The Changing Landscape Of Digitization And Preservation, Sharon Bradley
The Changing Landscape Of Digitization And Preservation, Sharon Bradley
Presentations
Digitization and the preservation of digitized materials presents many complex legal questions, like ownership, copyright, and conflicting laws. Digital materials may be subject to many levels of legal restrictions like copying, storage, access, and modification of content. The speaker will probably confuse things even more by talking about some issues that are coming over the hill including legally enforceable duties of stewardship, loss of academic scholarship and legal authority, and arguments against strict enforcement of copyright law. It’s also time to move from collaborations, because they’re good idea, to legally established partnerships, because they have teeth.

Copyright, Fair Use, Scholarly Communication, etc.
The 15th anniversary of the Budapest Open Access Initiative provided an excellent opportunity to take stock of global progress toward open access and to gauge the main obstacles still remaining to the widespread adoption of open access policies and practices. As part of this process, feedback was solicited through an open survey that was disseminated online, and that received responses from individuals in 60 countries around the world.
Markers of progress are clear. The lack of understanding of the concept of open access and a myriad of misconceptions that were pervasive at the time of the BOAI’s original convening have …

1976 - Mexican-American Land Tenure Conflict In California, David Hornbeck
Overview of California Private Land Claims and the Public Domain
This paper examines the merging of the Mexican and American land tenure systems and how the two very different concepts of land acquisition, organization and maintenance clashed resulting in a distinctive settlement pattern not usually associated with Anglo settlement. The Mexican landscape, organized according to centuries of Spanish tradition, was the antithesis of the type established by the westward moving American pioneer. Spatial differences were many, particularly in the areas of agriculture, settlement, transportation, space economy and land tenure.

Clear Statement Rules And The Integrity Of Labor Arbitration, Stephen Ross, Roy Eisenhardt
Clear Statement Rules And The Integrity Of Labor Arbitration, Stephen Ross, Roy Eisenhardt
Arbitration Law Review (2009 - Present)
Under the common law, employment contracts are submitted to civil courts to resolve disputes over interpretation, breach, and remedies. As an alternative, parties in collective bargaining agreements, can agree to dispute resolution by an independent arbitrator, whose decision is reviewed deferentially by judges. In this circumstance, the common law governing private associations affords judicial review that is more limited than a civil dispute, but more searching than is the case for …
