The Impact Of Implementing The Principles Of Good Governance On The Quality Of Administrative Reports In The Palestinian Municipal Councils, Faeyz Abuamria, Nasser Mohammad Soud Jaradat, Mohammad Shaded
Al-Balqa Journal for Research and Studies البلقاء للبحوث والدراسات
This study aims at clarifying the impact of implementing the principles of good governance on the quality of administrative reports in the Palestinian municipal councils. A questionnaire was designed to pilot the views of mayors, deputy mayors, directors, heads of departments and employees in Bethlehem and Hebron directorates. Results showed that it is too early to talk about sound governance at local councils in the absence of applying the minimal principles of governance such as accountability, transparency and involving staff in decision-making. Furthermore, the administrative reports administered by the heads of administrative departments do not reflect the real situation nor …

U.S. Prisons And System Reform, Darian Reimels
English Department: Research for Change - Wicked Problems in Our World
Prison systems, specifically in the U.S., are a wicked problem. For years prisoners have been treated inhumanely inside and outside of prison, with everyone looking at them with a judgmental eye. This essay aims to point out and bring light to these issues within the prison system. Specifically, it focuses on how inmates are treated during and after serving their sentence, and solitary confinement. To better understand and explain the problems to you, extensive research was done. Articles were read, organizations were researched, and a documentary was watched to gather the information needed to write this essay. The results showed …

Effect Of Free Trade Agreements On Pharmaceutical Market Competition: The Case Of The 2009 Us-Peru Free Trade Agreement And Its Implementation As National Drug Policy, Lita Araujo, Enrique Seoane-Vazquez, Michael Montagne
Pharmacy Faculty Articles and Research
Free Trade Agreements (FTA) are controversial for threatening essential aspects of health, especially access to affordable medicines. The US-Peru FTA required changes in the Peruvian pharmaceutical legislation that resulted in the implementation of the National Drug Policy (NDP) of 2009. The NDP included more robust technical requirements for registration, a Peruvian Good Manufacturing Practices certificate, a longer timeline for drug registration, and an increase in registration fees. This study evaluated the impact of the FTA on the number of registrations and competition in the Peruvian pharmaceutical market.

Fighting Human Trafficking And Exploitation Through The Power Of Local Policy And Programs: Analysis And Recommendations, Abby Torrice
Community Engagement Student Work
While the United States has made great strides since 2000 to combat human trafficking federally, there is still much to be done. This capstone project provides a comprehensive understanding of key terms related to human trafficking. These terms are then used to provide context to the reality of the issue of human trafficking and exploitation in our world today, and specifically the United States. Although human trafficking legislation has made swift advances at the federal level since 2000 and states have followed suit in creating their own policies, local municipalities and communities have an immense amount of power in creating …

Treaty Stories: Reclaiming The Unbroken History Of Lac Courte Oreilles Ojibwe Sovereignty, Margaret Huettl
Treaty Stories: Reclaiming The Unbroken History Of Lac Courte Oreilles Ojibwe Sovereignty, Margaret Huettl
Department of History: Faculty Publications
Ojibwe leaders negotiated treaties with the United States amid nineteenth-century encroachments on their territory. These treaties, which were more than tools of dispossession, enfolded and extended aadizookanag (sacred stories) in agreements that embodied Ojibwe relationships with land, language, sacred history, ceremony, and kin. Federal and state policy makers, fueled by the desire for Indian land and resources, attempted to unravel these relationships in the decades that followed. By continuing to live out through labor and stories their relationships with the woods, waters, and manoomin (wild rice) beds of Anishinaabewaki, the Lac Courte Oreilles Ojibweg kept their treaties and their sovereignty …
Us Vs. Wales: Comparing And Improving Refugee Health Policy, Payton Ramsey
Us Vs. Wales: Comparing And Improving Refugee Health Policy, Payton Ramsey
Senior Theses
Inadequate strides have been made to bolster the short and long-term health of growing numbers of refugees awaiting resettlement. The United Nations Higher Commission for Refugees (UNHCR), as well as many countries of resettlement, guarantee the right to health as signatories of the UN 1951 Refugee Convention, but in many situations refugee accessibility to healthcare and health resources is limited by time restrictions on benefits, immigration status, and/or financial circumstances.
This thesis provides a synopsis of the historical roots of current policies and legislative frameworks relating to refugee health for Wales and the US. Through the analysis of governmental policy …

Perceptions Of Bystander Intervention: Surveying Students’ Relationship To Sexual Misconduct, Emma G. Padrick
Perceptions Of Bystander Intervention: Surveying Students’ Relationship To Sexual Misconduct, Emma G. Padrick
Student Publications
Bystander intervention education programs have become increasingly popular as a tool for the primary prevention of sexual violence at institutions of higher education (IHEs). Emerging research surrounding bystander intervention on college campuses reveals promising results, yet there is limited extant research exploring how students perceive bystander intervention as a tool to protect themselves and their peers. Students over the age of 18 at a small, private, liberal arts IHE in the mid-Atlantic region of the United States with approximately 2,600 students were surveyed to assess knowledge, attitudes, and behaviors related to bystander intervention. Students demonstrated a willingness to intervene and …
Strategic Litigation And The Evolution Of Regional Human Rights Norms: Cases From Germany And The Netherlands, Cole Kovarik
Strategic Litigation And The Evolution Of Regional Human Rights Norms: Cases From Germany And The Netherlands, Cole Kovarik
Honors Program: Senior Projects (Public)
This study seeks to fill gaps in our understanding of how private actors participate in international human rights politics by examining civil society involvement in European Court of Human Rights (ECtHR) cases against long-standing democracies. Descriptive analysis of an exhaustive data set of instances of civil society organization (CSO) participation in ECtHR cases against Germany and The Netherlands is complemented by a comparative case study analysis of networks of organizations that mobilized around German and Dutch cases concerning Articles 8 (right to privacy) and 10 (freedom of expression). The data suggest that civil society organizations not only appear before the …
Increasing Substantive Fairness And Mitigating Social Costs In Eviction Proceedings: Instituting A Civil Right To Counsel For Indigent Tenants In Pennsylvania, Robin M. White
Dickinson Law Review (2017-Present)
The U.S. Constitution provides criminal defendants the right to a court-appointed attorney but gives no similar protection to civil litigants. Although federal law does not supply any categorical rights to counsel for civil litigants, all 50 states have instituted the right in at least one category of civil law that substantially impacts individuals’ rights. Since 2017, several U.S. cities have enacted such a right for tenants facing eviction. In so doing, these cities responded to American families’ increasing rent burden, the recent publication of nationwide eviction data, the sociological research concerning the impact of eviction, and the lack of procedural …

The “Innocence Penalty”: Is It More Pronounced For Juveniles?, Nilam A. Sanghvi, Elizabeth A. Delosa
Dickinson Law Review (2017-Present)
Despite the presumption of innocence, we know that individuals accused of crimes are punished for maintaining their innocence in ways both tangible and intangible as they make their way through our criminal justice system. For example, even if instructed not to, jurors may infer guilt from a defendant’s failure to testify; defendants who exercise their right to go to trial receive lengthier sentences if convicted than those who plead guilty; and, once convicted, defendants who maintain their innocence are often denied opportunities for parole or clemency. This article explores whether these “innocence penalties” are even greater for children who are …
Young, Black, And Wrongfully Charged: A Cumulative Disadvantage Framework, Emily Haney-Caron, Erika Fountain
Young, Black, And Wrongfully Charged: A Cumulative Disadvantage Framework, Emily Haney-Caron, Erika Fountain
Dickinson Law Review (2017-Present)
The term wrongful conviction typically refers to the conviction or adjudication of individuals who are factually innocent. Decades of research has rightfully focused on uncovering contributing factors of convictions of factually innocent people to inform policy and practice. However, in this paper we expand our conceptualization of wrongful conviction. Specifically, we propose a redefinition that includes other miscarriages of justice: A wrongful conviction is a conviction or adjudication for someone who never should have been involved in the juvenile or criminal legal system in the first place. Although there are various miscarriages of justice that might appropriately be categorized under …

Is This Seat Taken? African American Male Perceptions Of Ascension In The Federal Office Of Inspectors General Community, Donrich L. Young
Doctor of Education (Ed.D)
The federal law enforcement community is one that should be diverse and reflect society as a whole. Traditionally, federal law enforcement, and specifically the Office of Inspectors General (OIG) Community, has been occupied by White males at all levels. This qualitative exploratory case study examined the perceptions and lived experiences of eight African American males currently employed in or recently retired from the federal OIG community. The research findings resulted in the emergence of three themes: (1) mentorship, (2) treatment and opportunities, and (3) underrepresentation. The implications and recommendations which evolved from this research study may contribute to the development …

How Indigenous-Language Court Interpreters And Clients Navigate The U.S. Court System Under Strict Court-Interpreting Guidelines, Ashten Lehwalder
University Honors Theses
In Oregon, requests for court interpreters of languages indigenous to Latin America have increased within the last few years. However, the number of available indigenous-language court interpreters in the U.S. remains low. During the 2019 U.S.--Mexico Border Crisis, many refugees seeking asylum were from Mayan communities; indigenous-language court interpreters struggled to meet the demand. Even though court interpreting is a civil right in the U.S., many individuals have been afforded inadequate language services, or have gone without interpreters altogether. This study seeks to understand the experience of indigenous-language court interpreters, who must operate according to a code of ethics, through …

Breaking The Judicial Glass Ceiling: The Appointment Of Women To High Courts Worldwide, Maria C. Escobar-Lemmon, Valerie J. Hoekstra, Alice J. Kang, Miki Caul Kittilson
Department of Political Science: Faculty Publications
The salience of judicial institutions in democratic and nondemocratic countries has increased, making it important to have women on these powerful and visible decision-making bodies. Yet, women have only recently gained entrance to peak judicial bodies including constitutional and supreme courts. The appointment of the first woman to a high court is a historic landmark, breaking traditional ideas of who can and should be on the court. Using a global, longitudinal data set we show that certain explanatory factors matter differently in wealthy, stable democracies and in developing countries. The method of selecting high court justices exerts influence in wealthy, …

Courageous Endurance: The Lived Experiences Of Trans Folx And The Criminal Legal System, April Carrillo
Sociology & Criminal Justice Theses & Dissertations
The field of criminology and criminal justice have widely ignored the experience of being a trans person and interacting with the criminal legal system, despite the reality that trans folx experience discrimination and harm at the hands of criminal legal practitioners. This dissertation explores these experiences, as well as how trans folx navigate a myriad of other issues to include their identity and institutional discrimination. Trans folx are not guaranteed many protections or rights in the United States which leaves them at an especially vulnerable position when entering the criminal legal system. Essentially, trans folx are forced to navigate a …
To What Extent Is The Death Penalty A Tool Of Racial Terror In America, And How Can We Fix It?, Gabrielle Boileau
To What Extent Is The Death Penalty A Tool Of Racial Terror In America, And How Can We Fix It?, Gabrielle Boileau
Honors Projects
In this project, I seek to answer the question: To what extent is the death penalty a tool of racial terror in America, and how can we fix it? America has long been plagued by the legacy of slavery and white supremacy. In the reconstruction era, when slavery was no longer legal, angry white citizens would simply round up African-Americans and lynch them if they felt they had done something “wrong”. However, in the modern era, such blatant displays of racism are illegal, and the racist views of society are subverted into the court system. Black men are disproportionately arrested …

Legal incubators, also known as law firm incubators, in the United States are designed to help lawyers develop and launch law practices while expanding access to underserved populations. Based on business incubator models, legal incubator programs support the creation of new law firms by providing space, mentoring, and training to licensed lawyers. Most of the law firms produced by these legal incubators are solo or small firms that exist as both for profit businesses and nonprofit entities. Since the first legal incubator appeared in 2007, over 70 self-identified legal incubator programs have emerged around the globe.

The Absence Or Misuse Of Statistics In Forensic Science As A Contributor To Wrongful Convictions: From Pattern Matching To Medical Opinions About Child Abuse, Keith A. Findley
Dickinson Law Review (2017-Present)
The new scrutiny that has been applied to the forensic sciences since the emergence of DNA profiling as the gold standard three decades ago has identified numerous concerns about the absence of a solid scientific footing for most disciplines. This article examines one of the lesser-considered problems that afflicts virtually all of the pattern-matching (or “individualization”) disciplines (largely apart from DNA), and even undermines the validity of other forensic disciplines like forensic pathology and medical determinations about child abuse, particularly Shaken Baby Syndrome/Abusive Head Trauma (SBS/AHT). That problem is the absence or misuse of statistics. This article begins by applying …
