIC itself. RISDIC had maintained inadequate reserves, and on December 31, 1990, it found itself lacking the resources to cover depositor withdrawals from member institutions. The Greek government debt crisis was especially hard on the two largest Cypriot banks. Bank of Cyprus (BoC) and Laiki Bank lost EUR 1.8 billion and EUR 2.3 billion, respectively, on their Greek government bonds after the European Union (EU) decision in October 2011 to haircut the bonds.
