Profiteering Off Public Health Crises: The Viable Cure For Congressional Insider Trading, Charles L. Slamowitz Jul 2020

Profiteering Off Public Health Crises: The Viable Cure For Congressional Insider Trading, Charles L. Slamowitz

Washington and Lee Law Review Online

This article takes an approachable, forward-thinking, and academic dive into congressional insider trading in the wake of the coronavirus (COVID-19) pandemic. After a confidential briefing by the Senate Health Committee warned of COVID-19, massive stock sell-offs by members of Congress and their spouses suddenly ensued. Some senators even publicly disparaged COVID-19’s viral effects while their own shares were being offloaded. By the time the American people were made aware of its dangers, vast investment holdings by congressional insiders had already been sold. Shockingly, it is unclear if congressional insiders trading on confidential coronavirus information are actually breaking the law. Congress …

Human Supremacy As Posthuman Risk, Daniel Estrada

The Journal of Sociotechnical Critique

Human supremacy is the widely held view that human interests ought to be privileged over other interests as a matter of ethics and public policy. Posthumanism is the historical situation characterized by a critical reevaluation of anthropocentrist theory and practice. This paper draws on animal studies, critical posthumanism, and the critique of ideal theory in Charles Mills and Serene Khader to address the appeal to human supremacist rhetoric in AI ethics and policy discussions, particularly in the work of Joanna Bryson. This analysis identifies a specific risk posed by human supremacist policy in a posthuman context, namely the classification of …

Mcgirt V. Oklahoma, United States Supreme Court, Neil M. Gorsuch

US Government Documents Related to Indigenous Nations

This United States (US) Supreme Court case, decided July 9, 2020, clarified the boundaries of Indigenous land within the state of Oklahoma (OK) and, by extension, the limits of Oklahoma’s jurisdictional reach. Following the perpetration of his crimes in 1997, Oklahoma state court convicted Jimcy McGirt of three sexual offenses; however, McGirt contended that the state lacked the jurisdiction to try him for these crimes because he is an enrolled member of the Seminole Nation and because his crimes took place on the Creek Reservation (Muscogee Nation). Oklahoma argued that although an 1883 Treaty established a section of land for …

Cardinal vowels represent the duality of vowels, they represent the theoretical and practical aspects of vowels. Cardinal vowels are divided into: primary, secondary, and additional vowels. All cardinal vowels are defined according to …

Sunken Efforts? Legal Hurdles To Stemming Maritime Cbrne Proliferation, Arjun Banerjee Jul 2020

Sunken Efforts? Legal Hurdles To Stemming Maritime Cbrne Proliferation, Arjun Banerjee

International Journal of Nuclear Security

For four centuries, the law of the sea has rested on the principle of mare liberum or the freedom of the high seas. The oceans have traditionally been regarded as areas over which no state could claim dominion or sovereignty. Nations desirous of countering security threats have found that their efforts are curtailed by the traditional paradigm, partly because of the resistance from other states to permit further derogation. Several extant laws aim to contain the spread of CBRN (chemical, biological, radiological and nuclear) material through a variety of measures. Certain bilateral agreements between nations exist, but the foreign vessel …

Open Access Publishing In The European Union: The Example Of Scientific Works, Nikos Koutras

Research outputs 2014 to 2021

Access to information resources and publicly-funded research outcomes have been considered in Europe during the last decade. Open access practice became part of the European institutions’ agenda since 2006 within the final report of the European Research Advisory Board. The Lisbon Treaty (2007) explicitly confirmed the European Union’s commitment to free circulation of scientific knowledge (Article 179 TFEU) and the dissemination of research results (Article 183 TFEU). In this regard, the Horizon 2020 program illustrates the importance of open access policy towards further dissemination of scientific information. The European Commission also introduced in July 2012 a scientific information package to …

“Do My Complaints Matter?" Child Participation And Child-Friendliness Of Complaint Mechanisms In European Independent Children's Rights Institutions, Agnes Lux Phd

Societies Without Borders

The protection of children’s rights is an obvious task of independent children’s rights institutions (ICRIs), though achieved through a variety of means. Based on the guiding principles of the UN Convention on the Rights of the Child (UN CRC), the best interests of the child must be a primary consideration in protecting these fundamental rights, including the right to be heard. ICRIs carefully examine children’s rights through investigation and research. But are rights-defenders upholding these principles in their own work? In this brief article I examine the requirements of being a child-friendly and participatory ICRI, and through a three-element comparison …

The Detention-To-Deportation Pipeline And Local Policies Of Resistance: A Case Study Of Santa Clara County, California, Matt Bakker Phd Jul 2020

The Detention-To-Deportation Pipeline And Local Policies Of Resistance: A Case Study Of Santa Clara County, California, Matt Bakker Phd

Societies Without Borders

Deportation has reached record levels in the United States over the last decade. A major reason for this is that the federal government began using integrated databases and biometric surveillance technologies to identify deportable migrants whenever they come into contact with law enforcement officials. Implementing this enforcement technology in all jurisdictions across the country, the federal government undermined local inclusionary policies and brought state and local police into the work of federal immigration enforcement. This article examines efforts in one locality – Santa Clara County, California – to limit cooperation with this federal deportation machine. Drawing on documentary evidence and …
