The study aimed to investigate the level of cognitive load among middle school students with learning disabilities in Riyadh and to identify differences in cognitive load levels according to gender (male-female) and grade level (first, second, third). The study adopted a descriptive approach and was conducted on a sample of (80) students with learning disabilities, whose ages ranged from 14 to 16 years. This study investigates the quality of learning disabilities (LD) programs in the Kingdom of Saudi Arabia (KSA) from the perspectives of teachers directly involved in their implementation. The study adopts a qualitative research design, utilizing semi-structured interviews conducted with ten teachers of learning disabilities, including five male and five female teachers. The aim of the study is to explore teachers' perceptions of the effectiveness of current LD programs, identify key challenges encountered in practice, and highlight areas for improvement. Until recently, there has been little reason to question these foundational premises. U.S. electricity demand has remained flat for over a decade, and during earlier periods of growth, new energy generation plants were relatively easy to build. The past six years have seen two dramatic shifts in federal health and benefits policy. First, during the COVID pandemic, the government dramatically expanded public benefits. These expansions had incredibly positive effects, and recipients were largely satisfied with them. But after a relatively short time, Congress rolled back nearly all of the expansion. This essay identifies three central moral and political issues with the the Ukraine–U.S. Mineral Deal. First, by linking financial and military assistance to access to Ukraine’s natural resources, the deal entrenches a form of resource conditionality that is highly problematic from the moral standpoint of international justice and other ethical principles. A Chicana feminist philosopher, Anzaldúa was born in a little town in Texas in 1942 and passed away in 2004. I am going beyond her idea of borderlands to point out that her idea of Nepantla offers multiple options for approaching our social reality, such as tracing diagnoses and evaluating the social conditions for the constitution of an emancipatory political subjectivity. This article explains why an anti-state radical-right agenda can become politically effective in contemporary Argentina by shifting the focus from ideology to the organization of identities. Drawing on survey evidence (ENCResPA, 7,130 online cases collected in 2022) and a corpus of anonymized semi-structured interviews with young people (2024–2025), I argue that Milei’s appeal is best understood as a form of negative politicization: a post-partisan stance built around rejection of mediation (parties, unions, experts, public institutions) and condensed moral narratives (“caste,” “cuts,” “freedom”). This paper deals with recent political consequences of presentism as conceptualized by the historian Francois Hartog. It clarifies how our experiences of time and history have enlarged the present and the past and have almost disappeared the future (except for catastrophic views). Legal text translation is challenging because of its emphasis on semantic and syntactic faithfulness, while ST structures do not always have correspondent TL equivalents. จากการศึกษาเปรียบเทียบการกำกับดูแลการผูกขาดในประเทศสหรัฐอเมริกาและประเทศญี่ปุ่น ผู้เขียนได้ค้นพบว่าวัตถุประสงค์ของกฎหมายต่อต้านทรัสต์ของประเทศสหรัฐอเมริกาคือ “ประสิทธิภาพ” และ “สวัสดิการผู้บริโภค” ทำให้ในยุคเศรษฐกิจดิจิทัล หน่วยงานบังคับใช้กฎหมายต่อต้านทรัสต์ของประเทศสหรัฐ อเมริกาประสบปัญหาในการกำกับดูแลการผูกขาดโดยบริษัทแพลตฟอร์มอิเล็กทรอนิกส์ที่มีอำนาจเหนือตลาด เนื่องจากผู้บริโภคได้ประโยชน์จากการผูกขาดดังกล่าว แม้ว่าผู้มีส่วนได้เสียอื่น โดยเฉพาะอย่างยิ่งคู่ค้าที่เป็นบริษัทขนาดกลางและขนาดย่อม (Small and Medium Enterprise: SME) จะถูกเอารัดเอาเปรียบก็ตาม ส่วนในประเทศญี่ปุ่น วัตถุประสงค์ของกฎหมายป้องกันการผูกขาด คือ การสนับสนุนและรักษาไว้ซึ่ง “การแข่งขันที่เสรีและเป็นธรรม” ซึ่งหมายความรวมถึงการปกป้อง SMEs จากการถูกเอารัดเอาเปรียบและพฤติกรรมการปฏิบัติทางการค้าที่ไม่เป็นธรรม (Unfair Trade Practices) ของบริษัทขนาดใหญ่ด้วย ส่วนวัตถุประสงค์ของกฎหมายแข่งขันทางการค้าในประเทศไทยมีความคล้ายคลึงกับประเทศญี่ปุ่น จึงมีบทบัญญัติเกี่ยวกับพฤติกรรมการปฏิบัติทางการค้าที่ไม่เป็นธรรมเช่นเดียวกัน ผู้เขียนจึงเสนอแนะให้หน่วยงานบังคับใช้กฎหมายป้องกันการผูกขาดของประเทศไทยออกกฎหมายลำดับรองเพื่อกำกับดูแลพฤติกรรมของผู้ประกอบธุรกิจแพลตฟอร์มตัวกลางการซื้อขาย (E-Commerce) ที่มีอำนาจเหนือตลาดในประเทศไทย

หลักความคาดหวังอันชอบธรรมเป็นกลไกสำคัญในระบบกฎหมายปกครองสมัยใหม่ที่มุ่งคุ้มครองความไว้วางใจของประชาชนต่อการกระทำของรัฐ บทความนี้ศึกษาพัฒนาการและสาระสำคัญของหลักการดังกล่าวในระบบกฎหมายเปรียบเทียบ ได้แก่ ระบบกฎหมายเยอรมนีที่หลักความคาดหวังอันชอบธรรมได้รับการยอมรับเป็น “หลักรัฐธรรมนูญทั่วไป” ภายใต้หลักนิติรัฐ และเชื่อมโยงกับหลักความมั่นคงแน่นอนทางกฎหมายและหลักความได้สัดส่วน ในอังกฤษหลักนี้มีจุดเริ่มต้นจากแนวคิดเรื่องความเป็นธรรมในกระบวนการก่อนขยายไปสู่การคุ้มครองผลประโยชน์เชิงเนื้อหาโดยใช้หลักการถ่วงดุลกับประโยชน์สาธารณะ ส่วนประเทศอื่น เช่น ออสเตรเลีย แคนาดา โปแลนด์ อินเดีย และฝรั่งเศส ต่างมีลักษณะการปรับใช้เฉพาะที่สะท้อนเป้าหมายร่วมกันในการจำกัดอำนาจรัฐและคุ้มครองความไว้วางใจของประชาชน สำหรับประเทศไทย ศาลปกครองไทยได้วางหลักการตีความสำคัญหลายประการทั้งการคุ้มครองเชิงเนื้อหาที่รับรองฐานะทางกฎหมายแม้คำสั่งจะถูกเพิกถอนในภายหลัง การชั่งน้ำหนักระหว่างความคาดหวังส่วนบุคคลกับประโยชน์สาธารณะ การเชื่อมโยงหลักความคาดหวังอันชอบธรรมกับหลักนิติรัฐ ข้อยกเว้นกรณีประมาทเลินเล่อร้ายแรงและการปกปิดข้อเท็จจริงที่มีสาระสำคัญ อย่างไรก็ตาม การปรับใช้ยังขาดความสม่ำเสมอในสาระสำคัญของการคุ้มครองความไว้วางใจของประชาชน บทความจึงนำเสนอแนวทางการพัฒนากฎหมายปกครองไทย ทั้งการปรับปรุงกฎหมายที่มีอยู่ให้ครอบคลุมรูปแบบความคาดหวังที่หลากหลาย การพัฒนาแนวทางการตีความของศาลที่ยอมรับการคุ้มครองทั้งในเชิงกระบวนการและเชิงเนื้อหา และการสร้างกลไกทางกฎหมายใหม่ เช่น คณะกรรมการไกล่เกลี่ยข้อพิพาท อันจะนำไปสู่การพัฒนาระบบกฎหมายปกครองไทยที่เป็นธรรม โปร่งใส และสอดคล้องกับหลักนิติรัฐอย่างแท้จริง

การรอการกำหนดโทษหรือรอการลงโทษ ตามประมวลกฎหมายอาญา มาตรา 56 เป็นมาตรการที่มีความสำคัญในกระบวนการยุติธรรมทางอาญา ซึ่งเป็นมาตรการที่บัญญัติขึ้นโดยมีวัตถุประสงค์ให้ศาลใช้ดุลพินิจรอการกำหนดโทษหรือรอการลงโทษสำหรับคดีที่มีอัตราโทษจำคุกระยะสั้นหรือโทษปรับ ตามทฤษฎีการลงโทษเพื่อแก้ไขพฤติกรรมของผู้กระทำความผิด กล่าวคือ ในคดีความผิดอาญาที่มีโทษจำคุกหรือปรับ และศาลจะลงโทษจำคุกไม่เกิน 5 ปี ทั้งนี้ เพื่อมิให้ผู้กระทำความผิดเล็กน้อยนั้นเข้าไปปะปนกับผู้กระทำความผิดเป็นอาจิณและเลียนแบบพฤติกรรมนั้นจนกลับมากระทำความผิดซ้ำอีก และเพื่อให้โอกาสผู้กระทำความผิดได้รู้สำนึกถึงสิ่งที่ได้กระทำลงไป รวมถึงสามารถกลับมาดำเนินชีวิตในสังคมได้อย่างเป็นปกติ แต่ในทางกลับกันเมื่อพิจารณาจากการบังคับใช้ประมวลกฎหมายอาญา มาตรา 56 ศาลสามารถใช้ดุลพินิจได้กับทุกฐานความผิด แม้ลักษณะของฐานความผิดนั้นจะกระทบกระเทือนต่อความปลอดภัยของสังคมมากเพียงใด แต่หากโทษจำคุกที่ศาลลงมีกำหนดไม่เกิน 5 ปี ศาลก็สามารถสั่งรอการกำหนดโทษหรือรอการลงโทษได้กับทุกกรณี ซึ่งอาจจะขัดหรือแย้งกับทฤษฎีการลงโทษทางอาญาประการอื่น กล่าวคือ ทฤษฎีการลงโทษเพื่อแก้แค้น การลงโทษเพื่อข่มขู่ยับยั้ง การลงโทษเพื่อตัดผู้กระทำผิดออกจากสังคมรวมถึงการลงโทษเพื่อป้องกันอาชญากรรม อันส่งผลกระทบต่อความรู้สึกและการได้รับความยุติธรรมของผู้เสียหาย หรือเหยื่อในคดีอาญารวมทั้งประชาชนในสังคม เนื่องจากในบางกรณีเป็นฐานความผิดที่มีความร้ายแรง และเป็นอันตรายต่อสังคม แต่ผู้กระทำความผิดกลับไม่ถูกลงโทษ ยิ่งไปกว่านั้นอาจทำให้ผู้เสียหายไม่ได้รับความยุติธรรม และบุคคลทั่วไปย่อมเข้าใจว่าการกระทำร้ายแรงเช่นนั้นสามารถกระทำได้โดยไม่ต้องรับผลใด ๆ จากการกระทำดังกล่าว ฉะนั้นจึงควรปรับปรุงแก้ไข และจัดทำคำแนะนำเกี่ยวกับวิธีการรอการลงโทษหรือรอการกำหนดโทษให้มีความชัดเจนยิ่งขึ้น โดยการกำหนดแนวทาง หรือข้อพิจารณาที่ผู้ใช้กฎหมายควรให้การคำนึง และให้ความสำคัญยิ่งขึ้นเกี่ยวกับฐานความผิดร้ายแรงที่ไม่ควรรอการกำหนดโทษหรือรอการลงโทษ เพื่อให้การลงโทษเป็นไปตามสัดส่วนของการกระทำความผิด และตรงตามทฤษฎีวัตถุประสงค์ของการลงโทษ
