China’S Policy In Refusing North Korea Nuclear Proliferation, Vera Zerlinda Alamsyah Sulaiman

Global: Jurnal Politik Internasional

This paper explains the main factors underlying China's policy of refusing North Korea's nuclear proliferation, whereas the two countries have established defense alliance relations since the breakup of the Korean War. Geopolitically, North Korea is a strategic country for China in the East Asian region, and both countries view the presence of the US military in the region as a threat. Subsequently, North Korea began to develop its nuclear capability to challenge the continuous US military presence in South Korea. Although China and North Korea see the US influence as a security threat, China maintains its position of refusing North …

This article focuses on the factors which contributed to the withdrawal of Costa Rica by looking at: (1) the institutional level of SICA; (2) Costa Rica’s policies that have hindered Central American integration; and (3) Costa Rica’s main reasons for its …

Transnational Relations And Activism In International Relations: Debates And Consensus In Literature, Ani Widyani Soetjipto, Arivia Tri Dara Yuliestiana

Global: Jurnal Politik Internasional

This article explores the concepts of transnational relations and activism in the study of International Relations, specifically the role of civil society in transnational advocacy. It becomes fascinating to discuss the role of civil society when state actors are no longer the most prominent actors in International Relations studies in the midst of globalization. Some articles related to transnational relations were written by the scholars of International Relations such as Thomas Risse-Kappen (1995). Even so, one of the most sophisticated concepts of transnational activism was introduced by Margaret Keck and Kathryn Sikkink (1998), in the “Activists Beyond Borders: Advocacy Networks …

This paper aims to examine the position of Indonesia as a traditional regional maritime power in the context of this changing maritime landscape of the Indo-Pacific region. In doing so, this paper develops the concept of “the three faces of maritime power” which distinguishes maritime power into hard, soft, and normative maritime power. The findings of this …

Using the Securitisation theory from the Copenhagen School, this paper explains the analysis of the speech act and extraordinary measures from SBY’s administration, Jokowi’s first term and second term administration. While IUU fishing has been a severe global issue, 30 percent of the cases take place in Indonesia and it becomes a serious threat for the economy and maritime resources. In 2009, Indonesia amended the …

Climbing To 1011: Globalization, Digitization, Shareholder Capitalism And The Summits Of Contemporary Wealth, David A. Westbrook

Journal Articles

While we may find many sorts of inequality in the United States and elsewhere, this essay is about the specific form of inequality exemplified by Jeff Bezos or Bill Gates, that is, the Himalayan summits of contemporary wealth, mostly in the United States. Such wealth results from the confluence of three historical developments.

First, the social processes referred to under the rubric of “globalization” have created vast markets. A dominant position in such markets leads not only to great wealth, but the elimination of peers. Since there are few such markets, relatively significant wealth is possessed by very few people. …

Sociology Faculty Publications

Globally, firearms are the most frequent means of committing homicide with young males most likely to be victimized with guns. However, within the context of intimate partner violence and family violence, females’ risk of lethal gun violence rises significantly, supporting the need to pay more attention to firearms to reduce lethal VAW. One way to protect women from firearm violence within the private sphere is to regulate access to guns based on the risk of family violence. This study examines the extent to which gun availability and gun regulations affect lethal violence against women in a relatively large sample of …

In Albuquerque, University of New Mexico School of Law associate professor Maryam Ahranjani and Hope Pendleton, a board member of the Black Law Student Association at UNM, are saying now is the time to remove officers from schools.

“There’s a lot of unfortunate downstream negative repercussions for children from having police officers in schools,” Ahranjani said.

“Reallocating funds away from law enforcement …

Made In The Usa: Technological Corporatism, Infrastructure Regulation, And Dupont 1902-1917, Roman Y. Shemakov

Swarthmore Undergraduate History Journal

The turn of the twentieth century radically renewed industrial organization across the United States. Early American corporations -- centralized manufacturing hubs with journeymen and apprentices laboring under one roof -- were seldom prepared for the transformations that scientific management and structural reorganization would bring to social relations. At the helm of World War 1, DuPont became the epitome of broader national restructuring. Through a close relationship with American military industries and legislatures, the DuPont brothers came to represent Business as an inseparable component of the State. While labor historiography has primarily focused on organizers’ relationship with regulators, important segments of …

America's Newest Boogeyman For Deviant Teen Behavior: Violent Video Games And The First Amendment, Joseph C. Alfe, Grant D. Talabay Jun 2020

America's Newest Boogeyman For Deviant Teen Behavior: Violent Video Games And The First Amendment, Joseph C. Alfe, Grant D. Talabay

Pace Intellectual Property, Sports & Entertainment Law Forum

Are violent video games harming America’s youth? Is it possible a series of interconnected circuit boards can influence children (or even adults) to become, themselves, violent? If so, how should our society-- and government-- respond?

To properly answer this last query, violent video games must be viewed through the lens of the First Amendment. Simply put: do games depicting grotesque acts of depravity so profound as to negatively influence the psyche warrant the full constitutional protections ordinarily guaranteed under the mantle of free speech and expression? Are these guarantees without limit? If not, how far may the government go in …

An Examination Of Defense Attorney Knowledge Of Dispatcher Practices In Eyewitness Calls, Elena Christofi Jun 2020

An Examination Of Defense Attorney Knowledge Of Dispatcher Practices In Eyewitness Calls, Elena Christofi

Student Theses

911 dispatchers are often the first point of contact for witnesses to crimes. Dispatchers have an important role in collecting information related to a witness’ observations and recollection of events, and this information can serve as primary evidence in criminal cases. Therefore, it is crucial that evidence collected from eyewitnesses is as accurate and detailed as possible. In the present study, we investigated defense attorneys’ perceptions on how dispatchers gather information from eyewitnesses during 911 calls, because little is known with respect to how defense attorneys review, use, and challenge 911 calls. Using an online survey, we asked defense attorneys …

Law's Racism: The Perpetuation Of Settler Colonialism In Ktunaxa V. British Columbia, Christian J. Zukowski Jun 2020

Law's Racism: The Perpetuation Of Settler Colonialism In Ktunaxa V. British Columbia, Christian J. Zukowski

Gettysburg Social Sciences Review

In considering the nexus between law, religion, and settler colonialism I consider a case in which an Indigenous freedom of religion claim under section 2(a) of the Canadian Charter of Rights and Freedoms was ruled by the majority of Supreme Court of Canada as not being a valid freedom of religion claim. In examining this decision, I will construct an analytical framework by which I will examine the decision in a way that considers the legal system in which it occurs, that legal system’s culture, and the relevance of land in this case. Using this analytical framework, I will tease …

Copyright Reform: Imagining More Balanced Copyright Laws, Michelle M. Wu Jun 2020

Copyright Reform: Imagining More Balanced Copyright Laws, Michelle M. Wu

Georgetown Law Faculty Publications and Other Works

Earlier chapters of this book provide a history of copyright and libraries in the United States, a review of outdated language in the existing copyright code, and a discussion of actions by both copyright owners and the public to rebalance copyright outside of legislation. This chapter simply imagines what copyright could be if we disregard the known political and legal obstacles. It starts with no constraints, which one might argue is both impractical and foolish. Why spend time discussing what could be when treaties, self-interest, and powerful industry lobbies stand in the way?

The answer is simply that environments can …

When we transitioned rapidly to a work-from-home environment in mid-March, the library’s leadership was concerned not only that every staff member would …

Reflective Writing In Prisons: Rehabilitation And The Power Of Stories And Connections, Sandeep Kumar Jun 2020

Reflective Writing In Prisons: Rehabilitation And The Power Of Stories And Connections, Sandeep Kumar

VA Engage Journal

The United States has the highest rate of incarceration in the world. Even though the rate of crime is dropping, incarceration rates remain fairly steady. What’s more, recidivism (i.e., re-offending after conviction for other crimes) is also very high in the US. If offenders continue to offend, even after completing their sentences in a correctional system designed to address their underlying criminal activity, what is the point of having such a system? Can the system be made more accountable and better? Have we considered all the options for criminal reform? This article explores these questions using effective rehabilitation principles to …

Domestic abuse is a pervasive issue within the United States. Approximately three women will be murdered by an intimate partner every day and around half of all women will experience psychological abuse by an intimate partner in their lifetime. As such, it is important to have legal avenues that survivors can pursue in order to ensure safety for themselves and their children. There are many obstacles to obtaining a civil order of protection despite it being the most common legal option survivors choose to pursue. Survivors must take on the burden of proof and hire their own attorney if they …

The Third Wave Of Electrification: A Normative Tool Against Climate Change, Elizabeth L. Adams

Notre Dame Journal on Emerging Technologies

This article posits that the United States is now entering a third wave of electrification, one where we understand electricity not only as a universal service, but also as a mechanism for positive societal outcomes, namely the transition to a lower carbon future.

Part I evaluates the first two waves of electrification, starting with the introduction of electricity as a consumer product and transitioning to electrification as a basic right. Part II discusses the American regulatory framework which provides for government oversight of areas deemed to be “of the public interest.” Electric public utilities have participated in and been shaped …
