Catalan Identity And Paradiplomacy Strategy In Catalonia’S Independence Movement, Windy Dermawan, Akim Akim

Global: Jurnal Politik Internasional

This article seeks to analyse how Catalan identity, within the context of its conflict with the Spanish government, contributes to its foreign relations with the global public through paradiplomacy. This article uses qualitative research method with literature study. It finds that Catalonia, as one of Spain’s autonomous regions, have a distinct history, language, and culture from other Spanish regions. To protect their identity, there have been an emergence of movement for greater Catalan autonomy, even independence. This conflict reached climax on 1 October 2017 when the Catalan government initiated an independence referendum amongst Catalan people, with the majority voted for …

The Moderation Of Frente Farabundo Martí Para La Liberación Nacional’S Economic Orientation In El Salvador, 2009-2019, Petrus Putut Pradhopo Wening

Global: Jurnal Politik Internasional

Frente Farabundo Martí Para la Liberación Nacional (FMLN) was a Marxist guerrilla group, known for its activities in the 1980s and 1990s to seize El Salvador’s government through war. Post-peace accords, FMLN transformed into an electoral political party and successfully won to lead the government of El Salvador in 2009-2019, but then they compromised their economic policies to suit neoliberalism. This article uses Gill and Law’s conceptualisation of the theory of direct and structural power of capital to explain the causes of FMLN’s neoliberalism-compromising economic policy adjustment in 2009-2019. This article finds that El Salvador’s social and political-economy historical dynamics, …

Red Scare Or Red Herring: How The “China Initiative” Strategy For Non-Traditional Collectors Is Stifling Innovation In The United States, Bianca Tillman Dec 2020

Red Scare Or Red Herring: How The “China Initiative” Strategy For Non-Traditional Collectors Is Stifling Innovation In The United States, Bianca Tillman

Seattle Journal of Technology, Environmental, & Innovation Law

In 2018, the U.S. Department of Justice launched the “China Initiative” in response to the growing economic and national security threat posed by China. The China Initiative is a sweeping federal plan designed, in part, to protect the United States’ status as a leader in global innovation and scientific discourse. The U.S. is justified in its concern over China’s unfair practices to achieve military, technological, and economic prominence. While U.S. and Chinese intelligence agencies have spied on each other for decades, China has increased both the scope and the sophistication of its efforts to steal secrets from the U.S. in …

The “Green Patent Paradox” And Fair Use: The Intellectual Property Solution To Fight Climate Change, Samuel Cayton Dec 2020

The “Green Patent Paradox” And Fair Use: The Intellectual Property Solution To Fight Climate Change, Samuel Cayton

Seattle Journal of Technology, Environmental, & Innovation Law

As the climate crisis consistently worsens, the United States’ response to the crisis has proven inconsistent. Even with the United States likely to recommit to the Paris Climate Agreement, political tensions will likely further delay a climate response. The polarized characterization of the Green New Deal, the inaction of scientifically misguided conservatives, and the incessant proposal for middle ground approaches lacking the urgency needed to change course all contribute to this delay. While swift action from the federal government is needed, looking to the private sector to transition to sustainability is equally important. Specifically, patent protection is a strong intellectual …

Unique Characteristics Of Bias Crimes Committed By Males Or Females In The United States, Rebecca Stotzer, Meripa T. Godinet, Janet T. Davidson Dec 2020

Unique Characteristics Of Bias Crimes Committed By Males Or Females In The United States, Rebecca Stotzer, Meripa T. Godinet, Janet T. Davidson

Journal of Hate Studies

Despite increased research on women’s criminal offending patterns, research on women’s involvement in bias crimes is almost nonexistent. This study examines bias crime incidences that are considered crimes against persons (e.g., assault, murder, robbery, sexual assault) collected in the National Incidence-based Reporting System from 2009–2012 to determine what features characterize crimes committed by men or women. Results indicate that female bias crime suspects choose different victims than male suspects; female suspects are more likely than men to target friends and family members, more likely to target other women, and more frequently commit crimes based on race/ethnicity/national origin than religion or …

The Historical Facts About Hate Crime In America The Social Worker’S Role In Victim Recovery And Community Restoration, Mitchell A. Kaplan, Marian M. Inguanzo Dec 2020

The Historical Facts About Hate Crime In America The Social Worker’S Role In Victim Recovery And Community Restoration, Mitchell A. Kaplan, Marian M. Inguanzo

Journal of Hate Studies

Attitudes and belief systems associated with social intolerance and racial bigotry have been part of American society for generations. Analysis of historical records reveals a number of examples of how these social forces have shaped society’s reaction to those they consider to be not part of the mainstream culture. A review of research documented in the literature on social psychology indicates that individuals who hold strong prejudicial beliefs about others based solely on race, religion, sexual orientation, or ancestry often express those feelings in ways that lead to the commission of criminal acts known as hate crimes. The proliferation of …

Dialogue As Being With: An Antitoxin To Hate And Intolerance, Tony Osborne Dec 2020

Dialogue As Being With: An Antitoxin To Hate And Intolerance, Tony Osborne

Journal of Hate Studies

As the social and political landscape becomes more fearful, intolerant, and self-centered, the concept of dialogue offers a different path, a constructive way of approaching alien ideas and beliefs. Understanding the principles of true dialogue is the most effective way to foster inner and outer harmony, broaden one’s horizons, and check aggressive, intolerant impulses. Dialogue’s roots are ancient, related to a method of argument called dialectic. It is a special partnership based on mutual respect and humility. Dialogue isn’t easy to engender. It requires four pre-conditions: 1) non-empirically verifiable topic; 2) two-way flow; 3) fairness; and 4) willingness to risk …

Taking Profound Offence Seriously: Freedom Of Speech V. Human Dignity, Raphael Cohen-Almagor Dec 2020

Taking Profound Offence Seriously: Freedom Of Speech V. Human Dignity, Raphael Cohen-Almagor

Journal of Hate Studies

This study discusses the issue of offence to sensibilities as possible grounds for limiting freedom of expression. This issue is constantly brought to the public agenda, as for example, in the limitation imposed in Israel on the playing of Richard Wagner’s music by Israeli orchestras. The proposed thesis is as follows: The Offence to Sensibilities Argument will take precedence over free expression only in cases where profound and direct damage is inflicted upon the sensibilities of individuals or a target group, undermining their dignity, especially when the speaker’s intentions are to offend the target individual/group under circumstances in which the …

Anti-Lgbtq Hate: An Analysis Of Situational Variables, Jill Kehoe Dec 2020

Anti-Lgbtq Hate: An Analysis Of Situational Variables, Jill Kehoe

Journal of Hate Studies

The current study aimed to augment the scant body of literature on anti-LGBTQ hate by providing an in-depth examination of anti-LGBTQ hate incident situational characteristics including offender substance use, number of offenders, crime location, and victim-offender relationship. Analysis of situational dynamic variables provided support for the notion that anti-LGBTQ hate is a distinct type of criminal incident. Significantly increased levels of offender substance use, crimes perpetrated by multiple offenders, crimes perpetrated by acquaintances, and crimes taking place in open spaces substantiates the theory that anti-LGBTQ hate is qualitatively unique, typified by different characteristics than other forms of crime. The data …

Unity Starts With U: A Case Study Of A Counter-Hate Campaign Through The Use Of Social Media Platforms, Candace Leung, Richard Frank Dec 2020

Unity Starts With U: A Case Study Of A Counter-Hate Campaign Through The Use Of Social Media Platforms, Candace Leung, Richard Frank

Journal of Hate Studies

Hate has been a growing concern with hate-groups and individuals using the Internet, or more specifically, social media platforms, to globalize hate. Since these social media platforms can connect users around the world, hate-organizations are using these connections as opportunities to recruit candidates and spread their propaganda. Without opposing views, these extreme viewpoints can establish themselves as legitimate and then be used to incite hate in individuals. Thus, these extreme viewpoints must be countered by similar messages to discourage this online hate, and one such way is to use the same platforms through grassroots movements. This paper presents a case …

Hateful Emotional Responses Scale (Haters): Development And Initial Evaluation, Loren L. Toussaint, Michael Barry, Marcus Enomoto, Wyatt Anians, Kacy Rodamaker, Alahna Keil, Maxwell Meier Dec 2020

Hateful Emotional Responses Scale (Haters): Development And Initial Evaluation, Loren L. Toussaint, Michael Barry, Marcus Enomoto, Wyatt Anians, Kacy Rodamaker, Alahna Keil, Maxwell Meier

Journal of Hate Studies

The present investigation consists of two studies designed to provide a preliminary examination of a new scale for measuring hateful emotional responses to being hurt by an offender. Study 1 involved definition of hateful emotional responses, item development, analysis of internal consistency, and convergent and incremental validity. The scale was evaluated in a sample of 33 young (M = 26) college and community adults. A five-item hateful emotional responses scale was developed and psychometric properties of the scale were encouraging. Study 2 involved using the five-item scale developed and evaluated in Study 1 and examining factorial validity and sensitivity to …

When Vertical Is Horizontal: How Vertical Mergers Lead To Increases In “Effective Concentration”, Serge Moresi, Steven C. Salop Dec 2020

When Vertical Is Horizontal: How Vertical Mergers Lead To Increases In “Effective Concentration”, Serge Moresi, Steven C. Salop

Georgetown Law Faculty Publications and Other Works

This article explains the inherent loss of an indirect competitor and reduction in competition when a vertical merger raises input foreclosure concerns. We then calculate a measure of the effective increase in the HHI measure of concentration for the downstream market, and we refer to this “proxy” measure as the “dHHI.” We derive the dHHI measure by comparing the pricing incentives and associated upward pricing pressure (“UPP”) involved in two alternative types of acquisitions: (i) vertical mergers that raise unilateral input foreclosure concerns (and the associated vertical GUPPI measures), and (ii) horizontal acquisitions of partial ownership interests among …

Deported Veterans: The Unintended Consequences Of “Good Moral Character”, Jonathan Deras Dec 2020

Deported Veterans: The Unintended Consequences Of “Good Moral Character”, Jonathan Deras

Master's Theses

The purpose of this research is to argue that U.S. immigration policy, specifically the 1996 IIRIRA (also known as IIRAIRA), needs to change regarding the legal treatment of immigrant U.S. military veteran deportees due to the following concepts. The first concept is to articulate how the criminalization of immigration, and how the military system intersects to facilitate the Deportation of U.S veterans. A key concept in this analysis is the standard of “good moral character” set by the U.S. government that enlistees need to meet to be accepted into the military; this standard is also used against immigrant veterans during …

The Comparative Legal Landscape Of Educational Pluralism, Nicole Stelle Garnett Dec 2020

The Comparative Legal Landscape Of Educational Pluralism, Nicole Stelle Garnett

Arkansas Law Review

In the United States, debates about private and faith-based education tend to focus on questions about government funding: which kinds of schools should the government fund (and at what levels)? Should, for example, students be able to use public funds to attend privately operated schools? Faith-based schools? If so, what policy mechanisms should be used to fund private schools—vouchers, tax credits, direct transfer payments? How much funding should these schools receive? The same amount as public schools or less? As a historical matter, the focus on funding in the United States makes sense because only public (that is, government-operated) elementary …

Mission-Centered Collaborative Bridges To Increase Stem Motivations, Colleen Duffy Dec 2020

Mission-Centered Collaborative Bridges To Increase Stem Motivations, Colleen Duffy

Journal of Vincentian Social Action

Many school administrators are enthusiastic about implementing new educational initiatives but have their plans thwarted because they are faced with the reality of insufficient resources. This can greatly limit the expansion of K-12 educational programs and deprive students of valuable learning opportunities. Additionally, teacher preparation programs are required to meet state mandates such as providing field experiences for preservice teachers that promote the authentic application of knowledge in PK-12 classrooms, but regional competition for placement opportunities create tremendous obstacles for higher education faculty. This essay describes the creation and implementation of a mission-centered mutually beneficial K-12 and intercollegiate partnership that …

Building Teacher Empathy And Culturally Responsive Practice Through Professional Development And Self-Reflection, Barbara S. Rieckhoff, Melissa Ockerman, Amira Proweller, James Wolfinger Dec 2020

Building Teacher Empathy And Culturally Responsive Practice Through Professional Development And Self-Reflection, Barbara S. Rieckhoff, Melissa Ockerman, Amira Proweller, James Wolfinger

Journal of Vincentian Social Action

Today’s teachers face growing demands and mandates to support every aspect of a student’s academic success, with additional expectations to support students’ social and emotional needs both inside and outside of the classroom. In the face of increasing student cultural, racial and linguistic diversity, the teaching pool remains relatively homogeneous, consisting largely of white, European-American educators. This disconnect between the lived experiences of teachers and their students makes it difficult for teachers to value and connect to a diverse student body. This qualitative study explores how a collaborative multi-tiered critical professional development model between a non-for-profit organization and a University, …

Symbolic Boundaries And The Clinical Preparation Of Teacher Candidates, Bilge Cerezci, Donald Mcclure Dec 2020

Symbolic Boundaries And The Clinical Preparation Of Teacher Candidates, Bilge Cerezci, Donald Mcclure

Journal of Vincentian Social Action

The purpose of this essay is to make sense of the two divides in the clinical preparation of teacher candidates: (1) between professional knowledge and skilled practice, and (2) between university-based courses and school-based field experiences. This essay extends the work of Lamont and Molnár (2002) to conceptualize symbolic boundaries related to these two divides. Within this framework, a review of the research highlights three main implications. First, teacher education programs need to design teaching and learning experiences that allow teacher candidates to use the professional knowledge they have gained through their university courses across multiple educational settings. Second, such …

Improving Co-Teachers Relationships, Asher Samuel Dec 2020

Improving Co-Teachers Relationships, Asher Samuel

Journal of Vincentian Social Action

Co-teaching is an instructional strategy wherein two teachers, a general education teacher and a special education teacher, share instructional responsibilities in a general education class that includes students with disabilities (SWDs) (Friend, 2010). An important component of co-teaching is the relationship between the teachers (Kohler-Evans, 2006), which has been described as a professional marriage (Friend, 2010). However, there is limited information on factors influencing the relationship. This study investigated if teaching experience affects co-teachers’ perception of teamwork. Participants included special and general education co-teachers from eight public school districts in New York City. Co-teachers from grades K-12 completed the Tuckman …

The Impact Of Universally Accelerating Eighth Grade Mathematics Students On Participation And Achievement, Patrick Walsh Dec 2020

The Impact Of Universally Accelerating Eighth Grade Mathematics Students On Participation And Achievement, Patrick Walsh

Journal of Vincentian Social Action

In New York State students are traditionally scheduled to take Algebra I in their first year of high school mathematics. However, in many schools, the “top” students in a cohort have access to this course in eighth grade, tracking these high-achieving students ahead of their lower-achieving peers. In response, some schools have adopted the policy of “Algebra for all” in eighth grade – called universal acceleration. While this policy ensures equal access to a challenging curriculum for all students, regardless of race, socioeconomic status, and prior achievement, there is a concern that not all students are developmentally ready to take …

Who Upholds Your Human Rights When You Are “Stateless?” Why Couldn’T The Un Protect The Rohingya’S Human Rights?, Hyochan Lee Dec 2020

Who Upholds Your Human Rights When You Are “Stateless?” Why Couldn’T The Un Protect The Rohingya’S Human Rights?, Hyochan Lee

Student Theses and Dissertations

In 2017, genocide in Myanmar took place against the stateless minority Rohingya Muslims. Why couldn’t the UN protect the Rohingya’s human rights? The international community's efforts to oppose these violations against the stateless people have been only passive. Then, who upholds your human rights when you are stateless? Using chronology, historical institutionalism, and process tracing analyses, this thesis (1) evaluates the UN’s legal regime’s systemic design and capabilities in protecting human rights; then (2) identifies the design flaws of our international human rights regime; and lastly, (3) develops a recommendation to protect all people, stateless or not. Based on both …

A Crisis Within A Crisis: Nyc Landlords Ramp Up Harassment Of Vulnerable Tenants In Wake Of Pandemic, Joseph A. Jungermann Iii

Capstones

Already burdened with more sickness and death during the pandemic than other New Yorkers, low-income tenants and tenants of color are particularly vulnerable to additional harassment by landlords who seek to take advantage of the city's health and financial crisis to force them out. Brooklyn residents Delene Ahye, Dexter Lendor and Sonny Singh tell stories of their landlord, landlord agents and building manager’s harassment, which began during the pandemic’s most dangerous spikes in New York City. These forms of harassment included intimidation, abusive construction, constant buyout offers and biometrics and surveillance technology.

Federation Divided, Max M. Balton Dec 2020

Federation Divided, Max M. Balton

Capstones

At the start of the 2020 school year, a lack of covid safety plans led teachers like Rosy Clark to protest, urging her union the United Federation of Teachers to act. She and other progressives in the dissident caucus, Movement of Rank and File Educators, were willing to strike to ensure their safety. Union leadership hesitated largely because public union strikes are illegal under the state’s Taylor Law.

This four-part audio documentary looks at the history of the UFT and this contentious state law. The union began striking under more onerous strike prohibition legislation. Its roots are steeped in radical …

Court-Packing Time? Supreme Court Legitimacy And Positivity Theory, Stephen M. Feldman Dec 2020

Court-Packing Time? Supreme Court Legitimacy And Positivity Theory, Stephen M. Feldman

Buffalo Law Review

Many progressives have decided they need to change the Supreme Court to break the conservative justices’ lock on judicial power. Yet those same progressives disagree about the best way to change the Court. This Essay begins by comparing straight-forward court-packing—adding justices to shift the partisan balance on the Court—to other possible Court changes, such as court-curbing measures that would reduce the Court’s power. Court-packing has multiple advantages over these other possibilities, not the least of which is that even the current Roberts Court would almost certainly hold court-packing, unlike other potential changes, to be constitutional. Even so, some progressives view …
